Abstract

Extradition treaties are agreements between countries worldwide that involve the extradition of suspects or perpetrators of crimes, including economic crimes. Extradition treaties are between two countries to prevent transnational or cross-border crimes where the perpetrators flee to another country because they do not want to take responsibility for what they did. Extradition treaties have binding legal force following international law because they are international treaties. The extradition treaty made by Indonesia and Singapore is evidence of their positive cooperation in protecting law enforcement. Over the past few years, suspected Indonesian economic criminals have fled to Singapore with large amounts of money and capital. While Indonesian law cannot be applied to Singaporean territory, in the event of an extradition treaty between Indonesia and Singapore, it would have significant consequences. Suspected economic criminals can be brought back to Indonesia to be sentenced per applicable laws, while Singapore cannot. So this research aims to analyze the Extradition Treaty between Indonesia and Singapore According to International Law (Case Study of Tackling Corruption).

Abstract

Various aspects of social change planned through development are realized through the village government. In villages, hamlets or other names can be formed that are adapted to the origins, customs and socio-cultural values ​​of the community. A hamlet is a part of the area within a village where the work environment of village government is implemented. The hamlet head has the authority to supervise the implementation of development in his area. The implementation of development in the hamlet area in Bawang Village is directly supervised by the village head. In his daily life, the hamlet head in Bawang Village carries out delegative tasks given by the village head. Based on this, the identification of the problem in this research is regarding the supervisory authority of the hamlet head of Bawang Village, Bawang District, Batang Regency in implementing development in his area, as well as the constraints and obstacles in supervising the implementation of development in Bawang Village, Bawang District, Batang Regency. The method used in this research is an empirical juridical approach, with the research specifications used being analytical descriptive. The data sources used in this research are secondary data sources and primary data sources. The supervisory authority of the hamlet head in the implementation of development has been implemented. This authority has not been implemented optimally so more structured coordination is needed within the Bawang Village government. The obstacles in implementing development include lack of knowledge of employees in carrying out work, budget allocation, unpredictable weather, and lack of maximum community participation in implementing development.

Abstract

Eradication efforts of corrupting in Indonesia have been carried out, but until now there are still many corruption cases that have not been resolved in various ways by the perpetrators or corruptors. Corruptors often drain the funds from the results of corrupting, even the corruptors then go or run abroad. This raises problems in the process of law enforcement and recovery of financial and economic losses in the country, namely the mechanism for returning assets resulting from criminal acts of corrupting abroad. Therefore, the objectives of this study are to (1) Explain how is Indonesia Government's strategy in arrest and confiscation of criminal corruption (corruptor) assets abroad. (2) Explain how is international treaties concerning the seizure of assets resulting from criminal acts of corrupting are abroad. The research method used in this research is qualitative with a juridical legal approach normative. The results showed that the cooperation between countries is the best strategy that can be done by the Indonesia government in overcoming problems of sovereignty. Some examples of these forms of international cooperation are extradition treaties (extradition), Mutual legal assistance in criminal matters (MLA). The mechanism for the return of assets in MLA consists of four stages of the asset return process (Article 46 Chapter IV, UNCAC).Keywords:  international cooperation; eradication of corruption; confiscation of assets; extradition; mutual legal assistance in criminal matters.

Abstract

Sengketa dapat bermula dari berbagai sumber potensi sengketa, salah satunya adalah dapat berupa masalah bisnis internasional atau penanaman modal asing. Sengketa tersebut harus diselesaikan dengan hukum internasional. Peran yang dimainkan hukum internasional adalah memberikan cara bagaimana para pihak yang bersengketa untuk menyelesaikan sengketanya secara win win solution. Oleh karena itu tulisan ini bertujuan untuk menganalisis mengenai bagaimanakah perkembangan dan prospek penyelesaikan sengketa penanaman modal asing serta bagaimana Implementasinya di Indonesia. Penyajian hasil penelitian ini menggunakan penelitian kualitatif dengan pendekatan yuridis normatif. Hasil penelitian ini menujukkan bahwa Berdasarkan pembahasan dan uraian fakta yang telah dijabarkan sebelumnya, maka dapat disimpulkan bahwa Dalam menyelesaikan sengketa penanaman modal para pelaku usaha lebih menyukai penyelesaian di luar lembaga peradilan (non litigasi) yaitu penyelesaian dengan menggunakan jasa Arbitrase Komersial Internasional karena jalur/metode penyelesian tersebut lebih menguntungkan para pihak. Badan Arbitrase Komersial Internasional yang terkenal adalah ICSID, suatu badan arbitrase yang menangani sengketa-sengketa penanaman modal asing antara negara dengan investor asing. Indonesia adalah salah satu negara anggota ICSID yang diratifikasi dengan Undang-Undang No. 5 tahun 1968 tentang Persetujuan Atas Konvensi tentang Penyelesaian Perselisihan Antara Negara Dengan Warga Negara Asing Mengenai Penanaman Modal. Setiap sengketa antara Indonesia dan perusahaan Asing, dapat diselesaikan dengan menggunakan ICSID.

Abstract

The intervention of the state administration in providing legal protection and certainty for social welfare insurance is very important. However, there are still problems occurring in society, including acts of discrimination against accessing social needs, causing social inequality. The goal of this research is to determine how the government's responsibility in implementing social welfare is to provide legal protection and certainty to the community in the concept of a welfare state from the standpoint of state administrative law and how Arrangements for Social Welfare Policy Based on Government Regulation of the Republic of Indonesia Number 39 of 2012 Concerning Implementation of Social Welfare This research method is normative-juridical. The results of this study show that the responsibility and authority of the government in implementing social welfare and carrying out the duties of executive power must be based on the will of the state, which is based on statutory regulations established by the legislature. The policies regulated in the Government Regulation of the Republic of Indonesia Number 39 of 2012 concerning the Implementation of Social Welfare are rehabilitation policies, social security policies, social empowerment policies, social protection policies, infrastructure standard policies, community participation policies, registration procedures policies, and policies for institutions that organize social welfare
