Abstract

The Judicial Commission is an institution that was born as a result of demands for reform of the judiciary in Indonesia. The existence of the KY is not only limited to what is contained in the constitutional mandate, but is an external institution that has duties related to judicial oversight. More than that, the KY has a role in carrying out the function of checks and balances so that in the judicial power conditions can be created that are balanced, independent and free. Along his journey, KY experienced twists and turns. For example, the resistance of Supreme Court justices as externally supervised subjects, adjudication efforts at the Constitutional Court which weaken the role of the Judicial Commission as an external institution, and the authority to appoint and appoint Supreme Court judges, has made the Judicial Commission farther and farther away from realizing a clean and noble judiciary within the judiciary. The method used in this study is normative juridical with a statutory approach, a conceptual approach, and a case approach. The resulting conclusion is that through the reconstruction of the KY's authority, it is hoped that proposals for the appointment of constitutional judges can be based more on clear and transparent criteria and procedures, as well as taking into account the integrity and competence of prospective constitutional judges. In addition, to realize this, it is necessary to amend the 1945 Constitution of the Republic of Indonesia by amending the provisions of Article 24B paragraph (1) and Article 24C paragraph (3). These changes extend to laws, such as the Constitutional Court Law, the Supreme Court Law, and the Judicial Commission Law.

Abstract

The trade sector is one of the supports for the continuity of human life in increasing economic growth. The era of global trade is in line with international conventions that have been ratified by Indonesia so the role of brands is significant in maintaining healthy business competition. A brand becomes a marker that can be expected to produce economic value. Brands have an important role in describing a product's quality and commercial value, so it is necessary to apply for brand registration. However, according to the Directorate General of Intellectual Property (DJKI) of the Ministry of Law and Human Rights, there are still many MSME players who have not registered their brands, because MSME capital is still limited and there is a lack of understanding of the benefits of brand registration for the MSME industry. The observation method was used when searching for target partners, which in this activity was Kedai Geprek Mavera, an MSME in the culinary sector in the South Jakarta area. The activity was carried out in the form of socialization to MSME actors directly orally, covering the meaning of brand rights, the importance of registering a brand right, then the risks if the brand is not registered, as well as a simulation of registering the target partner's brand rights.

Abstract

The problem of stunting remains a prevalent health issue in Indonesia. Stunting not only affects typically developing individuals but can also occur among persons with disabilities. The suboptimal prevention of stunting is largely due to insufficient knowledge regarding its control and prevention within the disability community. Based on this concern, the Community Service Team of UPNVJ conducted an outreach activity with the aim of educating persons with disabilities about stunting prevention. The implementation method of this activity consisted of three stages: firstly, the pre-activity phase involved preparing the necessary resources and conducting location surveys. Secondly, the execution phase included checking for stunting among participants followed by providing educational sessions on stunting prevention. Lastly, there were discussions on stunting prevention strategies and distribution of support packages to the participants. The result of this activity is that participants gain an understanding of the methods and steps for controlling and preventing stunting among individuals with disabilities, and they are able to create balanced meal patterns or portions to prevent stunting.

Abstract

Penyandang disabilitas sering menghadapi hambatan dalam mengakses pendidikan yang setara, terutama dalam pendidikan inklusif yang belum sepenuhnya diterima atau dipahami oleh masyarakat. Di SLB Negeri 02 Jakarta, terdapat tantangan dalam meningkatkan pemahaman mengenai hak-hak pendidikan inklusif di kalangan penyandang disabilitas dan masyarakat sekitar. Tujuan kegiatan pengabdian ini adalah untuk memberdayakan penyandang disabilitas dengan memberikan pemahaman yang lebih baik mengenai hak dan kewajiban mereka dalam pendidikan inklusif, serta memberikan keterampilan yang dapat mendukung pengembangan diri mereka. Mitra dalam kegiatan ini adalah siswa-siswi SLB Negeri, komite orang tua, interpreter, dan guru atau pengajar SLB Negeri 02 Jakarta. Pelaksanaan kegiatan ini menggunakan metode Participatory Rural Appraisal (PRA), yang berfokus pada pendekatan partisipatif untuk mengumpulkan informasi dan memahami kondisi sosial, ekonomi, serta lingkungan di sekitar penyandang disabilitas. Hasil dari kegiatan pengabdian ini menunjukkan bahwa mayoritas peserta, baik penyandang disabilitas maupun masyarakat sekitar, merasa lebih terinformasi tentang hak-hak mereka dalam pendidikan inklusif. Selain itu, peserta juga merasa lebih percaya diri dalam mengakses layanan pendidikan yang sesuai dengan kebutuhan mereka. Evaluasi kegiatan menunjukkan bahwa peserta sangat antusias dan berkomitmen untuk mengimplementasikan pemahaman yang didapat untuk mendukung pendidikan inklusif di lingkungan mereka. Program ini berhasil meningkatkan pemahaman mengenai pentingnya pendidikan inklusif serta memberi dampak positif pada pengembangan potensi penyandang disabilitas.

Abstract

Kehadiran e-commerce saat ini menawarkan kemudahan bagi pengguna, seperti kenyamanan, variasi pilihan, aksesibilitas, penelusuran, perbandingan harga, serta kemudahan bertransaksi dari mana saja dan kapan saja. Namun, e-commerce dinilai sangat rentan karena posisi pelaku usaha sedikit lebih diuntungkan daripada posisi konsumen yang dapat mengakibatkan konsumen menjadi lebih lemah daripada pelaku usaha sehingga menimbulkan ketidakpuasan dan kerugian. Belum lagi e-commerce juga membawa beberapa tantangan yang berkaitan dengan hak-hak konsumen, privasi data pribadi, sistem keamanan, kualitas produk, dan penyelesaian sengketa. Upaya untuk melindungi konsumen dan pelaku usaha di Indonesia telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Namun, UUPK kurang relevan dan membutuhkan rekonstruksi mengingat timbulnya masalah-masalah baru dalam e-commerce dan financial technology khususnya dalam menangani penyelesaian sengketa dan perlindungan konsumen pada pihak ketiga. Dalam penelitian ini, metode yang digunakan adalah pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil dari penelitian ini membuktikan bahwa penyelesaian sengketa konsumen di era digital menjadi tantangan besar sebab terdapat tumpang tindih kewenangan antarlembaga, khususnya BPSK dengan Kementerian Perdagangan RI. Hal ini dapat terjadi karena UUPK belum secara eksplisit mengatur tentang pembagian kewenangan antara BPSK dan Kementerian Perdagangan RI dalam penanganan sengketa konsumen dalam transaksi digital. Diperlukan penyempurnaan hak dan kewajiban serta tanggung jawab konsumen dan pelaku usaha sebagai langkah preventif dan memperjelas tanggung jawab pelaku usaha, juga mendorong penguatan kelembagaan yang berkorelasi dengan perlindungan konsumen.
