Abstract

This paper will make a reconstruction of legal environmental paradigm and find the alternativeparadigm which sees the environment as a unity with human being. The debates of environmental rightsoffer new perspective on rights and environmental issues. The carelessness of sustainable environmentoften occur when the state apply the environmental regulations or policies.Nowadays, the thought of “ecojustice”—environmental justice—has been rapidly developed.Otto Sumarwoto said about “Our Common Future” (Otto, 1991), Jimly Asshiddiqie said about “GreenConstitution” (Jimly, 2009), and Fritjof Capra could say the same in “Green Politics: The GlobalPromise” (Capra, 1984). They make a sense that environmental protection is insufficient if it does notinclude the consideration of whole life, including present and future, that Environmental Rights is a roadto Intergenerational Justice.In developing country such as Indonesia, the development activities cause environmentaldamages. These conditions became worse in the autonomy era (since 2001) until present day, whichenvironmental institution become weak in environmental law enforcement. As examples are Buyat BayCase by Newmont Minahasa Raya, Ltd. (2004); and illegal logging by Adelin Lis (2007). These problemsshould be solved by beginning with an examination of the notion of rights to the environment and to theidentification of such rights in formulation of regulations and policies

Abstract

Globalization has placed Indonesia in a dilemma in creating the welfare of the people. Many legislations with liberal character are disallowed through the constitutional review by the constitutional court. The liberal character then becomes constraints for government to realize social welfare, thus harming the economic interest of people and contrary to the constitution (UUD 1945). Efforts to create welfare cannot be separated from state sovereignty in determining the economics welfare policy in the form of law. The State needs to adopt policies of recalibrating sovereignty to realize its objectives. Sovereignty is the essential requirement to be able to build pengayoman law character, ideology by Pancasila ideology and UUDNRI 1945. The legal substance of pengayoman law (protection and succor) will realize a balance between global interests and the interests of the nation. Pengayoman Law integrates the efficiency and freedom with fairness and welfare excellence. Also, the Pengayoman Law always opens the space to give a guarantee/partiality to the poor through social policies that are based on human dignity. Keywords: Welfare, Challenges, Globalization, Dilemma

Abstract

Abstract: The Paradigm of Legal Justice in the Communal Intellectual property Rights. Law and justice is a synthesis therefore inseparable. Basically, our society doesn’t recognize what is called as conflict. Conflict has been introduced by the Globalization. The regime of Intellectual property Rights was born as the effect of the free trade that adopts the equality. All the parties are the gladiator that needs to be survives in the battle (survival for the fittest). On the contrary, the traditional society doesn’t pay attention on the economic values of the culture. However, they are forced to compete in the Intellectual Property Rights battle, especially the Property Rights. This article will elaborate the law enforcement with the justice approach at the Intellectual property Conflict taken place in the Society.\Abstrak: Paradigma Hukum Berkeadilan Dalam Hak Kekayaan Intelektual Komunal. Hukum dan keadilan adalah sebuah sintesis, sehingga tidak\ terpisahkan. Pada dasarnya masyarakat Indonesia tidak mengenal konflik. Perkembangan global dalam penerapan hukum yang telah memperkenalkan kosakata “konflik” ke masyarakat Indonesia. Regim Hak Kekayaan Intelektual (HKI), misalnya, yang lahir dari perdagangan bebas tentu tidak akan jauh dari prinsip-prinsip perdagangan bebas yang menuntut persamaan. Semua pihak dianggap sebagai "gladiator" yang harus mampu bertahan dalam pertarungan (survival for the fittest). Dalam kompetisi macam ini, masyarakat tradisional yang tidak begitu mempedulikan nilai ekonomis dari suatu kebudayaan. Namunbegitu mereka, “dipaksa” bertarung dalam potensi konflik HKI, terutama hak cipta. Tulisan ini mengelaborasi pendekatan penegakan hukum yang berorientasi keadilan dalam konflik HKI yang berpotensi muncul. DOI: 10.15408/jch.v1i2.1469
