Abstract

Marine hull and Machinery insurance policyholders against claim rejections by insurance companies, as reflected in Decision Number 951/Pdt.G/2023/PN.Jkt.Brt. This study aims to analyze the factors causing default by insurance companies, the legal consequences that arise for policyholders, and the legal considerations of the panel of judges in providing legal protection. The research method used is normative juridical with a descriptive nature, through a statutory approach and a case approach. Data were obtained from a literature review of primary, secondary, and tertiary legal materials, which were analyzed qualitatively with deductive conclusions drawn. The results of the study indicate that rejections of marine hull and machinery insurance claims are caused by, among others, claims for risks not covered by the policy, including those included in policy exclusions, inaccurate information provided by the insured, and the unseaworthy condition of the vessel. However, in Decision Number 951/Pdt.G/2023/PN.Jkt.Brt, the panel of judges emphasized that rejection of claims made without a valid basis for agreement constitutes a form of breach of contract, so that the policyholder has the right to demand compensation for the insurer's failure to fulfill its obligations based on the principle of good faith in the insurance agreement

Abstract

Corporate Social Responsibility (CSR) merupakan bentuk tanggung jawab perusahaan atas dampak kegiatan usahanya terhadap masyarakat dan lingkungan, pelaksanaannya diatur dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas serta peraturan terkait lainnya. Pada sektor agroindustri, khususnya yang memanfaatkan sumber daya alam, CSR menjadi kewajiban hukum sekaligus sarana membangun hubungan yang harmonis dengan masyarakat. Implementasi CSR di PT. MA, yang berlokasi di Desa Sikapas, Muara Batang Gadis, Mandailing Natal, Sumatera Utara, menunjukkan fokus utama pada aspek sosial dan keagamaan, seperti pemberian bantuan kesehatan, pendidikan, dan kegiatan keagamaan. Namun, pelaksanaannya masih bersifat parsial dan belum sepenuhnya mencerminkan prinsip triple bottom line (profit, people, planet), terutama karena program lingkungan belum berjalan secara berkelanjutan. Meskipun demikian, kegiatan CSR tersebut mendapat respons positif dari masyarakat dan dukungan pemerintah daerah, yang turut memperkuat legitimasi sosial perusahaan. Hambatan yang muncul antara lain keterbatasan anggaran, perubahan kebutuhan sosial masyarakat, serta belum terintegrasinya kebijakan CSR dalam sistem perusahaan. Diperlukan pembaruan regulasi yang memperjelas indikator keberhasilan dan mekanisme evaluasi CSR, serta pemberian insentif bagi perusahaan yang konsisten menjalankannya. Bagi PT. MA, penguatan transparansi melalui laporan tahunan dan penyeimbangan antara aspek sosial, ekonomi, dan lingkungan menjadi langkah penting menuju pelaksanaan CSR yang berkelanjutan dan berorientasi pada pembangunan jangka panjang
