Abstract

AbstractCustomary inheritance law in Indonesia consists of unique and specific patterns that describe the values of traditional Indonesian society that are based on collective and communal culture. There are three types of customary inheritance system: patrilineal, matrilineal, and parental. Every system has a uniqueness that makes it different with others. These differences often cause disputes and problems. The problems are related especially to the status of men and women in relation to patriarchal and matriarchal systems. Settlement of inheritance is done through discussion, approval, or legal remedies. Judges decisions indicate that there is a renewal on the customary inheritance system in which men and women have equal opportunities to become inheritors of their parents. Abstrak Hukum waris adat di Indonesia terdiri dari pola unik dan spesifik yang menggambarkan nilai-nilai masyarakat tradisional Indonesia berdasarkan budaya kolektif dan komunal. Terdapat tiga macam sistem waris adat: patrilineal, matrilineal, dan parental. Setiap sistem memiliki perbedaan dan seringkali perbedaan tersebut menimbulkan sengketa dan masalah, terutama terkait dengan status laki-laki dan perempuan dalam hubungan sistem patriaki dan matriaki. Penyelesaian sengekta waris dilakukan melalui diskusi, persetujuan, atau upaya hukum. Abstract

ABSTRAKUpaya hukum PK terhadap putusan pengadilan yang membatalkan putusan arbitrase tidak diperkenankan oleh MA sebagaimana tercantum dalam SEMA No. 4 Tahun 2016. Artikel ini berdasarkan penelitian yuridis normatif membahas upaya hukum PK terhadap putusan pengadilan yang membatalkan putusan arbitrase ditinjau dari prinsip accsess to justice serta alasan PK terhadap putusan pengadilan yang membatalkan putusan arbitrase ditinjau dari prinsip access to justice. Bahwa pencari keadilan sebaiknya diberikan akses untuk melakukan upaya hukum PK terhadap putusan pengadilan yang telah berkekuatan hukum tetap yang membatalkan putusan arbitrase, sehingga tercapai access to justice dalam proses penyelesaian sengketa melalui pengadilan. Alasan yang dapat digunakan sebagai dasar permohonan PK terhadap putusan pengadilan yang membatalkan putusan arbitrase adalah aasan-alasan PK perkara perdata sebagaimana diatur Pasal 67 UU MA. Perlukan revisi SEMA No.4 Tahun 2016 dan UU Arbitrase dan Alternatif Penyelesaian Sengketa terkait upaya hukum PK.Kata kunci: access to justice, arbitrase, peninjauan kembali. ABSTRACTThe request civil towards a court verdict which annul the national arbitration award is not allowed by Supreme Court as confirmed in SEMA No. 4 Year 2016. This article use normative juridical that analyze the request civil towards a court verdict which annul the national arbitration award reviewed from access to justice principle and the reasons that could be used as the groundwork of the submission of it. The result is the justice seeker society should be granted access to request civil towards a court verdict that has permanent law enforcement which annul the national arbitration award, so that based on access to justice principle. The reasons could be used as the groundwork of the submission of it is the reason of the request civil on civil case as regulated in Article 67 of Supreme Court Law. The revision of SEMA No. 4 Year 2016 and Arbitration and Alternative Dispute Settlement Law regarding the request civil is necessary. Keywords: access to Justice, arbitration, reques civil.

Abstract

ABSTRAKRumah Sakit merupakan salah satu fasilitas pelayanan kesehatan yang diharapkan mampu mendukung upaya peningkatan kesehatan masyarakat. Dewasa ini kepemilikan Rumah Sakit didominasi oleh swasta yang berorientasi mencari keuntungan, namun demikian setiap Rumah Sakit dalam memberikan pelayanan kesehatan harus tetap mengutamakan kepentingan publik dan menjalankan fungsi sosialnya. Fungsi sosial Rumah Sakit ini kenyataannya dapat menimbulkan persepsi bahwa pasien berhak menuntut pelayanan kesehatan tanpa mempertimbangkan kemampuan finansialnya, dan berujung pada diterbitkannya piutang pasien. Piutang pasien terjadi karena pada saat pasien keluar Rumah Sakit tidak memiliki cukup uang untuk membayar biaya rumah sakit. Pelaksanaan prestasi berupa pembayaran imbalan jasa medis perlu ditagihkan kepada pasien dalam bentuk tertulis, dan diberikan waktu yang pantas apabila pembayaran seketika tidak dapat dilakukan. Mengingat bahwa imbalan jasa dokter sifatnya tidak mutlak dan tidak dapat diseragamkan, Rumah Sakit dapat melepaskan hak untuk menagih piutangnya kepada pasien, baik seluruhnya maupun sebagian, apabila hal tersebut sesuai dengan keputusan manajemen Rumah Sakit. Bagi pasien miskin atau tidak mampu, pembiayaan pelayanan kesehatan di Rumah Sakit ditanggung oleh pemerintah dan pemerintah daerah sesuai ketentuan perundang-undangan yang berlaku. Oleh karena itu peraturan internal Rumah Sakit mengenai pengelolaan piutang pasien dan kerjasama Rumah Sakit swasta dengan dinas kesehatan dan jaminan sosial kesehatan sangat diperlukan.Kata kunci: hukum piutang; pengelolaan piutang; piutang pasien.ABSTRACTHospital is one of the health care facilities that are expected to be able to support efforts to improve public health. Nowadays, Hospital ownership is dominated by profit-oriented private sector, however every hospital in providing health services must prioritize the public interest and carry out its social functions. The social function of the hospital can in fact lead to the perception that patients have the right to demand health services without considering their financial capabilities, and lead to the issuance of patient receivables. Patient’s receivables occur because when the patient leaves the hospital does not have enough money to pay for hospital fees. Payment of medical services needs to be billed to patients in written form, and given appropriate time if immediate payments cannot be made. Given that the physician services fee are not absolute and cannot be uniformed, the Hospital can give up the right to collect the receivables from the patient, either in whole or in part, if this is in accordance with the management’s decision. For patients who are poor or incapable, the financing of health services at the Hospital is borne by the government and local government in accordance with the applicable legislation. Therefore the internal regulations of the Hospital regarding the management of patient receivables and the collaboration of private hospitals with health services and health social security are very necessary.Keywords: law of receivables; management of receivable; patient receivables.DOI: https://doi.org/10.23920/jbmh.v3n2.16

