Abstract

Legalization of customary forests is an effective way to resolve social conflicts within customary forest areas and grant access and management rights to Indigenous communities, thereby improving their welfare. This study analyzes the efforts to legalize Customary Forests in North Lombok Regency (KLU). The research method used is the legal empirical research method conducted from May to September 2024. Data were collected through observation, interviews and literature study. Interview informants were selected using purposive sampling technique. The results showed that efforts to legalize Customary Forest in KLU have only reached the process of legalization of the legal subject, namely the Customary Law Community (MHA). The process of legalization of MHA has started since the existence of KLU Regional Regulation No. 6 of 2020. Based on the identification results of the KLU MHA Identification Team, there are 43 (forty-three) Customary Forest areas in KLU. Four (4) of these areas are located within the Forest Estate. The forty-three Customary Forests are located in five (5) Customary Law Community units. The process of establishing these Customary Forests was supported by many parties including customary stakeholders, communities, and social institutions.

Abstract

The customary inheritance law system in Indonesia regulates the distribution of inheritance based on local cultural norms. In regions like Manggarai, East Nusa Tenggara, the dominant patrilineal system causes gender inequality in inheritance distribution, prioritizing male heirs while females receive only symbolic gifts. Although Indonesia's positive law guarantees equal inheritance rights, customary practices that favor males hinder the effective implementation of gender equality. This qualitative study, using document analysis, in-depth interviews, and participatory observation, explores the interaction between customary and positive law and the application of gender equality in inheritance. The findings reveal a tension between male-preference cultural norms and the gender equality principles in positive law. Achieving better gender equality in inheritance requires collaboration between the government, customary communities, and legal institutions, along with effective socialization of women's rights in both legal systems to ensure fairer and more equitable inheritance distribution.

Abstract

Crimes of sexual intercourse committed by children are one type of crime that requires special attention, especially as the incidence of such crimes committed by children has been increasing year by year. The significant impact resulting from this crime should certainly be a matter of our collective concern. Therefore, this research aims to identify the factors underlying why children commit sexual offenses and the rehabilitation efforts undertaken by the Special Child Development Institution Class II Lombok Tengah for children who commit sexual offenses. This research is empirical in nature. Data in this research were obtained using observation methods, interviews, documentation, and literature study. The data were then analyzed using a sociological approach, a case study approach, and a legislative approach. The data was then presented using a descriptive qualitative method. The research results show that the factors causing children to commit sexual offenses are poor environmental factors, social media factors, and lack of parental supervision. Meanwhile, the efforts made by the Special Child Development Institution Class II Lombok Tengah for children who commit sexual offenses are personality development, including spiritual development, national and state awareness, reintegration, and intellectual development, and independence development, including horticulture, agriculture, basic welding techniques, and barbershop skills.

Abstract

The objective of this article is to examine the legal framework governing customary forests in the wake of the Constitutional Court's Decision No. 35 of 2012. Does the legislation contravene any established legal principles? What are the consequences of this decision? The research method employed is normative, with a conceptual and legislative approach. The findings of the study demonstrate that the legal regulations pertaining to customary forests subsequent to Constitutional Court Decision No. 35 of 2012 are not in accordance with the established legal hierarchy structure. This has an impact on the legal certainty of regulations on customary forests. One of the problems caused by the above is that the regulations on Customary Law Communities rights in the three ministerial regulations continue to change and have the potential to deviate from the spirit of Constitutional Court Decision No. 35 of 2012. As a result, the authority and rights of MHA over Customary Forests could be more explicit and are likely to always change when there is a change of minister. The results of this study make two (two) recommendations. First, legal regulations on Customary Forests must be addressed when preparing and discussing the Customary Law Community Bill. Second, there must be an explanation or proper interpretation of MHA rights over Customary Forests as intended in Constitutional Court Decision No. 35 of 2012

Abstract

Putusan MK No. 35 Tahun 2012 perihal hutan adat merupakan awal pengakuan hak Masyarakat Hukum Adat (MHA) atas hutan adat. Pengakuan hak tersebut menjadi dasar penetapan Hutan Adat sebagai salah satu skema dalam Program Perhutanan Sosial Kementerian LHK. Tujuan penelitian ini yakni mendeskripsikan pengaturan hukum tentang Masyarakat Hukum Adat (MHA) dalam program Perhutanan Sosial. Metode penelitian yang digunakan yakni metode normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukan peran masyarakat adat dalam Program Perhutanan Sosial diatur dalam Permen LHK No. 83 Tahun 2016 tentang Perhutanan Sosial; PP No. 23 Tahun 2021 tentang Penyelenggaraan Kehutanan dan Permen. LHK No. 9 Tahun 2021 tentang Pengelolahan Perhutanan Sosial. Masyarakat Hukum Adat (MHA) adalah salah subyek hukum pengelolaan perhutanan sosial dengan skema Hutan Adat. Kriteria penetapan status Hutan Adat dan hak MHA setelah ditetapkan sebagai subyek pengelolaan Hutan Adat diatur secara spesifik dalam Permen LHK No. 9 Tahun 2021 tentang Pengelolahan Perhutanan Sosial

