Abstract

Purphose: The importance of the transcendental paradigm, able to change the demoralization of the economic sphere, affects the changing economic goals of Pancasila.   Methodology: Using normative legal research, with paradigmatic approaches and using qualitative descriptive analysis. Finding: The symbolic phenomenon of religious rituals is not merely ritualism in the concept of civil religion. But able to penetrate the particulate partition of the operational dimension.  Similarly, the prophetic paradigm, with its prophetic ethics in terms of liberation, humanization, Transcendence, gives space to the fundamental beliefs of society in economics. Civil religion minimizes the ongoing dominance, hegemonic, and exploitative of anti-humanity. The prophetic paradigm and civil religion are capable of being great energy for the realization of the idealism of Pancasila, the first of the transcendental meaning. Importance: The transcendental dimension, of the first Sila, being a turning point. The importance of awareness of the community, and the legal traveler for the reconstruction of Indonesian economic law to realize the social justice of Pancasilais. Originality/Novelty: The Prophetic and civil religion paradigms, becoming one of the bids on economic demoralization. Keyword: Civil Religion; Profetic ethics; Pancasila; Indonesian economic law.

Abstract

The dynamics of Islamic banking since 2008 has grown rapidly after the enactment of Law Number 21 Year 2008 concerning Islamic Banking. Murabahah products undergo several stages of review or assessment in order to achieve compatibility between the fundamental aspects of its welfare and operations. The existence of various perceptions and implementations so far has become an important issue to be studied, considering the standardization of technical product which is a minimum standard, required as a reference for implementation products. This study used a type of doctrinal research, with textual inference procedures and qualitative descriptive analysis. The presents of Sharia or Islamic issues, legal issues and operational issues are several characteristics of norms stated in the Islamic Banking Law regarding murabahah instrument. Standard Book of murabahah products based on the Financial Services Authority Regulation which contains the capacity and service standards that are derived from important norms and guidelines in the operation of murabahah instrument. Understanding and implementing the Islamic banking industry brings together two dimensions of value, that are the value of professionals in the financial world and the value of compliance with sharia principles, one of which is the rules of commercial transaction that are not mixed with the rules of credit. These fundamental indicators determine the norm characteristics of Islamic banking in Indonesia. Thus, the construction of legal reforms for Islamic banks as beyond banking is well realized.

Abstract

Anti-discrimination is also known by the term opportunity and equal treatment. The opportunity and equal treatment is a right of every citizen in all fields of life, whether economic, social, cultural, political and labor affairs. One of the most fundamental rights is the maternal right of female workers, including the right to menstruation leave, maternity leave, get social security in the form of care during childbirth and after childbirth, breast feeding and caring for the rights and child rearing. This research is to look at the law as the principles of truth and justice that is natural and universally applicable. This is consistent with normative legal research, the study of the principles of law or legal principles. On normative legal research, data processing activities to conduct systematize nature of the material written law. Systematizes means making a classification of materials written laws to facilitate the analysis and construction work. The principle of anti-discrimination and protection of workers’ rights maternal woman in Indonesia has been stated in the statutory provisions and refers to international conventions on human rights and the Convention on the Elimination of All Forms of Discrimination Against Women and ILO Convention No. 183 Year 2000 on Maternity Protection (ILO Convention on Maternity Protection). These rights include the right to menstruation leave, maternity leave, maternity leave, the right to bear the cost of the company or employer through labor social security, and the right feed and care for the child and the right of special treatment (affirmative action) in employment. However, long-time child care, it is not described in detail in the statutory provisions and arrangements delivered to the employer or the employer and the worker. This clause is felt still too discriminatory given that the rights of children to be treated and was raised by a mother (especially working mothers) marred. So we need a judicial review of Law No. 13 of 2003 relating to the protection of the rights of women workers as a form of maternal implementing anti-discrimination principle.Keywords: Anti-Discrimination, Protection of Workers, Rights Maternal

Abstract

Sharia compliance is the basic basis for assessing whether Islamic banks have enforced sharia law. Law enforcement by Islamic banking must reach the element that the bank has implemented the rules of muamalah related to the prohibition of usury and dzolim. The factual phenomenon is fraud in the murabahah consumptive financing contract by Bank A Syariah. This is important to study and analyze considering that law enforcement on sharia compliance in bank A Syariah on contract and financing instruments has an impact on customer and public trust. This research uses normative legal research methods, with a critical legal study approach. The results of the study show that law enforcement is not directly proportional to sharia compliance. There is still a “legal trick” (Hilah) in the murabahah consumptive financing contract. Hilah is part of the legalization of taking usury. Bank A Syariah business activities have not been maximally carried out in the real or productive sector. Productive sectors, such as livestock, food crop agriculture, food and beverage processing industry, and others. Second, murabahah consumptive financing still relies on the pattern of consumptive lending in the form of a privileged civil servant decree as collateral. The object of the contract is money, not the real sector, so that the murabahah contract fraud by Sharia bank A also surfaced. The murabahah contract that is carried out between BA customers and Sharia bank A is one of the cases that justifies Islamic banks only have sharia labels, but their implementation has not been sharia.

