Abstract

The purpose of this study is to analyze the implementation of the Special Service Room for Children in the Investigation of Children in Conflict with the Law at the Rokan Hilir Police, to analyze the obstacles to the implementation of the Special Service Room for Children in the Investigation of Children in Conflict with the Law at the Rokan Hilir Police, and to analyze efforts to overcome obstacles in the implementation of the Special Service Room for Children in the Investigation of Children in Conflict with the Law at the Rokan Hilir Police. The method used is sociological legal research. Based on the results of the study, it is known that the Implementation of the Special Service Room for Children in the Investigation of Children in Conflict with the Law at the Rokan Hilir Police that the special service room for children at the Rokan Hilir Police has not run as it should be mandated by Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, this is because there is no special service room for children in the investigation of children in conflict with the law. This room is not only a place for examination, but also a place for protection and psychological recovery for children. Obstacles are budget limitations and physical infrastructure limitations, lack of competent human resources, weak coordination between institutions, and the lack of collective awareness of the community about the importance of a just legal approach to children.

Abstract

The phenomenon of child sexual exploitation shows an alarming trend. Although the number of cases is not always high quantitatively, the impact on victims is extremely serious and multidimensional affecting physical, psychological, social aspects, and the child’s future. Reported cases often involve girls under the age of 18 who fall victim to people close to them, such as familiar adults, neighbors, or even family members. In several instances, victims are drawn into covert prostitution networks, either directly or through social media, where they are lured with promises of money, jobs, or even love, only to end up being trafficked and sexually exploited. The aim of this research is to analyze Legal Protection for Children Victims of Sexual Exploitation in the Jurisdiction of Siak Police, to examine the obstacles in providing such protection, and to explore solutions to overcome these challenges. This study uses a sociological legal research method. Based on the findings, it is revealed that while legal protection for children victims of sexual exploitation in the jurisdiction of Siak Police is already in place, its implementation is not yet optimal, due to various challenges both in law enforcement and victim support services. This is evident from the continued occurrence of child sexual exploitation cases, both those that have been handled and those that remain undisclosed. This situation shows that, although legal instruments and related institutions exist, their implementation at the practical level is not yet fully effective in providing maximum protection to children as the most vulnerable group. One key indicator of the inadequacy of legal protection is the recurring cases of child sexual exploitation. These cases occur not only in private environments such as homes or schools but also in public spaces, which should be safe for children.

Abstract

Local governments and law enforcement agencies must promote legal education, improve the economic conditions of nearby communities, and strengthen security systems in areas vulnerable to theft. In this way, law enforcement can be more balanced: ensuring legal certainty, providing protection to victims, and acknowledging the humanitarian aspects concerning offenders who steal out of economic necessity. The aim of this study is to analyze Law Enforcement Against the Criminal Act of Palm Oil Theft in the Jurisdiction of the Bengkalis Police, to examine the obstacles to enforcement, and to identify efforts to overcome these obstacles. The method used in this research is sociological legal research. Based on the research findings, law enforcement against palm oil theft in the Bengkalis jurisdiction has not been effectively implemented. This is evidenced by the increasing frequency of palm oil theft cases within short time intervals. Although the police have taken various repressive measures, these crimes continue to recur and even tend to escalate. The public has become aware of how to circumvent legal repercussions, particularly regarding the threshold of financial loss stipulated in Supreme Court Regulation (Perma) Number 2 of 2012, which states that theft causing losses below Rp2,500,000 can be classified as a minor offense (tindak pidana ringan, or tipiring). Many offenders intentionally limit the amount of fresh fruit bunches (FFB) stolen to keep the value below this threshold. This tactic is deliberately used to avoid full criminal prosecution or harsher penalties. Obstacles in enforcing the law against palm oil theft in the Bengkalis region include: A lack of deterrent effect due to lenient penalties, Difficulty in proving the crime and calculating actual losses, Manipulation of stolen goods’ value by offenders, Socio-economic challenges faced by the surrounding communities.

