Decisions that legally enforceable could do the execution. One of the executionswas real execution. The object of Real Execution can be fixed or moving objects, andone of which is land. In practice, not kind of all execution can be carried out and thereare many constraints in such the party received an order from a decision that is notvoluntarily hand over the object to be executed so that the party filed a deferment ofexecution. Deferment of execution that underlies are the physical resistance thatendangers the safety of officers and the boundaries of the soil such as the river thatanytime are subject to change.

In their life humans always faced with risk, something that threaten their life and make them suffer losses, the risk can be losing of life, losing moen, accident, fire and many other. To reduce that risk people can use insurance. The purpose of insurance is to cover the loss from an event that cann’t be predicted before. Insurance company use a standard contract in their contract. The usage of fixed agreement in their contract is against abolition of agreement.

Penelitian mengenai Akibat Hukum Terhadap Kepemilikan Tanah Di BaliOleh Orang Asing Dengan Perjanjian Nominee. Penelitian ini bertujuan untukmengetahui latar belakang dibuatnya perjanjian nominee dan untuk mengetahuiakibat hukum terhadap perjanjian nominee yang disengketakan oleh para pihak.Dalam penelitian jurnal ini menggunakan jenis penelitian yuridis empiris. Hasilpenelitian ini menunjukkan bahwa latar belakang dibuatnya perjanjian nomineetersebut dikarenakan hak pakai dianggap tidak menguntungkan pihak asing.Sehingga muncul keinginan dari pihak asing untuk mensiasati peraturan yangberlaku. Sedangkan akibat hukum yang ditimbulkan dalam perjanjian nomineebila terjadi sengketa oleh para pihak adalah perjanjian tersebut menjadi tidak sahkarena telah melanggar ketentuan peraturan perundang-undangan, makaperjanjian nominee adalah perjanjian yang batal demi hukum.

The existence of the Land is very important because it is a place where people do alltheir activities. With the increasing population and limited land area, the state strictlyregulates the land, the rights attached to its owner, as well as the status of land ownershiptransfer procedures such. In regard to the role of Land deed Official are given the duty andauthority to make the deed as proof of ownership and transfer of copyright law subject to aground. Formulation of the problem that arises is about the legal status of the Deed of Salemade by the district head as Land deed Official in connection with the sale and purchase ofthe land and how the existence of the Deed Law published Land deed Official with Land deedOfficial districts in buying and selling land. To discuss this empirical research methods used.The concluded that the status of the Law of the Land Sale and Purchase Agreements issued byLand deed Official sub regency chief have any legal force so as a result of the Law on LandSale and Purchase Agreements made by the district head as Land deed Official , had no effecton the process of making the certificate Land Rights held at the office of the Agency NationalLand.

Property right over land can be transferred through the sale and purchase. By buyingand selling, title for the land to move from the land owner as the seller to another partyas a buyer. Land purchase agreement is set forth in the deed of sale of land issued bythe Land Deed Official (PPAT) is a proof of the above legal actions that lead to the civilright of a person or corporation on the ground. In the making of deed of sale of landrequired witnesses who knew about the contents of the deed. Purpose research is toknow what the terms to be a witness in making of deed of sale of land title before LandDeed Official (PPAT) and Land Deed Official (PPAT) how the role of witness todetermine feasibility in making the deed of sale land rights which have not beenregistered and has been registered. This type of research is used in this paper is a typeof normative study that describes the requirements to become a witness in the making ofdeed of sale of land titles before the Land Deed Official (PPAT). Requirements tobecome a witness in the manufacture of a dedd of sale of land titles contained in Law of40 number (1) on job title notary. Land Deed Official (PPAT) role in determining thefeasibility of a witness in the making of deed of sale of land titles which have not beenregistered, Land Deed Official (PPAT) can use at least two witnesses, namely the headof the village and a member of village government or village lies the respective plots ofthe local environment.Where as in determining the feasibility of a witness in a deedselling land titles were certified, the witness used by Land Deed Official (PPAT) is LandDeed Official (PPAT) employees who meet the requirement to become a witness in theinauguration of deed.

Pura sebagai Badan Hukum Keagamaan yang dapat mempunyai hak milik atas tanah mempunyai implikasi bahwa Pura dapat mempunyai hak milik atas tanah. Kemudian atas kepemilikan itu maka Pura sebagai subyek hukum dapat saja mengalihkannya kepada pihak lain melalui mekanisme jual beli. Tujuan penulisan jurnal ini adalah untuk mengetahui keabsahan jual beli hak milik atas tanah laba pura oleh Puri Jambe Celagi Gendong dan pihak pembeli dan untuk mengetahui dan mengkaji dasar pertimbangan hukum oleh hakim dalam PutusanPengadilan Negeri Denpasar No.160/PDT.G/1999/PN.DPS. Penulisan karya ilmiah ini menggunakan penelitian hukum normatif dimana mengkaji hukum tertulis dari berbagai aspek salah satunya putusan pengadilan negeri. Dalam putusan pengadilan negeri yang diteliti pada penelitian ini, jual beli hak milik atas tanah laba Pura Luhur Uluwatu, oleh Pengadilan Negeri Denpasardari seluruh pertimbangan hukum pada kasus ini, Majelis Hakim menyimpulkan penggugat tidak dapat membuktikan dalil gugatan, dilain pihak tergugat telah dapat membuktikan dalil bantahannya dan kemudian Majelis Hakim menyatakan bahwa jual beli atas tanah sengketa antara penggugat dengan tergugat adalah tidak sah dan batal demi hukum, ini dikarenakan dalam perjanjian antara penggugat dan tergugat tersebut dicantumkan sebuah klausul bahwa bila dalam batas waktu tanggal 18 Oktober 1998 harga tanah yang dibeli oleh penggugat tidak dilunasi, maka uang muka dari jual beli tersebut menjadi hangus dan ini berarti jual beli tersebut menjadi batal dengan sendirinya.

