Abstract

Kekhawatiran akan Covid 19 oleh para notaris dalam pembuatan akta. Pelaksanaan dalam Tugas Jabatan Notaris dalam Pembuatan Akta Sebelum dan dalam Masa Pandemi Covid 19 berbeda dari perbedaan tersebut terletak pada protocol kesehatan dan kehadiran penghadap berdasarkan SK Nomor 65/33-III/ PP-INI/2020 tanggal 17 Maret 2020 lalu, perihal sebagaimana dimaksud pada pokok surat, PP INI memandang perlu untuk menyampaikan hal-hal sebagai berikut: a) Pengurus Pusat Ikatan Notaris Indonesia (PP-INI) dan seluruh jajarannya menyampaikan rasa prihatin atas perkembangan masif penyebaran Covid-19 yang secara langsung mempengaruhi pelaksanaan tugas jabatan notaris dalam memberikan pelayanan kepada masyarakat; b) berkenaan dengan itu, kami menghimbau kepada semua anggota untuk mengikuti protol kesehatan yang ditetapkan oleh pemerintah dalam usaha mengatasi penyebaran Covid-19. Khususnya himbauan untuk Work From Home (WHF/bekerja dari rumah) dan melaksanakan social distancing (jaga larak). Pelaksanaan WFH tersebut bukan merupakan bentuk pelanggaran dari Pasal 17 UU 30/2004 tentang Jabatan Notaris sebagaimana telah diubah dengan UU 2/2014 terkait larangan untuk meninggalkan wilayah jabatannya lebih dari tujuh hari kerja berturut-turut tanpa alasan yang sah.c.kondisi WFH dan social distancing tersebut tentu akan membatasi pelaksanaan tugas jabatan notaris, oleh karena itu terhadap situasi tersebut dapat ditempuh beberapa alternatif antara lain sebagai berikut : Mengatur ulang jadwal penandatanganan akta dengan para penghadap, hingga kondisi memungkinkan. Merekomendasikan rekan notaris lain yang kondisinya memungkinkan untuk menjalankan jabatan. Untuk perjanjian, perbuatan, atau rapat yang menurut peraturan perundang-undangan dokumennya dapat dibuat di bawah tangah, agar dicantumkan klausula “akan dibuat/dinyatakan kembali dalam Akta Autentik segera setelah darurat Covid-19 dicabut oleh Pemerintah”.d.terkait butir tiga tersebut, agar dalam menjalankan jabatan tetap memperthatikan Undang-undang Jabatan Notaris (UUJN), kode etik, dan peraturan perundang-undangan lainnya.(2) Hambatan-hambatan dalam Tugas Jabatan Notaris dalam Pembuatan Akta Sebelum dan pada masa Pandemi Covid 19 adalah penghadap yang tidak menaati aturan pemerintah mengenai Protokol kesehatan.

Abstract

Notaris sebagai pejabat umum dalam menjalankan jabatannya harus mengenali dan memahami norma-norma dan unsur dalam delik pidana yang diatur dalam Kitab Undang-Undang Hukum Pidana(KUHP), mengenali dan memahami kewenangan atributif yang terdapat dalam Undang-Undang Jabatan Notaris (UUJN). Notaris juga dapat terlibat Tindak Pidana Pencucuian Uang (TPPU). Untuk dapat terhindar dari TPPU notaris harus ada upaya preventif dengan memahami norma-norma, memenuhi kewajiban-kewajiban dan menjauhi larangan yang dimuat dalam Undang-Undang Tindak Pidana Pencucian Uang (UU TPPU), termasuk penambahan klausul yang memberi jaminan dananya tersebut tidak berasal dari tindak pidana kejahatan atau perbuatan hukum lain yang melawan hukum.

