Abstract

Summons in the civil procedural law is to submit to the parties formally and properly related to the case in court, in the delivery procedure of a summons once the parties are not found, then the village head or Lurah is given the mandate to deliver it to the litigant. The results of research conducted on the village in Palu do not even have a procedure for accepting and submitting willingly, it is caused by the ignorance of the village regarding the obligation to submit summons, besides the village feels has no interest in the bailiff’s primary task. Analysis of village’s legal responsibility in the summoning function can be categorized as collective responsibility on the subject side, whereas from the other side, object side, it is a type of absolute accountability.

Abstract

The judge's decision that is a reflection of the upholding or not of law and justice, can not be separated from the role and responsibility of judges both legally and morally as a central figure in law enforcement. This article seeks to describe the responsibility of judges in controlling law enforcement and justice processes in Indonesia by presenting data, both normative, and empirical data. Referring to the facts, the legal downturn that has occurred for decades, poses a severe challenge to the world of justice, especially internal judges in restoring the stability of law enforcement and public trust in the profession of judges. So far, the authority has made new breakthroughs in organizing law enforcement institutions including the profession of judges with integrity and have a great responsibility both legal and moral responsibility. The issuance of several regulations and the establishment of several new legal institutions are evidence of serious efforts to realize fair law enforcement, although it must be recognized that there are still many challenges and obstacles, especially for internal judges.

Abstract

This study investigates the legal implications of waiting time fees imposed in the Delivery Food and Shop service of the Maxim ride-hailing platform in Palu City. It is an empirical legal research that employs a statutory approach to analyze Law No. 8 of 1999 on Consumer Protection and a conceptual approach to examine the ijarah contract within the framework of Islamic commercial law (fiqh muamalah). Primary data were collected through field observations and interviews with Maxim users, driver-partners, and staff, while secondary data were obtained from legal documents and academic literature. The findings reveal that the current fee policy charging IDR 250 per minute after a 20-minute grace period lacks adequate transparency and user consent, thereby introducing elements of gharar (uncertainty) in sharia and potentially violating the principles of fair contracting in positive law. Although such fees are permissible under Islamic law when clearly agreed upon, the absence of upfront disclosure renders the contract problematic. The study recommends that Maxim improve price transparency and in-app information delivery to ensure fairness, legal certainty, and compliance with applicable legal norms. Abstrak Penelitian ini mengkaji implikasi hukum dari penerapan biaya waktu tunggu pada layanan Delivery Food and Shop oleh platform ojek online Maxim di Kota Palu. Penelitian ini merupakan penelitian hukum empiris yang menggunakan pendekatan perundang-undangan untuk menganalisis Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen serta pendekatan konseptual untuk mengkaji akad ijarah dalam kerangka hukum ekonomi Islam (fiqh muamalah). Data primer diperoleh melalui observasi lapangan dan wawancara dengan pengguna, mitra pengemudi, serta staf Maxim, sementara data sekunder diperoleh dari dokumen hukum dan literatur akademik. Hasil penelitian menunjukkan bahwa kebijakan tarif saat ini—Rp250 per menit setelah masa tunggu gratis 20 menit—tidak disertai dengan transparansi dan persetujuan awal dari pengguna secara memadai. Hal ini menimbulkan unsur gharar (ketidakpastian) dalam perspektif syariah dan berpotensi melanggar prinsip keadilan kontraktual dalam hukum positif. Meskipun biaya tersebut dibolehkan dalam hukum Islam jika disepakati secara jelas, ketiadaan informasi yang disampaikan sejak awal membuat kontrak menjadi bermasalah. Studi ini merekomendasikan agar Maxim meningkatkan transparansi tarif dan penyampaian informasi dalam aplikasi untuk menjamin keadilan, kepastian hukum, dan kepatuhan terhadap norma hukum yang berlaku.

