Abstract

Aspek kemanusiaan yang sangat mendasar adalah hak untuk hidup dan hak untukmelangsungkan kehidupannya. Hak akan kemerdekaan dan kebebasan seseorang mencakupmakna dan aspek atau ruang lingkup yang sangat luas. Seseorang bebas menentukan,melangsungkan dan mempertahankan eksistensinya. Lembaga pemasyarakatan (LP)dinyatakan sebagai suatu sistem pembinaan terhadap para pelanggar hukum dan sebagaisuatu pengejawantahan keadilan yang bertujuan untuk mencapai reintegrasi sosial ataupulihnya kesatuan hubungan antara Warga Binaan Pemasyarakatan dengan masyarakat.Tujuan dan kegunaan penulisan ini adalah: (1) mengetahui unsur-unsur yang dapatmempegaruhi pola pembinaan narapidana di LP Kedungpane, (2) mengetahui bagaimanakonsep pembinaan para narapidana untuk memenuhi kebutuhannya, dan (3) mengetahuifaktor-faktor yang menghambat pola pembinaan di LP Kedungpane.Unsur-unsur yang dapat mempegaruhi pola pembinaan narapidana di LP 1 Kedungpanedidasarkan pada: visi, misi, tujuan dan sasaran, kondisi bangunan, penghuni lapas danpetugas Lapas. Konsep pembinaan narapidana untuk memenuhi kebutuhannya yaituberdasarkan, proses pembinaan tahap awal, pembinaan tahap lanjutan dan pembinaantahab akhir. Program pembinaan dan lingkup pembinaan yang terdiri dari pembinaankeprbadian dan pembinaan kemandirian. Faktor yang menghambat pola pembinaandiantaranya terjadinya overcapacity jumlah narapidana di LP Kedungpane dan LPKedungpane bukan LP khusus, misalnya LP Anak, LP tipikor atau LP Narkoba.Kata Kunci : hak asasi manusia (HAM), pembinaan, narapidana, lembaga pemasyarakatan(LP)

Abstract

Aktor intelektual tindak pidana korupsi belum tersentuh dalam penegakaan hukum, dan  mereka  tidak dijadikan sebagai tersangka.  Tujuan tulisan ini akan membahas siapa dan bagaimana peran aktor intelektual dalam terjadinya tindak pidana korupsi, dan faktor-faktor apa yang mempengaruhi  aktor intelektual tidak dimintai pertanggungjawaban pidana.Tulisan ini  bertumpu pada data sekunder, menggunakan analisis  isi (content analysis) berdasarkan pada:   Laporan kronologis,  Surat Dakwaan, Keterangan saksi-saksi, Keterangan Terdakwa, Surat Tuntutan, Pledoi,  Pertimbangan Hakim dan Vonis Hakim.   Pembahasan dalam tulisan ini adalah, Siapakah Aktor Intelektual dan perannya dalam terjadinya tindak pidana korupsi serta faktor faktor yang mempengaruhi aktor intelektual tidak dimintai pertanggungjawaban pidana.  Tulisan ini menyimpulkan, aktor intelektual adalah orang-orang  yang menduduki jabatan sebagai atasan para terdakwa. Yang melontarkan suatu ide yang berakibat  terjadinya suatu  tindak pidana  korupsi Disisi lain adanya diskresi  pidana yang dimiliki oleh aparat penegak hukum

Abstract

Guidance toward the female prisoners in the penitentiary institution is based on: age. sex and the length of the sanction. as well as other criteria or the development needed for the guidance. which requires special treatment. The purposes and importance of this research are: (J) to find out all of the elements that influence . the whole process of the prisoners guidance. (2) to discover all the uncovered needs during the guiding time and also discover the guidance model as an alternative. The method that is used in this research is ridical sociological with the specification of descriptive analysis. Based on the result 0 research and discussion. it can be concluded that the elements which influence the pris ers guidance contains four things: self,family. community and the officer. The all four el ments are connected each other. The needs that are not well accommodated in the implementation of prisoners guidance are: a) The prisoner who do not have any family that ar lling to guarantee. b) The management of stress. depression,fear that are experience Py the prisoners in the time when the prisoners will be free have not been accommodated. uggestion: it is necessary to create an institution and shelter for the ex-prisoners. includng the psychologists. Abstract

Many Indonesian children lost their parents who died because of Covid-19. These children need special protection and have rights that must be fulfilled by governments (either central or local). The aims of this study are to: 1) find out the role of the Semarang City Women's Empowerment and Child Protection Service (DP3A) in carrying out special protection for children whose parents died due to the COVID-19 pandemic and 2) find out the obstacles that are faced by DP3A in implementing this special protection. This research is a non-doctrinal (empirical) legal research and the data used are primary and secondary data. Primary data was obtained through interviews with the Office of Women's Empowerment and Child Protection (DP3A) Semarang City. Secondary data was obtained through literature study related to legal materials according to the research topic. The results of the study demonstrate that the Office of Women's Empowerment and Child Protection (DP3A) has carried out an imperative role in accordance with its duties and functions in accordance with applicable laws and regulations, namely in the field of child protection. The obstacles faced by DP3A are: limited authority and incomprehensive policy.

