Abstract

ABSTRAK Tujuan riset ini adalah untuk mengetahui dasar hukum kecakapan membuat perjanjian dihadapan notaris dan untuk mengkaji penerapan asas kepastian hukum dalam menentukan kecakapan membuat akta notariil. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Hasil penelitian menunjukkan bahwa dasar hukum kecakapan membuat perjanjian dihadapan notaris tercantum dalam Pasal 39 ayat (1) UUJN dan penerapan asas kepastian hukum terhadap kecakapan membuat akta yaitu dasar hukumnya mengacu pada UUJN bukan KUHPerdata. Penyelesaian konflik norma adalah dengan menggunakan asas preferensi yaitu aturan yang berlaku adalah aturan UUJN, sedangkan aturan KUHPerdata tidak berlaku. Abstract

The purpose of this paper is to examine the efficiencies of United Kingdom life insurance, which is regulated in the NHS with a tax-based funding system. The effectiveness of the Health Insurance System, will provide better health services for the people. Currently, there are still many complaints in the BPJS service system, such as late payments for hospitals and salaries for medical personnel. This study will use the comparative law method, by comparing the BPJS system in Indonesia with the NHS health insurance system in the UK. BPJS uses a monthly fee funding system, the amount of payment are depends on the types of class that BPJS participants has taken. Whereas the NHS only uses a tax-based funding system, where the use of this system can effectively meet all health service needs maximally. Based on the results of research on OECD countries, it is revealed that the tax-based social health insurance program tends to be more progressive and fair. Based on this comparative study, it is important for Indonesia to improve its health insurance system arrangements in order to adapt the tax-based funding system.

Abstract

It is necessary to know about the Position, Supervision and Cooperation between Bank Indonesia (BI) and the Otoritas Jasa Keuangan (OJK) on Electronic Money Issuers (E-Money issuers). OJK issues E-Money in the form of Banks and Non-Bank Financial Industries. OJK's supervision of E-Money Issuers by Financial Services Institutions is carried out under the authority of the OJK as supervisor, in order to encourage the two institutions to participate in supporting economic growth and maintaining monetary stability. Coordination between OJK and BI in the supervision of E-Money Issuers, namely, BI has the authority to grant licenses to become Electronic Money Issuers and OJK has the authority to supervise Electronic Money Issuers in the form of Banks and the Non-Bank Financial Industry. If the issuance is carried out by a Non-Financial Service Institution, BI shall supervise the issuance and electronic money as the payment system supervisory agency. Based on this research it can be seen that OJK should make a Financial Services Authority Regulation (POJK) that specifically regulates Electronic Money Issuers. BI should not use the term Non-Bank Institution (LSB) because it is considered inaccurate, can cause confusion, and can lead to different understandings.

Abstract

This research aims to understand the difference between transactions in equity crowdfunding and transactions in the capital market and to determine the urgency of managing the risk of conflict of interest in equity crowdfunding transactions. The method used in this research is normative legal research with a statute approach that is relevant to the object of research and an analytical approach. The resulst of the research conducted a conclusion that in fact equity crowdfunding is part of the capital market, but there are differences in substance that cause both of them to face different mechanisms and risks of implementing financing activities. POJK No. 57/POJK.04/2020 has not fully accommodated the legal needs related to the risk of conflict of interest in the equity crowdfunding sector as Law Number 8 of 1995 regarding the Capital Market has regulated the conflict of interest in the capital market sector.

