Abstract

Indonesia merupakan kepulauan yang sangat luas. Untuk mengatur hal tanah terdapat dalam UUD 1945 sebagai dasar pokok bahwa negara menguasai bumi dan air san kekayaan alam yang terkandung didalamnya sesuai Pasal 33 ayat (3). hal tersebut juga terkait dengan UUPA no 5 tahun 1960 yang menyatakan antara lain menyelenggarakan peruntukan dan penggunaan tanah, termasuk pendaftaran tanahnya. Dalam hal penjualan tanah sering terjadi permasalahan seperti Tidak hadirnya pihak penjual dalam penjualan, sehingga pihak lain dirugikan karena ketidak pastian dari peralihan hak atau balik nama sertipikat, sebagai contoh pada putusan Nomor: 219/PDT.G/2018/PN.Dpk. Metode penelitian yang digunakan adalah metode penelitian normatif dengan bersumber pada studi pustaka/data sekunder. Data sekunder terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Dari hasil penelitian dapat disimpulkan bahwa kepastian hukum atas peralihan hak atau balik nama sertipikat tanpa hadirnya pihak penjual untuk mendapatkan kepastian hukum penggugat akan diperoleh setelah namanya terdaftar di kantor pertanahan dimana objek tanah tersebut berada dengan melampirkan putusan pengadilan untuk dapat dilakukan peralihan balik nama sertipikat dan perlindungan hukum akan didapat setelah putusan pengadilan sehingga pihak penggugat dapat melakukan peralihan hak atas tanah atau balik nama sertipikat di kantor BPN.

Abstract

The role of a notary is crucial in facilitating legal certainty and protection for the community. In civil law, notaries hold a highly strategic position as their profession deals with fundamental and critical issues in every legal action, particularly within civil law. The public, both as subjects and objects of legal transactions, bear significant burdens regarding legal administration. Violations by notaries can be classified as breaches of professional ethics or breaches of the law, with consequences that may include civil liabilities (compensation), criminal penalties (imprisonment and fines), and administrative sanctions (dismissal from office). Every unlawful action causing harm to others must be accounted for by the perpetrator. In criminal law theory, offenses are categorized into intentional and negligent acts. Any action causing undue harm and violating the law constitutes an illegal act. This study analyzes the juridical implications of drafting a power of attorney for sale from normative and case-based perspectives. The research revealed that a notary's failure to conduct adequate checks on document legality for a Power of Attorney for Sale resulted in unlawful actions that harmed legitimate parties, leading to material losses.

Abstract

Menurut UUJN, notaris adalah pejabat umum yang berwenang membuat akta autentik dan kewenangan lainnya. Notaris harus mematuhi ketentuan UUJN dan Kode Etik untuk memastikan akta yang dibuat sah dan akurat. Kesalahan dalam pembuatan akta dapat menyebabkan kerugian, baik secara administratif maupun pidana. Namun, dalam menjalankan tugasnya, masih ada notaris yang tidak saksama dalam menjalankan tugasnya. Penelitian ini bertujuan untuk menganalisis akibat hukum bagi notaris yang tidak saksama dalam pembuatan akta kuasa menjual, dengan fokus pada studi kasus Putusan Mahkamah Agung Nomor 20 PK/Pid/2020. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif analisis, yang menekankan pada kajian dan analisis norma-norma hukum yang tertulis serta penerapannya dalam praktik hukum.Hasil penelitian menunjukkan bahwa ketidaksaksamaan notaris dalam pembuatan akta kuasa menjual dapat mengakibatkan konsekuensi hukum yang serius. Putusan Mahkamah Agung menegaskan bahwa notaris memiliki kewajiban untuk memastikan keabsahan dokumen dalam setiap transaksi. Kegagalan dalam hal ini dapat mengakibatkan sanksi pidana, perdata, dan administratif bagi notaris. Penelitian ini juga menyoroti pentingnya proses pengumpulan bukti yang kuat dan penilaian yang teliti terhadap unsur-unsur tindak pidana penipuan. Meskipun putusan di tingkat Pengadilan Tinggi menimbulkan keraguan, Mahkamah Agung dalam peninjauan kembali membatalkan putusan tingkat sebelumnya, menyatakan bahwa perbuatan notaris tidak dapat dikategorikan sebagai tindak pidana penipuan