Abstract

ABSTRAKAngka stunting di Nusa Tenggara Barat (NTB) masih terbilang tinggi yaitu sekitar 167 ribu atau 33,49 persen dari 500 ribu balita mengalami stunting. Hasil  Riset  Kesehatan  Dasar  Kabupaten Lombok Barat Tahun  2018  untuk  balita  usia  0-59  bulan  menunjukkan  bahwa  indeks  berat  badan menurut  umur (BB/U)  angka   kurang gizi  sebesar  29.94 %,  yang  artinya  bahwa  Kabupaten Lombok Barat   berada  pada  kategori  wilayah  rawan  gizi.  Penanganan masalah stunting tidak mungkin bisa diselesaikan sendiri oleh sektor kesehatan, oleh sebab itu perlu dukungan seluruh jajaran perangkat daerah dan masyarakat. Seperti yang sudah dilakukan oleh Pemeritah Kabupaten Lombok Barat dengan membuat Peraturan Bupati Lombok Barat No 19.A Tahun 2020 tentang Pencegahan dan Penangan Stunting, diundangkan pada tanggal 17 April 2020 pada Berita Daerah Kabupaten Lombok Barat Tahun 2020 Nomor 19.A. Dimana, dalam Pasal 10 angka 14 (a) Peraturan Bupati Lombok Barat No 19.A Tahun 2020. menyatakan adanya peran perangkat daerah dalam aksi konvergensi stunting yaitu: Peran Pemerintah Desa ialah menetapkan peraturan desa tentang pencegahan dan penanganan stunting. Dalam hal ini Desa Gelogor Kecamatan Kediri Kabupaten Lombok Barat belum juga mempunyai peraturan desa tentang pencegahan dan penanganan stunting sesuai amanat dari Peraturan Bupati Lombok Barat No 19.A Tahun 2020.Berdasarkan data dan informasi yang diperoleh pada saat kegiatan penyusunan rencana pembangunan jangka menengah desa (RPJMDes) ada berbagai persoalan dan masalah yang dihadapi masyarakat terutama masyarakat miskin dan perempuan. Dari berbagai persoalan dan masalah yang ada dapat dirangkum salah satunya adalah penanganan masalah stunting. Kegiatan pengabdian ini bertujuan memberikan pendampingan penyusunan rancangan peraturan desa tentang pencegahan dan penanangan stunting. Adapun yang hadir pada kegiatan ini adalah Anggota Pemerintah Desa, BPD, perwakilan Kepala Dusun, kader Posyandu, BKKBN/Penyuluh KB Lombok Barat, remaja, ibu hamil dan ibu menyusui. Hasil dari kegiatan ini adalah Pemerintah Desa Gelogor saat ini sudah mempunyai draf rancangan peraturan desa. Dimana draf rancangan peraturan desa tersebut akan dibahas pada tahap selanjutnya oleh Pemerintah Desa, BPD dan stakeholder lainnya. Kata kunci : stunting; rancangan; peraturan desa. ABSTRACTThe stunting rate in West Nusa Tenggara (NTB) is still relatively high, around 167,000 or 33.49 percent of the 500 thousand toddlers experiencing stunting. The 2018 West Lombok Regency Basic Health Research results for toddlers aged 0-59 months show that the bodyweight index for age (W/U) has a malnutrition rate of 29.94%, which means that West Lombok Regency is in the category of nutritionally vulnerable areas. The health sector can't solve the stunting problem alone. Therefore it requires the support of all regional apparatus and the community as done by the Government of West Lombok Regency by making West Lombok Regent Regulation No. 19. A of 2020 concerning Prevention and Handling of Stunting, promulgated on April 17, 2020, in the Regional News of West Lombok Regency of 2020 Number 19. A. Where, in Article 10 number 14 (a) West Lombok Regent Regulation No. 19.An of 2020. states the role of regional apparatus in stunting convergence action, namely: The part of the Village Government is to stipulate village regulations regarding stunting prevention and handling. In this case, Gelogor Village, Kediri District, West Lombok Regency does not yet have a village regulation regarding stunting prevention and handling as mandated by the West Lombok Regent Regulation No. 19.An of 2020. Based on data and information obtained during the village medium-term development plan ( RPJMDes), the community faces various problems, especially the poor and women. Of the various issues and problems that exist, it can be summarized, one of which is handling the stunting problem. This service activity aims to draft village regulations regarding stunting prevention and management. Those who attended this activity were Village Government Members, BPD, representatives of the Hamlet Head, Posyandu cadres, BKKBN / West Lombok Family Planning Extension, teenagers, pregnant women, and breastfeeding mothers. The result of this activity is that the Gelogor Village Government currently has a draft village regulation draft. The draft village regulation will be discussed later by the Village Government, BPD, and other stakeholders. Keywords: stunting; design; village regulations.

