Abstract

This research is conducted to describe the impact of the issuance of Government Regulation Number 11 of 2010 on the Control and Utilization of Abandoned Land that serves as an important part of the agrarian reform agenda. It is relevant to the solution to counteract and eradicate the crisis of poverty by providing land and other facilities necessary for production so that people are able to work more productively and live a prosperous life. Essentially, it involves the whole process of restructuring the tenure, ownership, use, and utilization of land in order to achieve social welfare and justice. This research applies normative legal methods to conduct a literary review because of the characteristics and traditions of law. The approaches used in legal research are the statute approach, the case approach, and the conceptual approach. The results of the research show that agrarian reform needs to be included in the nations agenda and the basic strategy of the country to build a just political, economic and social structure. This is the relevance of placing all references, understanding, scope, and usefulness of the management of "the abandoned land which later becomes the state property" in realizing the true agrarian reform.

Abstract

National land laws prohibit the ownership right of land by foreigners as reflected in the provisions of Article 9 UPPA, the Basic Agrarian Law, which confirm that only Indonesian citizens who can have ownership rights on the land. In addition, the provisions of Article 26 Paragraph (2) UUPA also prohibit the transfer of ownership of land from the citizen of Indonesian to foreign citizen, both directly and indirectly. Legal consequences of the deed of agreement of the land ownership rights of Indonesian citizen by foreign citizens made by a notary public is null and void because the objective conditions are not met, as postulated by Article 1320 of the Civil Code. Indeed ownership rights to land by foreign citizens, either directly or indirectly does not promise a legal protection to the party concerned.

Abstract

Penelitian ini di lakukan untuk menganalisa keteraturan hukum di masyarakat, Permasalahan Hak milik dalam Hal memiliki tempat tinggal serta lingkungan hidup yang baik dan sehat, adalah merupakan hak dasar setiap warga negara Indonesia. hakikatnyastrata title terdapat gabungan kepemilikan bersama dan kepemilikan individu. Hal ini tidak dikenal dalam kepemilikan tanah dan rumah pada kawasan horizontal seperti komplek perumahan (real estate) atau pemukiman lainnya baik di perkotaan maupun perkampungan. Penelitian ini menggunakan metode hukum yuridis Normatif untuk melakukan studi pustaka karena ciri khas dan tradisi ilmu hukumPendekatan yang digunakan didalam penelitian hukum adalah pendekatan peraturan perundang-undangan (statue opprach), pendekatan kasus (case opprach) dan pendekatan konseptual (conceptual opprach). Hasil penelitian menunjukan bahwa rumah susun di atas tanah Hak Guna Bangunan yang berdiri diatas tanah Hak Milik sebagai tempat hunian dan jenis pembebanan hak atas satuan rumah susun di atas tanah Hak Guna Bangunan yang berdiri diatas tanah Hak Milik dapat serta memperbaiki akses masyarakat kepada sumber-sumber ekonomi, terutama tanah atas penguasaan pemilikan, penggunaan dan pemanfaatan tanah dan sumber-sumber pertanahan untuk meminimalisir sengketa Pertanahan untuk meningkatkan kesejahteraan masyarakat. This research is done to analyze the legal regulation in the community. The issue of property rights in terms of having a good and healthy living place and environment is the basic right of every Indonesian citizen. the essence of the title is that of joint ownership and individual ownership. It is not known in the ownership of land and houses in the horizontal area such as housing complex (real estate) or other settlements in both urban and settlement areas. This research uses Normative juridical legal method to conduct literature study because of the characteristic and traditions of law. The approach used in legal research is the approach of legislation (statue opprach), case approach (case opprach) and conceptual approach (conceptual opprach). The result of the research shows that the flats on the land of Hak Guna Bangunan which stands on the land of Hak Milik as the dwelling place and the type of imposition of the right to the unit of flats on the land of Hak Guna Bangunan which stands on the land of Hak Milik can also improve the public access to the sources economic, especially land over ownership, use and utilization of land and land resources to minimize land disputes to improve peoples welfare.

