Abstract

The act of verbally insulting a deceased person is a crime regulated by the legal rules in force in Indonesia (KUHP). Open access allows various lectures and writings to become narratives that encourage hostility and hatred. In this case, insulting the cleric's grave gave rise to polarization and demonstrations. For this reason, it is necessary to study in more depth the elements of criminal liability that can be given to perpetrators of insults. The aim of this research is to find out how positive law regulates acts of insulting people who have died, even though the person being insulted has died. The research carried out is normative juridical research using primary, secondary, and tertiary legal materials. After the data is collected, it is then analyzed systematically and linked to legal materials. The results of this research show that even though the object of insult is a person who has died, the law regulates criminal acts of insult, which can be applied to insulting the graves of ulama. These regulations are regulated in articles 320 and 321 of the Criminal Code and articles 27 and 28 of the ITE Law.

Abstract

Background. Governor Ground land refers to land without ownership rights, which can be interpreted as abandoned land. Abandoned land is land controlled by the state where the legal relationship between the landowner and the land has been severed, as regulated in Article 27(a) of the Basic Agrarian Law (UUPA). The government's authority over such land is specified in Article 2, paragraph (2) of the UUPA. This study aims to provide answers regarding the rights over Governor Ground land. Research Methods. The research employs normative legal methods, using a conceptual, case, and legislative approach. Legal materials were collected through literature review and analysis of articles and opinions from previous researchers. Findings. Governor Ground land can be owned or utilized if specific requirements are met and permission is obtained from the government, particularly the National Land Agency (BPN). Governor Ground is land that has no ownership rights and can be considered as abandoned land. The community can use it for the common interest in accordance with the procedures in the Law. Conclusion. This land can have rights such as HGU, HGB, and Right to Use. If these rights are misused, they can be subject to criminal penalties with a sentence of three months or a fine of up to IDR 10,000. If the land is not maintained, the government can take back the land and demolish the buildings on it.

Abstract

In an increasingly sophisticated era, the development of technology has made major changes in the business world. One of them is on social media which is increasingly developing and facilitating communication. Communication in business is very important. So it is necessary to achieve the existing conveniences and need to be used as well as possible. This form of utilization can be accepted by MSME actors in Indonesia, especially MSMEs in Jombang District. By using the interview method to thoroughly discuss the use of social media in their business, and using supporting questions, the results of the study show that the use of social media can be made to facilitate media promotion, so as to improve the development of MSMEs themselves. The sales rate is getting faster and automatically increases in other aspects of the business. The increase that occurred has made MSME players feel benefited and facilitated by the current sophistication of technology. The positive benefits obtained by MSME players are expanding market networks, facilitating interaction with consumers, and increasing product sales.

Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan fungsi perangkat desa dalam mediasi sengketa batas tanah serta mengidentifikasi tantangan dan efektivitas penyelesaiannya di Desa Porodeso, Kecamatan Sekaran, Kabupaten Lamongan. Sengketa batas tanah merupakan konflik agraria yang lazim terjadi di desa dan seringkali tidak diselesaikan melalui jalur hukum formal karena tingginya biaya, lamanya waktu penyelesaian, serta rendahnya literasi hukum masyarakat. Perangkat desa memainkan peran strategis sebagai mediator karena kedekatannya dengan masyarakat dan pemahaman terhadap konteks lokal. Penelitian ini menggunakan metode kualitatif dengan pendekatan sosiologis-juridis dan teknik pengumpulan data berupa wawancara, observasi, dan studi pustaka. Hasil penelitian menunjukkan bahwa perangkat desa di Desa Porodeso menjalankan fungsi mediasi secara aktif dengan mengedepankan nilai musyawarah dan kekeluargaan. Namun, efektivitas mediasi masih terkendala oleh minimnya pelatihan, tidak adanya prosedur baku, dan lemahnya dokumentasi hasil kesepakatan. Keberhasilan mediasi sangat bergantung pada netralitas perangkat desa, komunikasi yang inklusif, serta dukungan regulasi dan administratif dari pemerintah daerah. Oleh karena itu, diperlukan penguatan kapasitas kelembagaan dan penyusunan standar operasional prosedur mediasi agar penyelesaian sengketa di desa dapat berlangsung secara adil, legal, dan berkelanjutan.