Abstract

This article discusses the strengthening of halal tourism based onthe Islamic Prophetic Paradigm. Halal tourism built in West Nusa Tenggara is unclear and final about the direction and concept. Many parties are hesitant and criticized about the title of the halal destination carried by the regional government. Is it true that the government is committed to creating a religious and halal tourism environment? Is it in line with the historical social inference of the NTB community in wrapping the cultural customs of the tribes in the region?. This study uses the sociological method of jurisprudence, with the approach of the Islamic prophetic paradigm.Furthermore, it uses the procedureof historical social inference to find convergence between Islamic values and the past, social aspects of the three major tribes in NTB. The results of the study show that the support and commitment of the NTB local government towards halal tourism that was built is based on Ahklak, Adab, and eastern culture. The main scheme is Muslim world tourists. This Akhlak, Adab, and east culture are very important to give a different color and show the local identity of an area. The halal concept was found through the convergence of cultural values and customs of the three tribes in NTB, namely the Sasak, Samawa, and Mbojo (Sasambo) tribes. It is contained and agreed upon in the norms and culture of the community, actualized at specific convergence points. The convergence of Islamic prophetic values with the historical, social benefits of the Sasak, Samawa and Mbojo tribes is seen in terms of halal food patterns, civilized patterns of association, clothing, and other economic trends. Like the Sasambo tribal philosophy “AdatBersendikanSyara’, Syara’ is based on the book of Allah’, which increasingly gives its Islamic identity. These paradigms and philosophies are the principal capital for the creation of regional halal regulations, accommodating local entities that are inherited and civilizedthrough local friendly entities.

Abstract

Di Nusa Tenggara Barat, jumlah bank sampah binaan Bank sampah Induk Regional Bintang Sejahtera (BSIR-BS) adalah sebanyak 115 BSU pada tahun 2018 dan meningkat menjadi 259 BSU pada tahun 2019. Bisnis pengelolaan sampah dengan konsep ekonomi syariah, semakin diterima oleh masyarakat. Transaksi jual beli sampah (muamalah) tidak hanya bertujuan pada keuntungan semata, tetapi selaras dengan moral, etika dan tujuantujuan syariat. Metode penelitian adalah kualitatif, dengan pendekatan kasus (case approach). Analisis data bersifat deskriptif kualitatif, perolehan data melalui studi kasus dan studi literatur. Hasil temuan riset adalah (BSIR-BS) merupakan bank sampah yang fokus dan komitment terhadap pengembangan tata niaga persampahan di NTB, dengan konsep “Bersama kami merubah sampah menjadi rupiah, merubah masalah menjadi berkah”. Konsep tersebut merupakan derivasi dari terlaksananya scale up bisnis sampah yang selaras dengan tujuan-tujuan syariat (al-maqasid al-syariah). Scale up bisnis pengelolaan bank sampah dilakukan dengan beberapa tahapan. Pertama, minimalisasi dampak lingkungan yang ditimbulkan dengan pengukuran kuantitas sampah yang bisa dikelola dan memiliki nilai ekonomi. Aspek kompetensi, kualitas, moral etis, amanah, dalam proses tata niaga bisnis sampah, sebagai upaya hifzu dien (menjaga agama), dan hifzu al-nasb (menjaga keturunan). Kedua pengetahuan pemahaman dan kesadaran terhadap pengelolaan sampah sebagai sumber daya, sebagai upaya hifzu al-nafs (melindungi jiwa), hifzualaql (melindungi akal). Ketiga, peningkatan jumlah bank sampah unit yang dibina, membangun jaringan yang lebih luas, melalui edukasi, penguatan ekonomi nasabah sebagai upaya hifzu al-mãl (melindungi harta).

Abstract

The use of social media today often triggers a war of opinion between its users and sometimes even leads to reporting to the authorities (police). Wars of opinion or differences of opinion occur because there are different views on something that is being discussed, such as the recent presidential election. Solving problems (simple) through legal channels, for some people is the right step, and provides a deterrent effect for the perpetrators. In fact, in the Covid- 19 era like now, the police have very many tasks, ranging from socialization activities on large-scale social restrictions to curbing and prosecuting people who violate the provisions of PP No. 21 of 2020 concerning Large-Scale Social Restrictions (PSBB) in the Context of Accelerating the Handling of Covid-19. The people began to abandon the habit that was carried out by the previous people in this country, that it would be better to solve problems peacefully and to forgive each other, for the sake of more harmonious and peaceful life. Islah can be manifested, one of which is the traditional tradition/local wisdom of sorong sala’ which is known in Tepal village, one of the areas in Sumbawa Regency, West Nusa Tenggara Province, which still adheres to Adat Bersedikan Syara’, Syara’ Bersendikan Kitabullah. This customary tradition is carried out so that the two warring parties can reconcile without involving the authorities. The method used in this research is descriptive qualitative as well as assessing secondary data about sorong sala ‘as well as filling.

