Abstract

Tujuan penelitian ini untuk mengetahui bagaimana pemahaman masyarakat Desa Tapalinna tentang akad muzara’ah,dan bagaimana akad muzara’ah yang selama ini dilakukan oleh petani padi Desa Tapalinna. Jenis penelitian yaitu penelitian deskriptif kualitatif. Penelitian ini berada dilokasi Desa Tapalinna Kec. Mambi Kab. Mamasa. Hasil penelitian ini  Pengetahuan dan pemahaman masyarakat tentang akad muzara’ah yakni banyak masyarakat yang tidak paham dengan istilah muzara’ah 2) Pada umumnya pelaksanaan akad muzaraah, meskipun  perjanjian bagi hasil yang mereka lakukan tidak tertulis tetapi tidak ada hukum-hukum yang mereka laksanakan yang bertentangan dengan hukum Islam dan pelaksaannya juga sudah sesuai dengan ketentuan hukum Islam. Kemudian itu sudah menjadi kebiasaan (urf) masyarakat yang ada di Desa TapalinnaImplikasi pada penelitian ini adalah , Sebaiknya  pemerintah yang ada di Desa Tapalinna memberikan pengetahuan atau sosialisasi kepada masyarakat khusunya yang ada di Desa Tapalinna tentang bagaimana harusnya kerjasama bagi hasil yang ada dalam Islam. 2) Sebaiknya akad muzara’ah yang dilakukan oleh masyarakat Desa Tapalinna khusunya Petani padi sebaiknya dilakukan secara tertulis sehingga apabila suatu hari nanti ada kekeliruan tentang pelaksaan bagi hasil yang timbul diantara pemilik sawah dan juga pengelolah sawah, maka kekeliruan tersebut akan cepat diselesaikan dengan adanya bukti perjanjian secara tertulis tersebut

Abstract

The uncertainty of the wage payment (ujrah) of nylon plastic rope between entrepreneurs and labour prompted this research. The purpose of this study is to determine the practice of giving wages given by , nylon plastic rope entrepreneurs to workers and understand the review of Islamic law regarding the practice of giving work wages between nylon plastic rope entrepreneurs and workers. This research is descriptive qualitative. Data collection techniques are carried out by means of observation, interviews and documentation. The results of this study indicate that the practice of giving work wages is permissible (mubah). The practice of ujrah applied by the Rajawali Rafia Rope entrepreneurs to workers who roll nylon plastic rope is that initially there is an agreement that if the worker has reached the predetermined roll target of approximately 1000 rolls, then the work wage will be given. But in practice, the wage paid depends on how fast the nylon plastic rope is sold. If the sales of nylon plastic rope in the Tali Rafia Rajawali business are sold quickly, the work wages will be given quickly. Although there is no clarity on the time of payment of wages, they still work as labourers.

Abstract

This research delves into the encounter between Islam and local culture within the community of Teluk Mandar. Utilizing phenomenological, historical, and cultural anthropology approaches, the findings unveil that initially, the encounter was peaceful, yet encountered resistance from certain residents post their Islamic studies at the local boarding school, citing the tradition as contradictory to Islamic teachings. Nevertheless, the tradition perseveres as a means to uphold environmental equilibrium and foster a tranquil and prosperous life. Traditional figures retain their pivotal roles, with Islamic elements seamlessly integrated into the ritual. In summary, the encounter between Islam and local culture within the Massorong tradition reflects mutual influence, accommodation, and potential conflict, necessitating profound comprehension and dialogue to sustain community harmony.
