Abstract

In the current digital era, information technology has been widely used for the development of the financial industry which encourages the growth of alternative financing for the business world, especially start-ups or novice business actors as a means of investment for the community. This is in line with the establishment of RI Presidential Regulation Number 95 of 2018 concerning Electronic-Based Government Systems (SPBE) which aims to realize clean, effective, transparent, accountable, as well as quality and reliable governance. One form of its activity is Crowdfunding Services Through Information Technology-Based Stock Offerings (Equity Crowdfunding), namely stock offering services carried out by issuers to sell shares directly to investors through an open network of electronic systems. This type of research is normative juridical with a statutory approach and legal principles. Using data sourced from secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials which are then analyzed qualitatively. The results of the study show that with the existence of policies regarding the implementation of crowdfunding services through information technology-based stock offerings, the national economy accelerates because in transactions using electronic media that is more practical, makes it easier for people to make transactions, develops trade and the national economy, and realizes financial inclusion targeted by the government

Abstract

The implementation of halal tourism has developed in Indonesia and even other countries have also organized halal tourism. Indonesia is the majority of Muslims, of course, it has great potential for the development of halal tourism, in essence the implementation of halal tourism itself does not limit tourists with various regulations. The role of the government is very large in the development and development of halal tourism to realize the improvement of the community's economy. This paper focuses on how the challenges and opportunities of halal tourism improve the community's economy. This writing method uses the normative juridical method by collecting secondary data through primary, secondary and tertiary materials by studying various books, journals, laws and regulations, documents, websites and writings related to the object of writing. The universe created by Allah SWT needs to be maintained, maintained and managed properly, including in tourism management, in the QS Surah Al-Mulk and Al-Baqarah have explained how to take care of yourself when traveling, hence the importance of the concept of halal tourism. In positive law, the provisions of Article 5 of Law Number 10 of 2009 concerning Tourism clearly state that the relationship between religious, customary, and cultural norms in tourism in each region has its own concept. The government has an important role in the development of halal tourism to improve the community's economy, job opportunities, state and regional income. The improvement of the economy is realized by the government bringing in and offering the concept of halal tourism to investors by providing licensing guarantees and legal certainty to investors to develop halal tourism.

Abstract

This study aim to analyzing the government goods and services procurement in  the 5.0’s society with Sharia economic law perspective. This research used normative juridical method based secondary data. Data analyzed by qualitative analysis methods. The results of the study conclude that Presidential Regulation Number 16 of 2018, LKPP Regulation Number 11 of 2018 and Presidential Regulation Number 17 of 2023 as a constitutional basis for adaptation the 5.0. Society Era in the government goods and services procurement was accordance with the Al-Qur'an, Al-Hadith, and the mu'amalah principles which include: The Law of Origin in Muamalah is Mubah (permissible), realizing Benefit, eliminating Competitive Prices, Eliminating Unethical Interventions Prohibited, Avoiding Exploitation, Honest and Trustful. Apart from that, it is also in accordance with Sharia Economic Law which contains the ikhtiyari principle (voluntary); trustworthiness (keep promises); Luzum principle (unchanged); the mutual benefit principle; taswiyah principle (equality); transparency principle; ability principle; taysir principle (convenience); the good faith principle; lawful cause; the al-Hurriyah principle (freedom to contract), but still does not consider the principle of ikhtiyati (prudence).

Abstract

Legal action for judicial review (PK) after the Constitutional Court decision No. 34/PUU-XVII/2019 in resolving industrial relations disputes. The research method uses a normative legal research type, the research approach is a statutory approach, the nature of the research is descriptive, the data source is secondary data, the data collection tool is document study, qualitative data analysis. The elimination of judicial review as an extraordinary legal remedy in resolving industrial relations disputes has an impact on the sense of justice of the parties. It is proven that there is a test of legal norms in Law no. 2 of 2004 concerning Settlement of Industrial Relations Disputes which is considered as the basis for eliminating legal remedies for judicial review with the emergence of the Decision of the Constitutional Court of the Republic of Indonesia Number 34/PUU-XVII/2019. In the research, it was found that the elimination of judicial review in industrial relations dispute cases actually eliminates justice contained in the principles of simple, fast, fair and cheap, it is better that judicial reviews (PK) continue to be held in order to provide space for extraordinary legal remedies as regulated in the Civil Code. The legal remedy for judicial review as an extraordinary measure in industrial relations dispute cases is actually still provided as a manifestation of legal equality and justice. one example that has become permanent law and cannot submit a PK is decision number 779 K/Pdt.Sus-PHI/2022 in the case between PT Belawan Indah against Supatno, Hanafi, Abu Hasan, et al. According to Gustav Radbruch, there are three elements that must always be considered, namely legal certainty, expediency and justice.

