Abstract

Dispute resolution through mediation is an alternative method outside of court proceedings that offers faster, more efficient, and amicable solutions between parties. Lawyers, as legal professionals, play a crucial role in assisting clients or acting as mediators in the mediation process. This study aims to analyze the strategic role of lawyers in mediation and the effectiveness of their involvement in peacefully resolving disputes outside the judiciary. The research uses a normative juridical method with a statutory and literature approach. The results indicate that lawyers are not only legal representatives but can also serve as neutral and professional mediators in accordance with Law Number 18 of 2003 on Advocates and relevant Supreme Court regulations. Their role in mediation contributes to more efficient dispute resolution, reduces the burden on courts, and supports the creation of restorative justice.

Abstract

This study discusses legal protection for customer data security in internet banking systems in Indonesia, especially after the enactment of various related laws and regulations. The purpose of this study is to analyze how legal protection is applied and the legal measures that can be taken by customers if their data is not protected. The research method used is normative legal research with a qualitative approach, through data collection from secondary sources such as laws, legal literature, and official documents. The final findings show that although legal protection has improved with the existence of relevant laws, there are still challenges in its implementation. Customers have the right to file complaints and legal claims in the event of a data breach, which includes complaint procedures with banks and the Financial Services Authority. Compliance with regulations and the principles of legal justice are essential to maintaining public trust in the banking sector.

Abstract

Consumer protection plays a crucial role in the insurance industry due to the complex, long-term, and trust-based nature of insurance products. Consumers are often in a vulnerable position because of limited access to information and a lack of understanding of policy terms, which increases the risk of losses, especially during claim settlement processes. This study aims to analyze the factors that influence the importance of consumer protection in Indonesia’s insurance sector and to examine the role of the Financial Services Authority (OJK) as the regulatory and supervisory body in financial services. The findings indicate that low financial literacy, information asymmetry, and the dominance of standard contracts are key factors that underscore the need for consumer protection. Meanwhile, OJK plays a strategic role through regulation, supervision, dispute resolution, and financial education for consumers. This study concludes that the effectiveness of consumer protection in the insurance sector depends largely on the synergy between strong regulations, consistent supervision, and improved public awareness of consumer rights.

Abstract

Remittances generated by migrant workers, particularly those from Indonesia, play a significant role in supporting the economic stability of households and national economies. However, the magnitude of these contributions contrasts sharply with the limited legal and social protection available to migrant workers. This research examines the key factors underlying the persistent impasse in migrant worker protection policies within ASEAN and explores potential strategies for improvement through a comparative assessment of the European Union experience. Using normative juridical methods that combine conceptual, regulatory, and comparative analyses, the study evaluates ASEAN legal instruments and compares them with the European Union framework for protecting migrant workers. The analysis identifies three main causes of policy stagnation in ASEAN. First, the region lacks binding obligations that require member states to adopt uniform minimum standards. Second, existing enforcement mechanisms are weak and do not ensure consistent implementation. Third, member states resist the establishment of supranational authority, limiting opportunities for stronger regional governance. Despite these challenges, functional adaptation through the selective adoption of European Union practices offers viable options, including harmonizing minimum standards, establishing regional complaint procedures, and facilitating the portability of social rights. The research concludes that a gradual and priority based approach, especially for high risk sectors, can enhance migrant worker protection while remaining consistent with the principles of the ASEAN Way.

Abstract

Penelitian ini membahas bagaimana masyarakat hukum adat diakui dalam sistem hukum di Indonesia, dengan fokus pada perbandingan antara komunitas adat yang sudah mendapatkan Surat Keputusan (SK) pengakuan dan yang belum. Menurut UUD 1945, Pasal 18B ayat (2) dan Pasal 28I ayat (3), negara seharusnya mengakui keberadaan masyarakat hukum adat, tetapi dalam praktiknya, pengakuan ini masih terbatas hanya pada aspek administratif. Penelitian ini menggunakan pendekatan yang kualitatif dengan metode studi kasus dan komparatif di Kabupaten Tapanuli Utara, di mana terdapat Desa Simaradangiang (yang sudah memiliki SK) dan Dusun Hopong (yang belum memiliki SK). Data dikumpulkan melalui pengamatan, wawancara, dan analisis dokumen hukum. Hasilnya menunjukkan bahwa keberadaan SK memberikan pengakuan hukum, perlindungan atas hak ulayat, dan kesempatan bagi masyarakat untuk ikut dalam kebijakan publik. Namun, komunitas yang tidak memiliki SK sering kali mengalami ketidakpastian hukum dan rentan terhadap konflik pertanahan. Berdasarkan teori pengakuan (Honneth) dan pluralisme hukum (Griffiths), pengakuan terhadap masyarakat adat seharusnya lebih dari sekadar bentuk resmi, tetapi harus memiliki makna yang mendalam. Penting untuk mengesahkan Rancangan Undang-Undang Masyarakat Adat untuk memperkuat perlindungan atas hak kolektif dan mencapai keadilan sosial dalam sistem hukum nasional yang beragam.

Abstract

The National Criminal Code's Criminal Law Reform governs criminal offences perpetrated by, for, and on behalf of the Corporation. Concerning Article 48 of the National Criminal Code, the framework of corporate criminal liability has embraced three models: the Corporation as maker and responsible entity, management as maker and responsible party, and the Corporation as both maker and accountable entity. Simultaneously, imposing fines, supplementary punishments, and sanctions within the National Criminal Code exemplifies utilitarian philosophy, integrating distributive and commutative justice. The practical perspective assesses punishment based on its advantages or utility; in this instance, the punishment aims to deter corporations from engaging in similar actions in the future

Abstract

This study examines PT AFC Indonesia and how companies should implement Corporate Social Responsibility (CSR) as a legal mandatory in Indonesia. Law No. 40 of 2007 regulates CSR as a moral responsibility. The purpose of this study is to evaluate how PT AFC Indonesia implements CSR and make recommendations for other companies. A qualitative method was used, which was used to analyze documents and interviews. The results show that PT AFC Indonesia improves the quality of life of the community through CSR programs that improve health services, clean water supply, and educational support. The conclusion is that this CSR implementation enhances the company's reputation and supports sustainable development in Indonesia.

Abstract

Sea transportation plays a very important role in international trade as one of the main components in the process of distributing goods. Nonetheless, the losses incurred in sea transportation activities are often greater than the losses caused by the transportation process itself, such as damage, shortages, and loss of goods that can occur during the process of unloading goods at the port by freight forwarding companies by sea. This study aims to analyze the limits of obligations and legal relationships between freight forwarding companies, carriers, and sea freight forwarding companies in the context of sea transportation activities. Using a normative legal research methodology, this study utilizes legal resources that include relevant laws and regulations as well as applicable court decisions, with a legislative approach and a case approach. The results of this study show that, first, the limitation on the responsibility of the expedition company regulated in Article 87 of the Commercial Code (KUHD), as well as the limitation of the carrier's liability regulated in Article 40 and Article 41 of Law Number 17 of 2008 concerning Shipping, unlawful acts under Article 1365 of the Civil Code, and the responsibility of the sea transportation expedition company in terms of providing convenience, licensing, supervision, and the implementation of order in sea transportation activities, as stipulated in Cassation Decision Number 2665 K/Pdt/2022 which corroborates the decision of the Medan District Court in case Number 728/Pdt.G/2016/PN.Mdn, is in accordance with and includes legal objectives which include legal certainty, justice, and benefits for all parties involved.
