Abstract

Enforcement of trademark-related criminal offenses by the Special Criminal Investigation Directorate of the Bali Provincial Police, in accordance with Law No. 20 of 2016 on Trademarks and Geographical Indications, is carried out through preventive law enforcement measures, which prioritize persuasive approaches and public awareness campaigns to prevent potential trademark infringements, as well as enhancing the knowledge of trademark owners through outreach activities. Preventive enforcement involves appeals and approaches, including socialization activities for registered trademark owners, and repressive measures, which include strict law enforcement, including the arrest and investigation of perpetrators, as well as the seizure of counterfeit trademark evidence. The obstacles faced by investigators from the Special Criminal Investigation Directorate of the Bali Regional Police in enforcing trademark rights include, first, legal obstacles, as trademark rights are a complaint-based offense, and second, obstacles related to law enforcement, namely the limited vocational training for personnel in Sub-Directorate I of the Special Criminal Investigation Directorate of the Bali Regional Police. Third, societal factors include the lack of public participation in providing information regarding suspected trademark infringement crimes.

Abstract

In enforcing the law on terrorism crimes, Densus 88 has broad authority including , arrest, investigation, and prosecution of suspected terrorists. This authority is regulated in Article 25 of Law Number 15 of 2003, which has been amended by Law Number 5 of 2018, and Law Number 1 of 2002 concerning the Eradication of Criminal Acts of Terrorism. Investigation, prosecution, and trial of terrorism crimes must be carried out in accordance with applicable legal procedures, unless there are other provisions in government regulations that replace this law. The problem is how is the authority of the Special Detachment 88 against perpetrators of terrorism in the Bali Regional Police, and how are the efforts to prevent terrorism crimes in the Bali Regional Police? (Polda) Special Detachment 88 has the authority to detain suspects for a maximum of months for the purposes of criminal investigation and prosecution, with the possibility of an extension of up to 7 times 24 hours in the arrest of terrorism, in accordance with Article 28. The efforts of the Special Detachment (Densus) 88 Police in Preventing Terrorism Crimes include preventive measures; in the form of socialization and education on terrorism to the community, coaching and mentoring for prisoners and former prisoners of terrorism in the social and economic fields, collaborating with various stakeholders such as universities and schools, the Social Service, and others. Repressive actions target arrests and prosecutions as well as trial trials for perpetrators of terrorism based on sufficient evidence.

Abstract

This research analyzes the implementation of diversion through a restorative justice approach in the handling of children facing the law (ABH) in the jurisdiction of the Bali Police. Using normative legal research methods with a qualitative approach, this study examines the effectiveness of the diversion mechanism based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The results of the study show that the implementation of diversion in the Bali Police has succeeded in reducing the burden of cases in court while creating a more humane settlement. However, several obstacles were found such as limited understanding of the apparatus, inadequate support facilities, and public resistance to the concept of diversion. This study also identifies opportunities for the integration of Balinese local wisdom values in the mediation process. The implications of this study include three main aspects: (1) policy - the need to improve the technical guidelines of diversion, (2) practice - the importance of building the capacity of mediators, and (3) academic - contribution to the development of diversion models based on local culture. The findings of this study are expected to be a reference for the development of a more effective and fair juvenile criminal justice system.

Abstract

The authority of psychologists in examining police members who commit disciplinary violations in the Bali regional police a) Helps identify problems that cause indisciplinary actions by police members. Police members are individual units that are also inseparable from problems in their daily environment. b) Helps in the form of counseling so as to reduce indisciplinary actions by police members. Related to the lack of awareness, compliance and implementation of police members towards their responsibilities as police members that bind them, it is necessary to carry out routine supervision by Siwas for general monitoring and supervision of the implementation of police leadership policies in the field of coaching and operations carried out by all work units. The obstacles faced by psychologists when examining police members who commit disciplinary violations in the Bali regional police are that superiors are not optimal in supporting counseling programs, lack of job desk arrangements for psychologists, budget factors, socialization factors and understanding factors of police members and psychologists. Meanwhile, the solution in the development of police psychology for members who commit disciplinary violations is the socialization of re-development of psychology to all members in the Bali Regional Police to prevent disciplinary violations, making regulations for the head of the Republic of Indonesia Police which stipulate that every superior is a counselor in order to meet the number of adequate psychological development.

