Abstract

Tujuan penelitian menganalisis efektivitas Pelaksanaan pengawasan Ombudsman Kota Makassar pada penyelenggaraan pelayanan publik dan faktor yang mempengaruhi Pelaksanaan pengawasan Ombudsman Kota Makassar pada penyelenggaraan pelayanan publik. Metode peneltian menggunakan penelitian hukum empiris. Hasil penelitian bahwa Lembaga Ombusmen Kota Makassar telah melaksanakan wewenang dan tugasnya dengan efisein dan seefektivitas mungkin hal ini dapat dilihat dari Jumlah laporan dan konsultasi yang masuk dan ditagani oleh Ombusmen Kota Makassar sejak Mei-Desember 2019 sebanyak 108 laporan antara lain: 54 orang yang berkunjung langsung ke Kantor OKM, melalui telepon sejumlah 23, dan Sosial Media sebanyak 31 yang mana penangananya dilakukan dengan memverifikasi dugaan pelanggaran baik terhadap temuan dan atau laporan dugaan pelanggaran pelayanan Publik. Faktor yang mempengaruhi pelaksanaan pengawasan Ombudsman Kota Makassar pada penyelenggaraan pelayanan publik yakni faktor penegak hukum, faktor sarana dan prasarana dan faktor masyarakat. faktor penegak hukum yakni masih diperlukannya pelatihan dan peningkatan kualitas di tubuh Ombusmen Kota Makassar secara massif, Faktor Sarana dan Prasana yakni diharapkan tidak terjadi suatu disfungsi dimana peraturan sudah eksis untuk difungsikan, padahal fasilitasnya belum tersedia lengkap, Faktor Masyarakat yakni penyelenggara pelayanan publik wajib melibatkan masyarakat dalam penyusunan dan penetapan standar pelayanan karena masyarakat merupakan salah satu pengawas eksternal dalam penyelenggaraan pelayanan publik. The research objective to analyze the effectiveness of the implementation of the supervision of the Makassar City Ombudsman on the implementation of public services and the factors that influence the implementation of the supervision of the Makassar City Ombudsman on the implementation of public services. The research method uses empirical legal research. The results of the study that the Makassar City Ombusmen Institute has carried out its authorities and duties as efficiently and effectively as possible this can be seen from the number of reports and consultations that have been submitted and handled by the Makassar City Ombusmen since May-December 2019 as many as 108 reports, including: 54 people who visited directly to the OKM Office, by telephone numbering 23, and Social Media as many as 31, where the handling is carried out by verifying alleged violations of findings and or reports of alleged violations of public services. Factors influencing the implementation of the Makassar City Ombudsman's supervision in the implementation of public services are law enforcement factors, facilities and infrastructure factors and community factors. law enforcement factors, namely the need for massive training and quality improvement in the Makassar City Ombusmen, the Facilities and Infrastructure Factors, which is expected to avoid a dysfunction where regulations already exist to function, even though the facilities are not fully available, Community Factors, namely public service providers must involve the community in the preparation and determination of service standards because the community is one of the external supervisors in the implementation of public services.

Abstract

This article aims to examine the implications of the Constitutional Court Decision Number 32/PUU-XIX/2021 on the decision of the General Election Organizers Honorary Council (DKPP) which is final and binding as stipulated in Article 458 paragraph (13) of Law Number 7 of 2017 concerning General Elections, where the arrangement does not regulate which parties are bound by the DKPP decision. The method used is normative, using a statutory approach and a conceptual approach, focusing on studying secondary data, and then analysing qualitatively-descriptively. The implications of the issuance of the Constitutional Court (MK) Decision on the binding nature of the DKPP decision include: First, it is only binding on the President, the General Election Commission, Provincial Election Commission, Regency/City General Election Commission, and the Election Supervisory Board. Second, the binding nature of DKPP's legal product in the form of a Decision must be interpreted as a Decision of State Administrative Officials (beschikking) which is individual, concrete, and final, not the nomenclature of "decision (verdict)". Court legal considerations, namely: The phrase "final and binding" has been submitted to a judicial review in the Constitutional Court against the previous election law, guaranteeing legal certainty and eliminating legal confusion about the nature of DKPP decisions which are different from the nature of judicial decisions in general, DKPP institutions are placed on an equal footing with the Bawaslu and KPU.

Abstract

This study aims to analyze the crime of deliberately not paying taxes that have been withheld or collected (Tax Evasion) in Indonesia. This study uses normative legal research with a statutory approach (statute approach) and a case approach (statute approach). In this study, legal materials were analyzed qualitatively with steps, namely (1) identifying legal facts and eliminating irrelevant matters; (2) collecting legal and non-legal materials; (3) conducting a review of legal issues; (4) drawing conclusions and providing prescriptions.The results of the study show that First, the general description includes the indictment, demands, witness statements, and expert statements. Second, in the analysis of facts, there are differences between public prosecutors and legal advisors specifically in calculating losses to state revenues, and thirdly, in the juridical analysis, there are differences in the application of legislation where the application of administrative penal law and ultimum remedium is not yet achieved

Abstract

This research aims to determine the effect of problem-based learning on improving learning outcomes. This research uses a quantitative approach with a quasi-experimental design to evaluate the impact of implementing a problem-based learning model on Social Sciences (IPS) learning outcomes at SMPN 33 class IX UPT SMP Negeri 33 Makassar City. The research sample consisted of two groups. The sample was determined using purposive sampling, 30 experimental and 30 control class samples. Data was collected using tests. The control group received conventional learning, while the experimental group received learning with a problem-based learning model. Data is collected through test results. The hypothesis test results show a significant difference in the ability of Social Sciences learning outcomes between the two research groups. Confirms that the application of the problem-based learning model has a positive effect in improving social studies learning outcomes at the junior high school level.

