Abstract

The current development of the Covid-19 pandemic is very worrying where there is an increase in special corona cases in Indonesia. This study aims to identify and analyze the policies taken by the government in handling the Covid-19 pandemic and the steps taken by the government to mitigate the impacts, especially the economic and social impacts of the Covid-19 pandemic. The legal research method used is the normative legal research method. The approach used in this research is a statutory approach and a conceptual approach. This research is based on the legislation governing the handling and handling of the Covid-19 pandemic as well as an analysis of the concept of establishing these laws and regulations. The results of this study are in the context of handling Covid-19, starting with the government issuing a policy on Large-Scale Social Restrictions which refers to Law Number 6 of 2018 concerning Health Quarantine. The implementing regulations are Government Regulation Number 21 of 2020 concerning Large-Scale Social Restrictions, as well as the Presidential Decree on Health Emergencies. Until now, the government has issued a PPKM policy which is carried out regularly. To address the economic and social impact of Covid-19, the government has taken several policies, including: Regulation of the Minister of Finance of the Republic of Indonesia Number 23/Pmk.03/2020 concerning Tax Incentives for Taxpayers Affected by the Coona Virus Outbreak; Regulation of the Financial Services Authority of the Republic of Indonesia Number 11 /Pojk.03/2020 concerning National Economic Stimulus as a Countercyclical Policy for the Impact of the Spread of Corona Virus Disease2019; and Instruction of the President of the Republic of Indonesia Number 4 of 2020 concerning Refocussing of Activities, Reallocation of Budgets, and Procurement of Goods and Services in the Context of Accelerating Handling of Corona Virus Disease 2019 (Covid-19).

Abstract

There are two types of work agreement issues as regulated in the Manpower Act which qualifies work agreements, namely, a Specific Time Work Agreement (PKWT) and an Indefinite Work Agreement. Specific Time (PKWT) in Law Number 11 of 2020 concerning Job Creation in Social Welfare and Subjective Perspectives. This research was conducted using a normative juridical approach, namely an approach that focuses on research and studies through theories and legal principles, as well as legislation on employment, especially related to non-permanent workers (PKWT) as regulated in the Job Creation Act. the policy of Specific Time Work Agreements (PKWT) in Law Number 11 of 2020 concerning Job Creation in the perspective of social and subjective welfare related to the goals of labor development in Indonesia has not been achieved optimally, because workers still feel they are being treated unfairly. This PKWT status does not provide legal certainty and a sense of security for the right to work guaranteed by the State. This PKWT status if viewed from the aspect of social welfare does not reflect welfare because at any time the entrepreneur can terminate it without any guarantee of welfare for his life and if it occurs as a whole it will lead to poverty and the feasibility of a prosperous life as mandated by the constitution

Abstract

One indicator of a democratic rule of law is general elections to ensure the sovereignty of the people, democratic elections are elections that run in accordance with the electoral legal framework. The implementation of elections has its own legal character, different from other laws, therefore, the legal framework for elections must be able to guarantee the rights of the people in elections, so that law enforcement and election justice can run upright and straight, leading to elections with integrity. In the electoral legal framework, Bawaslu is given more authority by the election law, in addition to being tasked with prevention and supervision, it is also given adjudication authority in resolving the process of handling election administrative violations. The research method that the author uses is normative juridical, primary, secondary and tertiary legal data sources, data collected through library studies and field studies, and analyzed by qualitative juridical. The results of the study show that the authority of Bawaslu in enforcing election law and justice is to take legal action in the election process if it is not in accordance with the election laws and regulations. Such legal actions can be constructive, namely law enforcement that allows to change and/or cancel decisions, and can be punitive, namely those that allow sanctions to be imposed on perpetrators of violations, the decisions issued by Bawaslu are binding on the parties. The Bawaslu adjudication mechanism is guided by Perbawaslu concerning the Settlement of Election Administrative Violations. KPU is obliged to follow up on Bawaslu's decision. If it is not followed up, the KPU can be reported to the DKPP, for violating the election organizer's code of ethics.

Abstract

The falling economic condition has forced the government and business to be more creative in creating business climate, government has created the legal instruments for the development of the investment through business activities. On the other hand, business actors try to catch every single business opportunity available, for example to make efficiency to cut the operational expenses. Outsourcing system becomes the trend used by several companies. Many big companies hire their workers through this system. The problems occurred were the employment of the Regulation of Ministry of Labor and Transmigration No. 19 of 2012 concerning Terms on Distribution of Work Partly to Other Corporation; the legal protection for the oursourcing worker under the Law No. 13 of 2003 concerning Labor jo Regulation of Ministry of Labor and Transmigration No. 19 of 2012 concerning Terms on Distribution of Work Partly to Other Corporation; the settlement to be taken by the government to protect the outsourcing workers. The method of research used in this was descriptive analytical specification in which the researcher described or illustrated a case that was analyzed with the laws using juridical normative method of approach. Stages of research used included library and field research. Data collecting technique was throudocument study and field study in the form of interview. The findings of the research concluded that both has violated Article 17 section (3) of the Regulation of Ministry of Labor and Transmigration No. 19 of 2012 in which both corporations did not place the outsourcing workers in supporting job, instead, they were posted for main job. The protection given by in general was similar namely health insurance, holiday allowance, overtime incentives. While at the other company, they gave one more incentives that was end of contract pension. The judgment of Constitutional Court No. 27/PUU-IX/2011 deciding in favour of the interest of the workers, ordered that every outsourcing worker should have their rights equal to the rights of the non-outsourcing workers. In addition, outsourcing company should count the working time into the guidance to determine the wages and other rights at the outsourcing companies including the transferof from the company receiving other works.