Abstract

Salah satu program yang dicanangkan pemerintah adalah Bantuan Operasional Sekolah (BOS), yang bertujuan untuk meningkatkan kualitas pendidikan, termasuk pemerataan sarana dan prasarana. Hal ini sesuai dengan amanat Pancasila, "Keadilan Sosial Bagi Seluruh Rakyat Indonesia", yang merupakan Sila Kelima Landasan Ideologi Nasional. Semua program anggaran sangat rentan terhadap korupsi, jadi perlu ada pengawasan yang ketat untuk memastikan bahwa program tersebut dilaksanakan dengan benar. Menurut Undang-Undang Nomor 15 Tahun 2006 tentang BPK, pemeriksaan keuangan terhadap laporan keuangan dilakukan dengan tujuan memberikan keyakinan yang memadai atau keyakinan yang wajar bahwa penyajian laporan telah dibuat secara wajar terkait semua hal material dalam substansinya, sesuai dengan prinsip-prinsip umum keakuntansian, seperti Laporan Keuangan Pemerintah Pusat. Tiga prinsip evaluasi harus dipatuhi: prinsip kontinuitas (kontinuitas), prinsip menyeluruh (komprehensif), dan prinsip objektivitas. Situasi sebagaimana diungkapkan diatas membuat pentingnya dilakukan analisis lebih lanjut mengenai Bagaimana pengaturan mekanisme pertanggunga jawaban Dana BOS berdasarkan prinsip akuntabilitas? Dan Bagaimana mekanisme pengawasan oleh BPK sebagai pihak yang berwenang untuk setiap program pemerintah terkait anggaran?

Abstract

Praktik hak angket sering mengalami kendala, sehingga banyak yang menilai belum ada tujuan dan skema pelaksanan yang jelas. Hak angket seharusnya dapat mendukung fungsi legislasi, anggaran, dan pengawasan DPR, namun seringkali hak angket lebih sering digunakan untuk kepentingan politik. Tujuan penelitian ini adalah untuk mendeskripsikan, memahami, dan menganalisis pengaturan hak angket DPR dalam pengawasan kebijakan pemerintah, serta mekanisme pengajuan dan penerapan hak angket. Metode penelitian ini menggunakan studi hukum normatif yang mengkaji aturan hukum formal, termasuk undang-undang dan literatur teori yang relevan. Teknik analisis yang digunakan adalah deskriptif analitis dan analisis argumentasi hukum. Hasil penelitian menunjukkan bahwa pengajuan hak angket diperlukan minimal 25 anggota parlemen lebih dari satu fraksi, diikuti dengan penyampaian permohonan rinci dan pertimbangan di sidang paripurna sesuai Pasal 177 UU Nomor 27 Tahun 2009. Hak angket DPR diatur dalam Pasal 20A ayat (2) UUD 1945 dan diperkuat dalam Pasal 79 ayat (3) UU Nomor 42 Tahun 2014. Hak ini memungkinkan DPR untuk menyelidiki pelaksanaan undang-undang atau kebijakan pemerintah yang dianggap bertentangan dengan peraturan. Dapat disimpulkan bahwa prinsip check and balance harus tetap dijunjung agar tidak melemahkan fungsi independensi lembaga.

Abstract

One of the phenomenal formulations of the Article is "unlawfully" Article 2 paragraph (1) of the PTPK Law which in its explanation is interpreted as acts against formal and material laws, has experienced a shift in meaning with the issuance of the Constitutional Court Decision No. 03/IV-PUU/2006 which only recognizes acts against formal laws, while acts against material laws are seen as not meeting the principle of legality, However, the Supreme Court in several of its decisions disagreed with the concept of the Constitutional Court's decision, using the doctrine of "Sens Chair" where judges are obliged to explore the values of law and justice that live in society. Based on these provisions, the problem can be formulated, namely how to develop the meaning of unlawful acts before and after the Constitutional Court Decision No. 03/IV-PUU/2006 on the Crime of Corruption and how the validity of the Supreme Court's decision which does not apply the decision of the Constitutional Court No. 03/PUU-IV/2006 in several decisions. To analyze these problems, the theory of criminal acts, the theory of corruption crimes and the theory of unlawful acts are used. This type of research is a normative research with a legislative approach, a historical approach and a conceptual approach, the sources of legal materials used in this study are primary, secondary and tresier legal materials, the collection of legal materials used is a documentation study and using quantitative analysis. The Constitutional Court's Decision No. 03/PUU-IV2006 has annulled the explanation of Article 2 paragraph (1) of the Law on the Eradication of Corruption (PTPK Law), which adopts the concept of material law in its positive function. As a result of this decision, the concept of unlawfulness in the PTPK Law should be interpreted as a teaching of formal and material unlawfulness in its negative function. The principle of legality is the main principle in criminal law, which aims to protect human rights from the arbitrary attitude of the rulers. However, the Supreme Court interprets formal and material unlawful acts in their positive function, they can still ensnare the perpetrators of corruption crimes and punish the defendants based on existing laws and regulations.
