Abstract

Seiring dengan pesatnya kemajuan pariwisata di Bali, kedatangan para wisatawan asing ke pulau dewata dengan tujuan berwisata semakin meningkat. Implikasi nyata yang terlihat dari kondisi ini adalah adanya pertukaran kebudayaan termasuk pengaruh di bidang fashion dan trend, khususnya trend perawatan kecantikan di Bali. Dalam Undang-Undang Perlindungan Konsumen diatur hak dan kewajiban konsumen serta pelaku usaha sehingga terjadi hubungan yang proporsional dimana perusahaan memperoleh profit atau keuntungan dan konsumen memperoleh barang/dan atau jasa sehingga muncul rasa puas. Dilihat dari sisi yang berbeda, tindakan medis bidang kecantikan dilakukan oleh klinik kecantikan memiliki resiko di bidang medis. Konsumen dapat saja mengalami kerugian akibat tindakan medis bidang kecantikan yang dilakukan oleh Klinik Kecantikan. Oleh karenanya, perlindungan konsumen atas tindakan medis bidang kecantikan yang dilakukan oleh klinik kecantikan perlu pengaturan yang jelas.Permasalahan yang diangkat untuk dianalisa dan dijawab dalam penelitian ini yaitu bagaimana perlindungan konsumen atas tindakan medis bidang kecantikan dan bagaimana penyelesaian sengketa atas kerugian konsumen yang timbul akibat tindakan medis bidang kecantikan khususnya di Rejuvie Clinic.Hasil analisis menunjukkan bahwa perlindungan konsumen atas tindakan medis bidang kecantikan di Rejuvie Clinic dilakukan dengan perjanjian tertulis yang mengatur tindakan penyelesaian di bidang administratif, perdata maupun pidana dari resiko di bidang medis. Kata Kunci: Penyelesaian Sengketa; Perlindungan Konsumen; Tindakan Medis Along with the rapid progress of tourism in Bali, the arrival of foreign tourists to the island of the gods with the aim of travelling is increasing. The real implication seen from this condition is the existence of cultural exchanges including influences in the field of fashion and trend, especially the trend of beauty care in Bali. In the Consumer Protection Act regulated the rights and obligations of consumers and business actors so that there is a proportional relationship where the company earns profits or profits and consumers obtain goods / and or services so that there is a sense of satisfaction. Viewed from a different side, medical treatment in the field of beauty is carried out by beauty clinics at risk in the medical area. Consumers can experience losses due to medical measures in the field of beauty carried out by the Beauty Clinic. Therefore, consumer protection for medical actions in the area of beauty carried out by beauty clinics needs clear arrangements. Problems raised for analysis and answers in this study are how to protect consumers from medical actions in the field of beauty and how dispute resolution over consumer losses arises from activities medical field of vision especially at Rejuvie Clinic. The results of the analysis show that consumer protection for medical treatment in the beauty field at Rejuvie Clinic is carried out by written agreements that regulate settlement actions in the administrative, civil and criminal areas of risk in the medical field. Abstract

This paper has the title " Payment of claims by the Perusahaan AJB Bumiputera 1912 in the case of a default by the insured in the partner program scholarship plan " . The research method used in this paper is the Juridical Empirical , namely a state research gap das solen ( theory ) and das sein ( practice or reality ) that the gap between the theoretical state of the legal facts . In this paper , the issue raised is why the Perusahaan AJB Bumiputera 1912 pleaded no cancellation insurance agreement to the judge in the case of a default by the insured and how the payment of claims against the insured who are in default . The conclusion is AJB Bumiputera 1912 the Company did not plead to the judge because the cancellation is costing , time as well as a great power , so its cancellation can be done by both parties only and on payment of a claim , the policy will only be made if the insured already has a cash value .

