Abstract

There are several weaknesses of UU LLAJ. The first weakness is related to centralistic approach used in the UU. Second, the content of the UU has not yet been adjusted with several related new regulations. Third, it has not yet integrate land, marine and air transport. Forth, there are overlaps among related institutions on their rights and responsibilities. Fifth, it has not yet accommodated low-cost and efficient public services. RUU LLAJ, on the other hand, is drafted to elucidate the weaknesses of UU LLAJ. Some changes regulated on RUU LLAJ are regarding decentralization approach, new type of license and new authority on issuing license, and the integration of land, marine and air transport. Furthermore, the RUU LLAJ regulates public participation which has not yet regulated in UU LLAJ. Some of the changes are positive. However, the changes regarding the license system could increase public burden and could cause public confusion.

Abstract

Nowadays the urgency of incorporating transpolitan transmigration, and a modern concept implements in transmigration, are important. Whereas the importants of transpolitan itself could accelerate the development in Indonesia. In order to to accelerate the national development, the urgency of transpolitan regulation is needed where the transpolitan play a huge role in it. The normative research type are used in this research. It showed that the government had directed every type of Transmigration in each stage to Transpolitan. Apart from that, Transpolitan transmigration also has its challenges given the inadequate legal structure in Indonesia, so it requires regulations on Transpolitan. It is argued that the application of Transpolitan can significantly accelerate development in Indonesia through the development of science and technology-based transmigration areas. Its explicitly discusses Transmigration in Indonesia and reflects the regulations in Indonesia. The findings provide information on a breakthrough in implementingTranspolitan, especially for stakeholders. In addition, this research can also be directed to enable the.

Abstract

This study aims to determine the policy of fulfilling electrical energy in Indonesia and the policy of developing liquified natural gas (LNG) infrastructure in the fulfillment of electrical energy in Indonesia. The method used in this research is normative research so that the data used is secondary data collected through literature study. The results of the study conclude that first, the laws and regulations related to electricity in Indonesia are described in several electricity policies including the General Plan for the Provision of Electricity (RUPTL). The electricity policy currently being worked on by the government is the 35 GW Electricity Development Program based on the 2019-2028 RUPTL. Second, electricity infrastructure development policies are spread across various laws and regulations and decisions. The LNG infrastructure development policy itself is contained in the Decree of the Minister of Energy and Mineral Resources Number 13K/13/MEM/2020 on the Assignment of the Implementation of the Supply and Development of LNG Infrastructure and the Conversion of the Use of Oil Fuel with LNG in the Provision of Electric Power. This policy encourages the development of LNG infrastructure and has an impact on accelerating development towards meeting the needs of electrical energy, especially for eastern Indonesia. The challenge is that there are still LNG export commitments with other countries that have the potential to hinder the fulfillment of domestic LNG needs. Key Words: LNG infrastructure development policy; LNG AbstrakKajian ini bertujuan untuk mengetahui kebijakan pemenuhan energi listrik di Indonesia serta kebijakan pembangunan infrastruktur liquified natural gas (LNG) dalam pemenuhan energi listrik di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian normatif sehingga data yang digunakan adalah data sekunder yang dikumpulkan melalui studi pustaka. Hasil penelitian menyimpulkan, bahwa pertama, peraturan perundang-undangan terkait ketenagalistrikan di Indonesia dijabarkan dalam beberapa kebijakan ketenagalistrikan diantaranya Rencana Umum Penyediaan Tenaga Listrik (RUPTL). Kebijakan ketenagalistrikan yang sedang dikerjakan oleh pemerintah saat ini adalah Program Pembangunan Ketenagalistrikan 35 GW berdasarkan RUPTL 2019-2028. Kedua, kebijakan pembangunan infrastruktur kelistrikan tersebar di berbagai peraturan perundang-undangan maupun keputusan. Kebijakan pembangunan infrastruktur LNG sendiri terdapat dalam Keputusan Menteri ESDM Nomor: 13K/13/MEM/2020 tentang Penugasan Pelaksanaan Penyediaan Pasokan dan Pembangunan Infrastruktur LNG serta Konversi Penggunaan Bahan Bakar Minyak dengan LNG dalam Penyediaan Tenaga Listrik. Kebijakan tersebut mendorong pembangunan infrastruktur LNG dan memberikan dampak bagi percepatan pembangunan menuju pemenuhan kebutuhan energi listrik khususnya bagi wilayah Indonesia timur. Tantangannya adalah masih terdapat komitmen ekspor LNG dengan negara lain yang berpotensi menghambat pemenuhan kebutuhan LNG dalam negeri. Kata-kata Kunci: Kebijkan pembangunan infrastruktur LNG; LNG