This paper has the title " Payment of claims by the Perusahaan AJB Bumiputera 1912 in the case of a default by the insured in the partner program scholarship plan " . The research method used in this paper is the Juridical Empirical , namely a state research gap das solen ( theory ) and das sein ( practice or reality ) that the gap between the theoretical state of the legal facts . In this paper , the issue raised is why the Perusahaan AJB Bumiputera 1912 pleaded no cancellation insurance agreement to the judge in the case of a default by the insured and how the payment of claims against the insured who are in default . The conclusion is AJB Bumiputera 1912 the Company did not plead to the judge because the cancellation is costing , time as well as a great power , so its cancellation can be done by both parties only and on payment of a claim , the policy will only be made if the insured already has a cash value .

In this time almost on every joint streets in Denpasar city shown advertisement: “sold the plot of land”, or “sold the plot of land ready to build”. Terminology plot of land is popular progressively in society, and many society require the land area for their residences and buy the land area which have in plot the land by right owner of land or by investors. The plot of land gives definition that a land area can by some or size measure as according to buyer with a certain rights reasons. Generally a land area can be divided or fragmented to coherent rights which designate that the land is represent the land by destining live house in settlement area. According to Regulation of Government number 24 year 1977, certificate isa rightful authority document which used as an evidence tool to right of land, right of management, property right of house and right of insurance which had booked on each their certificate. Every individual who have the right of land which representing law subject is entitled to do deed of law of their land, like to waive their right to the new right receiver candidate, and it’s legal. Seeing much the plot of land area in Denpasar City, Denpasar city governmental in order to arranged development of settlement and housing with environment vision, which including in arrange about allotment and exploiting of land have published Decision of Denpasar Mayor Number 396 year 2000 31 July 2000 about execution plot of land in Denpasar city and Regulation of Denpasar city number 6 year 2005 specified on 22December year 2005, about Retribution Permit Allotment Usage of Land. This regulation basically also arrange about licensing which must fulfill by individual and also law department conducting plot of land in Denpasar city. The method which used in this research is empiric method. Empiric method is a research about a problem which happened from its reality or practice.

Setiap benda yang dibebani dengan Jaminan Fidusia wajib didaftarkan. Kementerian Keuangan juga mengatur bahwa kewajiban pendaftaran Jaminan Fidusia juga berlaku bagi pembiayaan konsumen kendaraan bermotor. Pendaftaran Fidusia dapat dilakukan di Kantor Pendaftaran Fidusia. Namun seiring berjalannya waktu, demi kemudahan dan kelancaran dalam mendaftarkan Fidusia, maka dibentuklah sistem baru pendaftaran secara online dan pendaftaran secara manual tidak dilakukan lagi atau dihentikan. Berdasarkan uraian di atas, maka dibuatlah penelitian dengan judul Keabsahan Pendaftaran Fidusia Kendaraan Bermotor Secara Online Oleh PT. FIFGROUP. Penelitian ini menggunakan metode empiris dan bertujuan untuk mengetahui bagaimana keabsahan dari Pendaftaran Fidusia secara online dan bagaimanakah langkah atau tata cara yang ditempuh dalam mendaftarkan Fidusia secara online. Pada intinya, Pendaftaran Fidusia secara online dinyatakan sah oleh hukum dan proses Pendaftaran Fidusia secara online dan pemasukan data penting akan dilakukan setelah notaris mendapatkan semua dokumen penting yang diperlukan, yang sebelumnya sudah diberikan terlebih dahulu oleh PT. FIFGROUP.

The Central Government or local governments do accountability report of the implementation of the APBN/APBD for one year review by The Agency of Financial Examiners(BPK). Formulation of the problem raised is : how is the implementation of The Financial Examiner (BPK) in examining the financial statements and financial centre area as well as what are the different types of examinations conducted by BPK. The research is normative law research, with approach militate-invitations and legal analysis, which based on the source of primary law material and secondary law material, as well as analysis by way description and arguments. Based on the discussion of this research, the result is obtained the implementation and the types of conducted by Financial Audit Agency (BPK) to be able to find errors in the management of the state finances of central Government or local governments haave done and can harm the country as well as community.
