Abstract

Cultural and structural injustice resulting from the difference in genre which has been strongly adhered to by the Balinese community has been responsible for divorce, its settlement, and its implication on the Balinese women in Denpasar City. This study was intended to deconstruct, anticipate and implant the concept of structural and cultural injustice resulting from the difference in genre. The data were qualitatively analyzed using the analysis of gender. The theories used were the critical theory of postmodern such as the theory of hegemony and the theory of deconstruction and the other critical theories which are relevant to the present study. The result of the study shows that the divorce undergone by the Balinese women was the manifestation of the structural and cultural injustice resulting from the difference in gender. The decisions made through the traditional law and the Act Number 1 of 1974 concerning Divorce are still biased in regard to genre. The divorce undergone by the Balinese women affected the related families (the ex-wife’s family, the ex-husband’s family, and the other families related to them. The patriarchal ideology caused the Balinese women to be marginalized and subordinated and sensitive to both physical and psychological coercions. Economically, they were also neglected. The injustice in gender could also be eternalized through legal regulations. The Act Number 1 of 1974 concerning Marriage is still biased; it still refers to the traditional law which benefits men in divorce.

Abstract

The Violation of tourism in Bali is currently happening covers from various sectors of tourism, which is one of the sector is a guide as an intermediary deliver an explanation about existing attractions in Bali to tourists who are visiting. There are several requirements that are listed to be a legal guide, which has been set in the Bali Provincial Regulation No. 5 in 2008 about the Guides. The problems that occurred, the first is how the effectiveness of the Bali Provincial Regulation No. 5 in 2008 in province of Bali, the second is what kind of factors which is become a barriers to effective implementation of Bali Provincial Regulation No. 5 in 2008 in province of Bali. Conducted legal research is empirical legal research, which use techniques data collecting that is interview. Conclusions from the study showed that the number of offenses committed by the guides in the province of Bali is still in existence. The main limiting factor is the Human Resources (HR) which is still inadequate, so under the supervision of the guides is so weak.

Abstract

Customary law is the law of life and as a guideline to behave in social life. While the government through Presidential Decree No. 9 of 2000 on Gender Pengharusutaan in National Development. In connection with these two problem are; 1). What is the meaning of the gender ideology? and 2). How the ideological implications of the customary law of Bali? This study is a socio-legal, where field data as primary data. The results of the study addressed that there are two groups; The first group's view justify Balinese customary law is sound and reflects the uniqueness of Balinese society, women are not involved in decision-making in the family, a decision was taken on the deal man. In the field of inheritance girls are not taken into account. So the first group did not reflect the views of gender ideology, while the second group's view, gave the reason that customary law is difficult to change, to change requires public awareness, awig-awig has not set things up in accordance with the development of society and legislation can be made perarem. Most respondents have not gender responsive and only a small portion gender responsive and progressive-minded. Thus gender ideology customary law is not implicated in Bali. Factors that become barriers that the legal culture of the Balinese people, the patriarchal customary law is still strong binding Balinese life. The conclusion that the meaning of gender ideology implies equality of men and women and it is not affected by the customary law of Bali, because of the legal culture of society and customary law still strong binding. Hukum adat adalah hukum kehidupan dan sebagai pedoman untuk berperilaku dalam kehidupan sosial. Sedangkan pemerintah melalui Keputusan Presiden Nomor 9 Tahun 2000 tentang Kesehatan Jender dalam Pembangunan Nasional. Sehubungan dengan kedua masalah tersebut adalah; 1). Apa arti ideologi gender? Dan 2). Apa implikasi ideologis hukum adat Bali? Penelitian ini bersifat sosio-legal, dimana data lapangan sebagai data primer. Hasil penelitian menyebutkan bahwa ada dua kelompok; Pandangan kelompok pertama tentang membenarkan hukum adat Bali adalah suara dan mencerminkan keunikan Bali, wanita tidak terlibat dalam pengambilan keputusan di dalam keluarga, sebuah keputusan dibuat berdasarkan kesepakatan manusia. Di bidang warisan anak perempuan tidak diperhitungkan. Jadi kelompok pertama tidak mencerminkan pandangan ideologi gender, sedangkan pandangan kelompok kedua, dengan alasan bahwa hukum adat sulit untuk berubah, untuk berubah membutuhkan kesadaran masyarakat, awig awig tidak mengatur segala sesuatu sesuai dengan perkembangan masyarakat. Dan perundang-undangan bisa dibuat perarem. Sebagian besar responden belum responsif terhadap gender dan hanya sedikit yang responsif terhadap gender dan progresif. Dengan demikian ideologi gender hukum adat tidak dilibatkan di Bali. Faktor-faktor yang menghambat budaya hukum masyarakat Bali, hukum adat patriarkhi masih mengikat kehidupan masyarakat Bali yang kuat. Kesimpulan bahwa makna ideologi gender menyiratkan kesetaraan laki-laki dan perempuan dan tidak terpengaruh oleh hukum adat Bali, karena budaya hukum masyarakat dan hukum adat yang mengikat.

