Abstract

This study aims to analyze the application of the principle of beneficial owners in corporate crimes in Indonesia. The background of this research focuses on the challenges of identifying beneficial owners within corporate structures that are often used to commit crimes, including money laundering and corruption. The method used is normative legal research with a juridical approach, where data is collected from laws and regulations and case studies. The results show that although the principle of beneficial owners has been regulated in positive law, its implementation is still not effective. This is due to a lack of understanding and compliance from corporations as well as weaknesses in supervision by the relevant authorities. This study recommends the need for reforms in regulations and increased supervisory capacity to ensure that beneficial owners can be identified and held legally accountable in cases of corporate crimes.

Abstract

Victims of crime have not received adequate protection from the state, both in physical and economic aspects, including in fulfilling other needs related to their role as witnesses in the criminal justice process. This research aims to analyze the position of crime victims in the criminal justice system in Indonesia, as well as to examine the forms of legal protection for victims and perpetrators of crime based on the principle of equality before the law. The results of the research show that the position of victims in the criminal justice system is still not receiving proportional attention and tends to be neglected, especially in the Criminal Procedure Code and Criminal Code. Nevertheless, some laws and regulations have begun to accommodate the protection of victims, although not yet optimally. In the perspective of the principle of equality before the law, legal protection for victims and perpetrators of crime should be placed equally as legal subjects who have the right to be protected by the legal system, although its implementation is not yet fully ideal.

Abstract

This study discusses the factors that influence and constrain officers in preventing electricity theft in the PLN UP3 Kendari area. In this era, electricity has become a basic necessity for human life, resulting in electricity abuse by PLN customers. This study uses an empirical juridical research method that examines the laws that operate and are applied in society. The results of this study found that the factors causing electricity theft at PLN UP3 Kendari are insufficient electricity supply, electricity payments that are considered too expensive by customers, and the installation of illegal Kwh meters by the installation party. Meanwhile, the obstacles faced by officers in preventing electricity theft are customer resistance and officers who deny their actions, and requests for security from the police with the aim of making activities conducive and effective.

Abstract

Penulisan ini bertujuan untuk memberikan informasi mengenai jaminan perlindungan hukum yang disediakan oleh negara terhadap wanita dengan gangguan jiwa yang menjadi korban tindak pidana kekerasan seksual. Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan terhadap peraturan perundang-undangan yang relevan serta analisis terhadap norma hukum yang berlaku dari berbagai aspek. Hasil penelitian menunjukkan bahwa sejumlah regulasi telah menjadi dasar perlindungan hukum bagi wanita dengan gangguan jiwa, antara lain: Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia; Undang-Undang Nomor 31 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban; Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual; serta Peraturan Pemerintah Nomor 28 Tahun 2024 sebagai pelaksanaan dari Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Selain itu, Indonesia juga telah meratifikasi sejumlah konvensi internasional yang menegaskan komitmen terhadap penghormatan dan perlindungan hak-hak wanita dengan gangguan jiwa. Dalam kasus kekerasan seksual terhadap wanita dengan gangguan jiwa, hakim dituntut untuk menjatuhkan putusan yang seadil-adilnya. Hal ini mempertimbangkan persepsi masyarakat yang kerap menilai bahwa pelaku kejahatan terhadap wanita dengan gangguan jiwa seharusnya dijatuhi hukuman lebih berat. Namun, hal ini menimbulkan persoalan yuridis, mengingat belum terdapat ketentuan perundang-undangan yang secara eksplisit mengatur pemberatan pidana berdasarkan kondisi kerentanan korban. Dengan demikian, pemberian sanksi pidana kepada pelaku kekerasan seksual terhadap wanita dengan gangguan jiwa masih sangat bergantung pada pertimbangan moral dan hati nurani hakim, berdasarkan dampak psikologis maupun sosial yang dialami oleh korban.

Abstract

The purpose of the study is to know juridical analysis of non-fulfillment of the access principle to the legal counsel in theft criminal cases. The type of this research is Normative Legal Research using a Legislative and a Conceptual Approaches. The Public Prosecutor's indictment cannot be accepted as it was made based on an invalid (legally flawed) Investigation Report (BAP) and was not in accordance with the right of due process of law. Legal aid and the defendant must be accompanied by a legal advisor as regulated in Article 56 of the Criminal Procedure Code so that this creates a gap for the legal advisor in filing an exception and the exception becomes the judge's consideration in making a decision that the public prosecutor's indictment is null and void (Null and Void), as for example in the Interim Decision of the Tapak Tuan District Court Number 106/ Pid.B /2019/ PN.Ttn, which is threatened with imprisonment for a maximum of 7 (seven) years in accordance with the provisions of Article 363 Paragraph (1) 4 of the Criminal Code in conjunction with Article 64 paragraph (1) Criminal Code. However, during the investigation process, he was not accompanied by a legal advisor, making the Investigation Report (BAP) being invalid as well as null and void

Abstract

This paper aims to examine the offense of gratification when viewed from normal morals and legal norms. The results of the study show that in essence, the gratification offense is not only contrary to Article 12B of the anti-corruption law as a legal norm, but also violates moral norms. The natural law school believes that the offense of gratification is a violation of moral norms such as the value of justice, while the positivism school considers it a violation of legal norms. Ethically, the offense of gratification is an act that is inappropriate and contrary to public morality. The perpetrators of gratification offenses are driven by the nature of hedonism which only seeks outward pleasure without adhering to moral values that such actions can harm the wider community.
