Abstract

Pembahasan tentang iddah sudah ada dan dikenal sejak zaman pra Islam. Kemudian setelah masuk Islam, iddah dilanjutkan karena bermanfaat bagi kelangsungan hidup istri dan suami. Kemudian secara perlahan ajaran Islam datang melakukan perubahan yang cukup mendasar, Islam datang dengan mencari adanya hak-hak perempuan terkait Iddah. Iddah bagi laki-laki (syibhul 'iddah) menjadi fokus utama dalam pembahasan tulisan ini. Sedangkan dalam konsep maqashid al-syariah, penulis berpendapat bahwa penerapan syibhul 'iddah merupakan kewajiban yang harus dijaga keberadaannya, berdasarkan kemaslahatan yang melatarbelakangi penetapannya dalam konsep kesetaraan dan perlindungan gender. hak perempuan. Penerapan iddah bagi laki-laki tidak berarti melanggar dan menciptakan hukum Islam yang baru. Padahal, pelaksanaan iddah bagi laki-laki ditujukan pada semangat pelaksanaan syariat Islam yang mempertimbangkan aspek kemaslahatan, khususnya dalam rangka memelihara keturunan (hifzh al nasl).

Abstract

The fiqhiyah rule “al-'Adatu muhakkamah” (customs can be used as a source of law) is one of the important principles in Islamic law. This research aims to examine fiqhiyah rules related to customs and their application in community life. The method used is library research by collecting data from fiqh books, ushul fiqh books, journals, and related articles. The results show that customs can be accepted as a source of law if they meet certain conditions, such as not contradicting the nash (Al-Quran and Hadith), generally applicable, reasonable, and bring benefit. The application of this rule is found in various aspects of life, such as dress customs, marriage traditions, economic transactions, worship procedures, and local traditions. This study concludes that the rule of “al-'Adatu muhakkamah” shows the flexibility of Islamic law in accommodating the positive values of local culture, as long as it does not deviate from the basic principles of religion, emphasizing Islam as a religion of rahmatan lil 'alamin.

Abstract

This study aims to analyze the legal protection for wives in murder cases from the perspectives of Islamic law and positive law. In the context of Islamic law, the principle of justice governs the rights of wives, including protection against domestic violence. However, the implementation of this principle in judicial practice still faces various challenges. On the other hand, Indonesia's positive law, despite regulating women's protection through the Law on the Elimination of Domestic Violence (UU PKDRT), also encounters obstacles in effective law enforcement, particularly in cases of violence resulting in murder. This study also discusses the comparison of sanctions imposed on perpetrators of wife murder in both legal systems, highlighting significant differences in the determination and implementation of penalties. Additionally, this research identifies major challenges in law enforcement, such as the lack of gender sensitivity among law enforcers and the limited access victims have to effective protection. The proposed policy recommendations include strengthening regulations on wife protection, enhancing the capacity of law enforcement officers, and expanding access to legal and psychological services for victims. This study contributes to the development of a more responsive legal policy for women's protection.

Abstract

The final project in the form of a thesis is a requirement for obtaining a bachelor's degree and testing students' procedural skills, readiness, and learning outcomes. This study aimed to identify the obstacles faced by female students and their solutions in completing the thesis in the Comparative Mazhab Study Programme at STIBA Makassar in the 2022/2023 academic year. The research questions raised are: What are the obstacles and solutions for female students in completing the thesis in the Comparative Mazhab Study Programme at STIBA Makassar in the 2022/2023 academic year? This field research uses a qualitative approach with data collected through observation and questionnaires. The results showed that the main obstacles female students faced in completing the thesis were dominated by internal factors. These internal factors have a more significant impact than external factors. The main internal barriers include difficulties in mastering the thesis material, challenges in translating Arabic literature into Indonesian, and problems in mastering the Indonesian spelling system (EYD). External factors include a lack of understanding of STIBA's scientific writing guidelines, incomplete references to STIBA's women's library, and the activeness of supervisors. Solutions to these problems include supervisors directing students to focus on their research topics, encouraging them to read more, using dictionaries, and utilizing current technology. Additionally, academic institutions should impose strict deadlines to motivate students to complete their theses on time and ensure that supervisors provide adequate guidance and supervision. This study concludes that internal factors significantly hinder female students from completing their theses on time. Addressing these issues through better guidance and stricter deadlines can help to overcome these barriers

Abstract

The accompaniment strategy for muallaf (new converts to Islam) in understanding and practicing Islamic teachings plays a crucial role in building their Islamic identity. This program aims to provide guidance in reading the Qur’an using the Iqro’ method and to introduce fundamental Islamic values to muallaf in Tembilahan, Indragiri Hilir Regency. With a systematic approach tailored to individual needs, this program is expected to enhance the muallaf’s ability to read the Qur’an, strengthen their understanding of Islam, and offer the necessary social support during their adaptation process. The results of this community service activity successfully delivered effective guidance for muallaf in reading the Qur’an through the Iqro’ method and reinforced their comprehension of basic Islamic principles

Abstract

The era of disruption 5.0 is an era of massive development of information technology. Able to change culture, lifestyle patterns, family order quickly, the changes that occur tend to make family life unstable, not sustainable, differences in attitudes, changes in lifestyle, commitment as an external attack due to cultural shifts so that family life is unable to survive, increasing divorce rates, violence in the family. Generally, people who have families prioritize kafa'ah in choosing a partner, especially aspects of social status, wealth, career and position. From the existing phenomenon, it is necessary to implement maqasid kafa'ah towards family resilience of the era disrution 5.0 the Fiqh Perspective. The research method used is library research, the using triangulation method by classifying data, presenting and drawing conclusions and analyzing it through content analysis. Finddings reseach: First, it is necessary to choose partner who is as good as aspects of piety and noble morals, leading to realizing a sakinah, mawaddah family life while implementing Islamic values ​​in the family. Abstract

This program aimed to provide Islamic entrepreneurship experience for PAI students through the Ramadhan Stall in Tembilahan. Using practice-based learning, 35 sixth-semester students were divided into seven groups, each receiving IDR 200,000 as initial capital to operate for 20 days. Results showed an increase in understanding of Islamic entrepreneurship concepts from 61.5% to 87.8%, with an average ROI of 22.1%. The implementation of Islamic values reached 90.8%, particularly amanah (94%). Consumer satisfaction was also high (93.6%). This program provided academic, social, and economic benefits, supporting the SDGs, especially Goal 8 (Decent Work) and Goal 4 (Quality Education).