Abstract

ABSTRAK Penulisan penelitian ini bertujuan untuk mengkaji perlakuan diskriminasi terhadap kaum Muslim di India sebagai pelanggaran hak asasi manusia berdasarkan hukum internasional serta untuk menganalisis pertanggungjawaban pidana pelaku atas diskriminasi terhadap kaum Muslim di India. Metode penelitian dalam tulisan ilmiah ini merupakan metode penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan fakta. Berdasarkan penelitian ini, tindakan diskriminasi agama telah dilakukan oleh pemerintah dan aparat penegak hukum terhadap kaum Muslim di India, berupa perlakuan pembedaan dan pengecualian penegakan dan sistem hukumnya. Tindakan diskriminasi ini merupakan pelanggaran hak asasi manusia internasional berdasarkan Pasal 7 Universal Declaration of Human Rights (UDHR) serta Pasal 20 ayat (2) dan Pasal 26 International Covenant on Civil and Political Rights (ICCPR). Pertanggungjawaban pidana pelaku tindakan diskriminasi ini dapat dilaksanakan di India sesuai dengan yurisdiksi pelanggaran hak asasi manusia berdasarkan kewajiban negara anggota untuk menjamin perlindungan dan pelaksanaan hak-hak dan kewajiban yang tercantum dalam Konvensi. Selain itu, negara anggota ICCPR dapat melakukan pengaduan terhadap India atas pelanggaran yang dilakukan terhadap ketentuan Konvensi ini. Pengaduan individu diatur dalam Optional Protocol to the ICCPR yang memberikan korban pelanggaran hak asasi manusia kewenangan untuk melakukan pengaduan secara individual, akan tetapi India tidak terikat terhadap ketentuan tersebut karena tidak meratifikasinya. Kata kunci: Perlindungan Hukum, Diskriminasi Agama, Hak Asasi Manusia Internasional, Pertanggungjawaban Pidana. ABSTRACT The writing of this study aims to comprehend acts of discrimination in India against Muslims as an infringement of international human rights and to analyze the criminal responsibility of perpetrators of the discrimination against Muslims in India. The research method in this writing is the juridical normative research method and uses statute, cases, and fact approach. According to this study, India have been subjected to acts of religious discrimination by the government and law enforcement, including unfair treatment and exclusion from the legal system and enforcement. This act of discrimination is an infringement of international human rights based on Article 7 of the Universal Declaration of Human Rights (UDHR) and Article 20 paragraph (2) and Article 26 of the International Covenant on Civil and Political Rights (ICCPR). Pursuant to the responsibility of State Parties to ensure the implementation and protection of the rights and obligations stipulated in the Convention, perpetrators of this act of discrimination could be held criminally liable in India under the jurisdiction of human rights violations. Additionally, ICCPR State Parties may file complaints against India for violations committed against the regulations of this Convention. Individual complaints are regulated in the Optional Protocol to the ICCPR which gives victims of human rights infringements the authority to make individual complaints, but India is not bound by this provision because it has not ratified it. Abstract

Arbitration as an alternative dispute resolution effort must be determined by the parties based on an agreement to use the Arbitration Institution in civil cases in the future. As for this research, it shall discuss the implementation of the decision through a warning (aanmaning) based on the Arbitration Award which was decided by Verstek. The formulation of the problem in this research is how the process and legal product for the settlement of civil disputes and how the regulation of the implementation of security in default cases with Verstek Decisions based on the Indonesian Arbitration Institute. In this study using normative legal research methods using a substantial view. The results in this study are that the Arbitration Award is final and binding, which means it will immediately become the first and last level decision. The presence or absence of one of the parties in the arbitral tribunal does not stop the trial, making it possible for the arbitral tribunal to decide the case Verstek. The next effort is the process of warning (aanmaning) three times, if the opponent does not carry out the decision voluntarily. It is important to continue to apply this even in Arbitration cases, as an effort to pay off the obligations of the losing party in the trial.

Abstract

Dispute resolution is generally known to be resolved through litigation and non-litigation processes. Non-litigation legal efforts or alternative dispute resolution are agreements that are often chosen by business actors in the world of trade in goods and services. The purpose of this study is to find out more about arbitration regulations in both national and international law, especially in efforts to cancel arbitration decisions. This study uses a normative legal research method. requests for cancellation of decisions have also been regulated in the International Center for Settlement of Investment Disputes Rule can only be made in writing and not verbally. The results of the study indicate that the formation of an arbitration panel is considered inappropriate where if the formation is carried out through unreasonable stages as stated in the clause of the agreement of the parties, but the parties do not file objections and do not file a request for cancellation of the arbitration decision only because of the reason for the formation of the board or panel of arbitrators that is not appropriate then. The conclusion is that the arbitration decision will still be declared valid and final and binding. Meanwhile, in the case of a request for cancellation of an arbitration decision, it is not recognized in The United Nations Commission on International Trade Law Rule. In the event that the parties have different understandings during the resolution of the case, this can be used as a basis for submitting a request for interpretation.