Abstract

Incense is one of the results of the physical culture of the traditions that exist in Bali. There are some limitations that felt by the incense craftsmen. They have no ability to make a simple financial statement. Partners do not understand about sales system other than cash sales. Another sales system is believed to be able to attract more consumers, so that the sales value will increase. Partners also do not have an understanding of how to make a sales agreement. There are several problem solutions that are offered to overcome these obstacles. First, counseling on making a simple financial report, second is counseling on consignment sales system, and the last is counseling on making consignment sales agreement. After all of the work program are implemented, now the partner can make a daily cash note which is consist of daily cash notes on hand and daily cash notes on bank account . In addition, partner also know about consignment sales system and they can make a sales agreement. The work program already to improve the abilities and the skills of the craftsmen

Abstract

In this era of millennial global era, of course we are familiar with the term mobile banking. Mobile banking is one of the ways in which internet is used for promoting and making transactions of traditional products such as opening deposit account, transferring funds to another account as well as new banking products such as claims through the bank websites. Two problems are formulated in this study. The first problem is how the costumers are legally protected when they make transactions trough mobile banking, to what extend the bank is responsible for the loss possibly resulting from any transaction through the mobile banking. This study is classified as a normative legal study. What is meant is that the data needed was obtained by library research, meaning that the data was obtained from the secondary sources. The problem were analyzed using legal interpretation followed by theoretical argument based on the legal theories and concepts available. The results of the study show that the customers in transacting with the mobile banking system even though there are no provisions governing legal protection specifically, customers are still given legal protection both preventive and repressive by the provisions contained in the legislation relating to banks and consumer protection. Abstract

Secara fakta dapat diamati bahwa pengemudi angkutan tidak jarang melakukan tindakan yang diakibatkan kesengajaaan ataupun kelalaian yang berakibat pada kerugian bagi orang lain, yang dalam hal ini baik kerugian materiil ataupun kerugian immateriil. Hal tersebut dapat digambarkan seperti misalnya tindakan pengemudi yang sedang mengendarai kendaraannya secara tidak wajar dalam arti pada saat menjalankan tugas pengemudi sedang dalam keadaan tidak fit, lelah atapun dalam pengaruh alkohol atau obat terlarang yang tentu sangat berpengaruh terhadap kemampuannya untuk mengemudi kendaraan, sehingga terjadi kecelakaan dan menimbulkan kerugian bagi orang lain. Berdasarkan uraian tersebut maka peneliti merasa perlu untuk meneliti tingkat dan bentuk tanggungjawab perusahaan transportasi angkutan barang. Jenis penelitian yang dipergunakan dalam penelitian ini adalah jenis penelitian hukum empiris. Hasil daripada penelitian yaitu mengenai pengaturan pertanggungjawaban perusahaan angkutan dalam hal terjadi kerugian yang diakibatkan pengemudi selama kegiatan penyelenggaraan pengangkutan pada Kantor Pos Cabang Kamboja Denpasar dan PT. Maharani Prema Sakti Denpasar mengacu pada Undang-Undang No 22 Tahun 2009 Tentang Lalu Lintas Angkutan Jalan, yang dituangkan juga dalam perjanjian kontrak kerja antara perusahaan pengangkutan dengan pengemudi. Bentuk pertanggungjawaban perusahaan yakni Kantor Pos Cabang Kamboja Denpasar terhadap pengemudi, perusahaan sebelum memperkerjakan pengemudi sudah mengikutsertakan pengemudi tersebut dengan Asuransi. Namun apabila biaya asuransi masih kurang mencukupi untuk mem-back up pembiayaan pengemudi yang mengalami kecelakaan tersebut maka kekurangan biaya akan ditanggung oleh perusahaan. Sedangkan bentuk pertanggungjawaban pada perusahaan PT. Maharani Prema Sakti Denpasar yakni bertanggungjawab sesuai dengan isi daripada perjanjian kontrak kerja yang menyatakan tanggungjawabnya dalam nominal yang sudah ditentukan.

Abstract

The application of the Online Single Submission (“OSS”) is implemented by the government in order to streamline the business licensing process which has been considered very inefficient and requires a lot of time and money, requiring all Limited Liability Companies (“PT”) established under the laws of the Republic of Indonesia to obtain a Business Identification Number. (“NIB”) and further adjust the permits previously obtained by each of the PT, both those related to operations and non-operations, with the permits issued by OSS. As a result of the implementation of the OSS, companies that have applied for and obtained a Business Permit (Target Business Registration Certificate) but have not yet become effective, must fulfill other commitments, one of which is the Certificate of Feasibility of Function (“SLF”). The formulation of the problem in this study: (i) Application of the arrangement of the Function Feasibility Certificate (SLF) for buildings in the Province of Bali, (ii) the urgency of the implementation of the Commitment to the Certificate of Feasibility of Function (SLF) in the Province of Bali. This research uses normative legal research methods, with a statutory approach and legal concept analysis. The theory used in examining the problems in this research is the theory of economic law, the theory of state sovereignty and the conception of law as a policy process. Through this research, it can be determined the urgency of implementing the commitment to the Certificate of Functional Worth (SLF) for buildings in Denpasar City. Consistency of professional application based on justice, certainty and legal benefits by the government is needed so as to create economic growth through ideal and sustainable tourism in Bali. The benchmark for implementing the SLF commitment is by taking into account various legal factors and the efficiency of government policies in a deep, structured and systematic manner.