Abstract

This paper examines the accountability of online criminal case adjudication in Indonesia during the COVID-19 pandemic. Although normal court trials have resumed, the judiciary must prepare for the integration of online trials to improve efficiency and case management. This empirical study employs qualitative methods, collecting data through interviews with judges, prosecutors, and written interviews with lawyers, along with questionnaires. Conducted in three district courts in Central Java, it also incorporates secondary data from legal statutes and literature. Most judges, prosecutors, and attorneys found online trials accountable, with outcomes comparable to in-person hearings. However, challenges persist, such as administrative gaps, and technical disruptions. The study urges legislative action to establish procedural norms for online trials and recommends improving court decisions' quality and quantity to ensure justice.

Abstract

Restorative justice with a diversion approach has been initiated since 2012 following the promulgation of the Juvenile Criminal Justice System Law. After twelve years of this system being implemented how far has it been implemented, 2) what does the law apparatus encounter the obstacles? This research falls into the realm of qualitative research. The research location was determined at the Semarang District Court, Semarang Prosecutor's Office, Bapas, Semarang City Regional Police. Qualitative research is written on the base of primary data and secondary data. Primary data was obtained through interviews with informants and respondents. The study has demonstrated that the application of diversion and restorative justice in resolving juvenile criminal cases is based on Law Number 11 of 2012 concerning the Criminal Justice System and other regulations issued by law enforcement agencies. Diversion is generally carried out using restorative meetings (restorative conferencing). Factors that become obstacles are legal regulations that do not fully and clearly regulate restorative justice and diversion, law enforcement officers who do not understand children's rights, lack of understanding from families and communities, and lack of facilities and infrastructure to support the Juvenile Criminal Justice System Law. The implementation of diversion and restorative justice must be based on the principles of the child's rights.

Abstract

Indonesia kaya sumber daya genetik dan pengetahuan tradisional yang dimanfaatkan untuk obat tradisional. Sebagai salah satu Negara yang kaya SDG, maka Indonesia telah meratifikasi Konvensi Keanekaragaman Hayati dan Protokol Nagoya dalam Undang-Undang No. 5 Tahun 1994 dan Undang-Undang No. 11 Tahun 2013. Berkembangnya bioteknologi saat ini, menarik minat peneliti asing maupun pelaku usaha untuk mengembangkan obat tradisional menjadi komoditas bernilai ekonomi. Hal ini harus diantisipasi oleh Pemerintah, agar tidak menimbulkan dampak negatif berupa punahnya SDG, perpindahan SDG di luar kendali baik dalam maupun ke luar negeri, dan ketidakadilan masyarakat lokal. Pemerintah Jawa Tengah yang memiliki potensi SDG bertanggung jawab untuk melindungi kelestarian SDG beserta pengetahuan tradisional dengan tetap memberikan keleluasaan pemanfaatannya sesuai kewenangannya berdasarkan Undang-Undang No. 32 Tahun 2009 dan Undang-Undang No. 23 Tahun 2014.

Abstract

The press and freedom of speech play crucial roles in advancing democracy, fostering good governance, and promoting human development globally. However, despite their critical importance, journalists in Indonesia and other nations face escalating violence. This violence encompasses physical, psychological, and even sexual harm, compounded by the legal repercussions imposed by certain laws that potentially criminalize journalistic activities. This paper aims to explore incidents of violence against journalists and analyze specific provisions within Indonesia's existing Penal Code, the Information and Electronic Transactions Act (UU ITE), and the Personal Data Protection Act that could be utilized to criminalize journalists. The application of these laws poses significant threats to press freedom, media impartiality, and the integrity of information dissemination. Using a normative legal approach, this study draws on data derived from existing laws, online resources, research studies, and contemporary literature. Employing a descriptive-qualitative analysis, the findings underscore the prevalence of violence against journalists across Indonesia, with frequent violations of their rights to access information through intimidation, harassment, and various forms of physical and psychological coercion. Furthermore, journalists face potential imprisonment under the provisions of Indonesian laws, exacerbating the climate of fear among media professionals. The implications of these threats include a chilling effect on media freedom, hindering the free flow of information, diverse opinions, and critical ideas essential for an informed citizenry. Addressing these challenges requires robust protections for journalists, stringent adherence to international standards of press freedom, and reforms to ensure that laws safeguard rather than restrict journalistic activities.
