Abstract

Abstrak Peredaran narkotika di Indonesia sudah mencapai tahap darurat yang sangat mengkhawatirkan. Kejahatan tindak pidana narkotika, sangat wajar dalam hukum pidana sebut menjadi salah satu extra ordinary crime (kejahatan luar biasa. Korban peredaran narkotika tidak memandang usia, dari usia dewasa, remaja, dan anak-anak. Berdasarkan data Badan Narkotika Nasional melalui hasil survey nasional prevalensi penyalahguna narkotika tahun 2023, menunjukkan angka prevalensi sebesar 1,73 % atau setara  dengan 3,3 juta penduduk Indonesia yang berusia 15-64 tahun, yang menunjukkan adanya peningkatan penyalahgunaan narkotika secara signifikan pada kalangan kelompok usia 15-24 tahun. Adapun tujuan dari kegiatan pengabdian ini, memberikan penyuluhan hukum serta edukasi terhadap anak-anak Panti Asuhan Muhammadiyah Mataram, terhadap bahanyanya penyalahgunaan narkotika. Panti Asuhan Muhammadiyah adalah lembaga sosial yang didirikan oleh Muhammadiyah untuk memberikan perlindungan, pendidikan, dan pengasuhan bagi anak-anak yatim piatu dan keluarga kurang mampu. Saat ini, panti memiliki total 39 anak asuh dari jenjang SD, SMP, sampai SMA, dan 24 lansia dalam program home care. Adapun peserta yang terlibat dalam kegiatan ini sebanyak  anak jenjang SD-SMP.  Metode yang digunakan adalah sosialisasi dan penyuluhan hukum, dengan menyampaikan materi secara visualisasi, interaktif, serta pemilihan bahasa serderhana, agar mudah dipahami oleh anak-anak perserta. Selanjutnya sesi diskusi dan tanya jawab. Hasil kegiatan menunjukkan, saat penyampaian materi, anak-anak sangat antusias mendengarkan pemaparan materi, serta merespon dengan pengajuan pertanyaan dari 7 (tujuh) anak. Selanjutnya para pemateri kembali melakukan evaluasi dengan memberikan kuis kepada para perserta. Kata kunci: narkotika; usia rentan; anak; penyalahgunaan Abstract The circulation of narcotics in Indonesia has reached a very worrying emergency stage. Narcotics crime is very normal in criminal law to be called an extra ordinary crime. Victims of narcotics trafficking regardless of age, from adults, teenagers and children. Based on data from the National Narcotics Agency through the results of a national prevalence survey narcotics abusers in 2023, shows a prevalence rate of 1.73% or the equivalent of 3.3 million Indonesians aged 15-64 years, which shows a significant increase in narcotics abuse among the 15-24 year age group This service provides legal counseling and education to the children of the Mataram Muhammadiyah Orphanage, regarding the dangers of narcotics abuse. The Muhammadiyah Orphanage is a social institution founded by Muhammadiyah to provide protection, education and care for orphaned children and underprivileged families. Currently, the orphanage has a total of 39 foster children from elementary, middle and high school levels, and 24 elderly people in the home care program. The participants involved in this activity were as many as elementary-middle school level children.  The method used is legal outreach and counseling, by presenting material in a visual, interactive manner, and choosing simple language, so that it is easy for the participating children to understand. Next was a discussion and question and answer session. The results of the activity showed that when the material was delivered, the children were very enthusiastic about listening to the material presentation, and responded by asking questions from 7 (seven) children. Next, the presenters carried out another evaluation by giving a quiz to the participants. Keywords: narcotics; vulnerable age; child; abuser

Abstract

Press freedom for journalists has become increasingly restricted following the enactment of the National Criminal Code, Law No. 1 of 2023, by the government, raising concerns about the potential criminalization of journalists performing their duties. Several articles in the National Criminal Code (New Criminal Code) have been noted by the Press Council, one of which pertains to the broadcasting or dissemination of false news or information. The term 'any person' in the relevant article can apply to anyone, including journalists. Meanwhile, responsible and proper press freedom has already been accommodated through a specific law, namely Law No. 40 of 1999. The problem addressed in this study is how press freedom, based on Law No. 40 of 1999, relates to press offenses as regulated by Law No. 1 of 2023. The method used in this study is normative juridical, supported by empirical juridical analysis. The research findings indicate that even before the National Criminal Code was enacted, several journalists, including in the case of Asrul, were criminalized for allegedly spreading false news under the Electronic Information and Transactions Law (ITE Law). There is concern that the National Criminal Code could also be used by law enforcement to target journalists engaged in their journalistic profession. Therefore, revisions to certain articles in the National Criminal Code are necessary to provide exemptions for the journalistic profession, which is protected by the press law, and to establish a specific mechanism to be prioritized in the event of a press dispute.