Abstract

Among the sharia economic products that are present in society are pawn products. However, of course sharia pawning must still be tested in an effort to improve the welfare of society. This research tries to find answers related to questions regarding the execution of collateral objects carried out by Sharia Banks or Sharia Pegadaian on customers' gold when gold prices are falling which can cause losses for customers. Apart from experiencing losses due to the sale of their gold which has a lower value, they also have to pay pawn deposit fees and other costs. For this reason, legal protection is needed for customers to prevent and overcome these problems. The suggestion that the researcher recommends is that regulations need to be made, a standard pawn system and socialization of sharia pawn products, which at the very least will be supported by the government. In the event of a dispute, mediation must be prioritized which refers to the teachings of Islamic law

Abstract

Era globalisasi membawa perkembangan pesat dalam teknologi telekomunikasi, menciptakan ketergantungan masyarakat terhadap layanan telekomunikasi. Namun, hubungan antara konsumen dan pelaku usaha telekomunikasi sering menghadapi ketidakseimbangan, khususnya dalam pemberian ganti rugi saat terjadi kelalaian. Penelitian ini menganalisis prinsip keadilan dalam pemberian ganti rugi pada sengketa telekomunikasi di Indonesia dengan menggunakan pendekatan hukum normatif. Hasil penelitian menunjukkan bahwa pemberian ganti rugi kepada konsumen sering kali tidak mencerminkan prinsip keadilan karena adanya klausula eksonerasi, norma hukum yang tumpang tindih, dan lemahnya posisi konsumen. Analisis hukum menunjukkan perlunya harmonisasi regulasi dan penguatan peran lembaga penyelesaian sengketa untuk menjamin keadilan dalam pemberian ganti rugi.

Abstract

Adoption of children has become a societal need and is part of the family law system, because it concerns the interests of each person in the family. One of the legal consequences of adoption is regarding the status of the adopted child as the heir of his adoptive parents. This status regarding adopted children often causes problems in the family. Problems that can arise are regarding whether or not the adoption of a child is valid, as well as the position of the adopted child as the heir of the adoptive parents. The research method used is Normative Legal Research (Normative Jurisdiction), namely a legal research method that uses secondary data sources, by examining related library materials. The adoption of a child in the Batak Toba traditional community is carried out by means of a traditional ceremony (eating together) which is attended by the dalihan natolu, traditional king, dongan sahuta and other families. So the position of the adopted child regarding the division of the adoptive parents' inheritance is valid according to customary law, and there are also some communities who continue to ratify and determine the child's adoption with a court decision, after a traditional ceremony. Then it is registered at the local civil registration office, so that the adopted child's name is listed as a family member on his parents' family card. And in terms of inheritance distribution, adopted children have the same position as biological children.

Abstract

The Government of Aceh holds the authority to implement halal investment and tourism policies as outlined in Article 25 of Qanun Number 8 of 2013 on Tourism, in conjunction with Article 165 of Law Number 11 of the Aceh Government, which allows for domestic and foreign investment in tourist attraction businesses. However, this authority has not been fully utilized, leading to a negative impact on poverty rates in Aceh. This article employs a normative juridical method, utilizing library research and collecting primary, secondary, and tertiary materials to analyze laws and regulations qualitatively. The current implementation of halal tourism and investment policies in Aceh has not effectively addressed poverty alleviation. Halal tourism is not solely market-driven but also community-driven. Challenges to the implementation of halal tourism include internal factors such as natural disasters, political instability, and institutional management issues, as well as external factors like Islamophobia and marketing perceptions. To address these challenges, the Government of Aceh should establish national and international cooperation programs and strategies to promote the potential of halal tourism. Additionally, a dedicated qanun related to halal investment and tourism should be developed to support these efforts.

Abstract

Claim rejection by life insurance companies is one form of consumer dispute that often occurs in the financial services sector. To ensure legal protection for consumers, the Consumer Dispute Resolution Agency (BPSK) is authorized to resolve disputes outside the court quickly, simply, and cheaply. This study aims to analyze the legal force of BPSK decisions on life insurance claim rejection disputes and the extent of their effectiveness in practice. The method used is a normative legal approach with an analysis of laws and regulations, BPSK decisions, and related court decisions. The results of the study indicate that BPSK decisions have final and binding legal force if no objections are filed with the court within the specified time period. However, the effectiveness of its implementation is often hampered by institutional weaknesses and overlapping authority with other financial services sector dispute resolution institutions.

Abstract

An advocate is a lawyer who practices law through the power of attorney (volmacht) granted by clients, both persons and legal entities, both inside and outside of the courtroom. The range of legal services includes advising, assisting, exercising power of attorney, representing, defending, and taking other legal actions on behalf of their clients. The advocate is free to choose whether his client's case will be settled out of court (non-litigation) in the course of his work, particularly in the area of debt settlement. This area is governed by the Indonesian Advocate Code of Ethics and is known as the dominus litis principle. However, in order to exercise the authority, the advocate must possess financial knowledge in order to offer the client a case settlement plan as legal justification, allowing the client to accept legal counsel from his advocate to pursue an out-of-court settlement. Through training and certification programs coordinated and organized with the National Competency Certification Agency (BNSP), the Advocate Organization bears the responsibility of enhancing the expertise of advocates in addition to themselves. An advocate with greater expertise will be less likely to violate the advocate code of ethics while also providing clients with the best possible protection as recipients of legal services. Rather than creating more issues for their customers, advocates become part of the solution (problem solver).
