Abstract

This study aims to analyze the death penalty against qatl al-ghīlah and its relevance to positive law in Indonesia. Regardless of the debate, the death penalty in Islamic criminal law and positive Indonesian law still recognizes it as a punishment for murder. One of the four types of murder in Islamic criminal law is murder by deception (qatl al-ghīlah). It is similar to premeditated murder but differs in the method and process. This study used the qualitative method in the form of normative juridical research. This study found that, first, qatl al-ghīlah is a type of murder that does not open room for forgiveness, so qiṣāṣ is the only punishment. Second, qatl al-ghīlah differs from premeditated murder, so no specific rules govern it (rechtsvacuum). Third, this study encourages preserving the death penalty in extraordinary crime cases. The principle of justice is the primary basis for this conclusion. This study recommends incorporating elements of Islamic criminal law as one of the elements in national law.

Abstract

The effective recovery of assets derived from corruption remains a major challenge within Indonesia’s criminal justice system. The Draft Law on Asset Forfeiture (RUU PA) introduces a non-conviction-based (NCB) mechanism, enabling asset confiscation without a prior conviction of the offender. This study analyzes the normative legitimacy of the NCB approach under Indonesian positive law. It explores its doctrinal foundations from the perspective of Islamic criminal law, specifically through the concepts of ta‘zīr and maqāṣid al-sharī‘ah. Employing a normative-comparative approach, this research demonstrates that the principle of ta‘zīr provides legal justification for asset forfeiture in the pursuit of public welfare, even absent individual penal sentencing. The findings reveal that the NCB mechanism aligns with Islamic legal values, emphasizing substantive justice and the protection of public property. The novelty of this research lies in its integrative proposal to harmonize Islamic criminal principles with the national legal system, thus supporting a fair and effective asset recovery policy. The study also underscores the importance of strict and accountable regulatory safeguards to prevent abuse of power and to ensure the protection of constitutional rights.   Pemulihan aset hasil korupsi masih menjadi tantangan serius dalam sistem hukum pidana Indonesia. Rancangan Undang-Undang Perampasan Aset (RUU PA) memperkenalkan pendekatan non-conviction based asset forfeiture (NCB), yang memungkinkan perampasan aset tanpa menunggu putusan pidana terhadap pelaku. Studi ini menganalisis legitimasi normatif pendekatan NCB dalam hukum positif Indonesia serta mengeksplorasi fondasi hukumnya dalam perspektif hukum pidana Islam, khususnya melalui konsep ta‘zīr dan maqāṣid al-sharī‘ah. Dengan pendekatan normatif-komparatif, penelitian ini menunjukkan bahwa prinsip ta‘zīr memberi ruang legitimasi terhadap perampasan aset demi kemaslahatan publik, bahkan tanpa adanya pemidanaan individual. Hasil studi ini memperlihatkan bahwa pendekatan NCB sejalan dengan nilai-nilai hukum Islam yang menekankan keadilan substantif dan perlindungan terhadap harta publik. Kebaruan dari penelitian ini terletak pada tawaran integratif antara prinsip hukum pidana Islam dan sistem hukum nasional dalam mendukung kebijakan perampasan aset secara adil dan efektif. Ditekankan pula pentingnya pengaturan yang ketat dan akuntabel guna mencegah penyalahgunaan wewenang serta menjamin perlindungan hak konstitusional warga negara.

Abstract

Human trafficking constitutes a severe form of economic exploitation and fundamentally contradicts the principles of maqāṣid al-sharī'ah, particularly the preservation of wealth (ḥifẓ al-māl) and life (ḥifẓ al-nafs). This crime harms victims physically and psychologically while undermining their economic rights and disrupting social and economic justice. From the perspective of Islamic economic law, human trafficking is a grave violation of the obligation to uphold economic justice and equitable wealth distribution—core elements of maqāṣid al-sharī'ah. This study aims to analyze and compare the effectiveness of these two legal approaches and to formulate a cooperative and justice-oriented model of resolution. Employing a descriptive qualitative method, data were collected through in-depth interviews, field observations, and document analysis in several regions of Aceh. The findings reveal that the Qanun Jinayat does not explicitly regulate human trafficking offenses, resulting in suboptimal law enforcement. Meanwhile, the Musyawarah Gampong mechanism often fails to ensure adequate protection for victims, creating space for perpetrator impunity. Based on these findings, the study recommends revising the Qanun Jinayat to include specific provisions on human trafficking, enhancing legal training for village authorities, and strengthening legal literacy among the public to bridge the gap between legal norms and social practices. This study positions human trafficking as a violation of the principles of Islamic economic law, which demand distributive justice and the prohibition of exploitation in economic activities. Abstract

