Abstract

Pemilu di Indonesia harus dilaksanakan secara tertib dan bersih sesuai yang diatur dalam Undang-Undang No. 7 tahun 2017 tentang Pemilihan Umum, yang melarang praktik politik uang atau “money politic”, meskipun hal ini sering terjadi karena banyaknya peserta pencalonan. Penelitian ini kemudian membahas bagaimana pengaturan tindak pidana menjanjikan atau memberikan uang dalam Undang-Undang No. 7 tahun 2017 tentang Pemilihan Umum, dan bagaimana kajian pertimbangan hukum hakim melalui studi kasus Putusan No. 184/PID.SUS/2019/PT. MKS.  Penelitian ini menggunakan metode penelitian normatif melalui pendekatan peraturan perundang-undangan, literatur dan bahan ilmiah lain.  Hasil penelitian ini menunjukkan bahwa terdapat kelemahan dalam rumusan pasal-pasal yang mengatur tindak pidana pemilu politik uang, dan potensi timbulnya ketidakpastian hukum dalam putusan bebas terkait. Semestinya dalam perumusan sanksi dalam pasal terkait menjanjikan atau memberikan uang mencantumkan ketentuan minimum dalam pidana pokoknya, yaitu pidana penjara dan denda agar permasalahan tidak terjadi dalam praktek. Melalui kajian teori, pertimbangan hakim dalam Putusan No. 184/PID.SUS/2019/PT. MKS dirasa kurang tepat. Maka dari itu, perlu adanya perkembangan dan perbaikan dalam menegakkan hukum di kala maraknya politik uang di Indonesia.  Maka dari itu, diperlukan  pembaharuan regulasi Pemilu yang jelas (lex certa) dan tegas (lex stricta).

Abstract

The crime of sexual violence in Indonesia is increasing every year. Criminal penalties for perpetrators of sexual violence as stated in the Penal Code and Child Protection Act were considered ineffective until the Government issued The Replacement Government Regulation No. 1 of 2016 that applies criminal sanctions to perpetrators of sexual violence among others by chemically applying castration. This is the background to conducting normative research on the policy of chemicalbirth sanction formulations that apply in Indonesia today. His arrangement of chemical castration and rehabilitation as an additional punishment, to date has not been published, so the mechanisms and technicalities are unknown. In addition, interested sectors are not involved in the establishment of such rules resulting in rejection as executors.

Abstract

Since the publication of The Substitute Government Regulation (PERPU) No. 1 of 2016 on the second Amendment to Law No. 23 of 2002 on Child Protection, two cases have been decided given chemical castration measures. However, until now the process of funding / sanctions has not been implemented even though it has the power of law anyway. Due to the absence of institutions willing to do so, including Ikatan Dokter Indonesia who felt the sanction was an act that violated the Health Law, as well as the act of chemical castration is seen as retaliation for its actions that of course deviate from the original purpose of funding. This is the background to conducting normative research on the policy of chemicalbirth sanction formulations that apply in Indonesia in the future. This research uses normative research methods, to find the right formulation of sanctions for perpetrators of sexual crimes. The discussion of criminal formulation policy regarding chemical castration as punishment becomes very necessary, seeing its leading sector refuse to be an executor. The act of chemical castration into treatment or treatment of the perpetrator is a solution that can be provided, in line with the statement from ikatan dokter Indonesia, pedophilia is a sexual disorder that occurs due to psychological disorders.

Abstract

The establishment of the Daya Anagata Nusantara Investment Management Agency (Danantara) through Law No. 1 of 2025 represents a strategic initiative by the government to integrate state assets and strengthen the national economic structure in pursuit of Golden Indonesia 2045. With direct presidential authority and initial capital of at least IDR 1,000 trillion, Danantara holds a strong and independent institutional position. However, this institutional design raises serious concerns, particularly regarding the oversight system in fund and budget management. Given the inherent and sometimes unpredictable risks of investment activities, questions arise as to how Danantara implements its programs within the framework of the latest State-Owned Enterprises (BUMN) law and what potential corruption risks may emerge. This study employs a normative juridical method using Lawrence M. Friedman’s legal system theory and Syed Hussein Alatas’s theory of corruption to analyze Danantara’s supervisory structure and legal accountability. It further examines the legal protection provisions within Danantara’s framework, the role of individuals involved, and the mechanisms of public accountability. The findings are expected to contribute to the development of a more comprehensive oversight system for state asset management and to reinforce anti-corruption principles in public investment institutions.

