Abstract

Sociological jurisprudence menekankan perhatiannya pada kenyataan hukum daripada kedudukan dan fungsi hukum dalam masyarakat. Kenyataan hukum pada dasarnya adalah kemauan publik, jadi tidak sekedar hukum dalam pengertian law in books tetapi sesuai kebutuhan masyarakat hukum demi terciptanya kepastian hukum (positivism law) dan living law sebagai wujud penghargaan terhadap pentingnya peranan masyarakat dalam pembentukan hukum dan orientasi hukum. Peran strategis hakim dalam perspektif sociological jurisprudence adalah menerapkan hukum tidak hanya dipahami sebagai upaya social control yang bersifat formal dalam menyelesaikan konflik, tetapi sekaligus mendesain penerapan hukum itu sebagai upaya social engineering. Tugas yudisial hakim tidak lagi dipahami sekedar sebagai penerap undang-undang terhadap peristiwa konkrit (berupa berbagai kasus dan konflik) atau sebagai sekedar corong undang-undang (boncha de la loi) tetapi juga sebagai penggerak social engineering.Kata kunci : sociological jurisprudence, pembangunan, sistem hukum

Abstract

Salah satu bukti kedaulatan rakyat adalah melakukan pemilihan Presiden secara langsung, maka sebagai konsekuensi logisnya, selama jangka waktu tertentu Presiden harus dijamin tidak dijatuhkan melalui mekanisme pertanggungjawaban politik. Mekanisme pemberhentian Presiden melalui pertanggungjawaban haluan negara tidak benar untuk tetap dipertahankan. Presiden dan/atau Wakil Presiden hanya dapat diberhentikan dalam masa jabatannya oleh MPR atas usul DPR, baik apabila terbukti telah melakukan pelanggaran hukum berupa pengkhianatan terhadap negara, korupsi, penyuapan, tindak pidana berat lainnya, atau perbuatan tercela maupun apabila terbukti tidak lagi memenuhi syarat sebagai Presiden dan/atau Wakil Presiden.Kata kunci: impeachment, presiden dan/atau wakil presiden, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945

Abstract

Advancing the general welfare is the goal of the state as well as the mandate of the constitution. Welfare not only ensures a fair and equitable distribution of wealth; it also reduces poverty and provides basic services and provides social protection for every citizen. However, this noble goal has not been realized optimally. This research is normative legal research, and analyzed juridically and described descriptively. The results of the research on the principle of equitable welfare efficiency need to be supported by the state, civil society, and the market running in harmony. The welfare state that Indonesia wants based on Pancasila in the context of realizing social justice for all Indonesian people who have the spirit of divinity, civility, kinship and democratic mutual cooperation.

Abstract

The government is authorized to carry out agricultural water management in the village. This agricultural water management aims to ensure that water needs are well fulfilled and sustainable for the welfare of village communities. In this case, the Yosowilangun Lor Village Government, Yosowilangun District, Lumajang Regency, seeks to maintain sustainable agricultural water governance through the authority of the Village Government by establishing Village Regulation Number 7 of 2021 concerning Sustainable Agricultural Water Governance. However, based on the analysis of the situation, there are still problems regarding the implementation of Village Regulation 7 of 2021 concerning Sustainable Agricultural Water Governance, especially regarding the institutional structure and culture of the community in carrying out agricultural water governance in the country. Therefore, in order to strengthen the institutional structure. Moreover, the culture of the community in carrying out agricultural water governance in the village, steps are needed to strengthen the institutional management of agricultural water in the village.

Abstract

Website is a means to realize E-Government. Village E-Government is the implementation of village government through the use of websites, which is very important as a means of democracy and village government accountability for governance. The method used is to conduct training for Sukopuro village officials who are responsible for managing the website. The training included an introduction to creating the email, creating a Google form, and an introduction to how to accommodate community input from the Google form to the Sukopuro Village Government website. The results of this activity were very positive and received a good response from the village because it added knowledge and skills in organizing the web and creating Google forms as a means of community democracy and village development, in the framework of implementing the Sukopuro Village Government website. The understanding of village officials in Sukopuro Village about the website increased from 20% to 80%. Communities have the opportunity to increase their democracy in village development and stipulate of village government public policies through the Google form and website in the village.

