Abstract

The development of international trade is inseparable from the development oftechnology. Its influence can be seen through the use of electronic transactionshereinafter referred to as e-commerce. In the e-commerce, consumers are the mostoften injured, therefore arrangements that provide legal protection to consumers whoconduct e-commerce is needed. Besides e-commerce, electronic signature is also knownas a tool which serves to maintain the security of the data or information transmitted.However the current rules of international trade law on e-commerce and electronicsignature are only set in the UNCITRAL Model Law. This paper aims to analyze theform of legal protection to consumers who conduct e-commerce transactions. Thispaper also want to describe the existence of electronic signatures in international tradelaw. This writing is a normative legal research that uses statute approach.

Abstract

Sistem pemerintahan presidensial dipimpin oleh seorang Presiden dan Wakil Presiden. sering kali tugas dan wewenang Wakil Presiden tidak diketahui secara jelas. Penelitian ini ditujukan terhadap dua masalah pokok. Pertama, bagaimana kedudukan Wakil Presiden dalam sistem presidensial di Indonesia? Kedua, bagaimana pertanggungjawaban Wakil Presiden selama masa jabatannya? Permasalahan tersebut diteliti dengan menggunakan metode penelitian hukum normatif dengan melakukan pendekatan konseptual dan juga pendekatan perundang-undangan. Teknik pengumpulan bahan hukum menggunakan teknik studi kepustakaan lalu dilanjutkan dengan teknik analisis. Hasil penelitian menunjukan bahwa tugas dan wewenang Wakil Presiden tidak diatur secara tegas melalui Undang-Undang Dasar 1945 maupun peraturan perundang-undangan dibawahnya sehingga pemberian tugas dan wewenang Wakil Presiden dilakukan oleh Presiden. dengan kemungkinan faktor objektif dan faktor subjektif dalam pemberian tugas dan wewenang. Sementara itu, dalam berbagai kesempatan Wakil Presiden juga dapat bertindak sebagai pendamping bagi Presiden dalam melakukan kewajibannya. Dengan demikian Wakil Presiden memiliki lima kemungkinan posisi yaitu sebagai wakil yang mewakili Presiden, sebagai pengganti yang menggantikan Presiden, sebagai pembantu yang membantu Presiden, sebagai pendamping yang mendampingi Presiden, sebagai Wakil Presiden yang bersifat mandiri. Dari hasil penelitian mengenai pertanggungjawaban Wakil Presiden, Masalah seputar Wakil Presiden yang berhubungan dengan tanggungjawab seorang Wakil Presiden belum jelas. Wakil Presiden tidak bertanggungjawab kepada Presiden karena Wakil Presiden tidak diangkat oleh Presiden melainkan oleh rakyat. Tidak ada Pasal dalam Undang-Undang Dasar 1945 yang mengatur pertanggungjawaban Wakil Presiden, baik sebagai Wakil Kepala Pemerintahan maupun sebagai Wakil Kepala Negara. Kata Kunci: Kedudukan dan wewenang ; Pertanggungjawaban ; Wakil Presiden.

Abstract

During the COVID-19 pandemic, there were legal problems experienced by the public regarding ignorance of the existence of a credit restructuring program from the government to deal with non-performing loans during the COVID-19 pandemic and a lack of understanding regarding the relative nature of force majeure from the COVID-19 pandemic which did not eliminate credit obligations, but only suspended through relief on credit restructuring efforts. The activity is located in Satra Village, Klungkung Regency. This community service activity aims to provide understanding for people of Satra Village who have non performing loan credit during the COVID-19 pandemic. Considering that the COVID-19 pandemic has greatly affected the economic level of the community, this activity also aims to provide an understanding for the people of Satra Village, that during the COVID-19 pandemic the banks will not immediately execute collateral objects when credit problems occur, but the community can be given payment relief through efforts credit restructuring.The implementation of service activities is carried out by providing in-depth socialization, discussion and question and answer so that the goals of community service activities can be achieved very well. The results of this activity indicate that the activity was carried out very effectively, as evidenced by the enthusiasm of the respondents who are the general public, village administrators and BUMDES administrators in Satra Village in listening to the presentation of the service team. Abstract

ABSTRAK Tujuan dari studi ini adalah untuk meneliti relevansi proses pemilihan hakim konstitusi terhadap independensi dari kelembagaan Mahkamah Konstitusi, serta untuk menganalisis desain pemilihan hakim konstitusi yang ideal dalam menjamin independensi hakim konstitusi. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi menunjukkan bahwa terdapat relevansi antara proses pemilihan hakim konstitusi terhadap independensi kelembagaan Mahkamah Konstitusi ditinjau berdasarkan konsep Judicial Reform Index (JRI) dengan mengacu kepada Resolusi PBB 1985 Nomor 40/32 dan Nomor 40/146, Rekomendasi Dewan Eropa mengenai Independensi Hakim, Piagam Eropa tentang Statuta Hakim, dan Standar Minimum Independensi Peradilan IBA (1982). Dengan demikian, jaminan terhadap independensi hakim konstitusi hanya dapat dipenuhi apabila mekanisme awal pengangkatan hakim telah jauh dari adanya kepentingan politik. Pembenahan terhadap mekanisme pemilihan hakim konstitusi tersebut dapat dicapai melalui keterlibatan kembali KY dalam panel seleksi hakim mengacu terhadap Perppu Nomor 1 Tahun 2013 jo. UU Nomor 4 Tahun 2014 tentang Penetapan Perppu No. 1 Tahun 2013 tentang Perubahan Kedua atas UU No. 24 Tahun 2003 tentang Mahkamah Konstitusi. Pengakomodiran kembali KY dalam panel seleksi ditinjau berdasarkan 3 (tiga) pendekatan melalui teori sistem hukum Lawrence M. Friedman, yakni pendekatan substansi hukum, pendekatan struktur hukum, dan pendekatan budaya hukum. Kata Kunci: Mahkamah Konstitusi, Independensi Hakim, Pemilihan Hakim. ABSTRACT The aim of this study is to examine the relevance of the process of selecting constitutional judges to the independence of the Constitutional Court institution, as well as to analyze the ideal design for selecting constitutional judges in ensuring the independence of constitutional judges. This study uses normative legal research methods with a statutory approach and a conceptual approach. The results of the study show that there is relevance between the process of selecting constitutional judges and the institutional independence of the Constitutional Court reviewed based on the concept of the Judicial Reform Index (JRI) with reference to UN Resolution 1985 Number 40/32 and Number 40/146, the Council of Europe Recommendation on independence of judges, the European Charter on The Statute for judges, and the International Bar Assosiation Minimum Standards for Judicial Independence (1982). The guarantee of the independence of constitutional judges can only be fulfilled if the initial mechanism for appointing judges is far from political interests. Improvements to the mechanism for selecting constitutional judges can be achieved through the re-involvement of the Judicial Commission in the judge selection panel referring to Perppu Number 1 of 2013 jo. Law Number 4 of 2014 concerning the Determination of Perppu No. 1 of 2013 concerning the Second Amendment to Law no. 24 of 2003 concerning the Constitutional Court. The re-accommodation of KY in the selection panel was reviewed based on 3 (three) approaches based on Lawrence M. Friedman's legal system theory, namely the legal substance approach, legal structure approach and legal culture approach. Keywords: Constitutional Court, Independence of Judges, Election of Judges.