Abstract

This study aims to analyze the practice of nominee agreements in land ownership by foreigners in Indonesia as a form of legal smuggling in a positive legal perspective. In the regulation of land law in Indonesia, based on the UUPA, land ownership with ownership rights is only by Indonesian citizens. The practice that occurs, foreigners through a name loan agreement to be able to control and own land in Indonesia with property rights. The normative legal research method with a statutory approach and a conceptual approach uses primary legal materials and secondary legal materials. Through literature studies (literature studies). The legal materials obtained were analyzed in a qualitative descriptive manner. The results of the study show that the nominee agreement is an agreement made between a person who according to the law cannot be the subject of a certain land right (property rights), in this case a foreigner with an Indonesian citizen, with the intention that the foreigner can control (own) the land owned de facto, but legally-formally (dejure) the land is owned on behalf of Indonesian citizens. The name loan agreement is clearly a form of legal smuggling to avoid regulations that stipulate that foreigners are not qualified as subjects of land title holders in Indonesia in accordance with the provisions in Article 9 paragraph (1) jo. Article 21 paragraph (1) of the UUPA clearly states that only Indonesian citizens can have a full relationship with earth, water and space, and clearly stipulates that only Indonesian citizens can have property rights

Abstract

The objectives of this study are to examine and analyze the application of Restorative Justice in handling minor assault crimes at the Lombok Tengah District Police Station and to analyze the legal challenges faced in applying Restorative Justice to optimize its application in minor assault cases from a progressive legal perspective at the Lombok Tengah District Police Station. The research method used in this study is normative empirical law using a legal approach, conceptual approach, sociological approach, and case approach. The legal materials used in this study include primary legal materials, secondary legal materials, and tertiary legal materials. The results of the study on the application of restorative justice in cases of minor assault within the Lombok Tengah Police Department were conducted in accordance with the mechanisms or rules outlined in Police Chief Regulation year 2021. In addition, the police offered reconciliation efforts to the victims and suspects based on cases that met the criteria for restorative justice and involved several other parties, such as religious leaders, traditional leaders, and community leaders, without any pressure, coercion, or intimidation from the Central Lombok Police, who acted as facilitators of minor assault cases. Second, the challenges faced in the implementation of restorative justice at the Lombok Tengah Police Station in resolving criminal cases of assault within the community include determining the value of compensation or restitution. Second, there are differing opinions between the victim and the victim's family regarding the peace efforts, where the victim does not wish to reconcile, while the victim's family desires reconciliation, considering long-term implications.

Abstract

Iron sand mining in the Dedalpak Block began in 2009 where the authority to grant mining permits ranging from mining business permits (IUP) exploration to mining business permits (IUP) for production operations was issued by the Regent of East Lombok by adhering to article 37 of Law Number 4 of 2009. However, with the enactment of Law Number 32 of 2014 Challenging Regional Governments, the authority of the iron sand mining permit was taken by the NTB Provincial Government, then with the presence of Law Number 3 of 2020 the authority for iron sand mining business licenses by PT. AMG was taken over by the Centre. In its implementation, iron sand mining by PT. AMG with the enactment of Law Number 3 of 2020 has a significant impact on the mining licensing process for iron sand production in the Dedalpak block of East Lombok, where the central government through the Director General of Energy and Mineral Resources requires thirteen conditions so that the IUP for production operations can be obtained by PT. AMG. The company, however, has not been able to meet five requirements, so its license was suspended. Another impact, the community in the Dedalpak block circle resisted by going to race through a series of protests for the mining to be closed, because it caused a large environmental impact.