Abstract

Clandestine prostitution through massage parlors in the jurisdiction of Polresta Pekanbaru exemplifies how social crimes have evolved over time by exploiting regulatory loopholes. This form of prostitution is concealed under the guise of legitimate massage or spa services, making it difficult for law enforcement agencies to detect. In reality, these services involve sexual activities managed by pimps. The aim of this study is to analyze law enforcement efforts against pimps involved in clandestine prostitution in massage parlors within the jurisdiction of Polresta Pekanbaru, to identify the obstacles hindering such enforcement, and to explore strategies to overcome these challenges. The research employs a sociological legal method. The findings indicate that law enforcement efforts in this context have not been fully effective. Although the police and related agencies have undertaken enforcement actions, prostitution under the cover of massage parlors continues to thrive. These establishments often offer hidden sexual services. Operators or pimps typically disguise these activities using coded language with regular clients or through closed digital communication networks. This demonstrates that pimps have developed more sophisticated and discreet operational systems that are difficult for law enforcement to detect directly. Several obstacles hinder effective law enforcement: First, massage parlors often continue operating covertly after being raided, simply by changing their business name, location, or service format. Second, the absence of consistent and routine monitoring by both law enforcement and regulatory agencies allows these operations to resume freely. Third, the lack of legal education and awareness programs at the community level contributes to public ignorance, making people less likely to participate in prevention or report prostitution-related activities. To overcome these challenges, several efforts are necessary. First, there must be strengthened administrative oversight and improved business licensing verification systems. Second, a joint task force comprising multiple government agencies should be established to conduct regular inspections and supervision of locations suspected of facilitating clandestine prostitution. Third, law enforcement and local governments should initiate community-based legal education programs, particularly in areas vulnerable to or near suspected prostitution sites.

Abstract

Penelitian ini membahas penegakan hukum terhadap anak-anak yang terlibat dalam tindak pidana pencurian dengan kekerasan di wilayah hukum Kepolisian Resort Kota Pekanbaru. Anak-anak sebagai pelaku kejahatan seringkali menjadi fokus perhatian karena usia mereka yang masih di bawah batas usia dewasa. Penelitian ini menggunakan pendekatan kualitatif dengan menganalisis data dari berbagai sumber, seperti studi kasus, dokumen hukum, dan wawancara dengan pihak terkait. Temuan menunjukkan bahwa penegakan hukum terhadap anak-anak pelaku tindak pidana pencurian dengan kekerasan melibatkan berbagai aspek, termasuk hukum pidana, rehabilitasi, dan perlindungan hak-hak anak. Kepolisian Resort Kota Pekanbaru menerapkan pendekatan yang berorientasi pada perlindungan anak, dengan memperhatikan aspek keadilan restoratif dan upaya untuk memahami faktor-faktor penyebab keterlibatan anak dalam kejahatan. Tantangan utama dalam penegakan hukum terhadap anak-anak pelaku kejahatan adalah menemukan keseimbangan antara kebutuhan untuk memberikan sanksi yang sesuai dengan kejahatan yang dilakukan dan upaya untuk memperbaiki perilaku serta memberikan kesempatan kepada anak-anak tersebut untuk berubah. Perlunya kerja sama lintas sektor antara kepolisian, lembaga perlindungan anak, pemerintah daerah, dan masyarakat menjadi krusial dalam upaya pencegahan serta rehabilitasi anak-anak pelaku tindak pidana. Penelitian ini menggarisbawahi pentingnya pendekatan holistik dalam menangani anak-anak sebagai pelaku kejahatan. Menyediakan sanksi yang proporsional sekaligus memberikan kesempatan untuk rehabilitasi dan reintegrasi sosial bagi anak-anak pelaku kejahatan merupakan aspek penting dalam menjaga keseimbangan antara penegakan hukum dan keadilan terhadap anak-anak yang terlibat dalam tindak pidana.

Abstract

Transformasi budaya hukum merupakan suatu proses yang penting dalam meningkatkan kesadaran hukum di masyarakat multikultural. Penelitian ini bertujuan untuk menganalisis bagaimana hukum dapat diadaptasi dengan nilai-nilai budaya lokal dalam masyarakat yang memiliki keberagaman budaya. Proses ini melibatkan dialog antara hukum formal dan norma-norma sosial budaya yang sudah ada, dengan tujuan menciptakan hukum yang relevan dan diterima oleh masyarakat. Hasil penelitian menunjukkan bahwa kesadaran hukum masyarakat sangat dipengaruhi oleh nilai-nilai budaya yang berlaku di komunitas mereka, sehingga hukum perlu dirancang dengan memperhatikan norma budaya lokal untuk memperoleh legitimasi dan efektivitas. Pendekatan yang inklusif dan berbasis budaya sangat penting untuk membangun sistem hukum yang adil, harmonis, dan dapat diterima oleh masyarakat multikultural.

Abstract

The rights of the people constitute a fundamental element of Indonesia's constitutional system and are directly guaranteed by the 1945 Constitution of the Republic of Indonesia as well as by statutory regulations derived from it. These guarantees encompass civil, political, economic, social, and cultural rights that must be respected, protected, and fulfilled by the state through clear, transparent, and accountable legal policies. This study aims to analyze the forms of legal guarantees for community rights, their implementation within the national legal framework, and the challenges encountered in achieving effective protection. The findings indicate that although the normative framework is comprehensively regulated, its practical implementation still faces various obstacles, such as regulatory inconsistencies, weak law enforcement, and low public awareness of their rights. Therefore, strengthening regulations, enhancing the capacity of state apparatus, and improving public education are essential to ensuring that community rights are fully and equitably realized.

