Implementation of Guidance on Corruption Convicts is one of the things that must receive attention in prisons because it is one of the Extra Ordinary Crimes. In addition, most corruption crimes are committed by people who have a high social status, both in terms of their position before staying in prison as well as in terms of education and economic levels. Arrangements regarding the implementation of guidance for corruption convicts in Indonesia are regulated in the provisions of Law Number 12 of 1995 concerning Corrections and are described through Government Regulation Number 31 of 1999 concerning Guidance and Guidance of Correctional Citizens. Regarding the guidance for corruption convicts, it still refers to the provisions of Government Regulation Number 31 of 1999 where there is no difference in terms of the implementation of coaching which is still carried out through three stages, namely the initial stage, the advanced stage and the final stage. To be able to obtain the right to parole, there are special provisions that are applied to Corruption Convicts, namely in addition to having to behave well while in prison, they must also fulfill the obligation to complete the payment of fines or replacement money to be able to submit a parole proposal.

Implementation of verstek decision in the Religious Court is one of the decision which handed down by the judges in the court. Verstek decision, is the decision which handed down because the absence of the defendant even though the defendant himself has been summoned by the proper and authorized. Verstek decision will be handed down after the parties were called and examined his case and examine whether the matters raised by the plaintiff it can be proved and the authority of the Religious Court. In the verdict verstek, then demand can be granted if the suit was groundless and did not fight right. But if the suit was groundless and or against the rights, the decision of the judge verstek a statement that the plaintiffs claim is not accepted, and if the claim is granted with verstek verdict, the defendant may seek such objection with verzet.

The purpose of this study is to create a technology-based assessment model for special coaching recidivists by setting indicators of achievement of the implementation of activities so that the implementation of coaching can run well and directed. The type of research used in this study is a combination of normative legal research and empirical legal research. The implementation of the development of recidivist prisoners is not fully in line with the meaning of rehabilitation because there are still recidivist prisoners who repeat their crimes. The assessment model for fostering recidivist prisoners is made according to the type of crime committed and indicators of achievement of the assessment are set and the assessment system must be supported by online-based technology so that coaching can be controlled and is more transparent.

Penelitian ini adalah untuk mengetahui sah atau tidaknya tindakan pencabutan kembali Surat Perintah Penghentian Penyidikan (SP3) tanpa melalui proses praperadilan serta mengetahui penerbitan Surat Ketetapan tentang Pencabutan Penghentian Penyidikan termasuk dalam lingkup praperadilan atau tidak. Berdasarkan ketentuan Pasal 80 KUHAP yang mengatur bahwa Praperadilan dapat memutus sah atau tidaknya suatu penghentian penyidikan maupun penuntutan yang permohonannya dapat diajukan oleh penyidik maupun penuntut umum dengan menyebutkan alasannya. Selanjutnya berdasarkan Pasal 80 KUHAP bilamana Surat Perintah Penghentian Penyidikan (SP.3) mau dicabut kembali oleh pihak Penyidik dengan alasan adanya Novum, maka Penyidik tidak bisa secara langsung mencabut SP.3 tersebut, akan tetapi harus melalui Ketua Pengadilan dalam hal ini melalui lembaga proses praperadilan sehingga pencabutan Surat Perintah Penghentian Penyidikan (SP.3) oleh Penyidik tanpa adanya Putusan Praperadilan, konsekwensinya pencabutan SP.3 tersebut adalah batal demi hukum. Dalam pemeriksaan praperadilan, hakim yang menangani agar menggali kebenaran dari alasan hukum maupun alasan faktual, jadi tidak terbatas pada pengujian secara formil belaka. Kemudian hendaknya para penegak hukum hendaknya dalam melaksanakan tindakan hukum selalu berdasarkan aturan hukum yang ada (khususnya KUHAP) sehingga tidak memungkinkan pihak lain, baik itu tersangka/ terdakwa maupun pihak lain yang berkepentingan supaya proses hukum terhadap suatu perkara pidana tidak berlarut-larut.