Abstract

Suatu akta otentik ialah suatu akta yang dibuat dalam bentuk yang ditentukan undang-undang oleh atau dihadapan Pejabat Umum yang berwenang untuk itu di tempat akta itu dibuat. Jasa Notaris sebagai Pejabat Umum yang membuat akta-akta otentik sangat dibutuhkan dalam kegiatan usaha perbankan, salah satunya adalah dalam pembuatan akta perjanjian kredit perbankan yang melibatkan Nasabah dan Bank, guna menjamin kebenaran dari isi yang dituangkan dalam perjanjian kredit perbankan tersebut, supaya secara publik kebenarannya tidak diragukan lagi. Perjanjian kredit perbankan yang dibuat secara notariil bermanfaat bagi kreditor, dalam hal menjamin kekuatan pembuktiannya, menjamin kebenaran dari aktanya dan menjamin keamanan investasinya. Perjanjian kredit perbankan dibuat secara baku, namun tidak bertentangan dengan aturan yang dilarang dalam Pasal 18 Undang-undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, karena sebenarnya format baku tersebut hanya merupakan format pokok dari perjanjian kredit bank, yang dalam perkembangan selanjutnya terhadap format ini masih dimungkinkan adanya negosiasi. Bahwa perjanjian kredit antara nasabah debitor dengan Bank BRI dibentuk atas dasar kesepakatan (konsensualisme).

Abstract

Pandemi Covid – 19 yang melanda seluruh dunia, berdampak pada seluruh bidang kehidupan termasuk juga bidang pertanian. Dengan berbagai pembatasan kegiatan fisik, memaksa petani untuk tetap bisa bertahan hidup dan menjalankan kegiatan pertanianya dengan mencoba metode lain. Kegiatan pengabdian kepada masyarakat (PKM) ini bertujuan untuk mensosialisasikan pemanfaatan media online sebagai sarana pemasaran hasil produksi para petani di Desa Sumerta Kecamatan Denpasar Timur, Bali, agar dapat meningkatkan omzet penjualannya. Kegiatan ini melibatkan PT. Keberlanjutan Strategis Indonesia sebagai penyedia platform Taniku dan Jasa Kurir PT. Paxel Algorita Unggul. Kegiatan PKM ini dilakukan dengan cara melakukan sosialisasi berbisnis secara online, diskusi mendalam dan pendampingan pemanfaatan platform Taniku yang dioperasikan oleh fakultas ekonomi Universitas Warmadewa. Dari hasil kegiatan PKM tersebut, diperoleh hasil yang cukup memuaskan. Mitra binaan telah mengenal pemasaran hasil pertanian secara online dan mengetahui resiko yang mungkin timbul dari pemasaran online. Kegiatan ini diharapkan akan terus dilanjutkan pada periode selanjutnya agar pembinaan yang sudah dimulai ini dapat berkembang lebih baik dan memberikan dampak lebih besar kepada petani di Desa Sumerta.

Abstract

The efforts to reduce poverty through increasing the role of traditional villages are very appropriate to do especially in Bali. Based on the mandate of the Regional Regulation Province Bali Number 4 of 2019 Regarding Traditional Villages, the Poh Bergong Traditional Village through a perm formed Utsaha Padruwen Desa Adat (BUPDA) managed by the traditional village. This study aims to examine the implementation of BUPDA institutions in the management and utilization of customary village land assets in Bali. The research method used is normative legal research using a statutory approach and a conceptual approach. The results of the study indicate that the development of BUPDA management uses the objective of access reform with the concept of Tri Hita Karana, the implementation of BUPDA in the management of access reform which aims to prosper the indigenous peoples and relieve the person of the community in carrying out the custom.

Abstract

This study aims to analyze the urgency of land banks in maintaining the existence of land acquisition for development. This research method uses normative legal research methods with a statutory approach and a conceptual approach. The types and sources of legal materials used are primary, secondary and non-legal legal materials. The method of collecting legal materials uses the method of literature study. Analysis of legal materials using qualitative descriptive analysis. Based on the results of the study, it shows that the urgency of the Land Bank in land acquisition activities for development has the function of overcoming the problem of the form and value of compensation for land acquisition objects, preventing the growth of inventory of land needs for development activities for the public interest and reducing the implementation of land acquisition activities that require large costs and that take people's rights to their land.
