Abstract

In today's business world, there are actually many agreements that contain unfair elements against parties whose economic or social weaknesses are weaker on the pretext of maintaining unfair business competition. However, it cannot be denied that behind these business practices there are various kinds of competition. which is not healthy. This writing uses a normative juridical legal research method (normative research) with descriptive analytical research specifications that use secondary data. The data collection procedures are in the form of documentation of notes or quotations, searching legal literature, books and others related to problem identification both offline. and online which are then analyzed through the content analysis method (centent analysis method) with a focus on the problem of how the elements of a business agreement cause unfair business competition and how the responsibility of business actors to business agreements that cause unfair business competition. Whereas some elements of the agreement that cause unfair business competition are agreements to control the production and or marketing of goods and or services which may result in monopolistic practices and unfair business competition, an agreement that sets the price for a good and or service that must be paid by consumers or customers in the same relevant market.

Abstract

Berdasarkan kegiatan usaha yang dilaksanakan tersebut, berdasarkan ketentuan Pasal 74 Undang-undang No 40 Tahun 2007 Tentang Perseroan Terbatas(UUPT), maka sudah sewajarnya Perusahaan Perkebunan melaksanakan program corporate social responsibility sebagaimana dimaksud UUPT. Hal ini mengingat kegiatan usaha yang dilaksanakan oleh Perusahaan Perkebunan berkaitan dengan sumber daya alam, sehingga memiliki tanggung jawab sosial dan lingkungan.  Secara teori penerapan corporate social responsibility, umumnya di dasari pada tiga hal pokok, yaitu CSR adalah: pertama, suatu peran yang sifatnya sukarela (voluntary) dimana suatu perusahaan membantu mengatasi masalah sosial dan lingkungan, oleh karena itu perusahaan memiliki kehendak bebas untuk melakukan atau tidak melakukan peran ini; Kedua, disamping sebagai institusi profit, perusahaan menyisihkan sebagian keuntungannya untuk kedermawanan (filantropi) yang tujuannya untuk memberdayakan sosial dan perbaikan kerusakan lingkungan akibat eksplorasi dan eksploitasi. Ketiga, corporate social responsibility sebagai bentuk kewajiban (obligation) perusahaan untuk peduli terhadap dan mengentaskan krisis kemanusiaan dan lingkungan yang terus meningkat

Abstract

Perjanjian sewa-menyewa adalah suatu persetujuan dengan mana pihak yang satu mengikatkan diri untuk memberikan kenikmatan suatu barang kepada pihak lain selama waktu tertentu, dengan pembayaran suatu harga yang telah disanggupi oleh pihak yang lain. Yang bertujuan untuk memberikan hak dan kewajiban pemakaian saja, bukan hak milik atas suatu benda.Penelitian yang dilakukan adalah penelitian hukum yuridis empiris dengan melakukan wawancara dan penelurusan langsung kelapangan sebagai data primernya serta data sekunder dan data tersier. Berdasarkan hasil penelitian dapat dipahami bahwa Bentuk dari perjanjian sewa-menyewa rumah kontrakan yang direnovasi tanpa sepengetahuan pemilik ini berbentuk perjanjian tertulis yang dilakukan dibawah tangan dengan pemilik yang menjatuhkan kuasa kepada pihak ketiga untuk membuat perjanjian sewa-menyewa tersebut, Klausul-klausul dalam perjanjian sewa-menyewa rumah kontrakan juga terdapat di Peraturan Pemerintah No. 44 Tahun 1994 Tentang Penghunian Rumah Oleh Bukan Pemilik Pasal 4 ayat(2) Perjanjian sekurang-kurangnya mencantumkan ketentuan mengenai hak dan kewajiban, jangka waktu, dan besaran harga. Perlindungan hukum terhadap pemilik rumah konrakan yang direnovasi tanpa sepengetahuan pemilik itu terdapat di pasal 9 ayat (2) PP No. 44 Tahun 1994 Penyewa dilarang mengubah bentuk bangunan rumah tanpa izin tertulis dari pemilik. Oleh karena itu sesuai juga dalam pasal 11 ayat (1) huruf b jika yang dirugikan pihak pemilik, maka penyewa berkewajiban mengembalikan rumah dengan baik seperti keadaan semula , dan tidak dapat meminta Kembali uang sewa yang telah dibayar.