Abstract

As the country with the largest Muslim population in the world, Indonesia has a substantial opportunity to establish itself as a leading halal tourism destination. However, realizing this potential faces challenges related to the provision of halal facilities and the enforcement of government regulations. This research aims to analyze the development of halal tourism in the Sis Aljufri Religious Area based on local wisdom with reference to the Indonesian Ulema Council halal tourism guidelines. This qualitative research uses Miles and Huberman analysis. The study reveals that the development of halal tourism in this area can be categorized into four aspects: products and services, government support, human resources, and infrastructure. While the development of tourist attractions aligns with the general principles of Sharia tourism and guidelines related to tourists and destinations, facilities such as hotels and travel agencies still need to meet the required Sharia-compliant standards. Overall, the development of halal tourism in the Sis Aljufri Religious Area has shown significant progress, particularly in enhancing products and services, securing government support, and improving infrastructure. However, further efforts are needed to ensure full compliance with the Indonesian Ulema Council's guidelines, especially in the areas of Sharia hotels and travel agencies, to realize its full potential.

Abstract

The low level of education among the Kaili Da’a community impacts the vulnerability of family resilience, particularly in economic and social aspects, as reflected in the dominance of livelihoods in the informal sector, where 50.3% of Kaili Da’a livelihoods are in agriculture and gardening, while the remainder work as traders, miners, or vendors in markets. This study aims to analyze the strengthening of family resilience among the Kaili Da’a indigenous community from the perspective of Jamaluddin Athiyyah’s Maqāṣid al-Sharīʻah using qualitative methods as well as Miles and Huberman’s analysis. The results indicate that family resilience among the Kaili Da’a community encompasses five dimensions: legal and structural quality, physical resilience, economic resilience, socio-psychological resilience, and socio-cultural resilience. However, comprehensive fulfillment of indicators is only observed in the dimensions of legal and structural quality, physical resilience, and socio-cultural resilience, while the economic and socio-psychological dimensions remain suboptimal. From the perspective of Maqāṣid al-Sharīʻah, these findings indicate that the family resilience of the Kaili Da’a community reflects the dimensions of the individual, family, society, and humanity. This study contributes to the development of an analysis of family resilience based on Jamaluddin Athiyyah’s Maqāṣid al-Sharīʻah, which integrates the local values of the Kaili Da’a indigenous community with an Islamic perspective. This study also enriches the theoretical discourse on family resilience grounded in local culture and Maqāṣid al-Sharīʻah.

Abstract

Penelitian ini bertujuan untuk memberikan pengetahuan dan pemahaman terhadap pengimplementasian pasal 82 UU No. 7 tahun 1989 JIS UU No. 3 tahun 2006 UU no. 50 tahun 2009 pada perkara perceraian di Pengadilan Agama Klas I A Palu, dan bagaimana upaya dan solusi Pengadilan Agama Klas I A Palu dalam mengatasi perceraian. Penelitian ini di desain dengan menggunakan jenis penelitian lapangan, dengan menggunakan pendekatan kualitatif. Setelah menganalisis data penelitian tersebut maka langkah terakhir penelitian ini adalah pengecekan keabsahan data dengan maksud untuk membuktikan penelitian tersebut benar-benar absah keberadaannya. Hasil yang diperoleh dari penelitian di Pengadilan Agama tentang Implementasi pasal 82 UU, no. 7 tahun. 1989 JIS UU. No. 3 thm. 2006 UU No. 50 tahun. 2009 tentang perkara perceraian adalah wajib dilakukan karena sebuah keharusan menjalankannya dan telah terimplementasi dengan baik yang dibuktikan dengan data yang ada. Adapun solusi dalam mengatasi perkara perceraian adalah melakukan mediasi dan membuat pelatihan- pelatihan untuk para hakim agar dapat lebih memahami berbagai perkara dalam perceraian.

Abstract

Abstract The phenomena of natural disasters such as tsunamis, liquefaction, earthquakes, and also Covid 19 have contributed to increasing poverty in Palu City. This phenomenon is in contrast to the function of the National Amil Zakat Agency (BAZNAS) as an institution or agency tasked with distributing zakat funds as an alternative to poverty alleviation. This study aims to analyze the distribution of zakat by BAZNAS Palu City to alleviate poverty from a legal perspective. The research method used is qualitative research. Based on the results of the research, the zakat distribution mechanism by BAZNAS Palu City is channeled through consumptive and productive assistance. The inhibiting factor for the distribution of zakat funds is influenced by the not-yet-optimal development of amil towards mustahik. From a legal perspective, the distribution of zakat funds by the Amil Zakat Agency (BAZNAS) in Palu City complies with the provisions of Law Number 23 of 2011.   Keywords: BAZNAS, Zakat Distribution, Law.
