Abstract

This legal paper writing discusses the use of GPS review by online transportation drivers in Sleman Regency. The formulation problem is how to the use of GPS review by online transportation drivers in Sleman Regency. This study uses a normative legal research method supported by interviews with resource persons. Regulations using GPS on online transportation drivers while driving is fulfilling philosophically and juridically. Unfortunately, this arrangement is not sociologically recognized by the community, so it has not to be accepted and implemented. The prohibition of using GPS for online transportation drivers while driving is not optimally implementing. This is because investigators have difficulty in cracking down on online transportation drivers who see GPS while driving.

Abstract

Abstrak: Seiring dengan perkembangan digital, warganet sering kali ikut serta membagikan informasi kecelakaan lalu lintas. Sayangnya, foto dan video yang disebar tanpa sensor justru menimbulkan polemik baru karena meciderai hak atas privasi korban dan keluarga korban. Penelitian ini akan meninjau Tinjauan Hukum Pidana atas Hak Perlindungan Data Pribadi Korban KecelakaanPenelitian ini bertujuan untuk mengetahui perlindungan data pribadi pasien korban kecelakaan lalu lintas saat foto dan atau videonya diambil dan disebarkan. Perlindungan data pribadi korban kecelakaan lalu lintas akan dianalisis berdasarkan Undang-Undang No.17 Tahun 2023 tentang Kesehatan dan Undang-Undang No.27 Tahun 2022 tentang Perlindungan Data Pribadi.Penelitian ini merupakan penelitian hukum normatif. Metodologi penelitian yang dipilih oleh penulis adalah penelitian kepustakaan. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan dan pendekatan konsep, yang berkaitan dengan hukum pidana, hak atas privasi, data pribadi dan korban kecelakaan lalu lintasHasil dari penelitian ini yaitu bahwa Undang-Undang No.17 Tahun 2023 tentang Kesehatan dirasa belum cukup memberikan perlindungan terkait privasi dan data pribadi korban kecelakaan dengan belum adanya peraturan pemerintah yang mengatur sanksi pidana. Perlindungan data pribadi pasien korban kecelakaaan lalu lintas telah diatur secara komprehensif oleh Undang-Undang No.27 Tahun 2022 tentang Perlindungan Data Pribadi. Undang-Undang No.27 Tahun 2022 tentang Perlindungan Data Pribadi dapat mengisi kekosongan hukum berkaitan dengan sanksi pidana hak atas privasi korban kecelakaan yang belum diatur oleh oleh Undang-Undang No. 17 Tahun 2023 tentang Kesehatan.Kata kunci: Hukum Pidana, Hukum kesehatan, Data Pribadi Abstract: Along with digital developments, netizens often share information about traffic accidents. Unfortunately, photos and videos distributed without censorship make new polemics because they harm the privacy rights of victims and their families. This research will review the criminal law review of the personal data protection rights of accident victims.This research aims to determine the personal data protection of traffic accident victims when their photos and/or videos are taken and distributed. The protection of personal data of traffic accident victims will be analyzed based on Law No.17 of 2023 concerning Health and Health Law and Law No.27 of 2022 concerning Personal Data Protection.This research is normative legal research. The research methodology chosen by the author is library research. The approach method used in this research is a statutory approach and a conceptual approach, which relate to criminal law, the right to privacy, personal data, and traffic accident victims.The results of this research are that Law No. 17 of 2023 concerning Health does not provide sufficient protection regarding the privacy and personal data of accident victims in the absence of government regulations governing criminal sanctions. Patient data protection who are victims of traffic accidents has been comprehensively regulated by Law No. 27 of 2022 concerning Personal Data Protection. Law No. 27 of 2022 concerning Personal Data Protection can fill the legal vacuum relating to criminal sanctions for the right to privacy of accident victims which has not been regulated by Law No. 17 of 2023 concerning Health.Keywords: Criminal Law, Health Law, Personal data