Abstract

In many cases, perpetrators attempt to cover their tracks by killing the victim, making biological evidence difficult to find. This requires the police to work extra hard to collect forensic evidence and witness statements. The purpose of this study is to analyze law enforcement in cases of murder followed by sexual violence against children based on Law Number 17 of 2016 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection at the Indragiri Hulu Police. The method used is sociological legal research. Based on the results of the study, it is known that law enforcement in cases of murder followed by sexual violence against children based on Law Number 17 of 2016 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection at the Indragiri Hulu Police that the authorities have implemented the provisions of Law Number 17 of 2016 strictly. This regulatory change provides a strong legal basis for investigators in applying the maximum criminal threat, including the death penalty, life imprisonment, or other aggravating crimes. The investigation process is directed to fulfill the principles of child protection, victim justice, and legal certainty. Obstacles such as the limited number of investigators with specialized competencies in handling child-based crimes, the lack of comprehensive forensic facilities, and the often-impeded availability of post-mortem examinations and laboratory results contribute to slow investigations. Furthermore, this contributes to the deep trauma experienced by victims and their families. Efforts to overcome these obstacles include increasing the capacity of officers through specialized training in handling sexual violence against children. Local governments and law enforcement institutions also need to strengthen supporting facilities. Coordination with integrated service agencies must be improved to expedite the process of establishing evidence and providing assistance to victims.

Abstract

Criminal law reform in Indonesia has emerged as a pressing demand in line with the development of democratic principles and the need to enforce the law fairly and effectively. Changes in the criminal justice system are not merely adjustments to legal norms but also reflect society’s aspirations for justice, the protection of human rights, and the accountability of law enforcement authorities. This article analyzes the direction of criminal law reform, emphasizing the importance of democratizing law enforcement processes, including the modernization of criminal regulations, the application of the due process of law principle, and the enhancement of judicial institutions’ roles in ensuring legal certainty and protecting individual rights. Criminal law reform in Indonesia also requires an evaluation of law enforcement procedures that have historically been repressive and less responsive to democratic principles. This includes revising criminal laws, strengthening oversight mechanisms for law enforcement officers, and implementing a restorative justice approach that emphasizes both offender rehabilitation and victim recovery. The study shows that democratizing criminal law enforcement requires not only legislative changes but also a shift in legal culture, increased transparency, and public participation in the legal process. Moreover, this article highlights challenges arising in criminal law reform, such as bureaucratic resistance, disparities in access to justice, and potential conflicts between security needs and the protection of individual rights. Addressing these challenges requires comprehensive strategies, including legal education for the public, professional training for law enforcement officers, and the strengthening of independent oversight institutions. The overall process of criminal law reform based on democratic principles is expected to enhance the legitimacy of the criminal justice system, reduce crime rates, and create a more just and civilized society.

Abstract

Criminal law reform in Indonesia marks a significant shift from the old Penal Code (KUHP) to the new KUHP, aimed at strengthening law enforcement, ensuring legal certainty, and protecting human rights (HR). This reform reflects the necessity of a modern criminal justice system that is responsive to democratic demands and oriented towards substantive justice. One of the main aspects of the reform is the emphasis on progressive legal principles, including the protection of human rights during law enforcement processes and recognition of victims' rights. The new KUHP introduces more diversified punishment mechanisms, alternative criminal resolutions, and clearer provisions regarding criminal liability, including for corporate crimes. The reform underscores the importance of balancing state interests with individual protection within the criminal justice system. Thus, law enforcement focuses not only on repressive aspects but also on preventive, restorative, and rehabilitative measures. This study highlights the transformation of criminal norms, changes in legal structures, and the practical impact of the new KUHP on law enforcement practices in Indonesia. The analysis employs normative and descriptive juridical approaches, examining amended, deleted, or added articles and their implications for criminal justice institutions, including the police, prosecutors, courts, and correctional facilities. The results indicate that KUHP reform not only updates legal norms but also shifts the paradigm of law enforcement towards a more humane and democratic approach. Implementation challenges, such as law enforcement capacity, public awareness, and harmonization with other regulations, are crucial factors determining the effectiveness of this reform. In conclusion, the new KUHP represents a significant milestone in establishing a fair, transparent criminal law system oriented towards human rights protection, while simultaneously strengthening the legitimacy of law enforcement in Indonesia.