Abstract

Industrial relations disputes can be resolved through court (litigation) and out of court (non litigation) as stipulated in Law Number 2 of 2016 concerning Industrial Relations Dispute Settlement (PPHI). From the formal legal aspect governing the settlement of industrial relations disputes is the Law Civil Procedure that applies in the General Court, which is usually complicated and long. Usually for litigation at the District Court level, at least the workers/litigants must meet for 8 to 10 days. Padang District Court in the IA Class in order to achieve the principle of Civil Procedure Law Fast, Simple and Low Cost made a breakthrough with the success in bringing a decision on peace in industrial relations disputes in the past 4 years. The author is interested whether this Peace ruling does not contradict Article 4 of PERMA Number 1 of 2016 and does not confl ict with statutory regulations and has permanent legal force. The method used in this research is normative juridical analysis of facts that exist systematically. The results of the research and discussion showed that Article 4 of PERMA Number 1 of 2016 is doubly meaningful, so that the Peace Decision in the Padang District Court of Class IA is not in confl ict with the laws and regulations and has permanent legal force. The factors causing peace in the Padang Industrial Relations Court, namely Article 4 PERMA Number 1 of 2016 has a double meaning, so that the Padang Industrial Relations Court refers to Article 130 HIR, there is pressure on the bipartite process, mediation in the employment service is less than optimal, the parties those who disputed want peace to be carried out in the industrial relations court, the panel of judges considered that disputes were very possible to be carried out peacefully, and to reduce the accumulation of cases in the court.

Abstract

Judicial power as an independent and autonomous power must be free from any intervention and power, thus ensuring that judges possess independence and impartiality in handling cases. One of the measures for enhancing the independence and autonomy of the judiciary is by placing it under the one roof judicial arrangement developed by the Supreme Court, both from the judicial as well as the non-judicial technical aspects. Up to the present time, endeavors for bringing the four court jurisdictions under the one roof judicial arrangement developed by the Supreme Court have not been completely materialized, due to the existing dualism in judicial power at various courts. The objective of this research is to understand the developments in the endeavors towards bringing the Indonesian judicial system under the one roof judicial arrangement developed by the Supreme Court. The type of research applied is descriptive normative juridical research, namely legal research based on examining secondary data. As the research results indicate, the one roof system developed by the Supreme Court is already being implemented, with the exception of the Military Court and the Tax Court within the State Administration Court jurisdiction.

Abstract

In principle, the settlement of business disputes in Indonesia can be done amicably either through the court or outside the court. The court proceeding usually takes a long time, impacting overall case costs in comparison to dispute settlement outside the court. Arbitration as an alternative dispute resolution offers advantages compared to mediation, conciliation, and negotiation as it has an identical adjudicative nature to court proceedings. Therefore, arbitration is the preferred method for settling business disputes due to its perceived effectiveness and efficiency, resulting in win-win solutions. In addition, within the Indonesian legal framework, arbitration closely parallels court proceedings for dispute resolution, and its decisions carry the same level of binding authority and enforceability. This article relies on secondary data analyzed using a qualitative-juridical method to examine the jurisdiction of district court and arbitration. The findings reveal that arbitration has absolute jurisdiction when there exists an arbitration clause or an underlying arbitration agreement, thereby excluding the jurisdiction of the district court.

Abstract

Micro, small, and medium enterprises (MSMEs) play a crucial role in the economic development of Indonesia. One activity MSMEs can engage in is forming partnerships. These partnerships are established through innominate contracts, which, in principle, constitute partnership agreements. The Business Competition Supervision Commission, or Komisi Pengawasan Persaingan Usaha (KPPU), holds the authority to oversee both the formation and performance of partnership agreements entered into by MSMEs. This article uses a normative juridical approach with qualitative data to evaluate the supervisory role of KPPU in overseeing the performance of partnership agreements and the amicable settlement of disputes through changes in behavior under competition law. The results conclude that KPPU oversees compliance with the agreements and performance in accordance with general contractual principles, specifically those that must be included in partnership agreements. KPPU’s supervision, as part of law enforcement, occurs in two phases: the preliminary stage and the subsequent stage. In the subsequent stage, KPPU may impose administrative sanctions and criminal compensation based on the material facts of the proceedings. If the reported party changes their behavior during the preliminary stage, the proceeding may be terminated, allowing the dispute to be settled amicably. This approach should be prioritized as part of restorative justice, as it emphasizes law enforcement focused on restoring the original state and reestablishing harmonious relationships within society.
