Abstract

Penelitian ini bertujuan untuk mengetahui besarnya persentase elastisitas perubahan permintaan dan penawaran terhadap harga udang di Desa Bua, Kec. Tellu Limpoe. Penelitian ini termsuk dalam penelitian survey dengan menggunakan pendekatan Kuantitatif. Hasil penelitian ini menunjukkan bahwa elastisitas permintaan yang diperoleh oleh Bapak Riswandi yaitu 3,66 (elastis), Bapak A. Hardiadi yaitu 2,25 (elastis), bapak A. Asing yaitu 3, 25 (elastis), bapak Baharuddin yaitu 1,4 (elastis), bapak Jarum yaitu 0,71 (Inelastis), bapak A. Zaenuddin yaitu 7,29 (elastis), bapak Muhammad Ale yaitu 3,0 (elastis), bapak A. Syam yaitu 0,56 (Inelastis), bapak A. Ebang yaitu 3,0 (elastis), Ibu A. Nia yaitu 1,33 (elastis). Sedangkaan besar elastisitas penawaran yang diperoleh oleh bapak Riswandi yaitu 3,6 (elastis), bapak A. Hardiadi yaitu 1,0 (uniter), bapak A. Asing yaitu 0,56 (Inelastis), bapak Baharuddin yaitu 1,3 (elastis), bapak Jarum yaitu 2,0 (elastis), bapak A. Zenuddin yaitu 2,81 (elastis), Muhammad Ale yaitu 3,0 (elastis), bapak A. Syam yaitu 0,22 (Inelastis), bapak A. Ebang yaitu 1,5 (elastis), Ibu A.Nia yaitu 1,33 (elastis). Sedangkan elastisitas pendapatan yang diperoleh oleh bapak Riswandi yaitu 1,83, bapak A. Hardiadi yaitu 2,25, bapak A. Asing yaitu 4,33, bapak, Baharuddin yaitu 7,58, bapak Jarum yaitu -5,0, bapak A. Zenuddin yaitu 1,42 bapak Muhammad Ale yaitu 6,6, bapak A. Syam yaitu –0,95, bapak A. Ebang yaitu 1,6 Ibu A. Nia yaitu 2,0. Sehingga dapat disimpulkan bahwa usaha tambak udang di Desa Bua, Kec. Tellu Limpoe adalah elastis.

Abstract

Teaching and learning activities are conducted for elementary (SD/MI) In Gelogor, Subdistrict Kediri, West Lombok Regency. At this educational level, the motivation to learn the Quran among children is minimal due to their limited ability to read the Quran. The main objective of these instructional activities is to enhance the learning motivation of children, enabling them to become proficient in reading the Quran. The teaching method employed is descriptive, utilizing a combination of lectures, discussions, question-and-answer sessions, and simulations. The outcomes of the teaching and learning sessions are as follows: Firstly, students achieve a better understanding of the theory of Quranic recitation. Secondly, they exhibit an improved motivation to learn the Quran. Thirdly, through the tahsin method, students find it easier to enhance or refine their Quranic reading skills. Fourthly, there are noteworthy changes observed after the implementation of the tahsin method

Abstract

The debate on the heresy of waqf al-ahlī (family endowment) in the early 20th century significantly impacted its legality in Muslim countries. In Southeast Asia, with samples from Indonesia, Malaysia, and Singapore, they followed the majority opinion of ulama. They implemented it in the law to improve the management of waqf al-ahlī. This paper examines the legality of waqf al-ahlī from the perspective of fiqh and the Law and its implementation model in the three countries through extensive literature study. The results reveal that the debate on the legality of waqf al-ahlī is more influenced by socio-economic and political factors and misunderstandings about the purpose of waqf rather than theological considerations. Therefore, most Muslim scholars recognise this type of waqf, and it is implemented by most Muslim countries, including the three countries that are the objects of this study. Comparative analysis shows that Singapore achieves higher productivity and efficiency in managing waqf al-ahlī than Indonesia and Malaysia. These findings refute the view of waqf al-ahlī as heresy and emphasise the importance of good governance, a comprehensive legal framework, and efficient management to optimise the potential of waqf al-ahlī as an instrument of sustainable socio-economic development.

