Abstract

This study examines the legal responsibility of notaries of protocol holders related to the absence of copies of deeds and minutes of formally defective deeds, with a case study of Decision Number 205/Pdt.G/2023/PN Amb. Notaries of protocol holders are responsible for the deeds they hold, even though their authority is limited and cannot correct invalid deeds. Deeds that witnesses and notaries do not sign have legal weaknesses, so they are only considered deeds underhand. In this case, the notary who holds the protocol can explain to the witness or suggest the creation of a new deed. The absence of a signature on the deed impacts the validity of the document and the legal interests of the plaintiff. In addition, the District Court's decision stating that the lawsuit is inadmissible (NO) shows that there is a formal defect in the lawsuit so that the defendant fails to obtain legal protection. This study emphasizes the importance of notary compliance with legal procedures in making and storing deeds to ensure legal certainty for related parties.

Abstract

Tujuan penelitian dalam penelitian ini, untuk mengetahui kedudukan hukum atas kompensasi pembayaran sebagai pelaksanaan pemberian akses jalan antara pemilik hak atas tanah dengan pengguna akses jalan Putusan Perkara Nomor 69/Pdt.G/2019/PN.Smn dan akibat penyimpanagn terhadap perjanjian yang telah disepakati atas penggunaan tanah sesuai dengan perjanjian berdasarkan Putusan Perkara Nomor 69/Pdt.G/2019/PN.Smn. Penelitian ini, menggunakan metode penelitian hukum normatif (kepustakaan) dengan analisis secara kualitatif terhadap data sekunder, untuk mendapatkan kesimpulan tentang kedudukan hukum atas kompensasi pembayaran dalam pelaksanaan pemberian akses jalan antara pemilik hak atas tanah dengan pengguna akses jalan Putusan Perkara Nomor 69/Pdt.G/2019/PN.Smn tidak memberikan kepastian hukum bagi Pihak Penggugat dengan Tergugat. Menurut Penggugat menyatakan sebagai kompensasi sebidang tanah seluas 32 m2 untuk akses jalan sedangkan Tergugat menyatakan sebagai jual beli sebidang tanah (32 m2) untuk akses jalan. Akibat penyimpangan terhadap perjanjian yang telah disepakati atas penggunaan tanah sesuai dengan perjanjian berdasarkan Putusan Perkara Nomor 69/Pdt.G/2019/PN.Smn terjadi perbuatan melawan hukum dalam hal pembangunan garasi oleh Tergugat diatas sebidang tanah (32 m2) milik Penggugat yang digunakan sebagai akses jalan. Penyimpangan hal ini, terjadi dikarenakan dikarenakan belum ada aturan mengenai mekanisme dalam pemberian akses jalan dan sanksi kepada masyarakat yang tidak memberikan akses jalan untuk dilewati.

Abstract

This article explores the legal legitimacy and challenges in the implementation of electronic land certificates (e-certificates) within Indonesia’s national land administration system, while examining the concept of immutability the inability to alter data in the context of land law. It discusses the legal foundations, implementation processes, evidentiary strength, as well as technical and regulatory challenges, highlighting the potential of e-certificates as instruments that enhance legal certainty and security in the digital era of land administration. The digital transformation of Indonesia’s national land system introduces a significant innovation in the form of electronic land ownership certificates (e-certificates), aimed at improving efficiency, accountability, and legal certainty in land administration. This article critically examines the legal legitimacy, normative basis, and practical implications of implementing e-certificates within the framework of national land law, with a primary focus on the application of the principle of immutability, whereby data cannot be changed or manipulated without a legitimate audit trail. Using a normative juridical approach and empirical analysis based on primary data, this article identifies several implementation challenges including vulnerabilities in information systems, infrastructure gaps, suboptimal legal evidentiary mechanisms in court, and social resistance to the digitization of land ownership documents. The success of e-certificate implementation is highly dependent on data interoperability, resilient system design, and regulatory clarity regarding digital legal evidence. Digital transformation has become a national strategic agenda for bureaucratic modernization and improving public service quality, as outlined in Peraturan Presiden Nomor 95 Tahun 2018 on the Electronic-Based Government System (SPBE). One of the sectors undergoing accelerated digitalization is land administration, through the implementation of electronic certificates by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN), Peraturan Menteri ATR/BPN Nomor 3 Tahun 2023 concerning Electronic Documents. This initiative aims to create efficient, transparent, and integrated land registration services. However, the use of e-certificates as legal evidence of land rights presents both normative and practical challenges within the national legal system particularly regarding evidentiary strength, document legality, and data integrity and authentication safeguards. The effectiveness of e-certificate implementation depends on a legal system that is adaptive to technology, supported by a digital architecture that incorporates the principle of immutability through cryptographic technology, audit trails, and potential blockchain utilization. Thus, the certificate becomes not only an administrative tool but also a new foundation for the protection of agrarian rights in the digital era. These findings are relevant for policymakers, academics, and land practitioners in designing a modern, inclusive, and legally protective national land system.