Abstract

This study aims to find and analyze the legal status of women who marry into the family in the event of a divorce and society's views on their nationality. This is an empirical legal research with a non-doctrinal approach, which emphasizes field data. The data were collected using interview techniques, the data were processed and analyzed in a qualitative way and the findings were presented in descriptive analytical form.The findings of the study show that women suffer from divorce, have clear and unclear legal status. Obviously, accepted by parents and family, returned as family members. It is not clear because the parents and their families did not accept returning to their original home so that their status was floating (ngambang). It is not clear who will have a very fatal impact in the future in terms of his death, who is responsible, especially according to custom and religion. The public's view of their nationality varies greatly, namely a small proportion is still extreme by considering that they are no longer a tri-wangsa dynasty, but those who are more do not question it. This is reflected in the Balinese language used to communicate, there is no change. Against the extreme conditions where there are still Balinese people who uphold outdated customary values, it is not in line with the State law on Human Rights (women). Penelitian ini bertujuan untuk menemukan dan menganalisis tentang status hukum perempuan kawin nyerod dalam keluarga dalam hal terjadi perceraian dan pandangan masyarakat terhadap kewangsaannya. Ini penelitian hukum empiris dengan pendekatan non doktrinal, yang menekan pada data lapangan. Data dikumpulkan dengan teknik interview, data diolah dan dinalisis dengan cara kualitatif serta temuannya dipresentasikan dalam bentuk deskriptif analitis.Temuan penelitian menunjukan bahwa perempuan nyerod yang bercerai, status hukumnya ada yang jelas dan tidak jelas. Jelas karena diterima oleh orang tua dan keluarga, kembali sebagai anggota keluarga. Tidak jelas karena kembali ke rumah asal tidak diterima oleh tua dan keluarganya sehingga statusnya menggatung (ngambang). Tidak jelas membawa dampak yang sangat fatal ke depannya dalam hal kematiannya, siapa yang bertanggung jawab terutama secara adat dan agama. Pandangan masyarakat terhadap kewangsaannya, sangat bervariasi yakni sebagian kecil masih bersifat ekstrim dengan menganggap bukan lagi sebagai wangsa tri wangsa, tetapi yang lebih banyak tidak mempermasalahkannya. Hal tersebut tercermin dari bahasa Bali yang dipakai berkomunikasi tidak ada perubahan. Terhadap kondisi yang ekstrim dimana masih adanya warga masyarakat Bali yang menjujung tinggi nilai-nilai adat yang sudah usang, tidak selaras dengan hukum Negara tentang Hak Asasi Manusia (perempuan).

Abstract

Traditional village (Pakraman) is an indigenous people who have the authority to manage his own household, and the authority was born out of thevillage so it is often referred to as having genuine autonomy. On the other handwith the establishment of the state covering the entire area of the country wherethe indigenous villages were then raised the issue regarding the implementationof autonomy in relation to the traditional village authorities also state that givesautonomy to the region in accordance with the centralized system that wasfollowed. That's why it is necessary to examine the existence of a traditionalvillage in Bali autonomy within the framework of regional autonomy especially intourist object  management. This study were classified in empirical legal research can be seen in thestudy area were selected using purposive sampling method, it can be seen thatinitially the traditional village autonomy is not recognized in the context ofmanaging a tourist object because of the traditional village is not at all involvedin the management of tourist objects. It was only through an uphill battle, evenwith through demonstrations, traditional village involved in the management of atourist attraction. In the original development management involving privateparties as well as third party, then is only managed as a form of cooperationbetween local government and the Desa Pakraman only somewhat proportionaloutcomes assessed, although there are groups of people who do not approve evensueing Bendesa Desa Pakraman. The cooperation in tourism managementproficiency level set forth in a letter of the Collective Agreement between theGovernment and Bendesa Desa Pakraman.