Massive cases of animal abuse occur and are left unchecked, requiring more attention. This article aims to analyze cases of dog abuse in the perspective of positive law in Indonesia and Islamic criminal law. This article is qualitative with a normative juridical legal research method and is presented descriptively. Field case data were obtained through interviews with dog lover’s communities, police, and former dog slaughterers in Yogyakarta. This article finds that the criminal act of molesting dogs at slaughterhouses in Yogyakarta has fulfilled the criminal element of violating Law no. 41 of 2014 concerning Amendments to Law No. 18 of 2009 concerning Livestock and Animal Health and Government Regulation no. 95 of 2012 concerning Veterinary Public Health and Animal Welfare. Mistreatment of dogs has fulfilled the elements of an act called jarīmah and is subject to ta'zīr whose punishment provisions are the authority of the government. So that according to both perspectives, animal abuse is a criminal act and deserves punishment. The omission of the case proves that the law is not implemented properly. This article recommends all parties to participate in guarding and monitoring the welfare and safety of animals from acts of abuse.Kasus penganiayaan hewan yang massif terjadi dan terbiarkan, membutuhkan perhatian lebih. Artikel ini bertujuan untuk mengalisis kasus penganiayaan anjing dalam perspektif hukum positif di Indonesia dan hukum pidana Islam. Artikel ini bersifat kualitatif dengan metode penelitian hukum yuridis normatif dan disajikan secara deskriptif. Data kasus lapangan didapatkan melalui wawancara dengan komunitas pecinta anjing, Polsek Pundong, dan mantan jagal anjing di Yogyakarta. Artikel ini menemukan bahwa tindak pidana penganiayaan anjing di rumah jagal di Yogyakarta telah memenuhi unsur pidana melanggar UU No. 41 Tahun 2014 tentang Perubahan Atas UU No. 18 Tahun 2009 tentang Peternakan dan Kesehatan Hewan dan PP No. 95 Tahun 2012 tentang Kesehatan Masyarakat Veteriner dan Kesejahteraan Hewan. Penganiayaan anjing telah memenuhi unsur-unsur suatu perbuatan disebut jarīmah dan dikenakan ta’zīr yang ketentuan hukumannya menjadi wewenang pemerintah. Sehingga menurut kedua perspektif, tindakan penganiayaan hewan merupakan tindakan pidana dan layak mendapatkan hukuman. Pembiaran kasus membuktikan bahwa hukum tidak terlaksana dengan baik. Artikel ini merekemondasikan kepada semua pihak untuk ikut serta mengawal dan mengawasi kesejahteraan dan keamanan hewan dari tindakan penganiayaan.

Abstract

The principles of criminal law in Indonesia and Islamic criminal law do not burden the defendant in proving. However, there have been changes to the reverse burden of proof system, especially in cases of corruption and money laundering. This article discusses the principle of reversed burden of proof in Indonesian criminal law and Islamic criminal law. The research method is juridical-normative with statutory, conceptual, and historical approaches. Sources of data using primary and secondary legal materials. The results of the study show that there are seven principles of reverse proof in criminal law in Indonesia, namely the principle of justice, the principle of utility, the principle of wealth, the principle of evaluating evidence, the principle of legality, the principle of invisible crime, and the principle of presumption of guilt. Meanwhile, the principles of proof are reversed in Islamic criminal law, namely: intention, justice, maqāṣid al-sharīah, and presumption of guilt. Reverse proof in Islamic criminal law is not only applied in cases of corruption and money laundering, but is applied to all ḥudūd, qiṣāṣ and ta'zīr crimes. The principle of intention only exists in the Islamic criminal law system, because it relates to the divine side.

Abstract

Abstract The Zakat and Alms (ZIS) Institution, as a non-profit organization are required to work professionally and proportionally. The complex of challenges in managing operational from other institution and also satisfaction as a target for all the stakeholders. Neglecting and ignoring of these challenges can stimulate the stagnation and less of trust from all the component in this institution. Therefore, alternative solutions are needed in order to minimize the negative possibilities. Through of this review of study, that using the perspective of principles Good Governance and Islamic perspectives, this paper intends to discuss both of the approaches as an input for the ZIS institution in Higher Education Institution within their operating system all the business process run efficient and effective. Nine principles of Good Governance within the Islamic principles are necessary to apply and to implement a good way. Abstrak Lembaga Zakat, Infak dan Sedekah (ZIS), sebagai lembaga non-profit, dituntut untuk bekerja secara profesional dan proporsional. Tuntutan semacam itu muncul dibarengi dengan tantangan zaman yang semakin kompleks. Menafikan tantangan berakibat pada kemandegan dan kehilangan kepercayaan dari stakeholders. Oleh karenanya, dibutuhkan solusi alternative dalam rangka menyiasati akibat negative tersebut. Melalui kajian pustaka, menggunakan perspektif prinsip-prinsip good governance dan prinsip Islam, tulisan ini hendak membincang kedua pendekatan tersebut sebagai alat baca pada tata kelola Lembaga ZIS pada perguruan tinggi. Sembilan prinsip good governance yang sejalan dengan prinsip Islam, menjadi mutlak untuk diterapkan pada tata kelola Lembaga ZIS di perguruan tinggi.

Abstract

The Indonesian government, regulators, and Muslim consumers increasingly recognize the halal industry as an essential sector for economic growth. This study aims to assess the understanding, acceptance, and implementation of halal among educated Muslim youth and analyse the urgency of halal in food, tourism, and banking. The research was conducted at four State Islamic Universities (PTKIN) in Central Java, Indonesia, involving 145 students as respondents. A descriptive quantitative approach was applied using structured questionnaires, analysed with frequency and percentage techniques, and interpreted through Islamic legal philosophy, particularly fiqh and maqāṣid al-sharī‘a. The study finds that the halal of food, tourism, economy, and banking has a strong epistemological basis in Islam; however, a segment of Muslim minority students demonstrates rejection or inconsistent implementation due to differences in interpretation, limited accessibility, and perceptions of government policies. Despite this, there is strong support for halal, with over 91% endorsing government initiatives and 92% acknowledging their contribution to economic growth. Based on these findings, the study recommends standardizing halal concepts across sectors, systematically evaluating program impacts, and continuously educating the public to optimise the implementation of Indonesia’s halal industry policy.