Abstract

This study aims to examine research related to ghoror practices in qurban transactions in Indonesia and provide input solutions to eliminate ghoror and open discourse for further research. This study used a qualitative approach with the literature review method. The researcher examines research related to the practice of qurban transactions in Indonesia in journals and proceedings that are indexed by Sinta or have an ISSN. As well as normative descriptive methods to examine the ghoror aspects of transactions and solutions to eliminate them. Research divides qurban transactions into 3, namely qurban transactions using Islamic financial institutions, online qurban transactions and offline qurban transactions through mosques or Islamic schools. The result is that there are 4 types of ghoror that occur, namely ghoror in the contract, ownership, specifications for animals and guarantees. This research also provides solutions to every ghoror issue that occurs. In addition, more specific research on one type of transaction by adding samples from Scopus and WoS journals can expand the results of research that has been done. This study found that financial transaction innovations in qurban worship have the potential to cause ghoror in both financial transactions and reports. This research provides input so that qurban transactions and innovations that will be made are free from forbidden ghoror practices.

Abstract

Perjanjian bagi bangun merupakan sa1ah satu bentuk kerja sama yang sering di1akukan untuk memanfaatkan lahan terbatas guna mendukung kegiatan pembangunan. Perjanjian ini memiliki kelebihan dalam memberikan solusi bagi para pihak untuk mencapai kesepakatan pembangunan, tetapi juga menghadirkan risiko, seperti risiko konstruksi, biaya tak terduga, dan potensi wanprestasi. Dalam konteks ini, akta otentik yang dibuat o1eh notaris memainkan peran penting da1am memberikan kepastian hukum bagi para pihak. Penelitian ini menganalisis pelaksanaan perjanjian bagi bangun antara pemilik tanah dan pengembang serta per1indungan hukum yang diberikan kepada para pihak berdasarkan studi atas Putusan Nomor 133/Pdt.G/2022/PN.Ptk dan 05/Pdt.G/2018/PN-Sgi. Dengan pendekatan yuridis normatif, penelitian ini menemukan bahwa notaris memiliki tanggung jawab penting dalam memastikan legalitas dan keabsahan akta perjanjian. Hasil studi juga menunjukkan perlunya penguatan regulasi khusus mengenai perjanjian bagi bangun guna mengurangi potensi konf1ik di masa mendatang.

Abstract

The pandemic of Covid-19 that struck since beginning of 2020 had an enormous impact to the whole states in the world including Indonesia. The pandemic was bring worst influences to the economic and trading. The deadly disease automatically was paralyze an economy and trading. It is caused by restriction of people to drive and influences the product movement. Temporarily, export-import activities delayed as restriction of transportation entry among the states. Finally, Indonesia forced close for in and out flight of territory. The situation influence to the implementation of Economic Right of trademark right attach to the import and export products in Indonesia. By the reasons, the study categorized by, first, the development of Economic Right principle implementation of trademark right in the pandemic era. Secondly, the challenge and effort an implementation of Economic Right principle of trademark right in trading at pandemic era. The study uses normative law method by literature study of related material and the data analysis uses qualitative. According of Act No. 20 of 2016, involves Trademarks and Geographical Indications, the trademark right is an exclusive one granted by the state to the owner for a registered brand for a certain period by using the mark or giving permission to other parties for it. However,it is difficult in current conditions to introduce a new trademark to society amid a weak economic situation so that most recognized trademark will be better able to survive amid the economic downturn in the covid-19 pandemic era. The situation result in violation of trademark ownership when a product is given a label from a previously brand so that a lawsuit can be filed. An interested party may file a lawsuit for the cancellation of a registered trademark and the cancellation submitted to the Commercial Court against the owner of the registered trademark.

Abstract

In the few months there is a high intensity of illegal fishing at Indonesian waters. The most potential area located in the coast border of West Sumatera facing the high seas and Indian Ocean that have long been a target from abroad fishing boats. Geographically, there are three areas located in strategic west coast of Sumatera such as Padang City, South Coast District, and Mentawai District. By the situation of opened-coast territorial geography, it is susceptible for illegal fishing of tuna by the local or abroad ships. The observed problems in this research are finding causing factors of illegal fishing in west coast of Sumatera to protect the waters environment under the local wisdom, how to implement the countermeasures of illegal fishing in the west coast of Sumatera. Moreover, there is a special attempt to find out the system and proper policy to cope with the potential happening often of illegal fishing that threatens the waters protection in west coast of Sumatera. The dominant method used in research is qualitative approach by implement two legal studies such as socio legal and normative legal study used in research on doctrines or useful principles of law. Moreover, characteristically this research categorized as the analytical descriptive.