Abstract

Penelitian ini bertujuan untuk menganalisis peran hukum investasi dalam meningkatkan penanaman modal di Indonesia serta mengkaji pengaruh regulasi daerah terhadap iklim investasi. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Data dikumpulkan melalui studi kepustakaan dengan menelaah berbagai regulasi investasi serta peraturan daerah yang mempengaruhi kebijakan penanaman modal. Hasil penelitian menunjukkan bahwa meskipun pemerintah daerah berupaya menarik investasi dan meningkatkan Pendapatan Asli Daerah (PAD) melalui penerbitan Peraturan Daerah (Perda), beberapa kebijakan justru berpotensi menghambat investasi, terutama terkait perizinan, infrastruktur publik, dan pembebasan lahan. Perda yang mengatur retribusi parkir, penerangan jalan, serta perizinan di sektor industri dan perdagangan kerap disusun tanpa mempertimbangkan dampak jangka panjang terhadap iklim investasi. Oleh karena itu, diperlukan harmonisasi regulasi antara kebijakan daerah dan kebijakan nasional untuk menciptakan lingkungan investasi yang lebih kondusif serta mendukung pertumbuhan ekonomi yang berkelanjutan.

Abstract

Penelitian ini bertujuan untuk mengkaji berbagai alternatif penyelesaian sengketa hak cipta musik serta menganalisis kelebihan dan kekurangan masing-masing mekanisme yang tersedia. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil studi menunjukkan bahwa sengketa hak cipta musik dapat diselesaikan melalui tiga metode alternatif yang efektif, yaitu mediasi, arbitrase, dan negosiasi. Ketiga metode ini menawarkan pendekatan yang berbeda dalam penyelesaian sengketa dengan kelebihan dan kekurangan masing-masing. Di antara ketiga alternatif tersebut, mediasi dipandang sebagai metode paling efektif dan efisien. Proses mediasi berlangsung relatif cepat, dengan batas waktu maksimal 30 hari, sehingga para pihak dapat segera mendapatkan resolusi atas sengketa yang dihadapi tanpa harus menunggu waktu yang lama seperti dalam proses litigasi. Selain itu, mediasi juga menjamin kerahasiaan bagi semua pihak yang terlibat, sehingga informasi sensitif atau strategis tidak akan terungkap kepada publik. Hal ini sangat penting, terutama dalam industri musik di mana reputasi dan hak kekayaan intelektual memiliki nilai yang signifikan. Meskipun mediasi menawarkan banyak manfaat, keberhasilannya sangat bergantung pada iktikad baik dan komitmen masing-masing pihak yang terlibat. Untuk mencapai kesepakatan yang memuaskan, kedua belah pihak harus mau saling mendengarkan dan berkompromi. Tanpa adanya niat baik untuk menyelesaikan perselisihan, mediasi dapat menjadi tidak efektif dan bahkan berpotensi gagal. Oleh karena itu, penting bagi tiap pihak untuk memasuki proses mediasi dengan mindset yang konstruktif dan terbuka, sehingga hasil yang dicapai benar-benar dapat memenuhi kepentingan dan harapan semua pihak.

Abstract

Tujuan studi ini adalah mencari tahu dan menganalisis perihal mediasi sebagai mekanisme penyelesaian sengketa kebocoran rekam pasien layanan telemedecine. Penelitian ini menerapkan metode penelitian hukum normatif dengan pendekatan perundang-undangan serta menelaah ketentuan hukum positif yang berlaku di Indonesia secara kritis dan sistematis. Hasil penelitian mengindikasikan bahwa Permenkes Rekam Medis tidak mencantumkan sanksi apabila terjadi pelanggaran terkait keamanan dan perlindungan data rekam medis elektronik pasien, sehingga menimbulkan ketidakpastian hukum dalam praktiknya dan berpotensi merugikan pasien. Undang-Undang Perlindungan Data Pribadi juga tidak dapat secara komprehensif memberikan perlindungan terhadap rekam medis layanan telemedicine, sehingga telah ditemukan adanya kekosongan norma mengenai sanksi yang tegas bagi pihak yang melakukan pelanggaran rekam medis pasien dalam layanan telemedecine. Artikel ini juga membahas mengenai penyelesaian sengketa alternatif sebagai solusi dari sengketa kebocoran rekam medis pasien layanan telemedecine serta menguraikan tahapan-tahapan mediasi secara sistematis sebagai metode penyelesaian sengketa yang bersifat efisien, fleksibel, dan mengedepankan asas win-win solution bagi para pihak yang bersengketa.