Abstract

Dewasa ini generasi muda mulai mengalami penurunan kualitas mental dan etika. banyak dari mereka yang lebih mudah putus asa, tidak percaya diri, asal mengambil keputusan tanpa harus berfikir panjang, dan lebih ingin cara yang instan daripada menjalani sebuah proses. Dengan generasi muda di Indonesia yang tumbuh begitu pesat, maka gaya kepemimpinan yang muncul pun harus menyesuaikan ritme dan polanya. Pemimpin muda harus berkarakter dan bisa beradaptasi dengan perkembangan zaman. Terkait dengan hal tersebut, adapun yang menjadi tujuan pengabdian ini yaitu memberikan pemahaman kepada siswa/siswi Pesantren Mizanul Ulum tentang menjadi pemimpin muda yang berkarakter. Metode pelaksanaan yang digunakan dalam kegiatan pengabdian ini adalah dengan menggunakan metode ceramah dan metode tanya jawab. Berdasarkan diskusi dan pertemuan yang dilakukan dengan pihak yang terkait, bahwa pada umumnya siswa-siswi tidak mengetahui tentang makna pemimpin muda yang berkarakter. Setelah adanya sosialisasi, siswa/siwi mulai memahami makna pemimpin muda yang berkarakter. Dengan adanya kegiatan ini, maka membuka wawasan tentang pentingnya memiliki pemahaman menjadi pemimpin muda yang berkarakter dalam berorganisasi sebagai dasar mereka dalam belajar kepemimpinan bagi siswa/siswi di Pesantren Mizanul Ulum.

Abstract

Mahkamah Konstitusi melakukan Uji Materil Pasal 263 ayat (1) KUHAP dengan memutuskan dalam putusan No. 33/PUU-XIV/2016 dengan menyatakan mengabulkan permohonan Pemohon bahwa Pasal 263 ayat (1) KUHAP` bertentangan dengan UUD 1945 secara bersyarat, yaitu sepanjang dimaknai lain selain yang secara eksplisit tersurat dalam norma a quo; Namun dalam Dalam Undang-Undang Republik Indonesia Nomor 11 Tahun 2021 tentang Perubahan Atas Undang-Undang Nomor 16 Tahun 2004 Tentang Kejaksaan Republik Indonesia (selanjutnya disingkat UU 11/2021) Pasal 30C huruf h menentukan Kejaksaan mengajukan peninjauan kembali. Putusan Mahkamah Konstitusi dituliskan dalam berita negara, sehingga putusan MK berkekuatan setara dengan UU. Oleh karena itu perumusan sebuah norma dalam perundang-undangan tidak dapat bertentangan dengan Putusan MK. Disisi lain putuan MK memiliki karakteristik final dan mengikat yang artinya sejak diputuskan di MK maka putusan MK tersebut menjadi undang-undang dan mengikat semua warga negara

Abstract

This research aims to examine the position of the triumvirate of ministers in the constitutional system of the Republic of Indonesia and examine the relationship between the triumvirate of ministers as executors of presidential duties in the State Ministry system of the Republic of Indonesia. The type of research used in this research is normative legal research. The research results show that the position of the triumvirate of ministers in the constitutional system of the Unitary State of the Republic of Indonesia has been regulated in the third amendment to the 1945 Constitution of the Republic of Indonesia, namely Article 8 paragraph (3) which regulates more detailed rules in the event that the President and Vice President are absent. Then the reason why the ministers of the Triumvirate carry out presidential duties is because they are considered to understand the ins and outs of government affairs. The solution offered by the author is that the President and the People's Representative Council need to make derivative regulations for the implementation of Article 8 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia and a change needs to be made in Law Number 39 of 2008 concerning the Ministry of State Affairs.

Abstract

Based on the provisions of articles 28A to 28J of the 1945 Constitution, the state is obliged to fulfill, protect and respect the human rights of every citizen. This guarantee is not just written without reason or purpose, but this guarantee must protect every human being from the use of unlimited power or the actions of authorities who act arbitrarily. The research method uses library research, namely a research process carried out through collecting data and information from various related sources. The results of the research in this paper are that the right to education must be accessible to anyone regardless of the individual's background, so that everyone can receive education equally. Fulfillment of this right is implemented in the form of providing facilities, access or resources that enable the fulfillment of the right to education to all people, both those who have the ability to finance their education and those who do not have the ability to finance their education, or based on differences in ethnicity, religion, race, class. , gender, different social backgrounds

Abstract

The distribution of power in Indonesia and Russia shows differences in the implementation of the principle of separation of powers. Indonesia, as a unitary state with a presidential system, faces challenges in maintaining balance between the central and regional governments. Meanwhile, Russia, as a federal state with a semi-presidential system, remains centralized, with executive power largely dominated by the president. This study aims to analyze the model of power distribution in the constitutional law of Indonesia and the Russian Federation based on their respective governmental systems, as well as to identify the advantages, disadvantages, and implications for government stability in both countries. This research employs a normative legal method with a statutory, comparative, and conceptual approach to analyze the power distribution model in Indonesia and Russia based on their constitutions and relevant regulations, using library research techniques and qualitative analysis. The findings indicate that the power distribution models in Indonesia and Russia differ according to their respective governmental systems. Indonesia adopts a presidential system with strong checks and balances between the executive, legislative, and judicial branches, while Russia follows a semi-presidential system that grants dominant authority to the president. Indonesia emphasizes power balance through democracy and decentralization, though it faces challenges such as political gridlock and slow bureaucracy. Conversely, Russia enjoys stronger political stability due to executive dominance, but at the risk of weakening checks and balances and limiting political freedoms. Thus, the governmental systems in both countries have their own advantages and disadvantages in influencing stability and governance effectiveness.
