Abstract

Permasalahan yang menjadi fokus penelitian ini adalah bagaimana risiko bagi pekerja anak dibawah umur dan bagaimana hak-hak anak dan perlindungan hukum bagi pekerja anak berdasarkan Undang-undang tentang Ketenagakerjaan dan Undang-undang tentang Perlindungan Anak. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif yaitu penelitian dengan menerangkan ketentuan-ketentuan dalam peraturan perundang-undangan yang berlaku tersebut. Hasil penelitian menunjukkan bahwa Undang-Undang Ketenagakerjaan dan Undang-undang Perlindungan Anak menjadi payung hukum bagi pekerja anak. Strategi mengatasi permasalahan pekerja anak dapat dilakukan melalui proses penyadaran, penyediaan program antara (intermediate program) guna menjembatani antara proses penyadaran dan penghapusan pekerja anak, serta proses eliminasi pekerja anak yang dimulai dari penghapusan sektor-sektor kerja terburuk.

Abstract

Permasalahan dalam penelitian ini adalah bagaimana mekanisme prosedur hukum acara dalam penyelesaian sengketa tentang merek terkenal “Sephora” dan pembuktian perkara hak atas kekayaan intelektual di Pengadilan Niaga berdasarkan HIR dan apakah Putusan Pengadilan Niaga No.34/Pdt.Sus.Merek/ 2015/PN.Niaga.Jkt.Pst tentang pelanggaran merek terkenal “Sephora”, telah sesuai dengan prinsip-prinsip hukum merek yang diatur dalam TRIPs dan Undang-undang Nomor 15 tahun 2001 tentang Merek. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dan yuridis komparatif. Hasil penelitian menunjukkan bahwa pemilik merek terdaftar dan/atau penerima lisensi merek terdaftar dapat mengajukan gugatan terhadap pihak lain yang secara tanpa hak menggunakan merek yang mempunyai persamaan pada pokoknya atau keseluruhannya untuk barang dan/atau jasa yang sejenis berupa gugatan ganti dan/atau penghentian semua perbuatan yang berkaitan dengan penggunaan merek tersebut.

Abstract

Brand is a sign in the form of pictures, names, words of letters, numbers, arrangement of colors, or combinations of those elements which have distinguishthing power and are used in goods or service trade activities. The terms in the brand, especially regarding the protection of famous brands, can actually be applied in the case of domain names. "There is a provision in the TRIPs that governs the issue of protection of this famous brand, and the public becomes bound by the provision because it has been ratified". The meaning is Article 16 (3) TRIPs (Trade Related Aspect of Intellectual Property Rights). Article 16 (3) states that Article 6 bis of the Paris Convention on Protection of Industrial Property Rights shall apply, mutatis mutandis to goods and services which are not similar to goods and services to which a trademark has been registered.

Abstract

Reconvention can be filed in all cases except those which regulated in Article 132a HIR. HIR does not regulate material requirements regarding the substantial connection between convention and reconvention claim. Judicial practice tends to do so, as stated in Court Decision Number 452/Pdt.G/2023/PA JT. The Judges determined to reject the reconvention claim based on the consideration that the reconvention’s claim was closely related to the convention one, so the claim in the reconvention was rejected as the convention’s claim decided to be rejected. This research aims to determine the basis of the reconvention claim regarding the removal of collateral confiscation based on the Civil Procedure Law and determine the legal consequence of the court decision which rejected the reconvention claim regarding the collateral confiscation of dispute object. The results showed that the reconvention claim which requested the implementation of the confiscation of collateral is closely related to the convention one. The reconvention filed basically has fulfilled the regulations in Article 132a and Article 132b HIR. The decision to reject this claim was based on the fact that both claims, convention and reconvention, were closely related, this statement is supported by Jurisprudence Number 1527 K/Sip/1973. The legal consequence of rejecting both claims are that the dispute object is not under collateral confiscation status.

Abstract

The COVID-19 pandemic has significantly impacted the economy worldwide, including Indonesia. In the face of economic difficulties caused by social restrictions and declining demand, many companies have been forced to lay off employees as a last resort to maintain business continuity. This situation is often categorized as Force Majeure, an extraordinary event that cannot be predicted or avoided. Even though termination of employment can be carried out in these situations, applicable laws and regulations must still fulfill workers' rights. This study aims to determine the limitations of the COVID-19 pandemic as a Force Majeure situation and the company's responsibility towards workers laid off during the pandemic. The research method used is normative juridical, which is legal research on positive legal norms, principles, and doctrines with analytical descriptive research specifications that describe the applicable laws and regulations associated with legal theory and the practice of implementing positive law, which are then collected and classified into an orderly and systematic description. The study results show that the COVID-19 pandemic can be considered an urgent or Force Majeure, and companies are relieved to fulfill workers' rights. Still, many companies unilaterally layoff their workers. Protection of workers in these conditions is essential to prevent injustice and ensure social justice for the parties involved