Abstract

This study aimed to determine the knowledge of indigenous people of Bali against theConstitutional Court No.46 / PUU-VII / 2010, meaning the Constitutional Court rulingrelated to the child outside the mating position, to identify and analyze the attitudes ofindigenous communities Bali on the discharge of the Constitutional Court. This study is anempirical law with non-doctrinal approach (socio legal research).The results showed that indigenous people in general do not yet know Bali Court DecisionNo.46 / PUU-VII / 2010 was. Meaning beyond mating gives children the same rights aschildren born within marriage. Balinese people’s attitudes related to this decision, can beclassified into two: 1. Most accept the decision of the reason; children outside the matingstatus to clear, the mother can claim responsibility for the biological father of the child,the child is no longer despised in the family and society. 2. small Sebagain reject reason;children outside mating can cause problems in inheritance in biological father, contraryto the customary law of Bali, girls may prefer not to marry. The attitude of the indigenouspeoples of Bali pros and cons of the legal culture of society.Conclusion: Its meaning is to give children the right to marry outside the same as childrenborn within marriage. Balinese customary law community in general have not been awareof the Constitutional Court. Balinese people’s attitudes towards the Constitutional Courtruling pro and cons.

Abstract

Different weddings are still a polemic for the custom society of Bali until now, even though they have been normatively removed by Decree No. DPRD. 11 of 1951. This study aims to elaborate and analyze the notion of a marriage of different ancestors and the legal culture of Balinese indigenous peoples related to the marriage. The research method used is empirical legal research by prioritizing field data as primary data extracted by interviews. The type of pedestal is socio-legal. The results show that the marriage of different wangsa is a marriage between tri wangsa women and jaba wangsa men, while the legal culture of Balinese indigenous people towards marriage is as follows; most of the respondents no longer maintained their interfaith marriage in full meaning that the term was not discarded from the family, there was no ceremony for the decline of the house for the woman, and there was no change in calling her parents. This happens because of the development and progress in the fields of education, science, and information technology that change the mindset of some citizens. A small number of respondents still maintain an old tradition that is formally juridically revoked based on the Bali DPRD Decree No. 11 of 1951, wanted to maintain its nationality, respect the old customary law and lack of understanding of applicable law. Perkawinan beda wangsa masih merupakan polemik bagi masyarakat adat Bali hingga kini , walaupun secara normative sudah dihapus dengan Keputusan DPRD No. 11 Tahun 1951. Penelitian ini bertujuan untuk mengelaborasi dan menganalisis pengertian perkawinan beda wangsa dan budaya hukum masyarakat adat Bali terkait perkawinan tersebut. Metode penelitian yang dipakai adalah penelitian hukum empirik dengan mengutamakan data lapangan sebagai data primer yang digali dengan wawancara. Jenis pendekatannya adalah socio-legal. Hasil menunjukkan bahwa perkawinan beda wangsa adalah perkawinan antara perempuan tri wangsa dengan laki-laki jaba wangsa, sedangkan budaya hukum masyarakat adat Bali terhadap perkawinan tersebut adalah sebagai berikut; sebagian besar responden tidak lagi mempertahankan secara utuh perkawinan beda wangsa tersebut artinya tidak dilakukan istilah dibuang dari keluarga, tidak dilakukan upacara penurunan wangsa bagi si perempuan, dan tidak ada perubahan dalam memanggil orang tuanya. Hal tersebut terjadi karena perkembangan jaman dan kemajuan di bidang pendidikan, ilmu pengetahuan, dan teknologi informasi yang mengubah pola pikir dari sebagian warga masyarakat. Sebagian kecil responden masih ada mempertahankan tradisi lama yang secara yuridis formal sudah dicabut berdasarkan Keputusan DPRD Bali No. 11 Tahun 1951, ingin mempertahankan kewangsaannya, menghormati hukum adat yang sudah usang dan kurangnya pemahaman tentang hukum yang berlaku.

Abstract

Bali with the majority of its population embracing Hindu religion with patrilineai and caste system, in Marital law in force a national law Marriage Act No. 1174, which still allows the enforcement of the customary adat law. Those are of course influence the characteristic of the marriage and divorce, especially the type of marriage and the consequences of the status of wife and husband in marriage, right and obligation, authority over the children and properties. Furthermore, the status of wife I women if divorce take place, The women I wife as a widow is not automaticaliy return to her family of origin according to the type of marriage and the caste between husband and wife and many conditions must be fulfilled, if the conditions are not fulfilled, the divorced women will be trapped in uncertain and problematic status position, in which the man /male always get the benefit in all kind of ways