Abstract

Dalam penelitian ini membahas Ratio legis penghapusan izin lingkungan adalah untuk memberikan kemudahan penyelesaian izin lingkungan serta kemudahan dalam melakukan pengawasan, tanpa mengurangi esensi dari perizinan lingkungan itu sendiri. Selain itu Izin Lingkungan tidak menjadi prasyarat penerbitan izin usaha artinya kegiatan dapat dilakukan saat izin lingkungan belum diterbitkan dan masih diproses serta Problematika Penghapusan Izin Lingkungan muncul mengingat Izin lingkungan memiliki fungsi pencegahan dan merupakan salah satu dari beberapa instrumen yang berfungsi untuk mencegah kerusakan dan pencemaran lingkungan dan adanya penghapusan izin lingkungan Akan ada kewenangan yang hilang dari pemerintah baik pusat maupun daerah dalam melaksanakan pengendalian dampak pencemaran dan kerusakan selain itu Perizinan memiliki 3 fungsi antara lain sebagai berikut, pertama sebagai instrumen rekayasa pembangunan. Pemerintah dapat membuat regulasi atau keputusan yang memberikan insentif bagi pertumbuhan sosial ekonom. Kedua fungsi keuangan yaitu menjadi sumber pendapatan bagi negara Ketiga fungsi yaitu menjadi instrument pengaturan tindakan dan perilaku masyarakat.

Abstract

Pemutusan Hubungan Kerja (PHK) sudah sangat sering terjadi di dalam dunia pekerjaan. Dengan adanya penelitian ini bertujuan untuk memberikan pengetahuan terkait penyelesaian yang dapat dilakukan apabila karyawan atau masyarakat umum mengalami PHK sepihak. Dalam pengumpulan data menggunakan metode kualitatif yuridis dengan sumber sekunder dan peraturan positif yang berlaku di Indonesia. Hasil dari penelitian ini yaitu da penyelesaian dalam mengatasi PHK sepihak dapat dilakukan melalui bipatrit, tripatrit, serta pengadilan hubungan indusrial.Kata-kata Kunci : PHK sepihak, mutasi, pekerja/buruh, perselisihan hubungan indusrrial

Abstract

Hubungan hukum antara pekerja dan majikan, merupakan suatu hubungan hukum dengan ciri-ciri tersendiri dibandingkan dengan hubungan hukum lainnya. Hubungan hukum tersebut, merupakan hubungan hukum yang saling melengkapi dan menguntungkan. Serta pada saat yang sama saling bergantung, hal ini dapat menimbulkan suatu konflik diantara pekerja dengan pengusaha. Perselisihan hubungan industrial (PHI), dapat diselesaikan melalui jalur pengadilanĀ  ataupun di luar pengadilan. Para pihak bebas menentukan alternatif solusi, yang akan digunakan untuk meyelesaikan perselisihan hubungan industrial (PHI). Dan salah satu cara untuk menyelesaikan konflikĀ  tersebut, yaitu melalui jalur Non litigasi (Arbitrase). Tujuan penelitian ini ialah, untuk mengetahui tentang bagaimana proses penyelesaian sengketa diluar jalur hukum atau biasa dikenal dengan Alternative Dispute Resolution (ADR). Penelitian ini merupakan jenis penelitian hukum, yang menggunakan metode penelitian hukum yuridis-normatif, yaitu penelitian yang menggunakan sumber kepustakaan atau dokumen sekunder sebagai bahan sumber dalam penelitian, dengan cara menganalisis dan menelaah berbagai publikasi dari berbagai sumber yang berhubungan dengan Penyelesain Hubungan Industrial.

Abstract

Termination of employment should not be used unilaterally because in the legislation it has been explained in depth regarding the permitted termination of employment. The purpose of this study was to analyze the case of unilateral termination of employment with reasons in accordance with Supreme Court Decision No.450/K/Pdt.Sus-PHI/2021. The reasearch method used is normative juridical with the reasearch approach used is case based by combining existing legal facts. Based on the reasearch that has been carried out, unilateral termination of employment is not permitted under the law. However, it can be allowed for certain reasons. In the case of unilateral termination of employment due to age, it is not explained in detail in the Act, but the termination must go through a negotiation process and if there is no agreement, the employer or employee can apply through the relevant institution, in this case the agency industrial relations settlement. Abstract

One of the efforts to settle out of court is arbitration by emphasizing the principle of a win-win solution. The purpose of this paper is to find out the procedure for resolving industrial relations disputes through arbitration, and to find out the factors that cause arbitration to be less attractive. The type of research used is normative juridical research with a statutory approach. The results of the study indicate that the Arbitrator is obliged to settle industrial relations disputes within a maximum of 30 days, which can be extended to a maximum of 14 working days upon the agreement of the parties. Prior to that, peace is sought, if that fails, the arbitration trial will continue. One or the parties may apply for the cancellation of the arbitration award to the Supreme Court within a period of 30 days from the stipulation of the arbitrator's decision. Factors causing arbitration to be less desirable, namely Industrial Relations Arbitration does not have the authority to settle disputes over rights, settlement through arbitration is not yet familiar enough, arbitration can only be beneficial for honest and trustworthy parties, absolute dependence on arbitrators, there is no precedent for previous arbitration decisions, not possible to object.