Abstract

The aim of this study is to find out the crime of fraud (Article 378 of the Criminal Code) and the criminal act of embezzlement (Article 372 of the Criminal Code) can be charged to one of the parties in the agreement made by the notarial deed is considered to have committed default. This study uses normative juridical methods, which means that this study focuses on favourable laws such as Law No. 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning the Position of Notary, the Civil Code, the Criminal Code, and other laws and regulations. Based on analysis, the results of this study revealed that if one of the parties in the agreement made by his notarial deed is considered to have committed a default, it cannot be charged with the crime of fraud (Article 378 of the Criminal Code) and the criminal act of embezzlement (Article 372 of the Criminal Code) based on Article 11 of Law No. 12 of 2005 concerning ratification of the International Covenant on Civil and Political Rights. Some judges' decisions with loose verdicts (slag van all rechttsvervolging), i.e., the act charged is proven, but the act of default does not constitute a criminal offence.

Abstract

This study aims to determine the legal politics of the political aspects behind the process of forming laws and policies in a particular field, as well as greatly influencing the performance of relevant government institutions in that field in applying the provisions of legal products and policies, and also determine the policies of these institutions in a practical and operational setting. This research is a qualitative research with a normative juridical approach. Notary activities in Indonesia are heavily influenced by politics and law itself. The conclusion is that political influence can be seen from the making of a political product in the form of a special law that regulates the position of a notary, namely Act No. 2 of 2014 jo. No. 30 of 2004 concerning the Position of a Notary. And the status of Indonesia, which is a state of law, of course, will also affect the actions and actions of notaries because they must be guided by the applicable laws.

Abstract

Kehidupan manusia tentunya selalu mengalami perubahan-perubahan seiring dengan perkembangan zaman yang terjadi. Saat ini Indonesia mengalami transisi dalam mengikuti perkembangan zaman tersebut. Salah satu yang juga mengalami transisi adalah sektor ekonomi. Pada dasarnya faktor ekonomi memiliki peranan penting dalam kehidupan manusia yang diukur dari sebuah kesejahteraan dalam hal finansial apakah masyarakat sudah dapat memenuhi kebutuhan hidupnya? Hal ini akan dikaitkan dengan aturan-aturan serta kebijakan-kebijakan ekonomi yang berlaku apakah telah memfasilitasi masyarakat untuk mendapatkan ekonomi yang baik demi tercapainya kesejahteraan dan penghidupan yang layak. Legalitas merupakan sebuah produk yang wajib dimiliki oleh masyarakat untuk dapat melakukan kegiatan yang bersifat menghasilkan demi tercapainya kesejahteraan dan penghidupan yang layak. Legalitas ini diatur dalam aturan-aturan yang dibuat oleh Pemerintah.

Abstract

An agreement is an agreement of both parties to do a deed. Agreements are very often used in everyday life, both underhand and notary agreements. In the content of the agreement the parties make in accordance with the principle of freedom of contract. Agreements under hand often have problems between parties because the agreement is not strong binding. For this reason, the role of the Notary Public is needed in making a notarial agreement deed so that the parties can achieve their respective goals and it is safe if one day there is a party who defaults, the notarial agreement deed can be used as valid evidence. The principle of prudence into the deed of Notarial Sale and Purchase Binding Agreement on registered land to be recorded at the Land Office. Using normative methods with a statutory approach and a legal concept approach. The results of this study show that the Notarial Sale and Purchase Binding Agreement Arrangement on registered land registered at the Land Office can only be carried out against the Notarial Sale and Purchase Binding Agreement that has been paid off. The formulation of the precautionary principle into the Notarial Sale and Purchase Binding Agreement deed on registered land that will be registered at the Land Office can be seen in the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 16 of 2021, which can be done using analogous arguments by Notaries in applying the precautionary principle to the preparation of the Sale and Purchase Binding Agreement Deed.