Hak Asasi Manusia sampai saat ini masih merupakan sebuah persoalan dalam konteks pemenuhannya di Negara Indonesia. Sebagai sebuah negara berkembang, Indonesia masih terus berkutat dengan persoalan-persoalan klasik pelanggaran Hak Asasi Manusia. Sementara disisi lain, hak asasi manusia pada tataran konsepsional masih belum tergali dengan baik yang pada akhirnya berdampak pada terjadinya perbedaan pandangan dalam hal implementasi hak asasi manusia ditingkatan lokal negara-negara di dunia. Tujuan penulisan ini adalah untuk mengetahui apakah kemiskinan merupakan pelanggaran Hak Asasi Manusia dan bagaimana Konvensi EKOSOB dan MDGs dalam menyikapi masalah kemiskinan di Indonesia. Kemiskinan merupakan pelanggaran Hak Asasi Manusia jika kita melihatnya dari tanggung jawab Negara dalam hal mensejahterakan rakyatnya. Namun, hal ini harus dibarengi dengan usaha dari manusia itu sendiri dalam hal memperbaiki kehidupannya. Sebagaimana dalam konsep Islam dikatakan bahwa nasib seseorang itu dapat berubah karena ia berusaha dengan sungguh-sungguh. Selain itu, Konvensi EKOSOB dalam menyikapi masalah kemiskinan di Indonesia, dimana Negara wajib membebaskan masyarakat dari kondisi kemiskinan yang dapat dilakukan melalui upaya penghormatan, perlindungan, dan pemenuhan hak atas kebutuhan dasar. Upaya tersebut harus dilakukan oleh negara sebagai prioritas utama dalam pembangunan nasional termasuk untuk mensejahterakan masyarakat miskin. Selain itu, Pemerintah Indonesia menyadari bahwa pencapaian target-target MDGs secara nasional masih memerlukan upaya bersama semua pihak terkait, salah satu diantaranya adalah melakukan harmonisasi hukum / kebijakan pengentasan kemiskinan dengan MGDs.

The correctional facility is an implementing agency of the criminal system that has a function to foster citizens of correctional development, including in this case women undergoing an obligatory sentence to participate in a whole series of coaching activities in the correctional institution. This paper aims to look at the implementation of this form of guidance and find the right solution related to the problem of guiding prisoners in women's prisons, especially Class III Gorontalo prisons. The results obtained were that the implementation of the existing forms of guidance at the Class III Gorontalo Women's Prison was divided into three stages of coaching, namely the initial stage, the advanced stage and the final stage coaching. To overcome problems in the implementation of coaching women prisoners, synergy is needed between all parties involved, starting from prisoners, correctional officers and related agencies to cooperate with each other in the implementation of training for female prisoners. For this reason, it is necessary to repair and add infrastructure to support coaching activities and to involve officers in prisons through training activities that can support the implementation of coaching. Concerning the handicrafts of prisoners, it is also expected to increase marketing through the media, given the condition of Covid 19 which limits people from being able to interact directly with prisoners in prison

The purpose of this research is to investigate the application of sanctions against the manning of merchant ships that do not meet the qualifications and competence as well as to know which of the factors that affect the application of sanctions against the manning of merchant ships that do not meet the qualifications and competence in the port area Gorontalo. Metodh used is empirical legal research / sociological, the law conceived as an institution which in real terms are associated with other social variables. Sociological research using secondary data as the data initially, followed by a primary data or field researce. Conclusions from the findings that the imposition of sanctions against the manning of merchant ships that do not meet the qualifications and competence in the port area Gorontalo because there is not yet maximal application of criminal sanctions as stipulated in Article 310 of Law No. 17 of 2008 on the voyage. Sanctions are applied only to the extent the administrative sanctions and seizure of documents of the ship. The factors that hinder the application of criminal sanctions are investigators who do not have a certificate or has not even been sworn in completing education and training. Investigators who have sworn will have an impact on the validity of a legal process that is handled. Similarly, the leadership policy that does not emphasize the investigation of criminal offenses manning of merchant ships that do not meet the qualifications and competence due to the lack of budget allocation investigations, the lack of a fleet of patrol boats, patrol boats which are old and greatly decreased ability not to mention the legality of the investigators. So if there are violations of the sanctions was only limited to administrative sanctions.

