Abstract

Abstract

Abstract

This research aims to examine the effectivenessof legal settlements regarding the nouise disrtubances caused by sound horeg through  a restorative justice approach . sound horeg refers to high-decibel audio devices used in community events such as birthdays, circumcisions, and carnivals. Excessive and unregulated use of these devices often disturbs public comfort and order. This can be considered an unlawful act, as it violates established noise level thresholds and infringes on the public’s right to a peaceful and healthy environment. The research adopts a normative juridical method with statutory and conceptual approaches. Data sources include literature review of relevant regulations such as the Criminal Code, Law No. 32 of 2009 on Environmental Protection and Management, and Ministerial Regulations on noise level standards. Secondary data were obtained from articles, news reports, community complaints, and scientific journals. The findings show that a restorative justice approach is more effective in resolving legal issues related to sound horeg compared to repressive methods. Restorative justice emphasizes deliberation, restoration of social relations, education for offenders, and continuous supervision. This approach helps minimize social conflict, enhances legal awareness in the community, and supports the creation of sustainable public order.

Abstract

Kidney transplantation is a crucial healthcare service in managing end-stage chronic kidney disease. Despite its significant benefits for patients' survival and quality of life, this medical procedure may raise legal issues, particularly regarding the illegal trade of human organs. This study aims to analyze the legal basis, authority, and legal protection for urologist specialists in delivering kidney transplant services in Indonesia. The method employed is normative legal research with statutory and conceptual approaches. The findings indicate that kidney transplantation is permitted as long as it is conducted for humanitarian purposes, free from commercialization, and in accordance with positive law, such as the Health Law No. 17 of 2023 and Government Regulation No. 53 of 2021. Furthermore, urologist specialists must meet professional competency standards and operate within their authorized scope of practice. Legal protection is essential to ensure legal certainty in medical practice. From both Islamic and Catholic religious perspectives, kidney transplantation is allowed if performed voluntarily and ethically to help others.

Abstract

Apartments are included in the Commercial Apartment category as regulated in Article 1 number 10 of Law Number 20 of 2011 concerning Apartments (UURS), which are organized for commercial purposes to gain profit. In practice, developers as business actors often conduct promotions by offering various facilities and advantages of apartment units to consumers. However, it is not uncommon for the promised facilities to be not fulfilled, or the units are not handed over on time as stated in the Sales and Purchase Agreement (PPJB), resulting in default. This study aims to analyze the forms of default committed by developers in the delivery of apartment units and examine the form of legal protection for consumers who are harmed. The research method used is normative juridical with a statutory approach and literature study. The results of the study indicate that defaults committed by developers cause material losses and legal uncertainty for consumers, and place consumers in a weaker legal position in sales and purchase transactions. Legal protection for consumers should be sought through fair and balanced agreements, but in reality the PPJB has not provided adequate legal certainty. In the event of a default, consumers have the right to demand compensation as regulated in Articles 1238, 1243, and 1249 of the Civil Code, and can seek dispute resolution as regulated in Article 105 of the UURS through litigation in court.

Abstract

This research has a specific objective in providing descriptions and information about criminal offenses in cyberspace, today, various kinds of goals and motives carried out by a group of irresponsible individuals or people who then deliberately make a fuss with their special expertise, as a result. The existence of these crimes has implications for a global threat to the whole world, especially to individuals, legal entities, and government agencies. This research uses the normative juridical method, namely research that focuses on literature studies such as books, scientific papers/ journals, legislation and other legal materials that support this research which is then implicated in case studies that occur in cyberspace. So far, the impact or implication of criminal violations in cyberspace is not only misleading for readers of electronic information, but also threatens national sovereignty and the slow pace of economic growth. Crime in cyberspace that does not recognize space and time, if a legal umbrella is not immediately prepared in upholding the law and achieving justice for society, it has the potential to increase the level of crime violations that have started to enter the era of the Industrial Revolution 4.0 and will transform in the 5.0 era. prioritizing the digital side as a technology communication tool that is increasingly dangerous for the young generation to come, if not immediately anticipated by the regulation of a more adequate and more dynamic legal system. Even though currently Indonesia already has ITE Law no. 11/2008 and some have been updated by the issuance of Law no. 16/2016 but it is still not enough to deal with global flows across countries.
