Abstract

Inmates serving sentences have rights protected by human rights and Indonesian law, one of which is the granting of remission. Remission is a reduction in the criminal term for qualified inmates, among others, behaving well but not convicted with the death penalty or life imprisonment. The prison manages the granting of these waivers. The remission is a form of systematic construction in correctional services used in Indonesia. Remission supports the reintegration into society or rebuilding good relations between inmates and the community. Provision of Remission to Inmates who have committed a special criminal offense under Government Regulation No. 99, 2012, was based on a sense of social justice. Currently, the procedure for granting remission for special criminal acts is regulated in the Regulation of the Minister of Law and Human Rights No. 7 of 2022 About the Terms and Procedures for Granting Remission, Assimilation, Family Visiting Leave, Parole, Leave Before Release, and Conditional Leave are very different from the previous regulations. Abstract

Terjadinya kekerasan di lembaga pemasyarakatan menimbulkan kekhawatiran akan kembalinya sistem penjara masa lalu. Saat ini, undang-undang telah menetapkan batasan terhadap tindakan petugas untuk mencegah tindakan berlebihan, penggunaan kekerasan dan upaya paksa. Penelitian ini bertujuan memberikan gambaran atas pelanggaran hak konstitusonal warga binaan dan pertanggunjawaban hukumnya. Penelitian ini dikerjakan menggunakan pendekatan yuridis normatif yang melibatkan analisis terhadap peraturan-peraturan hukum dan konseptual. Hasil penelitian menunjukkan bahwa pendekatan pembinaan yang melibatkan tindakan kekerasan tidak selalu efektif dalam menyelesaikan masalah sampai ke akarnya atau memberikan dampak jera yang berkelanjutan, justru menciptakan dampak buruk yang terus-menerus seperti gangguan mental, peningkatan risiko depresi pada narapidana dan menghambat efektivitas program rehabilitasi. Kekerasan terhadap narapidana oleh petugas pemasyarakatan menjadi bukti tidak terpenuhinya hak-hak konsitusional narapidana sebagaimana amanat Undang-Undang Pemasyarakatan bahwa perlakuan terhadap narapidana yang kehilangan kebebasannya harus didasarkan pada prinsip perlindungan hukum dan penghormatan hak asasi manusia yang berlandaskan Pancasila dan UUD NRI 1945. Reformasi yang komprehensif diperlukan dalam sistem pemasyarakatan untuk memastikan hak-hak konstitusional narapidana dapat terpenuhi. Peneliti merekomendasikan agar pemerintah mengupayakan pengawasan dan tindakan tegas terhadap petugas pemasyarakatan. Pengawasan ini memastikan bahwa petugas mematuhi undang-undang, etika profesi, serta hak-hak kemanusiaan dalam menjalankan tugas dengan integritas.

Abstract

Security strategy in correctional facilities is a crucial aspect in preventing potential threats to safety and order. This study aims to analyze the implementation of Crime Prevention Through Environmental Design (CPTED) as a strategic approach to security at Class IIB Krui Detention Center. CPTED emphasizes the role of physical environment design and management in reducing crime opportunities and enhancing natural surveillance. This research uses a descriptive qualitative method with data collected through observation, interviews, and documentation. The results show that the security strategy at Class IIB Krui Detention Center has adopted CPTED principles such as natural surveillance, access control, and maintenance to create a secure and orderly environment. However, several challenges remain, including infrastructure limitations, human resource shortages, and budget constraints, which affect the effectiveness of the implementation. The study recommends capacity building for officers, utilizing surveillance technology, and improving spatial arrangements and physical facilities to optimally support CPTED principles. When properly applied, CPTED can serve as a strategic solution in creating a more preventive and efficient security system within correctional settings.

Abstract

The Class IIA Purwokerto Correctional Facility (Lapas) implements the Admission-Orientation Period (Mapenaling) program as an effort to help inmates adapt to the new environment and prevent violations during their imprisonment. Mapenaling plays an important role in the initial rehabilitation of inmates, but its implementation often faces challenges that affect the effectiveness of the program. This study aims to analyze the implementation of Mapenaling at the Class IIA Purwokerto Correctional Facility and identify the factors that hinder its success. This research uses a qualitative method with a case study approach. Data were collected through observations, in-depth interviews with correctional officers and inmates, and analysis of related documents. The results of the study indicate that there are discrepancies between the implementation of Mapenaling and the established standard operating procedures. Some of the main obstacles include the lack of training and understanding of the Mapenaling material among officers, time constraints, and inadequate resources. As a result, the program has not fully succeeded in shaping inmate behavior in accordance with the rehabilitation goals. The conclusion of this research underscores the need for improvements in the implementation of Mapenaling, including increased training for officers and adjustment of procedures to be more relevant to field conditions. It is hoped that with evaluation and adjustments, Mapenaling can become a more effective instrument in the inmate rehabilitation process at the Class IIA Purwokerto Correctional Facility. Abstract