Abstract

The sustainability of food land is crucial not only for economic productivity but also for maintaining ecological balance, cultural identity, and rural livelihoods. This study examines the effectiveness of legal protections for rural communities in safeguarding sustainable agricultural land, with a focus on Lamongan District, East Java. Using a normative-empirical approach, the research combines statutory analysis of agrarian laws with field surveys and interviews involving 256 respondents, including farmers, village officials, and legal experts. The findings reveal a persistent gap between legal norms and actual practices. Although Law No. 41/2009 on the Protection of Sustainable Agricultural Land and Law No. 5/1960 on Basic Agrarian Principles provide a strong legal foundation, enforcement is hindered by weak institutional coordination, low legal literacy, and limited authority at the village level. These challenges often result in land conversion without transparent procedures or adequate community participation, threatening both agrarian justice and national food security. The study underscores the need for participatory legal reforms, stronger intergovernmental coordination, and capacity-building initiatives for village institutions. The implications extend beyond Lamongan, offering insights for policymakers and scholars interested in land governance, food sovereignty, and rural sustainability. Future research should explore longitudinal and comparative perspectives to strengthen the integration of law and social policy in agrarian contexts.

Abstract

This study aims to analyze the role of farmer groups in preventing corruption of village funds, using a case study in Manyar Village, Lamongan Regency. The research employs a combination of normative and empirical legal approaches by examining relevant legal regulations and field findings based on direct community involvement. The results reveal that while the disbursement and use of village funds procedurally comply with existing laws, community participation in budget oversight remains limited. Farmer groups, traditionally perceived as agricultural production units, have demonstrated potential as informal agents in monitoring village projects. These findings indicate that their involvement in verifying physical project implementation and reporting discrepancies has helped reduce the risk of corruption. The scientific contribution of this research lies in recognizing local actors as key players in participatory governance and grassroots-based integrity systems. The study advocates for policy reforms that formally integrate farmer groups into village fund oversight frameworks to promote greater transparency and accountability in rural financial governance.

Abstract

Background. The issue of agrarian reform in Indonesia has long been a central theme in the country’s legal, political, and social development. This study aims to analyze the implementation of the amended Basic Agrarian Law in the land registration process at the village level, particularly in Ngarum Village, Lamongan, and to evaluate the effectiveness of socialization programs in improving community legal awareness regarding land registration. Research method. Employing a qualitative socio-legal approach, the research explores how legal norms interact with local institutions and community practices. Data were collected through interviews, observations, and legal document analysis. Findings. The implementation of land registration under Law Number 14 of 2024 still encounters obstacles such as limited community legal awareness, weak village administrative capacity, and the lack of data integration with land agencies. Nevertheless, supporting factors such as improved public interest in land certification and the strategic role of village leaders have been identified. The evaluation of socialization activities indicates a significant increase in awareness levels, although this improvement does not always translate into actual registration practices due to structural and cultural barriers. The analysis highlights a gap between the legal framework and its implementation, emphasizing the need for strengthening institutional capacity and enhancing community legal education. Conclusion. Successful implementation requires multidimensional strategies that involve legal, institutional, cultural, and technological support tailored to rural contexts.

Abstract

Background. Although village elections are inherently political, they also entail administrative dimensions subject to legal scrutiny, particularly regarding the regent’s decree confirming election results. The absence of a consistent legal interpretation has generated uncertainty within administrative judicial practice. This study examines the jurisdictional authority of the State Administrative Court (PTUN) in adjudicating village head election disputes, using the case of Ngarum Village, Lamongan Regency, as a focal point. Research Method. Employing a normative-empirical legal approach, this study integrates doctrinal analysis of administrative law and statutory frameworks with empirical observations of PTUN Surabaya’s handling of election disputes. Findings. The research identifies significant judicial inconsistency across PTUN jurisdictions in classifying regents’ decrees; some deem them political acts, while others recognize them as administrative decisions open to judicial review. Such divergence undermines legal certainty and equitable access to justice. Conclusion. PTUN possesses legitimate authority when a regent’s decree fulfills the characteristics of an administrative decision. Institutional reinforcement and uniform judicial guidelines are imperative to enhance accountability, ensure procedural fairness, and strengthen democratic governance at the local level.