Abstract

Equality are the essence of the principles of popular sovereignty. In Indonesia, the principle of popular sovereignty has been transformed and formulated into a legal basis in statutory regulations. However, setting the minimum age limit for Presidential and Vice Presidential Candidates has actually created injustice. This research aims to explain the principle of popular sovereignty in relation to the minimum age limit for presidential and vice presidential candidates. This type of research is normative juridical, with a prescriptive normative approach apart from being based on state teachings. The analysis was carried out normatively qualitatively. Research results: (1) A country that adheres to the principle of popular sovereignty wants every public position to be open and to provide equal and equal opportunities for every citizen to achieve it, including the positions of President and Vice President. (2) The regulation that limits the minimum age to 40 years as a requirement for candidates for President and Vice President is an action that violates human rights, is less sensitive to changes and the legal needs of society, and is not in accordance with the essence of popular sovereignty.

Abstract

The reconstruction of legal norms for people with disabilities as regional head candidates aims to improve regulations to make them more inclusive and fair. This reconstruction includes eliminating discriminatory requirements, such as physical or mental conditions that are not relevant to the ability to perform tasks. In addition, the law should require election administrators to provide reasonable accommodations, such as physical accessibility and technological assistance during the nomination and campaign process. To encourage the involvement of political parties, providing incentives for parties that nominate people with disabilities is also needed. This reconstruction strengthens legal protections for persons with disabilities, supports their political rights, and ensures equal participation in local democratic processes in accordance with the constitution and international commitments, including the Convention on the Rights of Persons with Disabilities.

Abstract

Penelitian ini bertujuan untuk mengkaji secara yuridis dan etik pelimpahan wewenang antar profesi kesehatan di fasilitas pelayanan kesehatan di Indonesia. Metode yang digunakan adalah yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan dan telaah dokumen hukum yang relevan. Analisis data dilakukan secara kualitatif melalui tahapan reduksi data, penyajian data, dan penarikan kesimpulan guna memperoleh pemahaman mendalam mengenai kesesuaian praktik pelimpahan wewenang dengan norma hukum dan prinsip etik profesi kesehatan. Hasil penelitian menunjukkan bahwa praktik pelimpahan wewenang antar profesi kesehatan di lapangan masih mengalami ketidaksesuaian signifikan dengan ketentuan hukum yang berlaku dan prinsip etik profesi. Pelimpahan sering kali dilakukan tanpa kepastian tertulis, pengawasan yang kurang optimal, serta penerima pelimpahan yang belum sepenuhnya memenuhi kompetensi yang dipersyaratkan. Ketidakjelasan pembagian tanggung jawab hukum menimbulkan dilema etis dan risiko hukum bagi tenaga kesehatan, sementara kurangnya pedoman teknis yang rinci memperbesar potensi pelanggaran etik dan hukum. Pelanggaran yang muncul meliputi pelimpahan kewenangan yang tidak tepat, overdelegation, penyalahgunaan kewenangan, serta komunikasi dan koordinasi yang buruk antarprofesi, yang secara keseluruhan dapat mengancam keselamatan pasien dan mutu pelayanan kesehatan.

Abstract

Parental refusal of immunization for children creates a conflict between parental rights in caregiving and the child’s right to health, which is guaranteed by law. This research aims to analyze the conflict between these two rights within the framework of Indonesian health law and to explain the state's authority to protect children's health rights. This research uses a normative juridical method by analyzing legal regulations, scholarly literature, and legal principles concerning the best interests of the child. The results indicate that parental rights are relative and may be restricted if they endanger the child's health. The state has a constitutional obligation to ensure immunization as part of the child’s right to health. The best interests of the child principle form the legal basis for limiting parental rights, and refusal of immunization can be classified as neglect of the child’s rights. This study recommends strengthening immunization regulations, community education, and inter-institutional collaboration between health and legal sectors to ensure optimal protection of children's rights.

Abstract

Desa inklusi memberikan ruang pada minoritas yaitu penyandang disabilitas terhadap haki dani kewajibani yangi isetara, iharkat idan imartabat iyang isederajat serta memiliki iperan idan kedudukan iyang isama idalam kehidupan masyarakat di desa. Pemerintah Desa Ngawonggo Kabupaten Malang telah mengupayakan perlindungan hukum terhadap penyandang disabilitas dengan menetapkan Peraturani Desai Nomori 2i Tahuni 2023i tentangi Pembentukani Kelompoki Inklusi Penyandang Disabilitas Desa. Metode yang digunakan adalah pelatihan terapi fisik kepada kelompok penyandang Disabilitas. hasilnya ii pengabdiani kepada masyarakat ini dalam rangka optimalisasi merealisasikan tugas dan fungsi kelompok inklusi sebagai upaya mempercepat kemandirian bagi penyandang disabilitas melalui pelatihan terapi fisik.