This study aims to analyze the management of the independence coaching program at the Narcotics Correctional Institution Class IIA Gunung Sindur. The background of this research focuses on the process of fostering independence, which has just undergone nomenclature from a special prison that focuses on spiritual guidance to a narcotics prison that provides guidance that provides independence guidance for the provision of prisoners when they have finished serving their sentence following Correctional Law No. 22 of 2022. The research method used is qualitative and descriptive, which involves in-depth interviews and documentation studies to collect data from officers and prisoners. The results showed that the coaching program has been running according to the established guidelines, although there are still challenges in terms of the availability of resources, facilities, regulations, and the interest of prisoners. In terms of coaching facilities, this study recommends motivating prisoners and continuous training for officers and prisoners so as not to rely on third parties to maintain the quality and effectiveness of self-reliance coaching. Abstract

This research aims to analyze the pattern of coaching prisoners based on Papuan culture and local wisdom in the Class IIA Abepura prison. The method used in this research is descriptive qualitative, with an observation, interview, and documentation approach. The research results show that the development program at the Class IIA Abepura Prison includes two main categories: the Personality Development Program and the Independence Development Program, which focuses on local cultural values ​​as a means of rehabilitation and reintegration. Local culture and wisdom are proven to play an important role in increasing inmates' involvement, identity, and motivation to change. However, challenges such as cultural diversity, limited resources, resistance, and lack of coordination become obstacles in implementing the program. To overcome these challenges, strategic steps such as staff training, increased collaboration, and the development of evaluation metrics are needed. The research conclusions confirm the importance of a culture-based approach to increase the effectiveness of development programs and support the reintegration of prisoners into society. Abstract

This study evaluates security management in preventing security disruptions after an earthquake at Class IIB Cianjur Correctional Facility. The November 2022 earthquake damaged the facility's infrastructure, increasing risks such as inmate escapes, riots, and contraband smuggling. Using a qualitative method, the research found that strict surveillance, patrols, access restrictions, and technology such as CCTV effectively prevented disruptions. However, challenges like staff shortages and coordination during renovation hindered optimal oversight. Overall, security management responded well, though improvements are still needed. Abstract

This study examines the implementation of the Pesantren Kilat (short-term Islamic boarding school) program during Ramadan to develop the personality of prisoners at Class IIA Bengkulu Penitentiary. This research employed a qualitative method, collecting data through field observations, interviews, and literature studies. Data analysis was conducted using data reduction techniques and the NVIVO 12 software to identify themes and keyword frequencies such as "pesantren" and "penitentiary." The findings revealed that the program was well-structured, involving students, instructors, and a clear schedule, despite challenges related to limited human resources within the penitentiary. However, the involvement of external instructors ensured the smooth operation of the program. The results indicate a high level of enthusiasm among prisoners in participating in the program to deepen their understanding of Islam. The Pesantren Kilat-based coaching was effective in enhancing their religious comprehension and behavior, though challenges such as the lack of voluntary participation from some prisoners were observed. This program is expected to be an effective step in facilitating positive character development and reducing recidivism, enabling prisoners to become better individuals and contribute to society after completing their sentences. Abstract

This study aims to evaluate the quality of healthcare services provided in Pematangsiantar Class IIA Penitentiary and to identify potential optimization efforts. Employing a qualitative approach, this research involved observations, interviews, and document analysis. The findings indicate that, overall, the healthcare services in the penitentiary have met minimum standards. The dimensions of reliability and responsiveness were assessed as fairly good, reflected in the availability of healthcare personnel and the speed of response to inmate needs. However, several aspects require improvement, particularly related to the dimensions of tangibles (facilities and equipment), assurance (quality assurance), and empathy (care). Limitations in facilities and infrastructure, as well as the need to enhance staff capacity in providing more personalized services, are the main challenges. This study suggests the need for increased investment in healthcare facilities, ongoing training for staff, and active involvement of inmates in the evaluation and improvement of services. Abstract

This study aims to evaluate the effectiveness of using the fingerprint system for residential room roll call in the Prisoner Block at the Class IIA Sidoharjo Penitentiary, which is designed to improve the security of the prisoner block, avoid head swapping between prisoners, and assist officers in accelerating the implementation of the inmate roll call. This study uses a qualitative method with an observation approach, document study, and in-depth interviews with the head of the prison security unit, head of the security squad, prison security unit staff, members of the guard squad, and two prisoners. The results of this study indicate that the fingerprint system is generally effective in identifying prisoners and accelerating the implementation of the residential room roll call. The time required for the residential room roll call was significantly reduced, and the incidents of illegal room transfers decreased. However, there are still some technical obstacles that cause identification failures and a lack of machines, so that use is still uneven. In addition, this system is considered less responsive to the increase in the number of prisoners and still requires routine maintenance. From an innovation perspective, the fingerprint system was well received by officers and management because it provided significant relative advantages over manual methods. Although the system was initially considered complicated, after training, officers were able to operate it well. The success of the system was also easily observed through increased inmate compliance with roll call rules and decreased incidents of violations.