Abstract

A brand is a sign or characteristic of a product. Giving a brand to goods and or services distinguishes the product from other products. With the brand as a differentiator between the products and other products, producers can easily introduce their goods and or services to consumers. For a brand to exist in the constituent system, trademark ownership must be registered. This is because, without registration, the brand owner cannot claim absolute ownership. In conducting counseling/service, we conducted a literature study on the Implementation of Registration and Brand Permits for MSME Actors. The writers also made preparations by providing facilities and infrastructure for these activities. We also determined the time of the activity implementation cooperatively with the implementing team, and determine and study the material to be delivered in legal counseling activities. The trademark registration process can also currently be carried out online at the website https://brand.dgip.go.id/. This website was available since the breakthrough of the Directorate General of Intellectual Property of the Ministry of Law and Human Rights.

Abstract

The relationship between the Force Majeure conditions resulting from COVID-19 with legal protection for banking clients affects the aspect of legal certainty and fairness. The normative aspect is crucial to be known and understood by all stakeholders, both the banking, the customer and the government through OJK and the legislature, concerning the legal basis of Force Majeure and the protection efforts for customers and banks. The condition of Force Majeure caused by the outbreak of COVID-19 is a condition of Majeure, based on Presidential Decree No. 12 of 2020. The presidential decree was the basis for the determination that Covid-19 was a national disaster. In that case, the banking must refer to the other legal provisions of article 1245 Civil Code and become the basis of the protection of banking customer rights. Therefore, online dissemination efforts felt critical to do to provide knowledge and understanding to the community, especially banking customers on the legal rights and economic rights, as the purpose of the community service activities conducted. They are using interactive lecture methods, questions and answers and discussions, and evaluations. The results of counseling, there is an increase in the number of tort cases in the period pandemic Covid-19 is 90 cases, between the Bank and the customer. And cases of deeds against the law as many as 3 cases. This legal remedy is a form of legal protection for banking customers who do not acquire the rights in the form of deduction and elimination of interest and fines, as stipulated in article 1245 of the Civil Code. Furthermore, the normative aspect, is not a reference yet, given the more tort lawsuit compared to lawsuits that are emerging in the condition of Force Majeure.Keywords: COVID-19; dissemination online; force majeure; banking customer rights. AbstrakHubungan antara kondisi force majeure akibat COVID-19 dengan perlindungan hukum bagi nasabah perbankan berpengaruh pada aspek kepastian hukum dan keadilan. Aspek normatif sangat penting untuk diketahui dan difahami oleh seluruh stakeholders, baik pihak perbankan, nasabah dan pemerintah melalui OJK dan legislatif, terkait dasar hukum force majeure dan upaya perlindungan bagi nasabah dan pihak perbankan. Kondisi force majeure yang disebabkan oleh wabah COVID-19, merupakan kondisi kahar, berdasarkan Keputusan Presiden nomor 12 tahun 2020. Kepres tersebut menjadi dasar penetapan bahwa COVID-19 adalah bencana nasional. Pada kondisi tersebut, pihak perbankan wajib merujuk pada ketentuan hukum lainnya yaitu pasal 1245 KUHPerdata dan menjadi dasar perlindungan hak nasabah perbankan. Oleh karena itu upaya diseminasi online dirasakan sangat penting untuk dilakukan dalam rangka memberikan pengetahuan dan pemahaman kepada masyarakat, khususnya nasabah perbankan terhadap hak-hak hukum dan hak ekonominya, sebagaimana tujuan dari kegiatan pengabdian masyarakat ini dilakukan. Menggunakan metode ceramah interaktif, tanya jawab dan diskusi, serta evaluasi. Hasil penyuluhan, ada peningkatan jumlah kasus wanprestasi di masa pandemic COVID-19 yaitu sebanyak 90 kasus, antara pihak bank dan nasabah. Dan kasus perbuatan melawan hukum sebanyak 3 kasus. Upaya hukum tersebut merupakan bentuk perlindungan hukum bagi nasabah perbankan, yang tidak memperoleh hak-haknya berupa pengurangan dan/atau penghapusan bunga dan denda sebagaimana diatur di dalam pasal 1245 KUHPerdata. Dan aspek normative tersebut, belum menjadi rujukan, mengingat gugatan wanprestasi lebih banyak dibandingkan dengan gugatan melawan hukum yang sejatinya muncul pada kondisi force majeure.
