Abstract

Penelitian ini bertujuan untuk mengetahui apakah kemandirian belajar berpengaruh terhadap kemampuan pemecahan masalah siswa. Penelitian ini menggunakan metode literatur review, dengan analisis deskriftif dan data yang di peroleh dengan data sekunder. Hasil penelitian menunjukan bahwa terdapat bebererapa hal yang harus diperhatikan dalam merealisasikan kemandirian belajar, seperti adanya motivasi dalam diri peserta didik terlebih dahulu, rasa ingin bisa belajar secara mandiri, tanggung jawab dan percaya diri bahwa bisa menyelesaikan permasalah dalam menghadapi materi pembelajaran. Kemandirian bisa dilakukan dengan didukung oleh fasilitas dan metode dalam kegiatan pembelajaran, perlu adanya pembiasaan mulai sejak dini dalam membiasakan memanfaatkan teknologi, gaya belajar dan belajar mandiri agar terbiasa dengan hal-hal baru. Agar peserta didik lebih terbiasa dengan belajar mandiri.

Abstract

Pembelaan terpaksa (noodwer) ialah tindakan melawan hukum dalam upaya membela diri ketika harta benda, properti, atau kehormatan orang lain diancam. Dalam situasi yang mendesak, tindakan ini dilakukan. Penelitian ini bertujuan untuk menggali apa dan bagaimana batasan yang sudah ditentukan oleh undang-undang maupun pandangan/doktrin tentang pembelaan terpaksa. Penelitian ini dalam penulisannya menggunakan metode yuridis-normatif dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Pembelaan terpaksa yang dilakukan seseorang dapat menjadi alasan penghapus pidana, tetapi harus tetap memenuhi syarat dan batasan yang telah ditentukan. Batasan-batasan itu antara lain: (1) perbuatan yang diperbuat terpaksa harus dilakukan untuk mempertahankan diri, (2) pembelaan harus dilakukan jika ada serangan terhadap badan, kehormatan dan barang diri sendiri atau orang lain. (3) harus ada serangan yang melawan hak dan/atau mengancam keselamatan diri. Hak membela diri yang terkandung dengan pembelaan terpaksa ini terkait dengan amanat Pasal 28A UUD 1945 yang mengatur bahwa setiap orang berhak hidup serta berhak mempertahankan kehidupannya. Lalu di Pasal 49 KUHP diberi penjelasan secara rinci tentang tidak dipidananya seseorang yang melakukan pembelaan diri/pembelaan terpaksa dengan memenuhi syarat dan batasan yang telah ditentukan. Syarat dan batasan yang telah ditentukan tersebut harus dibuktikan kemudian. Jika didapati bahwa syarat dan batasan tersebut tidak dipenuhi, maka alasan penghapusan pidana tidak dapat diperoleh, dan bisa berbanding terbalik dengan memperoleh hukuman yang diberikan majelis hakim.

Abstract

Maternity Rights are part of human rights and are inherent in women to obtain freedom from discrimination, equality, and harassment as regulated in the International Convention for the Protection of Maternity or ILO Convention Number 183 of 2000. Although Indonesia has established women's rights in the form of laws and regulations, the regulations are not in accordance with the standards set by the ILO, one of which is at PT. S. In the treatment of pregnant workers, the ILO has established special regulations to protect employment status and workers' rights, one of which is maternity protection. The problem is, whether PT. S's actions towards one of its female workers regarding maternity leave rights are in accordance with the ILO Convention standards and how PT. S's efforts can fulfill the fulfillment of maternity rights for female workers based on the ILO Convention. This research is a normative research, with a descriptive analytical nature and drawing conclusions with deductive logic. The result is that the fulfillment of maternity leave rights for one of its female workers at PT. S is not in accordance with the standards in Article 3 of the ILO Convention Number 183 of 2000 in providing the duration of maternity leave and health insurance for the rights of female workers.

Abstract

The principle of non-intervention is one of the fundamental norms in the ASEAN organisation that upholds the sovereignty of its member states. This can be seen from various ASEAN legal frameworks that explicitly state the principle. However, this principle poses a dilemma for ASEAN when faced with human rights violations by its member states, such as what happened in Myanmar after the 2021 coup. The formulation of the problem to be researched is whether the implementation of the principle of non-intervention affects ASEAN's mechanism in responding to human rights violations in Myanmar after the 2021 coup? The results of this study show that the principle limits the capacity of ASEAN mechanisms in responding to human rights violations that occurred in Myanmar after the 2021 coup, such as the ASEAN Human Rights Commission (AICHR) and also the Five-Point Consensus (5PC). As a result, the response of ASEAN mechanisms tends to be slow, non-binding, and less independent towards human rights protection.

Abstract

The practice of human trafficking is a form of modern slavery that can threaten state sovereignty and human rights which are regulated in the International Protocol to Prevent, Suppress and Punish Trafficking in Persons or the Palermo Protocol, this practice of human trafficking occurs among vulnerable parties including migrant workers as has happened to dozens non-procedural Indonesian migrant workers in Myanmar in 2022-2023. The formulation of the problem is what forms of human rights violations experienced by non-procedural Indonesian migrant workers in connection with the practice of human trafficking in Myanmar and how the Indonesian government is trying to fulfill the rights of non-procedural PMIs after the practice of human trafficking in Myanmar in 2022-2023 based on Palermo Protocols. This type of research is normative, descriptive research and drawing conclusions using deductive logic. As a result, non-procedural PMI who experience human trafficking practices in Myanmar experience a form of violation of human rights in the provisions of International Human Rights Law such as the right to life, the right to freedom, the right not to be tortured, the right not to be forced to work and other rights. Efforts made by the government Indonesia in fulfilling the non-procedural rights of PMI after the practice of human trafficking in Myanmar is the recovery of victims by legal processing of traffickers based on Law No. 21 of 2007 concerning trafficking in person to pay restitution and compensation, restore the psychological and traumatic conditions of victims in RPTC, carry out socialization by forming a trafficking in person Task Force, BP2MI, LPSK as well as collaboration with IOM, ASEAN and other countries.

Abstract

Many issues have arisen during the construction of the stadium for the FIFA World Cup in Qatar in 2022. The study's characterization of the issue is the pay and death of migrant workers. The research approach uses normative legal analysis of qualitative data. According to research and discussion, migrant worker deaths frequently occur without clear investigation into the causes. Without a clear investigation into the causes of migrant worker deaths, the families of migrant workers who are left behind cannot get adequate compensation. the remuneration of migrant workers is also a problem that has not been resolved, even though Qatar has tried many solutions to overcome it, in practice, the right to wages is still often violated. The conclusion is that Qatar has violated the provisions of the Right to Life and the Right to Wages of migrant workers set out in Article 2 and Article 23 point (2) of the UDHR. Qatar is also negligent in carrying out its obligations as a state, by not protecting the rights of migrant workers, not investigating the deaths of migrant workers, and being unable to provide solutions to the deaths and wages of migrant workers.
