Abstract

The concept of green tourism is a debate in its implementation. This concept puts forward the sustainability of an event based on Balinese cultural environmental law in supporting sustainable development. This is in line with the Roadmap for Leading Research Center for Research and Community Service (P3M) of Warmadewa University, namely the Environment with the topic of Ecotourism research based on environmental law. The concept of a tourism village is a form of community-based tourism that aims to improve the welfare of the people in the area. Miles and Huberman's model was used as data analysis. A SWOT analysis was also carried out to determine the potential of a tourist village in terms of three pillars, namely the concept of green, law, and culture. Currently, most of the tourist villages in Bali Province have not succeeded in developing properly. One of the problems is that people are confused about applying environmental law and their culture in conducting events. The research aimed to develop a model of green tourism village tourism based on Balinese cultural environmental law to improve environmental law compliance, at the event. This also helps increase the trust of guests in tourist villages because they are legally protected by the products purchased and ultimately have an impact on guests to buy event services, as well as improving people's living standards. This research is to produce a tourism village green tourism model based on Balinese cultural environmental law so that it can increase green reputation as a strategy in increasing tourism village income which leads to the welfare of the surrounding community sustainably. While the additional purpose of the results of this study is to be able to provide recommendations for the Bali provincial government and related parties regarding green tourism in tourist villages.

Abstract

During the globalization era, forest exploitation has become more frequent, one of them is burning land as a cause of rapid reduction in forest area. Forest and land fires caused by human activities can be categorized as legal acts, i.e. those occurrences or events that can trigger legal consequences. Therefore, forest and land burning is not included in ordinary criminal offenses. This research aims to analyze the arrangements for criminal liability for criminal negligence that causes forest and land fires (Ius Constitutum) and to analyze the considerations of the judges for negligence for causing forest and land fires in Decision Number 71/Pid B/LH/2021/PN Snt. The method used is a normative method with a statutory approach, legal concepts and theories. The result of this research is that criminal liability for the causes of forest and land fires can be identified from several legislations that have been established and are applicable at this time, both those committed intentionally and due to negligence, and both those committed by individuals and those committed by corporations. The Judges’ consideration in Decision Number: 71/Pid B/LH/2021/PN Snt, imposed a fine and additional punishment on the defendant that is PT Mega Anugrah Sawit. The judge only recognized the defendant’s guilt due to negligence, while from the facts of the trial there was an element of intent.

Abstract

Penelitian ini mengkaji problematika penerapan asas unus testis nullus testis dalam pembuktian tindak pidana Kekerasan Dalam Rumah Tangga (KDRT). Karakteristik KDRT yang terjadi di ruang privat menyebabkan korban kerap menjadi satu-satunya saksi, sehingga menimbulkan ketegangan antara kepastian hukum dan perlindungan korban berdasarkan UU Nomor 23 Tahun 2004. Penelitian ini bertujuan menganalisis penerapan asas tersebut dalam sistem pembuktian pidana Indonesia serta dampaknya terhadap akses keadilan bagi korban. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa sistem pembuktian Indonesia menganut negatief wettelijke bewijstheorie, yang mensyaratkan minimal dua alat bukti sah dan keyakinan hakim. Dalam perkara KDRT, keterangan satu saksi korban tetap memiliki kekuatan pembuktian apabila didukung alat bukti lain yang sah, sehingga penerapan asas unus testis nullus testis tidak dapat dilakukan secara kaku dan formalistik. Penelitian ini menyimpulkan bahwa diperlukan pendekatan interpretatif yang progresif agar tercapai keseimbangan antara kepastian hukum dan perlindungan hak asasi korban KDRT.

Abstract

Purpose: This study analyzes the legal regulation of foreign nationals within the Indonesian legal system and the sanctions imposed on them as perpetrators of online lending activities. Research Methodology: This research employs a normative legal approach using statutory, conceptual, and case analyses. Legal materials are examined qualitatively through literature review and deductive reasoning. Results: The findings show that foreign nationals are recognized as legal subjects under the principle of territorial jurisdiction and are subject to Indonesian law when conducting legal acts within its territory. Sanctions for involvement in online lending may include civil liability for breach of contract and unlawful acts under the Civil Code, criminal penalties, and administrative measures such as immigration sanctions. Conclusions: Indonesian positive law provides a sufficient legal framework to impose civil, criminal, and administrative sanctions on foreign nationals engaged in online lending. However, enforcement remains limited by practical constraints. Limitations: This study focuses on existing regulations and court decisions and does not examine international legal cooperation mechanisms in depth. Contributions: This study contributes to the literature by offering an integrated analysis of the legal position of foreign nationals in Indonesia’s online lending regulation.