Abstract

Pasal 19 Undang-Undang Pokok Agraria (UUPA) memperlihatkan perbedaan signifikan antara ketentuan UUPA dengan hukum adat Minangkabau terkait kepemilikan tanah. kemudian Pemerintah mengeluarkan PP Nomor 24 tahun 1997 tentang pendaftaran tanah, karena menurut UUPA dan peraturan pelaksanaannya, pendaftaran tanah bersifat individual, artinya tanah yang telah didaftarkan dan diterbitkan sertifikatnya dengan status hak milik menjadi milik pribadi atau individu yang namanya tercantum dalam sertifikat tersebut. Sertifikat berfungsi sebagai bukti hak yang kuat. Namun, hingga saat ini, belum ada aturan khusus yang mengatur pendaftaran tanah ulayat yang kepemilikannya bersifat komunal atau bersama dalam masyarakat Minangkabau, Kemudian pemerintah daerah Propinsi Sumatera Barat telah mengeluarkan Surat Edaran Gubernur Kepala Daerah Tingkat I Propinsi Sumatera Barat tanggal 26 Agustus 1983 Nomor: DA-6980/III/2F/1983 Tentang Penyelesaian Permohonan Penegasan Hak Atas Tanah Yang Berasal Dari Tanah Adat. Berdasarkan hal tersebut, diajukan penelitian dengan topik : Bagaimana Pensertipikatan Bagian Tanah Ulayat Mempengaruhi Kesejahteraan Kaum? Penelitian ini menggunakan metode yuridis normatif. Dari hasil penelitian, bahwa implementasi pendaftaran tanah ulayat yang bersifat komunal dalam masyarakat Minangkabau masih belum diatur secara khusus. Hal ini menimbulkan berbagai kendala dan kontroversi dalam pelaksanaan pendaftaran tanah ulayat kaum di Minangkabau, Sumatera Barat. Dampak dari pendaftaran hak ulayat terhadap kesejahteraan kaum sangat besar, karena tanah ulayat di Minangkabau semakin berkurang, sehingga generasi mendatang tidak akan mandapatkan warisan tanah ulayat tersebut. Perbedaan pola kepemilikan tanah antara hukum adat Minangkabau dan pola kepemilikan tanah dalam UUPA dan peraturan pelaksanaannya berdampak signifikan pada kesejahteraan kaum.

Abstract

This study examines the phenomenon of the 30% quota of women's representation in the Indonesian House of Representatives (DPR RI) legislative institution not being met even though affirmative policies have been implemented for almost two decades. Using a normative legal method supported by a legislative, conceptual, comparative, and historical approach, this study identifies various factors inhibiting women's representation. The results of the study show that women's representation in the Indonesian House of Representatives (DPR RI) still reached 20.52% in the 2019 Election, not meeting the 30% target. The identified structural obstacles include the subordination of women in politics, the practice of money politics, a gender-biased recruitment system, and a deficit in women's political-social capital. The study recommends a comprehensive strategy in the form of gender mainstreaming in policy, women's capacity building, gender-just legal reform, political culture transformation, and a multi-stakeholder approach. This study contributes to the development of studies on gender politics and women's political representation, while also providing input for policy makers to improve regulations on women's representation in the general election system.

Abstract

This community service program examines the implementation of Law Number 35 of 2014 concerning Child Protection in efforts to prevent violence, neglect, and exploitation of children in target communities. Using empirical legal methods with a legislative, participatory, and case approach, this program aims to socialize child protection policies, identify barriers to implementation at the community level, and formulate joint action strategies to optimize prevention efforts. The results of the community service show that although the legal framework for child protection has been strengthened, its understanding and implementation in the community still face structural, substantial, and cultural challenges. Inhibiting factors include low legal literacy in the community, lack of understanding of reporting mechanisms, limited access to protection services in the regions, and socio-cultural norms that still legitimize violence as a form of discipline. Optimization strategies developed together with the community include the establishment of village-level child protection forums, training of child protection cadres, community-based education campaigns, utilization of technology for reporting systems, and development of special protocols for handling cases in disaster situations. A collaborative approach involving community leaders, schools, families, and children themselves is key to the sustainability of child violence prevention programs in the community.