Abstract

The crime of theft of tower signal transmitter base transceiver station equipment is a crime of theft in which the object stolen is equipment for transmitting signals for cellphones, wifi, and electronic devices that use other signals. In Article 362 of the Criminal Code, theft is anyone who Anyone who takes something, which wholly or partly belongs to another person, with the intention of possessing it unlawfully, is threatened with theft, with a maximum imprisonment of five years or a maximum fine of nine hundred million rupiah. In this article it is regulated to ensnare perpetrators of criminal acts of theft. The research method used is normative juridical research, namely legal research carried out by examining library materials or secondary data. Criminal law enforcement is part of criminal policy as one of the overall crime prevention policies. Indeed, criminal law enforcement is not the only thing that can be a hope for being able to resolve or deal with crime completely, but its presence is highly expected in Indonesia which is based on law. to enforce criminal law in Indonesia. Law enforcement is aimed at increasing order and legal certainty in social life. This is done to regulate the functions, duties and authority of institutions that have the task of enforcing the law

Abstract

The large number of criminal acts of theft occurring among Indonesian society has created a feeling of anxiety and fear of losing the property they own, therefore law enforcement efforts by the Prosecutor's Office must also be carried out seriously and professionally. The formulation of the problem is how to analyze the decision with aggravated theft in Decision Number: 504/Pid.B/2020/PN SRH, and what is the authority of the Prosecutor in trying to prove the crime of aggravated theft, as well as how to apply the law for the crime of aggravated theft in Decision Number: 504/Pid.B/2020/PN.Srh. The research method used is normative legal research. The legal provisions for the crime of aggravated theft are regulated in the provisions of Article 363 of the Criminal Code, categories of acts of theft that can be aggravated, due to the situation in which the theft is carried out, such as stealing livestock, stealing during riots, stealing at night, stealing from more than one perpetrator, and stealing by breaking into a house, and the Prosecutor's authority in trying to prove the crime of theft by aggravation, is as a functional official who is authorized by law to act as a public prosecutor and implement court decisions that have obtained permanent legal force and other authorities based on law. law, as well as the judge's consideration in the crime of theft with the aggravation of decision Number: 504/PID.B/2020/PN.SRH, that all the elements of Article 363 paragraph (1) 1st and 4th of the Criminal Code have been fulfilled and there is the Judge's confidence , then the Defendant must be declared to have been legally and convincingly proven as in the first alternative indictment. So, as a suggestion, the rules regarding criminal sanctions in the crime of theft with weights should be supplemented with compensation for losses experienced by the victim, and the prosecutor should be able to try to resolve theft cases through maximum restorative justice efforts.

Abstract

Criminal acts committed by children are a serious problem for the government in tackling criminal acts in Indonesia, where children are the perpetrators. As previously explained in the Indonesian constitution, the State guarantees every child's right to survival, growth and development and the right to protection from violence and discrimination, as explained in the 1945 Constitution Article 28 B paragraph 2. Because children are an important element of the State. The formulation of the problem is how to regulate diversion against ABH and how the Prosecutor's efforts to implement diversion against ABH, as well as what obstacles the Serdang Bedagai District Prosecutor's Office faces in efforts to implement diversion against ABH. Normative legal research methods. Regarding the provisions for diversion against ABH, it is regulated in Law No: 11 of 2012 UUSPPA, and efforts to implement diversion by Prosecutors against ABH, are regulated in PERJA No: PER-006/A/J.A/O4/2015 concerning Guidelines for Implementing Diversion in Prosecution Level, to respond to the mandate of the UUSPPA, in particular implementing the Prosecutor's obligation to seek diversion at the prosecution level. There are two types of obstacles found in implementing diversion, namely internal obstacles, namely special children's room facilities that do not meet standards and external obstacles that come from parties who are not willing to attend diversion deliberations. So the suggestion is that there should be an update in the UUSPPA because criminal acts committed by children are increasing, making ABH prevention regulations involving schools, parents and community leaders.

