Abstract

The controversy over legal decisions regarding song copyright royalties as joint property in Indonesia can generally be termed joint ownership of individual rights. This paradigm assesses the status of joint property based on the time of acquisition, the spouse's contribution, or the character of the asset. Joint property in Indonesian marital law is all property acquired during the marriage period unless there is a property separation agreement agreed upon before marriage. Inherited assets, inheritance, or grants remain the personal property of each spouse unless otherwise agreed. This issue arises because royalties have both a personal nature and long-term economic potential. This article analyses the controversy using a qualitative approach with a case study method, exploring the forms of controversy, causal factors, and implications. Data were obtained from a qualitative case study conducted by reviewing decision No. 1622/Pdt.G/2023/PA.JB and interviewing 3 judges and 2 advocates. The main findings show that controversy arose in three aspects: royalty division, copyright status, and asset division. Contributing factors include the misalignment between the personal nature of copyright and the communal concept of property, legal uncertainty, and the difficulty of economic valuation of song copyrights. The implications of this controversy include shifting social norms, uncertainty for creators, and increased complexity in asset division. This research underscores the need for comprehensive legal reform to accommodate the complexity of copyright royalty issues in the context of common property, as well as the development of more accurate valuation methods. This study contributes to a deeper understanding of the interaction between intellectual property law and family law in Indonesia.

Abstract

The customary law of the people of Lampung in Sukadana District is guided by the Ketaro Adat Lappung which is a book used for the people of Lampung Pepadun. The Lampung Adat Ketaro Manuscript contains customary rules, regarding rules of conduct, marriage, appointment of counterweights, and fines and sanctions (Cepalo 12 (severe sanctions) and Cepalo 80 (ordinary sanctions)) for those who violate customary rules in indigenous peoples. This research is qualitative descriptive research (field research) with inductive thinking. The methods used were interviews, documentation, and observation. Respondents were obtained through purposive sampling techniques. Researchers use language translators in interviews. The implementation of Lampung customary law in relation to customary sanctions has been actualized. If someone violates customary law, he is obliged to report the customary elder regarding his mistake and apologize and repent, then the customary elders consult to decide on a sanction. After the sanction is paid, the pepadun will be upright again. Sanctions for violations, namely compensation for immaterial damages, payment of customary money to those affected, shame cover, apologies, various death sentences, exile (non-active) from society and placing the person outside the legal system. Factors influencing the implementation of Lampung's customary law are its customary law, customary law enforcers, means and facilities to support the implementation of customary law, society (HR), and culture/culture.

Abstract

Implementasi syura’ dalam demokrasi mencerminkan integrasi nilai-nilai musyawarah untuk mufakat yang terkandung dalam prinsip Pancasila. Syura’ berasal dari tradisi Islam menekankan pada proses pengambilan keputusan melalui musyawarah dan pasrtisipasi aktif semua pihak untuk mancapai kesepakatan bersama. Dalam konteks Indonesia, nilai syura’ ini diadaptasi dalam struktur perwakilan rakyat, terutama dalam lembaga Majelis Permusyawaratan Rakyat (MPR), yang berfungsi untuk merumuskan dan mengesahkan undang-undang melalui proses musyawarah. Dalam system ini pengambilan keputusan lebih mengutamakan musyawarah daripada pemungutan suara, pemungutan suara hanya dilakukan apabila terjadi kebuntuan. Meskipun Indonesia mengadopsi sistem demokrasi modern, prinsip syura tetap dijunjung  tinggi sebagai dasar pengambilan keputusan yang mencerminkan kehendak rakyat. Artikel ini membaha stentang implementasi syura’ dalam proses legislasi Indonesia dan bagaimana konsep ini beradaptasi dengan praktik pemerintahan modern, yang mengadopsi elemen-elemen seperti checks and balance untuk menjaga keseimbangan kekuasaan dan mencegah potensi kepemimpinan otoriter. Melalui penerapan prinsip syura’, diharapkan proses poliyik di Indonesia dapat lebih inklusif, transparan, dan mencerminkan aspirasi masyarakat secara luas.
