Abstract

Konsitusi memberikan kedudukan yang sama dan persamaan hak antar warga negara. Bentuk persamaan hak salah satunya adalah kebebasan menyampaikan pendapat. Dimana salah satunya adalah adanya jaminan kemerdekaan pers. Pers adalah lembaga sosial dan wahana komunikasi massa yang melaksanakan kegiatan jurnalistik yang meliputi mencari, memperoleh, memiliki, menyimpan, mengolah, dan menyampaikan informasi baik dalam bentuk tulisan, suara, gambar, suara dan gambar, serta data dan grafik maupun dalam bentuk lainnya dengan menggunakan media cetak, media elektronik, dan segala jenis saluran yang tersedia. Adapun yang menjadi permasalahan dalam tulisan ini adalah Bagaimana peran dan fungsi pers dalam penegakkan serta Bagaimana Tanggung Jawab Pers dan Kode Etik Pers ditinjau dari UU Nomor 40 Tahun 1999. Adapun metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Adapun kesimpulan dalam penelitian ini pertama bahwa Pers merupakan pilar demokrasi keempat setelah eksekutif, legislatif dan yudikatif, pers sebagai kontrol atas ketiga pilar itu dan melandasi kinerjanya dengan check and balance. untuk dapat melakukan peranannya perlu dijunjung kebebasan pers dalam menyampaikan informasi publik secara jujur dan berimbang. Kedua kebebasan Pers bukan mutlak untuk pers semata, melainkan untuk menjamin hak-hak masyarakat untuk memperoleh informasi.

Abstract

Penyandang disabilitas sering menghadapi hambatan dalam mengakses pendidikan yang setara, terutama dalam pendidikan inklusif yang belum sepenuhnya diterima atau dipahami oleh masyarakat. Di SLB Negeri 02 Jakarta, terdapat tantangan dalam meningkatkan pemahaman mengenai hak-hak pendidikan inklusif di kalangan penyandang disabilitas dan masyarakat sekitar. Tujuan kegiatan pengabdian ini adalah untuk memberdayakan penyandang disabilitas dengan memberikan pemahaman yang lebih baik mengenai hak dan kewajiban mereka dalam pendidikan inklusif, serta memberikan keterampilan yang dapat mendukung pengembangan diri mereka. Mitra dalam kegiatan ini adalah siswa-siswi SLB Negeri, komite orang tua, interpreter, dan guru atau pengajar SLB Negeri 02 Jakarta. Pelaksanaan kegiatan ini menggunakan metode Participatory Rural Appraisal (PRA), yang berfokus pada pendekatan partisipatif untuk mengumpulkan informasi dan memahami kondisi sosial, ekonomi, serta lingkungan di sekitar penyandang disabilitas. Hasil dari kegiatan pengabdian ini menunjukkan bahwa mayoritas peserta, baik penyandang disabilitas maupun masyarakat sekitar, merasa lebih terinformasi tentang hak-hak mereka dalam pendidikan inklusif. Selain itu, peserta juga merasa lebih percaya diri dalam mengakses layanan pendidikan yang sesuai dengan kebutuhan mereka. Evaluasi kegiatan menunjukkan bahwa peserta sangat antusias dan berkomitmen untuk mengimplementasikan pemahaman yang didapat untuk mendukung pendidikan inklusif di lingkungan mereka. Program ini berhasil meningkatkan pemahaman mengenai pentingnya pendidikan inklusif serta memberi dampak positif pada pengembangan potensi penyandang disabilitas.

Abstract

In Indonesia, foreigners' land ownership is restricted by law. However, in practice, some foreigners legally own Indonesian land through a nominee agreement. This study aims to find out the importance of understanding legal protection for the parties involved in the nominee agreement, as well as the judge's considerations in deciding the case of villa business management with a nominee agreement in Decision No. 129/Pdt.G/2021/PN. Amp. The research method used is normative juridical which involves the analysis of regulations and cases related to land ownership by foreigners through nominee agreements, and through literature studies and data access through journals, as well as the Internet. The results of this study show that the form of protection for the parties involved in the nominee agreement is that the interests of the parties can be protected if there is a basis to prove when negligence occurs as a result of a legally made agreement. Then the judge's consideration in Decision No.129/Pdt.G/PN. Amp is indeed in accordance with the provisions applicable in Indonesia, but there is still a void regarding the regulation of ownership of land and buildings on it which if not regulated in the decision will have the potential to cause illegal control by foreign citizens.