Abstract

Corruption is closely related to the abuse of authority or influence that exists in a person's position as an official which deviates from legal provisions so that these actions have harmed the State's finances. The formulation of the problem is how to criminalize abuse of authority which results in harm to the State's finances, and what criminal responsibility is in cases of criminal acts of corruption committed due to abuse of authority, as well as how judges consider in cases of criminal acts of corruption committed due to abuse of authority in case Number: 85/Pid.Sus-Tpk/2018/PN.Mdn). The research method used is normative legal research. In relation to the criminal regulation of abusing authority which results in harm to the State's finances, it is regulated in Article 3 of the Corruption Law and the criminal responsibility for corruption with the mode of abuse of authority under Article 3 of the Corruption Law must have an element of every person who has authority, so that the conditions for a person to be declared to have violated Article 3 namely that he must have the authority, position, title and consideration of the Panel of Judges in cases of criminal acts of corruption committed due to abuse of authority in case Number: 85/Pid. Sus-Tpk/2018/PN.Mdn), Defendant "AS" was not legally and convincingly proven guilty of committing a crime as in the Primair indictment, however, Defendant "AS" was declared by the Panel of Judges to be legally and convincingly proven guilty of committing the crime of "Corruption abuseof authority” as stated in the indictment of the Subsidiary Public Prosecutor. So, as a suggestion, there should be regulations established so that the Prosecutor's Office is given the authority to supervise State Officials as the Authority for Using the Budget, since they are about to make policies, so that there are no abuses of authority that result in harm to State finances.

Abstract

This research is to see the fulfillment of women's educational rights according to the Universal Declaration of Human Rights (UDHR) and Islamic law. The problem is what is the right to education for women according to the UDHR and how Islamic law views women's right to education. The method used to achieve the objectives of this research is normative legal research, namely research whose data is sourced from secondary data. The nature of this research is descriptive, which aims to provide an overview of women's rights to education. The research results show that education is the key to freedom which helps an individual to develop himself and then contribute to society. This concept has become an international consensus. In the context of human rights, education is a human right that must be respected, fulfilled and protected. In the UDHR it is known that every individual has the right to obtain education, at least basic education. When some people find it difficult to obtain the right to education which is their basic right, the party who is obliged to fulfill this right is none other than the state. Islam places women in a very noble position. Islam does not prohibit women from studying and teaching knowledge, in fact it is Islam that requires them to seek knowledge and gives them the freedom to provide teaching about the knowledge they have mastered. Islam does not deny the intelligence of women.

Abstract

The era of globalization has made Indonesia a country that is open to the entry of foreign citizens to carry out activities in the fields of industry, tourism and other trade in Indonesia. In connection with this, in order to ensure the maintenance of stability from the influence of foreigners in Indonesia, regulations regarding the rights and obligations of foreigners are regulated in Law Number 9 of 1992 in conjunction with Law No. 37 of 2009 concerning Immigration which has been amended by Law Number 6 of 2011 concerning Immigration. To ensure that the provisions in this law are adhered to, this law also regulates criminal provisions that regulate several acts that qualify as criminal acts in the immigration sector committed by foreigners. Results of research on types of residence permits for foreign nationals in Indonesia based on Law Number 6 of 2011 concerning Immigration in the jurisdiction of the Class I North Sumatra Immigration Office. Article 1 of Law Number 6 of 2011 states that a permanent residence permit is a permit granted to foreigners. certain to reside and remain in the territory of Indonesia as a resident of Indonesia.

Abstract

This article is to find out the law of bitcon as a currency that is widely used as a means of payment and public investment in the era of the digital economy. From the data obtained now the use of bitcoin there are already around 200,000 Bitcoin investors in Indonesia who at least represent transaction flows worth Rp. 4,000,000,000, (four billion) per day.  Bank Indonesia as the authority in the financial sector states that bitcoin is not a legal currency that can be used for transactions in trade so that this will create a legal vacuum. The approach method used in this study is a normative approach by reviewing applicable laws and regulations relating to bitcoin currency. The data source used is secondary data from the results of literature research which is then analyzed qualitatively. The results showed that public ignorance of bitcoin's legal position as a means of payment in trading and investing will have an impact on the bitcoin user community not getting legal protection. For this reason, it needs socialization and education from the government so that people are not deceived in the use of bitcoin.
