Abstract

Relationship among stakeholders in an industrial environment does not always run well. The conflicts within an industrial relationship are common, and they are known as industrial relation disputes. However, the disputes must be settled such as by mediation. This study aimed to analyze and investigate the 30 (thirty) day mediation period specified by Article 15 of the PPHI Law for the settlement of industrial relation disputes by the mediator. This study is a normative legal study utilizing a statutory approach and a case approach in which legal materials were gained through literature review. It was found that the settlement period must be completed by the mediator was ideally considering two aspects: the number of cases and the number of mediators. The researchers suggested that the provisions of Article 15 of the PPHI Law cannot be implemented equally; due to each region have the different number of cases and the number of mediators. In addition, the non-ideal number of functional mediators was taking into account the aspect of the number of cases received, so currently the service and technical implementation of the settlements do not run optimally. Based on the results of the study, the researcher suggests the stakeholders: first, to revise Article 15 of the PPHI Law, which is related to the period of time for the mediator in completing the duties. Second, to increase the number of functional mediators by considering the number of cases received.

Abstract

Penelitian ini membahas tentang monitoring perlindungan pengungsi dalam program UNHCR, yang dapat dilaksanakan oleh Negara peserta Konvensi mengenai Pengungsi. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif, yang bersifat preskriptif, dikaji dengan pendekatan peraturan perundang-undangan dan konseptual. Penulis berargumen bahwa UNHCR telah berupaya untuk menyediakan instrumen dalam rangka memberikan perlindungan bagi pengungsi internasional, agar pengungsi mendapat standar perlakuan sesuai dengan ketentuan hukum internasional melalui monitoring program UNHCR. Dalam programnya, UNHCR berkoordinasi dengan beberapa organisasi internasional yang berkaitan dengan pengungsi, dengan harapan monitoring program UNHCR dapat membantu pengungsi untuk memperoleh hak-hak dasar yang melekat pada pengungsi serta mengurangi tindakan sewenang-wenang negara peserta dalam memperlakukan pengungsi internasional.

Abstract

This study aims to find out how to monitor the compliance of countries participating in the convention through an international human rights monitoring system. This research is a normative legal research. The approaches used in this research include the statutory approach and the case approach, which are obtained from legal materials conducted through a literature study. Based on research, it is known that there is no monitoring system for state compliance with a convention, in this case the refugee convention. Reservations in conventions are often excluded on grounds of State ownership. On the other hand, refugees themselves have the same human rights as other human rights. International human rights monitoring mechanisms consist of treaty-based mechanisms and charter-based mechanisms. The international human rights monitoring system is the one most closely related to the supervision of participating countries/monitoring of the 1951 Convention considering the system between refugees and the human rights attached to it. In this case, the international human rights monitoring mechanism that can be used is a mechanism based on a treaty or a mechanism based on an international agreement. Abstract

Pelaksanaan Pengabdian Kepada Masyarakat (PKM) ini bertujuan diantaranya pertama menumbuhkan kecerdasan  dan kecakapan kewarganegaraan terkait dengan peran warga negara muda menghadapi pandemi Covid-19,  kedua kecakapan dan kesadaran kewarganegaraan tersebut diimplementasikan ketika mampu bersikap efektif didalam tindakan serta mampu mengaktualisasikan nilai-nilai Pancasila dalam menghadapi pandemi Covid-19, dan ketiga mitra mampu berperan dalam menyikapi realitas dimasa pandemi termasuk dengan kebajikan yang dilakukan. Mitra dalam PKM ini adalah para siswa SMAN 20 Kabupaten Tangerang. Metode pelaksanaan yang digunakan yaitu penyuluhan dalam bentuk ceramah melalui media googlemeet. Dalam PKM ini materi yang disampaikan meliputi kesadaran bela negara ditengah pandemi, aktualisasi nilai Pancasila menjadi relevan dengan situasi hari ini, dan bagaimana siswa dapat berperan serta dalam menyikapi realitas dimasa pandemi. Adapun kesimpulan dalam materi ini menekankan pada konsep triple helix concept, dimana pemerintah dengan political power, akademisi/ pelajar dengan knowledge power dan masyarakat dengan social control, harus senantiasa bersinergi bersama dalam menanggulangi pandemi ini. Dampak dengan diadakannya workshop kegiatan terhadap Siswa SMAN 20 Kabupaten Tangerang, tidak lain sedikitnya merupakan salah satu upaya untuk menumbuhkan kecakapan kewarganegaraan utamanya terhadap warga negara muda. Kecakapan warga negara itu harus ditimbulkan dan disadarkan melalui pendidikan ataupun contoh nyata yang dilakukan berbagai elemen bangsa. Adapun rekomendasi terhadap pelaksnaan PKM ini kedepan diantaranya adalah pertama, adanya kegiatan lanjutan yang melibatkan komponen masyarakat, kedua, melakukan pendampingan secara langsung dengan memperhatikan protokol kesehatan, dan ketiga, singkronisasi yang lebih luas khususnya instansi pemerintah.

Abstract

Taxes are mandatory contributions imposed on the public coercively by state without direct reciprocal obtained from the tax payment. The main purpose of such is as state revenue for national development which aims to improve the welfare of its people and is collected based on the principle of justice. This can be observed from 3 perspectives, which is philosophical, juridical, and sociological perspectives. Philosophically, tax collection is fair because it is desired and approved by the public through DPR as the people’s representative who creates law on tax collection. Moreover, the collected taxes are also for national development in order to achieve welfare state. Juridically, the government has made efforys to improve tax regulations to keep up with the times and society since the early days of independence, such as UU KUP that has beed revised several times from 1983 to 2009. In addition, the issued tax regulations also prioritize elements of justice such as PPh which in calculation uses progressive rates and PTKP. Sociologically, public awareness is still lacking. This can be solved by government efforts to create good image of tax by implementing the principles of good governance in order to create social trust and the people themselves want to pay taxes (voluntary tax compliance). Abstract

River is the main source of water which is used to support the primary needed of surrounding community. One of these rivers is the Cisadane River, which is located in Tangerang. This study aims to find out how the Banten Provincial Government's policies are related to the management of the Cisadane River Basin Area. This research belongs to Normative Law research which has Prescriptive sight. The legal source of this study is obtain through the library research. This reseach used statute approach and case approach. Based on the results of research and discussion, showed that there is no policy related to the management of the Cisadane River Basin Area, neither in Tangerang City, nor in South Tangerang, nor in Tangerang Regency. The recommended solution that can be given is wether the Regional Governments in Banten Province, or South Tangerang, or Tangerang Regency, to legislate the Regional Policy related to the Management of the Cisadane River Basin Area. Second, optimizing the role of  surrounding community of the Cisadane River Basin Area in Banten Province for caring and maintaining enviromental hygiene, wether in the river or surrounding environment near to the river which can be minimized the impact of river pollution.
