Abstract

In a case of a dispute between an islamic bank and a customer related to multi-service financing using an ijarah contract at an islamic bank, the customer is suing for the cancellation of the contract on the multi-service financing on the grounds that the object of the contract is not the object of the contract, so the contract should be null and void. However, the court decision stated that he rejected the customer's claim. This research was conducted to examine the application of sharia principles in legal considerations in court decisions regarding contract objects in multi-service financing using the ijarah contract. This research is a normative legal research using the statutory approach method. The results of this study indicate that the legal considerations in court decisions regarding the object of the contract in multi-service financing using the ijarah contract are formally correct, but materially there is still a possibility of gharar that is not in accordance with sharia principles.

Abstract

Abstrak Jaminan fidusia dalam akad murabahah diperbolehkan agar nasabah serius dalam pesanannya, sehingga nasabah akan melaksanakan pembayarannya kepada lembaga keuangan atas barang yang telah dipesan. Sesuai dengan Pasal 11 Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia, setiap benda yang dibebani jaminan fidusia wajib didaftarkan. Namun dalam praktiknya, masih ada jaminan fidusia yang tidak didaftarkan. Penelitian ini dilakukan untuk mengetahui perlindungan hukum bagi pemegang jaminan fidusia dalam akad murabahah yang jaminan fidusianya tidak didaftarkan. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan metode pendekatan perundang-undangan. Hasil penelitian ini menunjukkan bahwa tidak ada kepastian dan perlindungan hukum bagi pemegang fidusia apabila jaminan fidusia tersebut tidak didaftarkan. Kata kunci: Akad Murabahah, Jaminan Fidusia, Perlindungan Hukum Abstract Fiduciary guarantees in murabaha contracts are allowed so that customers are serious about their orders, so they will carry out payments to financial institutions for goods that have been ordered. In accordance with Article 11 of Law Number 42 Year 1999 concerning Fiduciary Collateral, every object charged with fiduciary collateral must be registered. But in practice, there are still fiduciary guarantees that are not registered. This research was conducted to determine the legal protection for fiduciary holders in murabahah contracts whose fiduciary guarantees were not registered. This research is a normative legal research using the legislative approach method. The results of this study indicate that there is no certainty and legal protection for fiduciary holders if the fiduciary guarantee is not registered.

Abstract

The rapid development and advancement of technology is a matter that has a major impact on social change in today's society. Communication and information technology has been transformed into a community need and its presence has been integrated with the life of the community itself. As a result of the development of communication and information technology, it can be said that there are no more boundaries as a result of the flow of information. The development and advancement of technology brought many changes in the social fabric of society. These changes unconsciously brought society into a new era known as the era of disruption. Disruption filled with new innovations brings society to a new social order that is very different from what has happened before. The development of disruption in the technology sector poses a challenge in itself to the application of the law. The new innovations that appear in the era of disruption are very new and different, so that there must be a struggle between law and disruption itself. This paper will discuss the sociological view of law on technological disruption. Where in the end the law itself has not been able to position itself in the midst of the current of disruption.

Abstract

This article examines the presence of independent agencies that perform executive functions within Indonesia’s constitutional system as a normative critique of post-reform institutional design. The article discusses the concept of the Unitary Executive Theory, which developed in the United States as an adherent of a pure presidential system, the position of the President under the 1945 Constitution of the Republic of Indonesia, as well as the relevance and operationalization of this theory within the context of Indonesia’s constitutional system. The research employs a normative legal approach using four methodologies: the statutory approach, the conceptual approach, the comparative approach, and the historical approach. The conclusion of this article is that the 1945 Constitution of the Republic of Indonesia contains a sufficient constitutional basis for the application of the Weak Unitary Executive Theory; therefore, institutions performing executive functions should be under the President’s chain of command to ensure presidential accountability and consistency.

Abstract

Kekerasan terhadap perempuan dan anak masih menjadi permasalahan serius di Indonesia, termasuk di Kota Kupang yang menunjukkan angka mengkhawatirkan dengan 138 kasus pada perempuan dan 119 kasus pada anak pada tahun 2023. Komunitas pemulung sebagai kelompok rentan menghadapi risiko lebih tinggi akibat keterbatasan ekonomi, rendahnya akses pendidikan, serta kuatnya norma sosial yang permisif terhadap kekerasan. Kondisi ini diperparah oleh fenomena underreporting yang menyebabkan banyak kasus tidak terungkap ke permukaan. Oleh karena itu, diperlukan intervensi edukatif yang mampu meningkatkan kesadaran dan pemahaman secara langsung pada komunitas.  Kegiatan pengabdian kepada masyarakat ini dilaksanakan pada 17 Desember 2024 dengan jumlah peserta sekitar 40 orang dari komunitas rentan di Kota Kupang. Metode yang digunakan adalah pendekatan partisipatif-kualitatif melalui Focus Group Discussion (FGD) dan edukasi interaktif yang melibatkan simulasi serta media audiovisual. Evaluasi dilakukan menggunakan instrumen pre-test dan post-test untuk mengukur perubahan pemahaman peserta. Hasil kegiatan menunjukkan adanya peningkatan signifikan pemahaman peserta, dengan skor rata-rata meningkat dari 56,25 menjadi 82,50 atau sebesar 46,7%. Peserta mampu mengidentifikasi empat bentuk kekerasan, yaitu fisik, seksual, psikologis, dan ekonomi, serta memahami dampak multidimensional yang ditimbulkan. Selain itu, terjadi peningkatan partisipasi aktif hingga 70%, yang mencerminkan tumbuhnya keberanian, empati, dan solidaritas dalam komunitas. Akses informasi terkait mekanisme pelaporan dan layanan perlindungan juga meningkat secara signifikan. Meskipun demikian, perubahan pada aspek struktural seperti norma sosial dan tekanan ekonomi belum menunjukkan pergeseran yang berarti dalam jangka pendek. Dengan demikian, kegiatan ini efektif sebagai langkah awal transformasi kesadaran, namun memerlukan intervensi berkelanjutan untuk menghasilkan perubahan sosial yang lebih luas.

Abstract

This study examines how subrogation functions within the Credit Guarantee mechanism of a government-backed microcredit program in Indonesia (Kredit Usaha Rakyat) as a tool for protecting banks’ legal interests in cases of non-performing loans. Although subrogation is formally regulated under the Indonesian Civil Code, the practice of KUR credit guarantees demonstrates that subrogation is often narrowly understood as merely an administrative consequence of guarantee claim payments. This situation arises because KUR guarantees cover only a portion of the credit risk, resulting in a partial transfer of receivables and creating legal complexities in the relationships among banks, debtors, and credit guarantee institutions. Using a normative legal research approach through the examination of the Indonesian Civil Code, regulations governing the KUR program guarantee scheme, and the prudential principle in banking law, this study finds that subrogation in KUR guarantees is inherently partial and possesses a strategic function that has not yet been fully optimized. Partial subrogation not only facilitates the transfer of receivables but also serves as a proportional and layered legal protection mechanism for banks in resolving non-performing loans. This study emphasizes that the systematic integration of subrogation within the legal framework of a government-backed microcredit program in Indonesia (Kredit Usaha Rakyat) guarantee scheme has the potential to strengthen the legal protection of banks’ interests while supporting the stability of government- backed credit distribution.   Keywords: Subrogation; KUR; Credit Guarantee; Legal Protection of Banks.
