Abstract

This study reveals the journey of Islamic Law from doctrine to social action that brings change. Using a library research method through a comprehensive literature analysis, this study presents the complex challenges of translating Islamic law principles into concrete actions that expand social justice. The findings of this study identify that the gap between idealism and practice is often a major hurdle in implementing Islamic law. Islamic legal theory offers profound guidance on justice, ethics, and morality, emphasizing values such as social justice, general welfare, and protection of individual rights. However, its implementation often faces obstacles that obscure these noble goals. To achieve true social justice, implementing Islamic law must reflect these core values and not just be empty symbolism. It must be applied, embodying justice, benevolence, and the protection of human rights in everyday life.

Abstract

This study examines the legal uncertainty surrounding the Tayade land and tree transaction system in Gorontalo, Indonesia, which lacks formal regulations under both positive and Islamic law. The Tayade system separates ownership rights between land and vegetation, resulting in dual ownership over a single plot. This research explores solutions to the dual ownership issue and its implications for land and tree owners. A comparative approach with descriptive methods was used, analyzing land and tree transaction rules from positive and Islamic law perspectives through a literature review. The findings reveal that the absence of clear regulations creates legal uncertainty and potential conflicts due to inconsistencies between Tayade customary law, positive law, and Islamic law. The study concludes that harmonizing these legal systems is essential for effectively managing land and vegetation rights. Such harmonization would strengthen legal certainty and reduce conflicts in transferring rights under the Tayade system. The study recommends the development of more specific regulations to govern the practice, ensuring more transparent and more appropriate legal frameworks for the community.

Abstract

Implementation of parole revocation for prisoners at the Correctional Center Class II Gorontalo. This study aims to understand the legal basis, procedures, and impact of parole revocation on prisoners, as well as evaluate the consistency of the application with applicable correctional principles. The method used is juridical-empirical, by collecting data through interviews with correctional officers, and correctional center clients, and analysis of related documents. The results show that there are cases where there is a non-optimal revocation of parole, which has the potential to cause injustice and hamper the process of rehabilitation and reintegration of prisoners into society. Recommendations include the need for increased training and supervision for correctional officers, strengthening the complaint mechanism and appeal process for prisoners, and policy adjustments to ensure a fairer and more effective application of parole rights.

Abstract

Kegiatan pengabdian masyarakat yang dilakukan oleh Tim Dosen Fakultas Hukum Universitas Ichsan Gorontalo bertujuan untuk meningkatkan pengetahuan dan pemahaman siswa tentang pentingnya pencegahan perkawinan di bawah umur. Melalui kegiatan ini, siswa dapat memahami peran masyarakat dan pemerintah dalam mencegah dan melindungi hak anak dari perkawinan di bawah umur. Dengan demikian, kegiatan pengabdian masyarakat ini dapat memiliki dampak positif dalam meningkatkan kesadaran dan pengetahuan masyarakat tentang pentingnya pencegahan perkawinan di bawah umur. Pemilihan metode penyuluhan hukum dipandang relevan karena mampu menjangkau langsung peserta didik dengan pendekatan interaktif, diskusi kelompok, serta studi kasus yang berkaitan dengan praktik perkawinan anak di masyarakat. Metode ini juga dilengkapi dengan penyampaian materi berbasis regulasi yang berlaku, seperti Undang-Undang Perkawinan dan Undang-Undang Perlindungan Anak, sehingga siswa tidak hanya memahami teori tetapi juga aspek normatifnya. Hasil kegiatan menunjukkan bahwa siswa lebih memahami dampak negatif perkawinan anak, baik dari sisi normatif, pendidikan, kesehatan, maupun sosial. Selain itu, mereka juga menyadari pentingnya peran keluarga, sekolah, dan aparat pemerintah dalam mencegah terjadinya praktik tersebut. Kesadaran ini diharapkan dapat menjadi bekal bagi siswa untuk turut berperan aktif dalam menyuarakan pencegahan perkawinan di bawah umur di lingkungan mereka.

Abstract

This research aims to determine the judge's considerations in carrying out his juridical function to adjudicate cases, whether they align with legal principles governing marriage and protecting children's rights, and how social stigma influences the judge's decision-making process in many instances.  Interviews were conducted directly to create effective and efficient discussions to collect the primary data. In addition, data was obtained through literature and research studies, including regulations, documents, and related books.  This paper examines a case study concerning a judge's decision to grant dispensation to a married couple not yet of legal age due to a request for parental guardianship submitted to the Gorontalo Religious Court in decision Number 10/Pdt.P/2021/PA. The findings show that the convergence of various legal aspects, cultural values, and social norms can influence judges' considerations in determining child marriage dispensations. The issue of child marriage in Indonesia is complex and needs serious attention. A legal framework must support objective legal principles, take into account the needs and interests of all parties, and overcome social stigma against child marriage.

Abstract

This study examines the authority of regional heads in dismissing State Civil Apparatus (ASN) in South Bolaang Mongondow Regency based on court decisions that have permanent legal force (inkracht). This study is important considering that regional heads have a strategic role in fostering regional personnel, but the exercise of their authority in terms of dismissal of ASN often raises legal problems, especially when dealing with a final and binding court decision. This study uses a normative juridical method with a legislative approach and case studies in the area. The results of the study show that normatively, regional heads have a clear legal basis to dismiss civil servants who have been sentenced to criminal offense based on court decisions that have been inkracht, as stipulated in Law Number 5 of 2014 concerning the State Civil Apparatus and its implementing regulations. However, in South Bolaang Mongondow Regency, the implementation of these authorities still faces challenges, such as inconsistencies in regulatory interpretations, political interventions, and lack of understanding of the general principles of good governance (AUPB). Therefore, legal certainty, strict technical guidelines, and stronger supervision are needed so that the authority of regional heads in dismissing ASN is truly carried out professionally, objectively, and fairly.

Abstract

This study aims to determine the implementation of assessments of recidivist perpetrators of narcotics abuse at the National Narcotics Agency (BNN) of Gorontalo Province, as well as identify supporting and inhibiting factors in the assessment process. The research method used is a qualitative method with a descriptive approach. Data were obtained through in-depth interviews, observations, and documentation of assessment officers, addiction counselors, and recidivist perpetrators undergoing rehabilitation programs. The results of the study show that the implementation of the assessment at the Gorontalo Province BNN includes the screening stage, initial assessment, follow-up assessment, and determination of rehabilitation intervention plans. The implementation of the assessment was carried out in accordance with the Standard Operating Procedures (SOP) set by BNN, but in practice there were still obstacles such as limited human resources, lack of standardized psychological measuring tools, and low level of cooperation from recidivist actors. Nevertheless, assessment plays an important role in determining the level of dependence and the right direction of treatment for recidivists in order to reduce the risk of recurrence of narcotics abuse. Thus, increasing the capacity of officers and providing assessment support facilities are things that need to be considered for optimizing rehabilitation programs within the Gorontalo Province BNN
