Abstract

PT. Jasa Marga (Persero) Tbk, merupakan perusahaan pemerintah yang diberikan mandat untuk pengusahaan Jalan Tol. Dalam pengusahaan ini, yang mencakup salah satunya pemeliharaan, dapat mengikutsertakan badan usaha lain (swasta) yang dilaksanakan dengan suatu kontrak, Kontrak Pemborongan Pekerjaan Pemeliharaan Rutin Kebersihan Jalan dan Pertamanan Rual Jalan Tol Regional Jabodetabek-Jabar. Dengan metode penilitian yang dilakukan dengan pendekatan yuridis normatif  berdasarkan bantuan data hukum secara yuridis empiris, untuk menganalisis  bagaimana pelaksanaan perjanjian kontrak kerja jasa pemborongan pekerjaan pada PT. Jasamarga Regional Jabodetabek Jabar ditinjau dari Kitab Undang-undang Hukum Perdata (Burgelijke Wetboek) dan bentuk pengoptimalan pelaksanaan perjanjian kontrak kerja jasa pemborongan pekerjaan tersebut. Berdasarkan penelitian dengan menganalisis sumber data yang diperoleh, hasilnya bahwa kontrak  pekerjaan jasa pemborongan perawatan rutin jalan dan pertamanan ruas jalan tol regional Jabodetabek-Jabar Tahun 2019 (Kontrak Paket JT-01 2019) dalam pelaksanaannya dilimpahkan ke pihak lain, yang seharusnya berdasarkan peraturan tidak dibolehkan, namun dalam pengoptimalan terhadap kontrak yang menyangkut pengusahaan jalan tol dapat  dialihkan kepada badan usaha yang memiliki spesifikasi pekerjaan sesuai dengan kontrak tersebut.  Selain itu, agar dalam pelaksanaan kontrak perlu adanya Dewan Pengawas untuk mengawasi jalannya pekerjaan dan pada kontrak tersebut penting untuk dicantumkan ketentuan sistem pembayaran otomatis, sehingga tidak merugikan pihak yang melaksanakan pekerjaan jika terjadi keterlambatn pembayaran sebagai bentuk kepastian hukum dan perlindungan terhadap para pihak.

Abstract

Lembaga anti rasuah di Indonesia (KPK) dengan struktur yang ada, telah melakukan berbagai cara, baik untuk pemberantasan maupun pencegahan korupsi di Indonesia. Upaya di bidang penindakan mengalami peningkatan pada tahun berikutnya. Usaha keras menghapus dan mencegah korupsi oleh KPK patut mendapatkan apresiasi. IPK Indonesia tahun 2018 naik sedikit hingga mencapai 38, namun jika dilihat dari perspektif tingkstan, maka negara Indonesia yang masih di angka 89, dengan nilai kosong (0) adalah negara yang paling korup dan nilai seratur (100)merupakan negara  yang dipersepsikan tidak melakukan korupsi, maka masih perlu untuk di tingkatkan. Berbagai cara harus dilakukan untuk memberantas dan mencegah korupsi di Indonesia, baik melalui jalur penegakan peraturan, jalur penegakan etika (moral dan iman), jaluir pendidikan dan jalur sosio-kultural. Hanya dengan segala upaya dan semangat juang yang tinggi, Indonesia segera terbebas dari korupsi.

Abstract

Regulatory reform is a priority program as stated in the strategic plan and work plan of the current Government. The urgency of regulatory reform is based on the condition of national regulations that are hyperregulated, inconsistent, disharmony (vertical and horizontal). Regulatory Mapping and Review (RMR) is an innovative tool that can be used to assess the quality of a large number of regulations. It is expected to be able to support regulatory reform programs. In RMR, the analysis and evaluation method uses qualitative and quantitative approaches. RMR can, in fact, help improve the quality of regulations within the Ministry of Maritime Affairs and Fisheries. The stages in RMR begin with an inventory, mapping and review/analysis of a large number of regulations, which outputs in the form of recommendations to the Ministry of Maritime Affairs and Fisheries in improving regulations that are considered problematic or formulating regulations that will be issued, making it easier for the Government to produce quality regulations and be effective in their implementation. On the other hand, RMR in fact supports efforts to simplify the number of regulations, so that an ideal number of regulations can be produced in accordance with needs, without conflict both vertically and horizontally and in an efficient and effective manner.

Abstract

Regional Regulation (Perda) Number 1 Bogor Regent. 3 of 2013 Regarding Social and Environmental Responsibility is a regulation issued by the Bogor City Regional Government to regulate the responsibilities of the business world in protecting the environment and carrying out social activities in the environmental sector. Objective: The main objective of this sector regulation is to ensure that every business operating in Bogor Regency is socially and environmentally responsible, and makes an active contribution to regional development and the welfare of the local community. Method: Regional regulatory system. Bogor Number 3 of 2013 is a regional regulation issued by the Bogor City Government in Indonesia regarding social and environmental responsibility. This regulation aims to explain the obligations and responsibilities of individuals, businesses and organizations related to social welfare and environmental protection in the jurisdiction of the Bogor Regent.