Abstract

Indonesia is a country with a high level of labor-related issues, particularly in relation to the protection and fulfillment of workers’ rights. Common problems include termination of employment, unpaid wages, and inadequate severance payments. One such case is the bankruptcy petition filed against PT. Setiaji Mandiri, which serves as the focus of this study. The objective of this research is to analyze the legal considerations behind the Commercial Court’s decision to grant the bankruptcy request and its implications for labor rights. This study employs a normative juridical method by analyzing relevant legislation and court rulings, particularly referring to Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations, and Law No. 2 of 2004 on Industrial Relations Dispute Settlement. The findings show that PT. Setiaji Mandiri had indeed made efforts to settle its financial obligations, but these efforts were deemed insufficient by the court, leading to the acceptance of the bankruptcy petition. However, a key issue that emerged was the absence of debt registration with the Industrial Relations Court (PHI), which is mandated by law in cases involving employment disputes. According to the prevailing labor laws, the PHI must first determine the amount of severance pay owed to employees, which can then be used as a reference in bankruptcy proceedings. The study concludes that there was a procedural oversight in the handling of labor claims in this bankruptcy case. It emphasizes the importance of adhering to legal mechanisms that protect workers’ rights and recommends stricter coordination between commercial and labor courts to prevent similar issues in the future.

Abstract

This study aims to examine the evidentiary process in lease agreement disputes involving undue influence and to analyze the legal protection afforded to lessees under the Indonesian Civil Code. The research gives particular attention to cases where undue influence is not exerted by the contracting parties themselves but by third parties who intervene in the contractual relationship. This study uses a normative legal research method combining conceptual, statutory, and case analysis, complemented by an empirical component through a structured interview with a District Court judge experienced in lease disputes. Decision No. 8/Pdt.G/2022/PN Mdn was purposively selected as the case study because it directly involves annulment of a lease agreement based on third-party undue influence. The novelty of this study lies in its systematic analysis of undue influence exerted by third parties in lease agreements, an aspect rarely examined in Indonesian legal doctrine and not explicitly regulated under positive law. This contribution fills an academic gap while providing a legal-argumentative framework that integrates doctrinal analysis with judicial practice. The results of this study indicate that third-party undue influence introduces an additional evidentiary burden: claimants must prove the lessee’s vulnerable condition, the deliberate intervention of a third party, and a causal link between that intervention and the lessee’s consent. Furthermore, legal protection for good-faith lessees is reinforced by Civil Code provisions, including Articles 1315, 1320–1321, 1338(3), and 1365, as well as supporting jurisprudence that emphasizes fairness and proportionality in assigning liability. This study concludes that undue influence by a third party can constitute a valid legal ground for annulment of lease agreements and that lessees acting in good faith must be shielded from disproportionate liability. The findings reinforce the judiciary’s duty to uphold substantive justice and provide guidance for courts, policymakers, and contracting parties in safeguarding fairness within Indonesian contract law.

Abstract

Artificial intelligence (AI) is a technology that refers to the simulation of human intelligence programmed into electronic devices to think like humans and mimic human actions. The rapid development of AI has sparked debates in the legal field, particularly when errors occur and cause harm to the public. Currently, Indonesian law does not explicitly regulate legal protection for a party who suffers material or immaterial damages due to errors caused by AI. This research aims to contribute to the development of civil law discourses through a normative and descriptive approach. The data used are secondary data, and a qualitative method is used to analyze and present the data descriptively. The research finds that there are no specific regulations governing liability for material or immaterial damages resulting from AI activities. The conclusion drawn is that AI cannot be considered a legal subject and lacks control over its actions and intent. Therefore, the burden of compensation for errors caused by AI falls on the creators and users of AI, as stipulated under Article 1365 of the Civil Code and Article 1367 of the Civil Code, which states that: "A person is not only liable for losses caused by their own actions but also for losses caused by the actions of those for whom they are responsible or by goods under their supervision."

Abstract

Seringkali masih terdapat gap antara dunia kampus dengan permasalahan yang nyata terjadi di masyarakat. Program pengabdian kepada masyarakat dilaksanakan untuk mensinkronisasikan keduanya. Universitas Padjadjaran memiliki program Pengabdian kepada Masyarakat yang terintegrasi dengan Praktik Kerja Lapangan (PKL) bagi mahasiswa dan magang. Pada periode 2023-2025, tim dari berbagai fakultas yang diketuai oleh Fakultas Hukum, menyelenggarakan pengabdian kepada masyarakat di Desa Ngamplangsari, Kecamatan Cilawu, Kabupaten Garut. Di wilayah ini, terdapat pelaku usaha kuliner lokal asal Garut yang berpotensi meningkatkan perekonomiannya namun masih terkendala dengan belum adanya merek dagang, misalnya. Tim dari Unpad memberikan pendampingan hukum untuk penelusuran hingga pendaftaran merek dagang. Untuk mengatasi permasalahan lingkungan, kegiatan ini berupaya untuk bersama-sama mencari solusi pengemasan pangan dan pengolahan limbah produksi yang ramah lingkungan. Strategi Branding yang menjadi ujung tombak hingga produk kuliner lokal para pelaku usaha tersebut sampai ke tangan konsumen perlu disentuh oleh para antropolog untuk memberikan story-telling. Tim pengabdian masyarakat dan mahasiswa dari akademisi berkolaborasi dengan masyarakat setempat, termasuk pemerintah desa dan pelaku usaha, untuk mewujudkan kesejahteraan dan kualitas hidup yang lebih baik di masa depan.   Kata kunci: kuliner, Garut, lokal, SDGs, merek dagang Keywords:  culinary, Garut, local, SDGs, trademark