Abstract

The objective of this community service activity was to ascertain the location and extent of customary forests in Bayan Village, with the intention of subsequently preparing a map delineating the boundaries of these areas. The preparation of the map was conducted through a participatory approach, which involved the village government, customary leaders, representatives of indigenous communities, youth leaders, and communities situated in close proximity to the customary forest area. The location of the service was determined through the use of purposive sampling, with the following considerations taken into account: Bayan Village is notable for its extensive customary forest area, ranking among the largest in North Lombok Regency. However, there has been no data update related to the customary forest area since 2005. The data sources employed in this activity encompassed both secondary and primary data, which were subsequently classified into two distinct categories: primary data, comprising boundary digitization results, satellite imagery, village boundaries, village profiles, and pertinent literature; and secondary data, obtained from various sources, including satellite imagery, village boundaries, village profiles, and related literature. The data were analyzed using ArcGIS 10.8.2 software, resulting in a map visualization of the customary forest areas. The mapping results demonstrate that the Bayan Village Customary Forest is divided into four distinct areas: Bangket Bayan, Mandala, Pangempokan, and Tiu Rarangan. The total area of the customary forest in Bayan Village is 82.02 hectares, representing a decrease of 1.18 hectares from the 2005 mapping results, which recorded 83.2 hectares

Abstract

Kegiatan berternak dan bertani merupakan aktivitas yang memiliki peran penting dalam pemenuhan kebutuhan pangan masyarakat Lampok - Sumbawa. Persoalan yang terjadi yakni hewan ternak masyarakat masuk di area lahan pertanian warga lainnya. Penelitian ini bertujuan untuk memberikan rekomendasi penyelesaian konflik kerusakan lahan akibat hewan ternak di Lampk – Sumbawa. Untuk itu, peneliti mengkaaji strategi penyelesaian konflik konflik kerusakan lahan akibat hewan ternak di Lampok – Sumbawa. Metode yang digunakan yakni metode normatif empiris dengan sumber data empiris (tentang kondisi empirik di Lampok – Sumbawa) dan data sekunder yang diambil dari sumber-sumber hukum primer dan sumber hukum sekunder. Hasil penelitian menunjukkan bahwa dari analisis perspektif hukum pidana, perdata, dan hukum adat, terdapat mekanisme untuk menangani kerugian akibat hewan ternak. Hukum pidana memberikan sanksi bagi pemilik ternak yang lalai, sementara hukum perdata memungkinkan pemilik lahan untuk menuntut ganti rugi. Hukum adat menekankan musyawarah dan tanggung jawab sosial dalam menyelesaikan konflik. Berdasarkan pertimbangan penggantian kerugian warga yang dirugikan dan kondisi masyarakat, peneliti merekomendasi pendekatan perdata untuk menyelesaiakan konflik hewan ternak masyarakat masuk di area lahan pertanian di Lampok – Sumbawa.

Abstract

Children who have committed legal violations are inmates at the Class II Special Child Development Institution in Lombok Tengah. During the child rehabilitation process at LPKA Lombok Tengah, some children continue to violate the rules, making the conditions unfavorable. The purpose of this research is to ensure the legal basis for the imposition of sanctions and the enforcement of disciplinary sanctions, as well as the obstacles faced by LPKA Lombok Tengah. The method used in this writing is normative-empirical with a case, legislative, and sociological approach. The results of this study are as follows: First, the legal basis for imposing disciplinary punishment is outlined in the Decree of the Minister of Law and Human Rights Number M.HH-03.OT.02.02 of 2014 concerning guidelines for the treatment of children in LPKA. Second, the light disciplinary sanctions include verbal reprimands, moderate sanctions such as apologies and agreements between the staff and the inmates, and heavy disciplinary sanctions such as cleaning the bathroom and restricting visitation activities. The obstacles encountered include the factor of the inmates being difficult to discipline, the condition of the inmates being unwell when sanctions are to be imposed, and the factor of facilities and infrastructure.

Abstract

In Bayan Village, West Nusa Tenggara, there are four customary forest areas that have the potential to be developed through the Customary Forest scheme. This scheme is part of the Social Forestry Program which provides access and forest management rights to indigenous communities. The four forests are currently being managed by the indigenous peoples but have not yet been granted the status of customary forest. The aim of this study is to evaluate the potential of the Bayan indigenous community to acquire forest management rights under the Customary Forest scheme. The research employed a normative-empirical approach. The results indicate that the Bayan indigenous peoples meets all the criteria in the Government Regulation No. 23 of 2021 on the Implementation of Forestry and the Ministry of Environment and Forestry Regulation No. 9 of 2021 on Social Forestry Management. The Bayan indigenous peoples is eligible to be designated as a Customary Law Community by the Regent of North Lombok and to obtain Customary Forest management rights from the Ministry of Environment and Forestry. This potential is supported by two factors: (1) the potential for forest and tourism development; and (2) the potential for well-maintained local wisdom.

Abstract

Bayan Village, North Lombok District has four customary forests, namely Mandala Customary Forest, Pengempokan Customary Forest, Tiu Rarangan Customary Forest, and Bengket Bayan Customary Forest. The four customary forests have the potential to be developed with the concept of ecotourism. This study uses a qualitative descriptive method. With the determination of the location and respondents using Purposive Sampling. The study was conducted with the aim of analyzing the feasibility of developing Customary Forests into one of the ecotourism attractions using the parameters of ecotourism appeal, accessibility, conditions of the surrounding area, accommodation, facilities and infrastructure and the availability of clean water. The research parameters used the Guidelines for Analysis of Natural Tourism Attraction Operation Areas (ADO-ODTWA) stipulated by the Director General of Forest Protection and Nature Conservation (Dirjen PHKA) in 2003. The results of the study showed that the four tourist attractions in Bayan Village have the potential to be developed into ecotourism destinations, with respective index values, namely Mandala Customary Forest 86.83%, Pengempokan Customary Forest 84.03%, Bangket Bayan Customary Forest 87.69% and Tiu Rarangan Customary Forest 84%
