Abstract

Essentially, the application of Islamic law in Indonesia has a huge opportunity. Undeniably, there remain challenges, both from within (Muslims) and from outside (other than Muslims). The great and tremendous challenges come from Muslims themselves. Muslims do not want Islamic law in Indonesia upright. The reason is the government is also unwilling because of the existing legal system and dissimilarity of attitude, understanding, practice of Muslims and Islamic leaders of Al-Quran and Al-Hadith, especially in relation to politics. It is likely to continue in line with the dynamics of Muslims in the state and nation. Pros and cons of Muslims against the application of Islamic law, including the unwillingness of groups against Islamic approach to structural (power) and Islamic cultural (culture), will raise the difficult and impossible application of Islamic law in Indonesia. Therefore, for most Muslims, the teachings should be reinterpreted beyond the textual meaning and application in real life.

Abstract

Article 29 paragraph 1 of the 1945 Constitution of the Republic of Indonesia states that "the State is based on the One Supreme Godhead." This means that the state has given legitimacy to Islamic law as formal law in the Indonesian constitutional system. Islamic law has a great opportunity to be formalized into regulations, because the majority of Indonesians are Muslims. Perda Syariah itself in its journey has shown significant developments. There have been 433 regional regulations issued in Indonesia since 1998, however, these regional regulations with Islamic nuances have generated pro-contra attitudes from various parties. This study uses a qualitative research method with a literature approach. The results of the study state that there are still some parties who feel that regional regulations were born only as political needs that are less effective in their implementation, and others think that sharia regulations are an effort to regulate people's behavior so that they are in accordance with living norms.Keywords: Sharia Regional Regulation; Regional Autonomy; Formalization of Islamic Law Abstrak: Pasal 29 ayat 1 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa “Negara berdasarkan atas Ketuhanan Yang Maha Esa.” Artinya negara telah memberikan legitimasi hukum Islam sebagai hukum formal dalam sistem ketatanegaraan Indonesia. Hukum Islam memiliki peluang yang besar untuk diformalkan menjadi peraturan, karena mayoritas bangsa Indonesia adalah pemeluk agama Islam. Perda Syariah sendiri dalam perjalanannya telah menunjukkan perkembangan yang signifikan. Telah ada 433 Perda lahir di Indonesia sejak tahun 1998, namun Perda-perda bernuansa Islam tersebut menimbulkan sikap pro-kontra dari berbagai pihak. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan literatur. Hasil penelitian menyatakan bahwa masih ada sebagian pihak merasa bahwa Perda lahir hanya sebagai kebutuhan politik yang kurang efektif dalam pelaksanaannya, dan  sebagian lain beranggapan bahwa Perda syariah adalah sebuah upaya untuk menertibkan perilaku masyarakat agar sesuai dengan norma-norma yang hidup.Kata Kunci: Perda Syariah; Otonomi Daerah; Formalisasi Hukum Islam

Abstract

This study aims to explore and analyze al-Buti's thoughts on maslahah (public interest) and its application issued by world-prominent Fatwa Institutions, namely Ḍār al-Iftā al-Miṣriyah in Egypt, Ḍār al-Iftā al-‘Irāqiyah in Iraq, and al-Majlis al-Islamī al-Sūrī in Syria. The research adopts a normative method, employing conceptual, literary, and sociological approaches that is analyzed descriptively. The findings of this research focus on the application of al-Buti's concept of maṣlaḥah to the online marriage contract fatwas issued by the aforementioned Fatwa Institutions. The results indicate that these fatwas do not align with a credible interpretation of maṣlaḥah within Islamic law. Further, it can be seen that two key points support this conclusion: (i) they contradict the maqāṣid sharī'ah (objectives of Islamic law), particularly the highest objective of preserving religion (hiẓ al-dīn), and (ii) the urgency of maṣlaḥah in the context of online marriage contracts varies and cannot be universally applied. This research contributes to the enhancement of fatwa decision-making processes in Indonesia.

Abstract

Abstrak: Pembentukan UU Perbankan Islam dalam Perspektif Politik. Artikel ini mendiskusikan sejarah berdirinya perbankan syariah di Indonesia. Pada awalnya, di masa Orde Baru, hubungan antara umat Islam dengan pemerintah diliputi dengan kecurigaan dan prasangka bahwa setiap yang berbau Islam dianggap upaya untuk merealisasikan Piagam Jakarta atau untuk mendirikan negara Islam. Tetapi kemudian, ketika Indonesia mengalami kegoncangan ekonomi yang begitu hebat dan diikuti dengan perubahan dalam struktur politik/pemerintahan, gagasan umat Islam Indonesia untuk mendirikan Bank Syariah akhirnya dapat diwujudkan. Keberhasilan pembentukan lembaga perbankan syari’ah ini, berdasarkan data yang penulis peroleh, tidak terlepas dari situasi politik yang melingkupinya. Abstract: The Ratification of the Islamic Banking Act in Political Perspective. This article discusses the history of the formation of Islamic banking in Indonesia. At first, in the New Order era, the relationship between Muslims and the government was filled with suspicion and prejudice that every activities related to Islam was considered as an attempt to actualize the Jakarta Charter or to establish an Islamic state. However, when Indonesia experienced economic hardship followed by changes in the structure of politics/government, the idea of Indonesian Muslims to establish shariah bank can ultimately be realized. The success of the establishment of the shariah banking institutions, in many ways, can not be separated from the then political circumstances.

Abstract

In recent decades, businesses based on Islamic principles have experienced significant growth. Business models that are in line with Islamic values have become a major concern for Islamic business and economic actors. This phenomenon has triggered intense discussions on the impact of ethics and Islamic law on Islamic business practices. This study will analyse the comparison between ethics and Islamic law in the context of Islamic business. This research is a qualitative literature study that incorporates data from 1991 to 2023 taken from sources found on Google Scholar. The qualitative literature review research method is used to investigate, analyse, and compile a comprehensive understanding of developments, trends, and significant findings in various fields of knowledge relevant to the topic of this research. The results show that business management in the Islamic context is based on ethical and legal principles derived from Islamic religious teachings. These principles complement each other and form the basis for the Islamic business management model. Ethical principles, such as taqwa, good deeds, justice and ihsan, encourage integrity, honesty and social responsibility in business. Meanwhile, legal principles, involving sharia, contracts, zakat, waqf, haram, and halal, govern the legal aspects of business, ensuring compliance with Islamic values and rules.