Abstract

Cases of violations of child protection. Of the reports received, 837 cases occurred within the education unit, including: Children who were victims of bullying or harassment: 87 cases, Children victims of educational policies: 27 cases, Children victims of physical and/or psychological violence: 236 cases and Children victims of sexual violence: 487 cases. From data collected by the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases are still a terror for children in the school environment. Meanwhile, the types of bullying that victims often experience are physical bullying (55.5%), verbal bullying (29.3%), and psychological bullying (15.2%). Meanwhile, regarding educational level, elementary school students were the most victims of bullying (26%), followed by middle school students (25%), and high school students (18.75%). The aim of this service is to provide education to participants in community service activities so that bullying does not occur at school. The method used is a socialization method carried out face to face. The results are 50%. Orphaned children do not understand the limits of bullying itself, and their rights as children and citizens, despite the social and economic disparities they have. Some of the orphanage children are still insecure about their condition of not having parents, or having incomplete parents. So they tend to tolerate what happens to them, because they are not aware of these rights and also their own condition.

Abstract

ABSTRACT Purpose of the Study: This paper aims to analyze the judicial consideration of judges in Decision No. 273/Pdt.g/2021/PA.Bkt from the perspective of benefit and justice for all parties in the murabahah and its legal consequences.  Methodology: This research used the literature review method. It used the descriptive qualitative analysis, which was conducted by profoundly reading the decision, analyzing the case, examining the appropriateness of the legal basis, and how to define them. Results: The legal considerations of judges in Decision No. 273/Pdt.g/2021/PA.Bkt are: (1) the resolution of disputes on sharia economy is the absolute authority of the Religious Court; (2) the judge assembly must maintain the legal interests and rights of the plaintiff from the actions of the defendant to undergo an auction, as well as avoiding the losses and harm that may befall the plaintiff; (3) there was an emphasis on good intentions, benefit, and justice for all parties but the judges punished the defendant to undergo rescheduling, restructuring, and reconditioning. Applications of this study: It can inspire judges to create legal reasoning that supports the aspect of legal certainty. It can inspire banks and customers to emphasize the aspects of good intention, benefit, and justice in implementing contracts. Novelty/ Originality of this study: It explained the legal consideration of judges that emphasized the aspect of mediation through contract renegotiation based on the positive law and relevant sharia principles. Keywords: Judicial consideration, murabahah contracts, banks, good intention, benefit, justice.  ABSTRAK  Tujuan: Tulisan ini bertujuan untuk menganalisis pertimbangan yuridis hakim dalam Putusan No. 273/Pdt.g/2021/PA.Bkt dari perspektif kemanfaatan dan keadilan bagi semua pihak dalam murabahah dan akibat hukumnya.  Metodologi: Penelitian ini menggunakan metode literature review. Analisis yang digunakan adalah deskriptif kualitatif, yang dilakukan dengan membaca putusan secara mendalam, menganalisis kasus, memeriksa kesesuaian dasar hukum, dan bagaimana mendefinisikannya.  Hasil: Pertimbangan hukum hakim dalam Putusan Nomor 273/Pdt.g/2021/PA.Bkt adalah: (1) penyelesaian sengketa ekonomi syariah merupakan kewenangan mutlak Peradilan Agama; (2) majelis hakim harus menjaga kepentingan hukum dan hak penggugat dari tindakan tergugat untuk menjalani lelang, serta menghindari kerugian dan kerugian yang mungkin menimpa penggugat; (3) ada penekanan pada itikad baik, kemanfaatan, dan keadilan bagi semua pihak tetapi hakim menghukum terdakwa dengan penjadwalan ulang, penataan ulang, dan rekondisi.   Aplikasi penelitian ini: Dapat menginspirasi hakim untuk menciptakan penalaran hukum yang mendukung aspek kepastian hukum. Hal tersebut dapat menggugah bank dan nasabah untuk mengedepankan aspek itikad baik, manfaat, dan keadilan dalam pelaksanaan kontrak.  Kebaruan/Orisinalitas: Dijelaskan pertimbangan hukum hakim yang menekankan aspek mediasi melalui renegosiasi kontrak berdasarkan hukum positif dan prinsip syariah yang relevan.  Kata kunci: akad murabahah, bank, itikad baik, kemanfaatan, keadilan