Abstract

Nilai harga jual beli tanah merupakan hasil dari kesepakatan para pihak sendiri (penjual-pembeli) yang diinformasikan kepada PPAT. Tujuan penelitian aspek hukum penetapan harga bidang tanah pada transaksi jual beli dan kepastian hukum kewenangan validasi Pemerintah Daerah Kabupaten Karawang terhadap penetapan harga bidang tanah pada transaksi jual beli. Penelitian ini, menggunakan metode normatif (kepustakaan) dengan menganalisis data sekunder untuk mendapatkan kesimpulan tentang aspek hukum penetapan harga bidang tanah pada transaksi jual beli berdasarkan Undang-Undang Nomor 28 Tahun 2009 tentang Pajak Daerah dan Retribusi Daerah sebagaimana telah diubah menjadi Undang-Undang Nomor 1 Tahun 2022 tentang Hubungan Keuangan Antara Pemerintah Pusat dan Pemerintahan Daerah dan Undang-Undang Nomor 20 Tahun 2000 tentang Perubahan Atas Undang-Undang Nomor 21 Tahun 1997 tentang Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB). Kepastian hukum kewenangan validasi Pemerintah Daerah Kabupaten Karawang terhadap penetapan harga bidang tanah pada transaksi jual beli tidak terdapat aturan dan kebijakan yang mengatur.

Abstract

The purpose of this study is to examine and analyze the role and responsibilities of notaries in drafting Islamic banking agreements. This study uses a doctrinal legal approach. The findings show that notaries have the authority to prepare authentic deeds for Islamic banking contracts. These deeds serve as strong legal evidence in resolving disputes in the context of Islamic banking. The responsibility of notaries in preparing Islamic banking agreements includes three legal aspects. First, under civil law, Article 84 of the Notary Law outlines the civil liability of notaries. Second, under administrative law, Article 85 of the Notary Law provides that if a notary makes an error when drafting a deed, they may be subject to administrative sanctions in accordance with the Notary Law and its implementing regulations. Third, in terms of criminal law, if a notary commits an act that constitutes a criminal offense as defined in the Criminal Code, they may face criminal sanctions accordingly. The study suggests that sharia training and certification for notaries should be made standard, especially for those involved in Islamic finance.

Abstract

Pembangunan ibu kota baru Indonesia, Ibu Kota Nusantara (IKN), telah menimbulkan tantangan hukum yang signifikan terkait hak atas tanah masyarakat lokal dan kecukupan kompensasi dalam proses pengadaan tanah. Studi ini mengkaji status hukum tanah yang dikuasai masyarakat dalam kerangka agraria Indonesia, mengevaluasi mekanisme kompensasi yang diterapkan dalam pengadaan tanah IKN, dan menilai kesesuaiannya dengan standar hak asasi manusia, khususnya hak-hak masyarakat adat dan prinsip Persetujuan Atas Dasar Informasi Awal Tanpa Paksaan (FPIC). Abstract

AJB is an authentic document whose validity is highly dependent on the manufacturing process that must meet legal provisions, one of which is the presence of the parties and PPAT when making and signing the Acte. The presence of PPAT is absolute because it acts as a state official who guarantees the formal and material truth of the contents of the Acte and explains the legal consequences of the transaction to the parties. This type of research is normative law research, with a study of legal materials containing normative legal rules. This research relates to legal norms that exist in society and in legislation and court decisions. In Indonesia Civil Code Clause 1338 Verse 3, good faith is only mentioned in relation to the making of treatys, but is not regulated further. Therefore, in SEMA Number 4 of 2016, buyers who have good faith are given a guarantee in the form of legal protection. Good faith itself consists of two types, namely subjective, which is interpreted as honesty, and objective, which is interpreted as a form of politeness and manners, whereby a person must also comply with social norms. A buyer acting in good faith is a buyer who carefully examines the physical condition and legal data of a transfer of land rights being purchased, both before and at the time of transfer. However, if the buyer is aware of a defect in the transfer of rights process, the buyer's good faith is considered lost. Legal protection for buyers is only for buyers acting in good faith. In the cancellation of an AJB, protection for buyers is in the form of a civil lawsuit against the deed and compensation. Under certain conditions, an agreement may be cancelled, either by the parties or by court order. As a form of binding agreement, a land sale and purchase agreement contains the rights and obligations of the parties who made it, so that if the terms agreed upon in the sale and purchase agreement are violated or not fulfilled by the parties who made it, then it can be said that there has been a breach of contract. Before a sale and purchase can be carried out before an authorised official, namely the Land Deed Official (PPAT), the parties who will sell and purchase land rights must meet all the requirements stipulated for the sale and purchase of land. Requirements regarding the object of sale and purchase, for example, the land rights to be sold and purchased are legally owned by the seller, as evidenced by a land certificate or other valid proof of such rights, and the land being sold and purchased is not in dispute with other parties, and so on

Abstract

This study aims to analyze the synergy between customary law and Islamic law in the mechanism for resolving customary land disputes in Pampang Customary Village, North Samarinda. The problem of customary land in this region is not only related to the aspect of ownership, but also touches the social, spiritual, and cultural dimensions of the Dayak Kenyah community. The research approach uses qualitative methods with a combination of normative and empirical approaches, through the analysis of legal documents, interviews with traditional leaders, and observation of customary mediation practices. The results of the study show that dispute resolution in Pampang Village is carried out through a consensus deliberation mechanism led by the Customary Head, with an emphasis on the value of justice, social balance, and community peace. This mechanism has a substantive conformity with  the principle of ṣulḥ (peace) in Islamic law, which emphasizes peaceful, participatory, and equitable resolution of disputes. The research discussion emphasized that the integration between customary law and Islamic law can strengthen social legitimacy, increase legal certainty, and present a more contextual dispute resolution model for customary law communities. These findings have implications for the need for state recognition of customary decisions as part of a pluralistic and equitable national legal system.