Abstract

Commercial players have greater and more comprehensive resources, marketing and relationships than consumers. It can even be said that consumers have relatively limited legal awareness and their rights as consumers, so that perpetrators are often treated unfairly against companies. The injustice in question can be observed in one of the advertisements. Entrepreneurs are not clear in the legislation on consumer protection, the structure of legal responsibility for advertising that harms consumers. This study aims to examine the philosophical nature of consumer legal protection in relation to harmful advertising. The method used in this study is a type of legal normative research method. Based on the results of the study, this study indicated that consumer protection arrangements in Indonesia are still not optimal considering that contracts do not cover the legal responsibilities of economic actors who broadcast products advertised by advertising companies. Of course, the philosophical aspects involved in looking at the Pancasila perspective are Precepts 2 and 5 which contain elements of human rights. The principle of fairness regarding the rights and obligations of entrepreneurs is therefore not balanced. More appropriate action is needed to strictly control the advertisements on broadcasters. This can become legal knowledge for consumers, law enforcement officers, businesses or broadcasters to pay attention to the advertisements that are broadcast so as not to cause consumers to lose right.

Abstract

Sejak bulan Mei 2022, kasus COVID-19 masih dilaporkan terjadi di Bali, tetapi jumlah kasus dan tingkat keparahannya sudah tidak mengkhawatirkan lagi seperti tahun-tahun sebelumnya. Bali sudah terbuka untuk wisatawan, baik wisatawan domestik maupun wisatawan internasional. Pariwisata mulai bangkit dan perekonomian pun berangsur-angsur pulih. Berbagai kegiatan, yang dikenal dengan sebutan MICE (meeting, incentive, conference, and exhibition), marak diselenggarakan di Bali. MICE akan terus berlangsung hingga puncaknya pada pertemuan G20. Ubud, sebagai salah satu destinasi wisata di Bali, mulai bangkit. Tujuan program kemitraan masyarakat ini adalah mempersiapkan Rumah Sakit Umum Ari Canti untuk membuka klinik wisata (travel clinic), yaitu dengan memberdayakan kelompok pekerja sesuai dengan latar belakang mereka. Mitra pengabdiam masyarakat adalah kelompok pekerja, yang meliputi kelompok klinis dan non klinis. Kelompok klinis meliputi dokter umum, perawat, dan apoteker; sedangkan kelompok non klinis terdiri dari staf administrasi dan pemasaran. Mula-mula dilakukan telusur lapangan, telusur dokumen, dan wawancara kelompok pekerja uantuk mendapatkan gambaran umum sehingga masukan atau saran yang diberikan sesuai dengan keadaan di lapangan. Selanjutnya dilakukan bimbingan teknis kesehatan pariwisata dengan mengacu pada kerangka keilmuan yang dipublikasikan oleh The National Travel Health Network and Centre (NaTHNaC) bagi kelompok pekerja klinis dan kode etik rumah sakit mengacu pada kode etik rumah sakit yang ditetapkan oleh Perhimpunan Rumah Sakit Seluruh Indonesia bagi kelompok pekerja non klinis.

Abstract

The 1945 Constitution of the Republic of Indonesia clearly states that the State of Indonesia is a state of law. If an invention or work, it must be identical to a patent that is then filed by an Intellectual Property Consultant. What is meant by this patent is that it must belong to the inventor or creator. Therefore, researchers want to know more about the above, which can be formulated. The problem is about the legal arrangement of the position of intellectual property rights consultants in the registration of patent rights according to patent law and legal consequences if there is a violation by an intellectual property rights consultant in the registration of patent rights. This research uses a normative type, namely research by analyzing literature based on the legal materials used. The legal basis for intellectual property rights consultants is regulated in the Government Regulation of the Republic of Indonesia Number 2 of 2005 concerning Intellectual Property Rights Consultants. The use of a person's patent rights without permission has an impact on legal consequences and can be entangled in accordance with the articles in Law Number 13 of 2016 concerning Patents.