Bentuk pembinaan terhadap narapidana yang dilakukan oleh lembaga pemasyarakatan tidak hanya sebatas melalui metode di dalam saja, melainkan metode pembinaan di luar lapas yang salah satu hak narapidana yang diatur dalam Undang-Undang Nomor 12 Tahun 1995 Tentang Pemasyarakatan Pasal 14 huruf (k) adalah narapidana berhak mendapatkan pembebasan bersyarat. Pembebasan bersyarat terhadap narapidana korupsimemiliki kriteria khusus yang harus dipenuhi berdasarkan peraturan perundang-undangan. Adanya persyaratan tambahan bagi terpidana kasus korupsi dalam memperoleh haknya untuk mendapatkan pembebasan bersyarat dikarenakan tindak pidana korupsi memiliki dampak dan pengaruh yang besar dibandingkan tindak pidana umum lainnya. Tujuan penulisan ini adalah untuk mengetahui dan menganalisis prosedur pemenuhan hak pemberian Pembebasan Bersyarat Bagi Narapidana Korupsi serta apakah pemberian pembebasan bersyarat terhadap narapidana korupsi sudah sejalan dengan asas yang terkandung di dalam Undang-Undang Pemasyarakatan. Penelitian ini menggunakan metode penelitian hukum normatif, yaitu mengkaji dan menganalisis norma-norma hukum yang berkaitan dengan pembebasan bersyarat. Prosedur Pemenuhan Hak Pemberian Pembebasan Bersyarat Bagi Narapidana Korupsi dilakukan berdasarkan Peraturan Pemerintah Nomor 99 Tahun 2012 Tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan dimana pemberian pembebasan bersyarat terhadap narapidana korupsi selain harus memenuhi pensyaratan pada pasal 43 ayat (2) juga harus memenuhi pensyaratan tambahan yang diatur dalam Pasal 43 A Ayat (1) Peraturan pemerintah tersebut. Pemberian Program Pembebasan Bersyarat bagi Narapidana korupsi harus memenuhi dasar pertimbangan aspek legalitas, aspek filosofis dan aspek sosiologis. Dimana dalam pemberian pembebasan bersyarat terhadap narapidana korupsi sudah sesuai dengan asas-asas yang terkandung di dalam Pasal 5 Undang-Undang Pemasyarakatan.

Keberhasilan dari pemberantasan tindak pidana korupsi tidak hanya diukur berdasarkan keberhasilan dalam menghukum pelaku tindak pidana korupsi akan tetapi juga dilihat dari tingkat keberhasilan dalam hal pengembalian aset kerugian Negara. Tujuan penulisan ini adalah untuk mengetahui hambatan dalam pengembalian aset kerugian negara akibat korupsi dan melihat Pengaturan Pengembalian Kerugian Negara dalam pemikiran ius constituendum. Penelitian ini merupakan penelitian hukum normatif dimana mengkaji dan menganalisis norma yang terkait dengan pengembalian aset kerugian Negara dalam peraturan perundang-undangan. Hambatan Pengembalian Aset Kerugian Negara akibat korupsi dipengaruhi oleh faktor substansi dan struktur hukum yang masih memiliki celah dalam hal pelaksanaan putusan hakim. Adapun pengaturan mengenai pengembalian kerugian negara di masa yang akan datang yaitu dengan melakukan revisi terhadap ketentuan Pasal 18 Ayat (3) Undang-Undang Nomor 31 Tahun 1999 Jo. The future of the Indonesian nation is very dependent on the condition of today's children. Therefore, future attention to children is the main focus, especially for Correctional Students (ADP) who live in the Special Child Development Institution (LPKA). One of the things that is of concern to children who are behind bars is the right to obtain formal and informal education. The purpose of this study was to analyze and evaluate the implementation of the fulfillment of the right to education for correctional students and to design an ideal model of fulfilling the right to education for children in Class II LPKA Gorontalo. The type of research used in this research is empirical normative legal research. The research results show that the educational process for ADP at LPKA is carried out in accordance with the mandate of Law Number 22 of 2022 concerning Corrections where ADP can pursue formal or informal education. In the implementation of formal learning process activities, there are still obstacles in the form of learning processes carried out outside LPKA, so it is necessary to formulate a learning model that should be made like a child-friendly school within LPKA and supported by educators who are truly competent and experienced in educating children.