Abstract

Violence, neglect, and exploitation of children remain serious problems in Indonesia that require systematic prevention efforts based on law and community participation. This study aims to increase public understanding of the prevention of violence against children based on Law Number 35 of 2014 concerning Child Protection through a comprehensive community service program. The method used is a participatory and educational approach with a mixed qualitative-quantitative design, involving 255 participants consisting of 100 heads of families, 50 educators, 30 community leaders, and 75 children aged 10-17 years. Activities were carried out for 6 months at the village level through participatory workshops, intensive training, legal socialization, and the establishment of a community-based child protection forum. Data collection was carried out through pre-post test surveys, in-depth interviews, focus group discussions, and participant observation. The results showed a significant increase in participants' knowledge by 34% exceeding the minimum target of 25%, a positive attitude change in 89% of participants to report cases of child violence, and a participation rate of 92%. The establishment of a child protection forum with 35 members from various community elements and a strategic partnership network with relevant agencies demonstrates the program's success in building a sustainable protection system. Implementation faced challenges such as cultural resistance, limited infrastructure, and the community's socioeconomic conditions. The program successfully created a community-based child protection model that can be replicated in other regions with adaptations to local contexts to achieve a child-friendly Indonesia.

Abstract

This study is motivated by the growing number of legal violations committed by Land Deed Officials (PPAT), encompassing administrative, ethical, and even criminal misconduct, as exemplified by the Magelang District Court Decision No. 56/Pid.B/2022/PN.MGG concerning the forgery of sale and mortgage deeds. The purpose of this research is to analyze the legal responsibility of PPATs in drafting authentic deeds that contain legal defects or elements of forgery and to examine the interrelation among administrative, ethical, and criminal violations within the framework of Indonesian positive law and the constitutional principle of social justice enshrined in the 1945 Constitution of the Republic of Indonesia. This research employs a normative juridical method using a statutory and case study approach. The findings reveal overlapping accountability mechanisms between ethical and criminal dimensions, as well as inadequate supervision of PPAT practices. It is therefore concluded that a reformulation of the sanction and supervision system for PPATs is necessary to ensure proportionality and alignment with the constitutional principle of social justice.

Abstract

The fourth industrial revolution has brought about major changes in how we live and labor, specifically affecting family dynamics. This abstract explores how families adjust to these changes to maintain productivity and well-being in the digital age. We concentrate on the effects of technology adoption on the labor market and the necessary skills, including automation, artificial intelligence, and the Internet of Things (IoT). Adapting abilities to stay professionally relevant and maintain social-emotional balance in the face of evolving digitally affected interaction patterns is a major problem for families. This study emphasizes how crucial it is for families to adjust quickly in order to acquire new skills and maintain up good communication. We demonstrate how families can prosper in the digital age by effectively adapting. Families that recognize and solve these issues will be able to maintain their well-being in the face of swift global change.

Abstract

Disputes concerning the annulment of land grant deeds between Inheritors constitute a complex issue within civil and agrarian law, requiring an in-depth understanding of the rationale behind court decisions. This research aims to analyze the rationale of the Panel of Judges of the Kepanjen District Court in Decision Number 175/Pdt.G/2023/PN Kpn regarding the annulment of Grant Deed Number 167/KEP-35.10/IX/2020. Employing a normative legal research method with a case study approach, the qualitative analysis focused on the legal considerations (ratio decidendi) within the decision. The analysis results indicate the Panel of Judges’ rationale was primarily based on the assessment of evidence corroborating the Plaintiff’s pre-grant proper claim derived from an oral transaction, setting aside the formal strength of the authentic deed due to the Defendant’s absence of rebuttal evidence. The juridical annulment of the deed was grounded in the direct application of the Nemo dat quod non habet principle, referenced through Article 210 section (2) of the Compilation of Islamic Law because the Grantor was proven to have granted part of the object that was not his right. The qualification of unlawful act against the Defendant was determined as a logical consequence of this finding, albeit without in-depth elaboration of the elements, demonstrating pragmatic reasoning. In conclusion, the judicial rationale, in this case, tends to prioritize substantive justice over formal legal certainty, yet it raises discourse concerning evidentiary standards and potential issues of inheritance law coherence that remain unaddressed.