Abstract

The manual storage of notary protocols poses various risks such as damage due to unforeseen events, degradation from chemical influences, destruction by rodents or insects, dispersal, loss, and physical harm. It is crucial for notaries to embrace modern technology for storing notary protocols electronically, particularly through the use of Cloud Computing Systems. According to Article 1 number 13 of the Notary Act, notary protocols are considered state archives that notaries are responsible for preserving in compliance with relevant legal regulations. Therefore, the management of notary protocols should adhere to the Archives Law and Government Regulation Number 28 of 2012. The Notary Protocol, considered a dynamic archive of vital importance, should have the capability to be transformed into electronic documents. As stated in Article 48 and Article 49 paragraph (1) of Government Regulation Number 28 of 2012, the transfer of dynamic archive media is permissible, and such transfer can take any form in line with technological advancements and information regulations. The adoption of a Cloud Computing System for the electronic storage of Notary Protocols reflects the progress in technology and information. The concept of Idea cyber notary involves using technological advancements to enable notaries to perform their notarial responsibilities. Notaries, acting as data controllers and processors for their clients' personal data, have the responsibility to gather, store, and handle such information. In legal terms, notaries can be held accountable for mishandling personal data.

Abstract

The limited liability company law in Indonesia has undergone substantial modifications due to Law Number 11 of 2020 on Job Creation. One important development is the introduction of the idea of an individual limited liability company. The previous model of PT as a capital partnership has been replaced by this new model, which allows its formation by an individual. As a capital partnership, the Limited Liability Company faces a paradigm shift with the enactment of the Job Creation Law. The question is, how will this transition occur? How will this change in thinking affect the level of certainty that stakeholders, including business actors, have in the law? Conceptual and statutory approaches are used in this research as part of the normative legal research process. The research findings show that the paradigm shift of the PT has far-reaching consequences for several areas of corporate law, including limited liability, segregation of wealth, and corporate governance. There are theoretical and practical barriers to formally establishing micro and small businesses that the amendment seeks to remove. To maintain the consistency of the entire PT legal system, it is necessary to harmonize the Job Creation Law, UUPT, and other implementing regulations.

Abstract

Purpose:The result is that the MPWN decision must be appealed to someone other than the Central Supervisory Board. Because there is a rule in Article 28 paragraph (2) of PERMENKUMHAM number 15 of 2020, namely MPW has the authority to reject objections to decisions on oral warning sanctions and written warnings, in this case, the oral warning sanctions and written warnings are final and cannot be appealed.Methodology:This research is a descriptive analysis. Namely, the discussion is done by presenting and explaining data thoroughly, in detail and systematically. This type of research is normative legal research, a legal research method that examines library materials.Findings:The result is that the MPWN decision must be appealed to someone other than the Central Supervisory Board. Because there is a rule in Article 28 paragraph (2) of PERMENKUMHAM number 15 of 2020, namely MPW has the authority to reject objections to decisions on oral warning sanctions and written warnings, in this case, the oral warning sanctions and written warnings are final and cannot be appealed.Implication:However, with the law on judicial power and the law on administrative court, the party who objected can file a legal remedy in Administrative Justice. The MPWN decision can be subject to State Administration, and the proper application of the law is outlined in Article 17, paragraph (2) of the amendment law. As a supervisor, the MPWN must remain objective and thorough to prevent errors in the application of the law from recurring.

Abstract

Transfer of land rights and review of Indigenous Villages' position as land rights owners based on Indonesian positive law. This writing includes normative legal research or what is usually called 'library research', namely research by examining secondary materials or data regarding research on legal principles, research on legal systematics, research on the synchronization stages of vertical and horizontal norms, harmonization of law and legal history. The provisions of the transfer of rights to land under the UUPA as a legal act of transfer of land rights are deliberately carried out so that the right is independent of the holder and transferred to another party. Customary villages, as owners of property rights to land reviewed under the law, can be domiciled as legal subjects of land rights owners, usually found through the purchase process or other businesses. However, there is still a potential dispute over efforts to certify customary village land.