Abstract

Pemerintah mencoba mengatasi permasalahan ekonomi di masa pandemi Covid-19 dengan mengambil kebijakan refocusing kegiatan dan realokasi anggaran. Pemerintah Daerah juga dituntut untuk melakukan refocusing kegiatan dan realokasi anggaran melalui perubahan APBD. Namun, tidak semua daerah bisa dengan segera melakukannya. Penelitian ini bertujuan untuk menganalisis, melihat tantangan, dan memberikan solusi perumusan kebijakan refocusing kegiatan dan realokasi anggaran Pemerintah Daerah di masa pandemi Covid-19. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perbandingan dan pendekatan peraturan perundang-undangan. Hasil penelitian menunjukkan adanya variasi perubahan APBD dalam melakukan refocusing kegiatan dan realokasi anggaran yang disebabkan karena beberapa hal, seperti perbedaan fleksibilitas keuangan daerah dan tidak adanya panduan yang jelas dalam melakukan refocusing kegiatan dan realokasi anggaran. Guna menghadapi permasalahan tersebut, solusi yang dapat dijalankan oleh Pemerintah Pusat sebagai pengarah kebijakan bagi Pemerintah Daerah dalam hal refocusing kegiatan dan realokasi anggaran adalah membuat semacam Standar Operasional Prosedur yang memuat batasan ruang lingkup anggaran dan kegiatan yang harus dikurangi, ditambah, maupun disesuaikan kembali.

Abstract

Penggunaan al-Qur’an sebagai syarat kompetensi calon kepala daerah dalam Pilkada Aceh menjadikan kitab suci itu sebagai alat politik. Kajian ini berargumen bahwa uji baca al-Qur’an telah dipolititasi dalam rekrutmen calon kepala daerah di Aceh. Terdapat dua pertanyaan diajukan, bagaimana bentuk politisasi al-Qur’an dalam uji baca al-Qur’an calon kepala daerah berlangsung di Aceh? dan apa sebab serta dampak politisasi al-Qur’an terhadap demokrasi? Penelitian dilakukan secara deskriptif dengan analisis dan wawancara atas kebijakan uji mampu baca al-Qur’an dalam seleksi calon kepala daerah di Aceh. Hasil penelitian menunjukkan politisasi al-Qur’an dalam uji kompetensi calon kepala daerah di Aceh terjadi dalam tiga bentuk: kemampuan baca al-Qur’an menjadi syarat kompetensi sehingga pengaturannya cukup rinci, kemampuan baca al-Qur’an menjadi sarana mempengaruhi pemilih oleh ulama maupun kontestan pemilu, dan penerimaan pemilih terhadap calon kepala daerah dengan kompetensi keagamaan dibandingkan kompetensi kinerja. Fenomena ini dilatari berlakunya syari’at Islam di Aceh mendorong terjadinya syariatisasi memungkinkan masuknya hukum syari’ah ke semua bidang. Bagi demokrasi, politisasi al-Qur’an mendistorsi keputusan publik dalam pemilu, di mana agama telah berhasil mengendalikan pemilihan umum di Aceh. Selain itu, juga berdampak pada pengabaian kompetensi kinerja kepala daerah, di mana kesalehan menjadi standar minimum yang harus dimiliki seseorang agar mampu mengemban jabatan publik.

Abstract

Fuel subsidies have become one of the heaviest burdens in Indonesia's State Budget (APBN), aimed at ensuring equitable accessibility of fuel to all segments of society. However, the mistargeting of the fuel subsidies can lead to the Indonesian population's dependence on subsidised fuel, thus undermining the efforts to address inequitable access to fuel. This study aims to analyse the realization of the fuel subsidy scheme in Indonesia and explore possible measures to achieve a more targeted and volume-appropriate fuel subsidy program. This paper focuses on the analysis of existing regulations concerning fuel subsidies in Indonesia, the weaknesses of these regulations, and the distribution of fuel subsidies as well as its current implementation. A live case study approach was employed. The research examined the gaps between the ideal state (das solen) and the actual state (das sein) of fuel subsidies by first examining the applicable legal norms. Subsequently, an analysis was conducted to determine whether or not the implementation is appropriate. Notably, Presidential Regulation Number 191 of 2014 does not specify the criteria for recipients of subsidised fuel of the JBKP (Special Assignment Fuel Type). This legal absence has resulted in an imprecise targeting and volume of the distribution of subsidised fuel.

Abstract

The judiciary has diverse decisions regarding on their competence to review the Audit Report of the Financial Audit Board (the LHP BPK). Some of judges in ordinary courts regarded that the LHP BPK falls in the competence of Administrative Courts; however, some judges of Administrative Courts regarded that the LHP BPK is not similar to an administrative decision; so that, they decline to review the LHP BPK. Therefore, this paper aims to evaluate where and how should the LHP BPK be reviewed This study uses a normative juridical research method using secondary data in the form of regulations, books, articles, research, and journals to analyze the position of the LHP BPK as a form of implementing the duties, functions, and authority of BPK as an independent institution. This research finds that the problematic situations occur because of legal loopholes due to the silent of the Law. Legislature therefore needs to promulgate norms on the matter. Meanwhile this study offer some temporary solutions to mitigate the loopholes.