Abstract

This study aims to examine the effects of product, price, and service quality on consumers’ shopping interest at Pasar Bersih Telaga Mas, North Bekasi, while also formulating marketing strategies that reflect actual field conditions. A quantitative approach was employed, with data collected through questionnaires administered to 60 respondents. The data were analyzed using multiple linear regression to assess both partial and simultaneous relationships among variables. The findings indicate that product and price have a positive and statistically significant effect on consumers’ shopping interest, with product emerging as the most dominant variable. In contrast, service quality does not exhibit a significant effect. Simultaneously, all three variables significantly influence shopping interest, as reflected in a high coefficient of determination, indicating that the model accounts for a substantial proportion of the variation in consumer interest. These results suggest that improving product quality and variety, along with maintaining competitive and consistent pricing, constitutes the primary basis for enhancing consumer interest. The study is expected to provide practical considerations for market management in formulating more targeted and contextually grounded marketing policies and strategies.

Abstract

The rapid advancement of digital technology has enabled seamless global communication, yet it simultaneously heightens the risk of personal data breaches. A salient example is the Facebook data incidents between 2018 and 2021 which affected millions of Indonesian users and revealed systemic weaknesses in data governance. Earlier regulatory instruments, particularly the Information and Electronic Transactions Law (UU ITE), provided limited remedies and made accountability for data controllers difficult to enforce. This study examines legal protections for personal data and the legal liability of Meta through a normative juridical method integrating statutory, conceptual, and case-based analyses using descriptive secondary data. The analysis focuses on key provisions of the Personal Data Protection Law, including Article 17, which guarantees data subject rights to access, correct, and delete their data; Article 18, which obliges controllers to implement adequate security measures to prevent breaches; Article 58, which establishes supervisory authorities to ensure compliance; and Article 75, which imposes administrative sanctions as a deterrent. These provisions collectively strengthen legal certainty for victims and address deficiencies in prior regulations by compelling global digital platforms to adopt higher compliance standards. In conclusion, the Personal Data Protection Law constructs a comprehensive protection regime by affirming user rights and enforcing sanctions effectively.

Abstract

Professionalism in law enforcement plays a role in establishing justice, legal certainty, and public trust. However, law enforcement practices in Indonesia reveal disparities between normative legal provisions and their implementation in society. This study aims to analyze the professionalism of law enforcement officers from the perspective of sociology of law and to examine its implications for the legitimacy of law enforcement institutions. The research employs a socio-legal method by integrating normative analysis with the examination of realities in law enforcement practices. The study applies statutory, conceptual, and sociological approaches to evaluate how professionalism influences the legitimacy of law enforcement. The findings demonstrate that professionalism in law enforcement extends beyond technical competence and procedural compliance. It also encompasses integrity, ethical responsibility, independence, accountability, and sensitivity toward values within society. Weak professionalism among law enforcement officers often results in disproportionate enforcement, discriminatory treatment, abuse of discretion, and inconsistency in applying legal norms. These conditions contribute to declining public trust and weakening institutional legitimacy. From the perspective of sociology of law, legal legitimacy is not derived solely from state authority, but also from public acceptance of how laws are implemented fairly and effectively in practice. This study concludes that strengthening the professionalism of law enforcement officers is an essential prerequisite for creating legitimacy and law enforcement. Improving professionalism should not only focus on legal reform but also on strengthening legal culture, professional ethics, and institutional accountability mechanisms in order to achieve justice and maintain public confidence in the rule of law.