Abstract

Christian places of worship have become the most frequently targeted places of worship in Indonesia, with the reported religious discrimination numbers increasing over the past several years, according to reports from the Setara Institute. One of the prominent cases is a prolonged opposition and rejection of the GBI Tlogosari church construction, which lasted from 1998 to 2020. Throughout this period, the involved parties attempted to settle the conflict through various approaches to conflict resolution. This research aims to explore the conflict resolution efforts made particularly by the GBI Tlogosari. Data was collected from diverse sources, including reports from civil society organizations, and analyzed using a qualitative descriptive method. After enduring minoritization and experiencing a situation of de facto rightlessness for more than twenty years, the GBI Tlogosari congregations finally achieved its objective of establishing a church building. Although the initial negotiations with lower-level government officials denied their right to freedom of religion and belief, the subsequent mediations with higher-level government officials proved to be successful. The mediation approach employed by the lower-level officials largely relied on power and authority, whereas the higher-level officials tended to integrate both rights-based and interests-based models.Keywords: minoritization, religious discrimination, freedom of religion and belief, conflict resolution

Abstract

The aim of this study is to analyze the legality of changes to charges by the public prosecutor during the reply stage in the Valencya case in Karawang, focusing on whether such changes are legally valid and their implications for the Indonesian judicial system. The method of research used is a normative juridical approach, which examines the applicable legal regulations and conducts a case study related to changes in charges at the reply stage. This approach also involves an analysis of relevant legal guidelines and procedures in the context of criminal justice in Indonesia. The novelty of this research lies in the analysis of the prosecutor's discretion in changing charges at the reply stage, something that is rarely studied in Indonesian law. This research provides new insights into the practice of changing criminal charges based on considerations of justice and legal morality. The results of the research show that although changing criminal charges to no charges is unusual, it is legally permissible. This provision is regulated in the Attorney General's Office Law and Guideline Book Number 24 of 2021. The amendment of charges was made because the public prosecutor prioritized the principle of justice over legal certainty, taking into consideration truth, conscience, and the values of God Almighty. The Attorney General conducted a special examination of this case because it was considered controversial and had a broad social impact. The conclusion of this study is that although changes to charges at the reply stage are permitted, clearer legal guidelines are needed to regulate the use of prosecutorial discretion. This aims to maintain a balance between justice and legal certainty, as well as to avoid inconsistencies in the application of the law, so that decisions made remain in line with the principles of fair law.

Abstract

Marital rape is a crucial issue in Indonesia and Singapore, influenced by patriarchal culture and legal loopholes. This study aims to analyse the comparison of marital rape laws between the two countries, identifying significant differences in legal systems, definitions, and criminal sanctions. Unlike the Indonesian Criminal Code, which does not explicitly recognize marital rape, Singapore has reformed its laws through the Criminal Law Reform Act 2019 to criminalize such acts. This study finds that Singaporean law can contribute to Indonesia, particularly in terms of arrest procedures, victim protection systems, and the concept of consent. Using a normative-juridical approach with comparative methods, this study provides recommendations for the modernization of Indonesian law, emphasizing the need for more specific regulations and the establishment of special family courts to ensure better protection for victims.

Abstract

The press and freedom of speech play crucial roles in advancing democracy, fostering good governance, and promoting human development globally. However, despite their critical importance, journalists in Indonesia and other nations face escalating violence. This violence encompasses physical, psychological, and even sexual harm, compounded by the legal repercussions imposed by certain laws that potentially criminalize journalistic activities. This paper aims to explore incidents of violence against journalists and analyze specific provisions within Indonesia's existing Penal Code, the Information and Electronic Transactions Act (UU ITE), and the Personal Data Protection Act that could be utilized to criminalize journalists. The application of these laws poses significant threats to press freedom, media impartiality, and the integrity of information dissemination. Using a normative legal approach, this study draws on data derived from existing laws, online resources, research studies, and contemporary literature. Employing a descriptive-qualitative analysis, the findings underscore the prevalence of violence against journalists across Indonesia, with frequent violations of their rights to access information through intimidation, harassment, and various forms of physical and psychological coercion. Furthermore, journalists face potential imprisonment under the provisions of Indonesian laws, exacerbating the climate of fear among media professionals. The implications of these threats include a chilling effect on media freedom, hindering the free flow of information, diverse opinions, and critical ideas essential for an informed citizenry. Addressing these challenges requires robust protections for journalists, stringent adherence to international standards of press freedom, and reforms to ensure that laws safeguard rather than restrict journalistic activities.
