Abstract

In accordance with the research, the population of violence among the woman increased dramatically. Therefore, it is strongly required a legal protection to the woman. This article, in this regard, offers a kind of protection that will be called mahram. The main objective of this article is to discuss the meaning of mahram, and to what extend to role of this concept toward the protection of the woman. The writer come to conclude that prophet tradition contains a number of guidance in terms of mahram concept.. This concept entails the model of responsibility in order to build a system so the woman can be active safely among the man.

Abstract

Islam sangat memuliakan perempuan, bahkan terdapat banyak ayat al-Qur’an dan hadis yang menyatakan bahwa perempuan adalah makhluk mulia dan sama seperti laki-laki. Namun, terdapat sebuah hadis yang menjustifikasi bahwa kaum perempuan adalah makhluk yang lemah akalnya, kurang agamanya dan penghuni neraka terbanyak. Stigma atau justifikasi terhadap perempuan tersebut sangat bertolak belakang dengan gambaran umum tentang perempuan pada masa Rasulullah SAW yang cerdas dan berakal. Untuk mengetahui keotentikan hadis tersebut, maka perlu sekali dilakukan pengkajian hadis terutama dari segi matan. Dari beberapa metode kritik matan yang ada, teori tentang ke-sahîh-an matan yang relatif memadai adalah metodologi Salahudin ibn Ahmad al-Adlabi. Setelah melakukan pengkajian hadis berdasarkan metodologi tersebut, maka disimpulkan bahwa kualitas matan hadis tersebut tidak memenuhi kriteria ke-sahîh-an matan hadis

Abstract

Umrah carried out by agencies of a travel agency with several provisions issued by the ministry of religion RI. The meaning of mahram that was set by the ministry of religion is include to a mahram pilgrims, mahram referred in family relationship or marriage. This is regulated by the rules of registration of pilgrims and associated with the administration of Hajj and Umrah service. So that they try as much as possible to include a mahram as defined in the shari'ah by including the documents to indicate the mahram validation. They try to make it all based on the documents which corroborate these requirement as evidence of the validity of requirement. The provision as above, would be very detrimental to women those will carry out the pilgrimage, because they will be burdened with additional costs while they did not get the expected benefits. For contextual understanding that participation of mahram can be interpreted as safety. But in pilgrimage, mahram has not been found detailed provisions in the pilgrims discurs. By paying a "mahram money" for women under 40 years old those without mahram in $ 300,000 upto $. 600,000, they will be looked for a Mahram by officer. Although, for the fact or in practice, during Umrah trip, they are not accompanied by a mahram that should accompany during the implementation of Umrah.

Abstract

This research is motivated by the declining marriage rate in the contemporary era due to a shift in orientation among Gen Z and Millennials. So that not marrying (singlehood) has become a trend and a life principle. This problem seems to be at odds with the hadith of the Prophet Muhammad SAW which in his narration forbids someone from being single (tabattul). Therefore, this study aims to determine the quality of the hadith about tabattul which is then relevant to the phenomenon of singlehood that is rampant lately. This research uses a qualitative method with a type of literature study, the problems and hadith in this study are examined using a takhrij approach that includes criticism of sanad and matan within the scope of discussion of Sufism and psychology. The results obtained from this study are first, the quality of the hadith about tabatuul has authentic quality (H.R Al-Bukhari No. 5073), this is illustrated by the results of the takhrij which shows the presence of syawahid and tawabi. In addition, the sanad of the hadith is connected and has a fair and strong narrator of memorization, then the hadith also does not contradict the Qur'an. However, from a Sufi perspective, the term "tabattul" differs from the "uzlah" practiced by Sufis. Meanwhile, from a psychological perspective, the term "tabattul" in the hadith can be equated etymologically with the phenomenon of singlehood, as both involve the absence of a romantic relationship. Ultimately, according to the hadith, "tabattul" is permissible if there is a valid Islamic excuse. However, singlehood is prohibited if the reason is for promiscuity, partying, or a reluctance to follow the Sunnah of the Prophet Muhammad.