Abstract

Pengelolaan kawasan hutan Indonesia menghadapi tantangan kompleks meliputi tumpang tindih kepemilikan lahan, konflik agraria berkelanjutan, dan lemahnya koordinasi antarinstitusi. Perpres No. 5 Tahun 2025 tentang Penertiban Kawasan Hutan merespons krisis ini dengan membentuk Satgas PKH lintas sektor untuk mengkonsolidasikan kewenangan penegakan hukum dan pemulihan aset kawasan hutan secara terkoordinasi dan responsif. Penelitian menggunakan pendekatan multidisiplin mengintegrasikan yuridis normatif. Focus Group Discussion, dan studi lapangan. Analisis menggabungkan teknik content analysis terhadap dokumen kebijakan dengan cross-case comparison untuk mengidentifikasi pola implementasi dan tantangan struktural yang kompleks. Capaian administratif Satgas PKH menunjukkan penguasaan kembali 3,3 juta hektare kawasan hutan hingga September 2025, jauh melampaui target awal. Namun, di balik capaian ini terdapat permasalahan fundamental: ketidakvalidan data spasial, tumpang tindih wilayah adat antara 17,6 hingga 24,4 juta hektare, asimetri perlakuan terhadap pelaku usaha, dan minimnya partisipasi masyarakat. Konflik sosial-ekologis meningkat dengan resistensi masyarakat terhadap penertiban represif. Best practice alternatif seperti PPTPKH/TORA dan perhutanan sosial menunjukkan model pengelolaan berbasis partisipasi dapat mengintegrasikan keadilan sosial dengan kelestarian ekologis, mencakup 3,04 juta dan 4,1 juta hektare dengan melibatkan ribuan keluarga. Reformasi mendesak diperlukan mencakup transformasi kelembagaan Satgas, penguatan sistem data terintegrasi, penerapan Free Prior and Informed Consent, harmonisasi regulasi, dan implementasi keadilan restoratif. Hanya dengan mengintegrasikan keadilan distributif, prosedural, dan restoratif sebagai fondasi, disertai partisipasi masyarakat dan transparansi, Perpres No. 5 Tahun 2025 dapat mewujudkan pengelolaan hutan yang sesungguhnya adil dan berkelanjutan.

Abstract

Penyelesaian sengketa pertanahan di Indonesia menghadapi kompleksitas multi-dimensi yang berasal dari ketidakjelasan batas lahan, tumpang tindih hak kepemilikan, dan konflik antara masyarakat adat dengan negara. Peraturan Menteri Agraria dan Tata Ruang/Badan Pertanahan Nasional (Permen ATR/BPN) No. 21 Tahun 2020 memperkenalkan mekanisme mediasi berbasis prinsip restorative justice sebagai alternatif penyelesaian sengketa non-litigasi yang fokus pada pemulihan hubungan sosial dan musyawarah mufakat sesuai kearifan lokal. Penelitian ini menggunakan pendekatan kualitatif dengan studi kebijakan dan analisis kelembagaan untuk menganalisis implementasi Permen ATR/BPN No. 21 Tahun 2020 dalam konteks penguatan kelembagaan Badan Pertanahan Nasional. Data dikumpulkan melalui wawancara mendalam dengan pejabat BPN, mediator, dan pihak terkait; observasi langsung proses mediasi; serta studi dokumen regulasi dan laporan implementasi. Temuan utama mengungkap bahwa meskipun keberhasilan mediasi dapat mencapai 28,5% hingga 55-65% di wilayah dengan integrasi musyawarah adat, implementasi optimal masih terhambat oleh gap struktural kelembagaan, heterogenitas kapasitas mediator dengan hanya 45% bersertifikat, lemahnya kekuatan hukum hasil mediasi yang memungkinkan pembatalan 25% kesepakatan, koordinasi lintas lembaga yang masih informal, dan pemanfaatan teknologi yang terbatas. Penguatan kebijakan memerlukan pendekatan holistik yang mengintegrasikan restrukturisasi kelembagaan dengan pembentukan unit mediasi khusus, pengembangan standar kompetensi berlapis, penguatan regulasi dengan kekuatan eksekutorial, formalisasi koordinasi lintas lembaga termasuk pengakuan legal musyawarah adat, dan optimalisasi teknologi JUSTISIA. Implikasi sosial hukum menunjukkan bahwa restorative justice berkontribusi signifikan dalam mengurangi ketegangan sosial dan meningkatkan kepercayaan institusi, terutama dengan mengintegrasikan kearifan lokal.