Abstract

The rapid advancement of technology has significantly impacted various aspects of society, particularly in the field of trade conducted through electronic systems. One important innovation emerging from this development is the smart contract. However, alongside these advancements, new challenges have arisen, especially technical vulnerabilities that can occur at any time. Although smart contracts offer increased efficiency and security, they remain inherently susceptible to bugs. Therefore, this study aims to analyze the potential losses caused by bugs in smart contracts within electronic trading systems, as well as to examine how existing legal instruments protect parties harmed by such bugs. This research employs a normative legal methodology, utilizing statutory and conceptual approaches, and relies on secondary data obtained through a literature review. The findings indicate that bugs in smart contracts used in electronic trading can result in both material and immaterial losses for users. Furthermore, legal protection to mitigate such losses is supported by two main pillars: preventive protection and repressive protection, both of which are guaranteed under Indonesian positive law. Thus, the findings show that although Indonesia does not yet have specific legislation explicitly regulating smart contracts, legal protection for aggrieved parties is still available through the existing legal framework, including the Electronic Information and Transactions Law (UU ITE), the Consumer Protection Law (UU PK), Government Regulation on Electronic Systems and Transactions (PP PSTE), and Government Regulation on Trading Through Electronic Systems (PP PMSE) which collectively cover protection aspects in technology-based trade transactions.

Abstract

The purpose of this paper is to analyze the compensation mechanism as a form of business actor's accountability for overclaim practices in skincare product promotions, focusing on a case study of the Azarine product. Overclaim is an action by business actors in providing excessive information or claims regarding the benefits of a product without adequate scientific evidence. This practice not only violates the principles of transparency and honesty in promotion but also has the potential to mislead and harm consumers. This study uses an empirical legal method with a statutory approach and a case approach. The results of the study show that overclaims carried out by business actors violate the provisions of Law Number 8 of 1999 concerning Consumer Protection and BPOM Regulation Number 3 of 2022 concerning Cosmetic Claims. Business actors who are proven to have committed overclaims are obliged to be responsible for providing compensation to consumers in the form of a refund, product exchange, or other compensation in accordance with the losses experienced. This shows the importance of business actors' responsibility to ensure that consumer rights are fulfilled

Abstract

Pandemi COVID-19 sangat berdampak terhadap banyak sektor kehidupan rakyat Indonesia, tanpa terkecuali ketenagakerjaan. Hingga Oktober 2020, pekerja yang terkena Pemutusan Hubungan Kerja (PHK) maupun dinonaktifkan dalam kurun waktu yang tidak ditentukan mencapai 6,4 juta sebagai imbas dari kerugian yang terus dialami perusahaan. Lebih buruk lagi, banyak di antara mereka yang tidak memperoleh haknya setelah mengalami PHK dengan alasan COVID-19 tersebut. Hal ini menunjukkan peraturan perundang-undangan yang selama ini berlaku tidak mampu dilaksnakan sepenuhnya. Namun, kini, telah terjadi perubahan peraturan mengenai hak pekerja ter-PHK, yakni Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja yang mencabut/mengubah beberapa ketentuan dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Tujuan yang ingin diraih dengan adanya penelitian ini adalah untuk memperoleh hasil analisis perihal hak-hak pekerja ter-PHK dengan alasan COVID-19 menurut Undang-Undang Cipta Kerja, dan bentuk pelindungannya. Analisis dilakukan melalui metode studi kepustakaan dengan menggunakan Undang-Undang Cipta Kerja sebagai bahan analisis utama, dan ditunjuang dengan bahan hukum lain yang terkait. Penelitian ini menghasilkan kesimpulan bahwa terjadi perubahan mengenai hak-hak pekerja ter-PHK, khususnya dengan alasan COVID-19. Di samping itu, Undang-Undang Cipta Kerja juga turut memberikan pelindungan terhadap hak pekerja ter-PHK.

Abstract

This study examines the extent to which the public can access civil dispute decisions through the e-Court system as an implementation of the principle of open trials. Through a normative juridical approach to legal regulations and court decisions, it was found that although e-Court can accelerate and simplify judicial administration, public access to decisions remains unequal. Electronic copies of decisions are only provided to parties directly involved in the case, while the general public or third parties must still submit manual requests or wait for publication in the Supreme Court Decision Directory, which is often not updated quickly and comprehensively. Differences in implementation in each regional court also widen the gap in transparency. The results of this study indicate that the success of e-Court in supporting judicial transparency requires improvements to the publication system and standardization of procedures to ensure more secure and equitable public access to decisions.
